Ordinance - 137ORDINANCE NO. 137 AN ORDINANCE AMENDING ORDINANCE 133 ENTITLED "iiN ORDINANCE OF THE CITY OF WEST COVINA PRO- HIBITING AND REGULATING THE CONSTRUCTION,. MAINTAINING, AND USE OF DWELLINGS, TRAILERS, AND STORAGE AREAS" BY ADDING THERETO SECTIONS TO BE KN0WN AS SECTION SIX AND SECTION SEVEN. The City Council in the City of West Covina do ordain as follows: -Section .l. Ordinance No. 133, entitled "An Ordinance prohibiting and regulating the construction, maintaining, and -use of dwelling, trailers, and storage areas"' and prescribing the minimum square feet of floor area of a building to be used as a dwelling and defining the means by wh'J.ch a building may be attached to the land, is hereby amended by add- ing thereto sections to be known as Sections 6 and 7, and to read as follows: Section 6. In any case or cases where a person or persons., association, or corporation desires immediate occupancy of a building, structure, or improvement which is ineomplete,and/or outhouse incidental to and in close proximity to the principal building or structure, the Building Inspector may issue a permit providing for the temporary occupancy of such building, structure, or improvement, for apperidd not to exceed Sixty (60) days at any one time, if the Building Inspector finds that (a) The applicant for the permit of temporary occupancy has -secured a building permit from the City of West Covina for a dwell- ing to be erected upon the premises whereon the temporary structure is located; (b) That construction of the principal building upon the premises has been commenced and has progressed to a stage where the foundation is complete; (c) That the premises whereon the temporary struct- ure is located is a lot in an approved sub- division tract, or is not a lot described by metes and bounds and conveyed after the 16th day of May, 1947; (dj When the applicant shall have complied with Section 7 hereof; Section 7. In any case or cases where a person, or persons, association, or corporation desires immediate occupancy of a building, structure, or improvement, which is incomplete, or parts of which are incomplete, in any structural parts or portions and/or which does not comply with the provisions of this ordinance and all other ordinances of the City of West Covina, and/or any law of the State of California, or, defective or Page 1. incomplete in any manner affecting the continued safe use, operation, and/or maintanence of the building structure, or improvement, Such person may at the option of the building inspector make a deposit'in the form of a certified check guaranteeing the completion of the building, structure, or improvement, in accordance with such plans and/or provisions in respect to the structural parts or portions, con- tinued safe use, operations, and/or maintanence. Such deposit shall be in an amount, but in no case less than Five Hundred Dollars ($500.00) which in the judgment of the building inspect- or whould be sufficient to def rgy the cost of the work, and/or material necessary to complete the building, structure, or improvement, in re- spect to the said dtructural parts or of the portions, The condition of the deposit of which amounie' shall be that, if the person, association, or corporation making such deposit shall fail, upon written notice, to do such work within a reasonable time, the city may, at its discretion, cause such work, to be done in accordance with the plan and/or, ;provisions, and may apply":•such part or all of such tposit toward the payment and sat- isfaction;. of, any expense which the said city may have incurred by reason of having caused such work to be done. A further condition of such deposit shall be that the depositor agrees to permit access by the said city and its agents to the premisses upon which the work is to be done in any case where it's necessary.for the city to do the work.
