The City Council of the City cf' West Covina does ordain as follows: ARTICLES 1, DEFINITIONS. Section 1. Whenevr�r any words or phrases used herein are not defined Herein but are now defined in the Vehicle Code of this State, such definitions are incorporated herein and shall be deemed to apply to such words and phrases used herein. Section 2, Whenever in this ordinance the following v;ords and phrases set forth in this Article are used, they shall for the purpose of this ordinance have the meanings respectively ascribed to them in this Article. Section,3. ALLEY. Any street less than twenty-five (25) feet, in width between property lines. • Section 4. BUSINESS DISTRICT. For the purposes of this ordinance the words "Business District" shall have the same meaning and definition as ascribed to the v,�ords "Business District" in the Vehicle Code. Section 5. C0I.:11ERCIAL VEHICLE. The ?ords "commercial vehicle" as used in t lis ordinance shall_ be deemed to mean every self-propelled vehicle having a nanufacIl-urer's rated capacity of over two tons, designed for, or engaged in, the car.•'ying of any materials, goods, wa..es, t:aerchandise, freight, or other cor,:liodities, whether sil.ch vehicle be laden or unladen, or any vehicle iah:i.ch, having no such rat- ing is nev rti7eless loaded, cart ing or laden t?ith more th n tr o tons of any mat_rials, c,?oods, wa.­es, L-erehandise, freight or other coriunod- ities. Nothing in this definition contained sh-�,11 be deemed to r,,, an or include railroad, street or interurban railtjav cars, or vehicles for the carrying of passengers. Section 6. LOADL�G ZCIiE. That space ad:lacent to a curb reserved for the exclusive use of vehicles during the loading or un- loading of passengers or Materials. Section 7. LIITIT LINE. A si,n.gle white line not less than two inches in uaidth painted on the surface of a street or highway and cross ing a lane or lanes used by traffic on such street or highway. Such lines may be placed at such places and at such angle or angles across such traffic land or lanes as in the opinion of the Traffic Authority the limitati_ns imrosed thereby on approaching traffic may require. Section 8. OFFICIAL TRAFFIC CONTROL DEVICES. All signs, -1- f signals, markings, and devices not inconsistent with this ordinance placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traffic. Section 9, OFFICIAL SIGNALS. Any device, whether manually, electrically, or mechanically operated, by,,hi.ch traffic is alter— nately directed to stop and .to proceed, and which is erected by. authority of a public body or -official having jurisdiction. Section 10. PAR1MAY. That portion of a street other than a roadway or a sidewalk. Section 11. PASSENGER LOADING ZME. That space ad j&cent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers. Section 12. PEDE STRAIN. Any person afoot. Section 13. POLICE OFFICER. Every officer of the Police Department of the City of West Covina, California. Section 14. "SHALL" and t%UlY". "Sha11" is mandatory and "TRAY" isr'ermissive. Se-ction 15. (a) STOP, when required means complete cessation of movement. • (b) STOP OR STAND, when prohibited, weans any stopping of a vehicle except when necessary to avoid conflict with other traffic or in compliance with the direction of a police oi'ficer or official traffic control device. (c) PARK, the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading passengers or materials. Section 16. "STREET" or "PUBLIC STREET", shall include all public streets, --highways, avenues, lanes, alleys, courts., places, squares, curbs or -other public ways in said City which have been or may hereafter be dedicated and' open to public use or such other public property so designated in any la.�r of this State. OBEDIENCE TO TRAFFIC REGULATIONS. !t) Section 1. DUTIES OF POLICE. (a) It shall be the duty of the officers of the Police Department to enforce provisions of this ordinance. (b) Officers of the Police Department are hereby authorized to direct all traffic by voice, hand or signal, in conformance with traffic laws, provided that, in the event of fire or other emergency, police officers may direct traffic as conditions may require not- withstanding the provisions of the traffic laws. Section 2. OBEDIENCE TO POLICE. No person shall willfully fail .or refuse to comply with any lawful order, direction or signal of a police officer. Section 3. DIRECTION OF TRAFFIC. No person other than an n officer of the Police Department, or a person designated by the Chief of Police, or an employee of the City of olest Covina who is at the time engaged in the necessary performance of his duties for said City, shall direct or attempt to direct traffic by voice, hand or ©they signal, except as required in the vehicle Code of the State of Calif., and except that persons may ope_:ate, whey and as herein provided, any mechanical signal erected by order of the legislative bocy of said City, or the traffic Authority. Section 4. ,PUBLIC EMPLOYEES TO OBEY cEGULATICINS. The provisions of this Ordinance shall apply to the driver of any vehicle owned or used in the service of the U. S. Government, this • State, any County, City or Eunicipal Corporation, or other public agency, and it shall. be unlawful for any said driver to violate any of the provisions of this prdinance, except as otherwise permitted in this ordinance. Section 5. E,XE1PTIONS TO CERTAIN VEHICLES. (a) The provision of this Ordinance regulating the operation, parking and standing of vehicles shall not apply to any vehicle of the Police Department or Fire Department, any public ambulance, or any public utility vehicle or private ambulance which has qualified as an authorized emergency vehicle when any vehicle mentioned in this section is operated in the manner specified in the Vehicle Code in response to an emergency call. (b) The foregoing exemptions shall not, however, protect the driver of any such vehicle from the consequences of his willful disre- gard of the safety of others. (c) The provisions of this Ordinance regulating the placing, parking or standing of vehicles or equipment shall not apply to any vehicle or other equipment of a city department or public utility, or franchise or special permit holder of a franchise or permit issued by said City or its authorized officers, while same is necessarily in use for construction or repair work, Section 6. REPORT OF DANAGE `1'O CERTAIM PROPERTY. (a) The driver of a vehicle, or tine person in charge of any animal, involved Q any accident jesulting in damage to any property publicly owned or owned by any public utility, including but not limited to any fire hydrant, ornamental lighting-ost,teleph7ne pole, electric light or power pole, ornamental shade tree or other property of a like nature located in or along; any street, shall wit4in twenty-four hours after such addicent make a written report of such accident to the I-olice Department of said City. -3- (b) Everysuch report shall state the time when and the ?� place where the accident -took place, the n r.-ie and address of th-� pe_ son otF'ning and of the person driving or in charge of such vehicle or animal, the license number of every such vehicle, and shall briefly describe the propes,ty damaged in such accident. ARTICLE III. TRA2FIC M.TROL DEVICES. Section 1 E" THTRA-IT11'IC A1,`_-HCJ",ITY `�:'C :T. TRAFFIC RCL DEVICES. The Traffic Authority shall have the exclusive poiner and duty to place and maintain or cause to be Dlaced or maintained Official traffic control siLf-'ns and devices when and as required unCier this Ordinance to make effective the provisions of said Ordianance, and may place and iflai-ntain such additional signs and traffic control devices as he may daerd necessary% to regulate traffic under this Ordinance or under Sate laws or to P,,,uide or warn traffic. Section 2. THE `'iiA:'+:IC !�T:`.�' CRITY ` C, I4:S `LL. _`A='_,IC SIGNALS SAFETY LOT+,iES AND LAITES F(I,,'. 'IRA'TIPIC. The Traffic Authority is hereby authorized: (a):'To install and maintain official traffic signals at such intersections and other laces as he may deem necessary for the regu- lation of traffic. • (b) To establish safety zones at such places as he. may deem necessary for the protection of pedestrians. (c) To mark lanes for traffic on street paveraents at such places as he may deem advisable, consistent with the Vehicle Code and traffic Ordinances of said City. Section 3, OBEDIENCE TO TRAFFIC CONTROL DEVICES. (a) The driver of any vehicle and the -person in charge of any animal, and the motorman of any street or interurban car, shall obey the instructions of any official traffic control device applicable thereto placed in accordance with this Ordinance unless otherwise directdd by a police officer, subject to the exemptions granted by Section 5 of Article II of this Ordinance. (b) The driver of any vehicle and the person in charge of any animal, and the motorman of any street or interurban car, shall obey the instructions of any bafr•ier or sign erected by any of the public departments of said City or public utilities in said City, or by other person, pursuant to the law. . Section 4. SIGNS REQUIRED• No provision of this Ordinance for which signs or markings are req_iir•dd shall be enforced against an alleged violator, -if, at the time and n3ace of the alleged violation, an official sign or marking is not in place and sufficiently legible and visible to be -seen by an ordinarily observant person. ARTICLE IV. TURNING AMOV-ZAJENTS . Section 1. SIGNS PROHIBITING LEFT TdiiNS. The Traffic Author- ity may erect or place and maintain signs at any intersection prohibit- ing the Making of left turns by drivers of vehicles wherever said -4- a 0 • Traffic Authority determines that such left turns would cause traffic congestion or traffic hazard and dLtring the time such signs are so erected or placed no left hand turns shall be permitted at such des- ignated intersections and it shall be unlawful for the operator or driver ofany vehicle to Lmake any left hand turn -in such intersection at such times. Section 2. TURIJING 1VUBIKERS. (a) The Traffic Authority may place markers, buttons or signs withil'n/or adjacent to intersections indicating the course to be traveled by vehicles t'LTning at such inter. sections. (b) When authorized markers, buttons or other indications are placed within an intersection indicating the course to be traveled by vehicles turning thereat, no driver of a vehicle small disobey t . 1B directions of such indications'. Section 3. U-TIMPINS IN CERTAIN- DISTI'?ICTS. No vithicle shall be turned at any time at an intersection or in any street in any business district in complete circle or 'except at , intersections in much manner as to proceed in the opposite direction upon the, street upon which said vehicle is traveling at the time of entering said intersection, or at the time of coinimencing any such turn; provided no such turn shall be made at or in any intersection when traffic signs are in place prohibiting such turning. ARTICLE V. THROUGH STREETS, BOULEVARD STOPS, STOP INTEk'3ECTIONS ANTD SPECIAL STOPS. Section 1. THROUGH.STREETS. The following streets and parts of streets are hereby declared to be through streets ( or through highways) within said City, to vit: State Hightvay, knoi�,�n as Holt Ave., - and Garvey Blvd. Section-2. The Traffic. Authority shall erect a stop sign on each and every street intersecting any through street or -p-ortion • thereof at or near the entrance of such intersecting street to such through street or highway. Every such sign shall conform as to type, location and placeraent and in all other respects t'o the requirements of the Vehicle Code relating to stop signs. Section 3. When a stop sign is erected and in place as herei provided at or near the entrance to any through street or highway, every driver or operator of a vehicle and evury,riiot-orraan or operator 4ele of a street or interurban car shall stop such v.6h.L or car at or near the entrance to such throggh street or highway before entering the same, except when directe(I to proceed by a police, highway or traffic Officer or traffic control signal. (a) No vehicle and no driver of a vehicle exce-ou'l I ng an authorized emergency vehicle, a vehicle of a duly authorized member of the Fire Department of said City, shall follovv any fire apparatus ansi;iering a fire alarm,, closer than 300 feet, or park an-v vehicle v'tiithin 300 feet of a fire, or o-oerate or -r)ark any vehicle in such manner as to interfere with any fire apparatus or line of fire hose ,T4hen in use at a fire or when in -place for use in response to a fire .ala-cm. A person operating a riotorcycle or bicycle upon a street shjgll-not.ride other than upon the permanent and regular seat attached thereto, b or carry any other person upon s---U-ch motorcycle or bicycle other than upon a- firmly attached seat to the rear of the operator, nor shall any person ride upon a motorcycle or bicycle upon a street other than is above authorized. Section 4. CLINGING TO 1JO-\TIIeG VEHICLE. Any person riding upon any bicycle, motorcycle, coaster, roller skates or any toy vehicle, shall not attach the same or himself to any street car or moving vehicle upon any roadway. Section 5. VEHICLES AND BICYCLES SMALL NOT BE DRIVEN OR ANMIALS BE RIDDEN ON THE SIDEWALK. The driver or operator of a vehicle or bicycle shall not drive or operate the same, nor shall the rider of any anixaal ride or drive such anirial, within anj- side- walk area of any parkway except at a permanent or temporary driveway: • A temporary driveiijay for the purposes of this section is defined to ME mean a crossing or driveway suitably planked or othervJise protected to prevent injury to the curb or sidewalk. Section 6. NEW PAVF4ii,NT. No person shall ride or drive any animal or any vehicle or bicycle over -or across any newly made pave- ment or freshly painted marking.in any street when a barrier or sign is in place warning persons not to drive over or ac-•oss such pavement or marking, or when a sign is in place stating that the street or any portion thereof is closed. Section 7. BACKIi,,G OF WEHICLES. Unless in complaince with the iin ediate direction or order of the Traffic Authority or any Police Officer of the -City of West Covina to the contrary, no person shall back or operate in reverse gear any vehicle on any street withir said City for a greater distance -than is necessary in order to place such veh_.cle in a position for the lawful operation theroof in a for- ward direction upon such street. ARTICLE VII. MISCELLAl`3EOUS REG..LATIu'NS `iAE.GTiLAT=CI,TG TO USE OF S. Section 1. OBSTRUCTIONS IN STR`ETS. No person shall erect, • construct, place, aaintain, leave or abandon any building, fence, porch, steps, post, pole, tract, mire, pipe, conduit or other stri.c- ture in vlhole or in part in or upon any sfd�e-et %o ithin said City,;' and no person shall place, affix, paint, iaintain, leave or abandon any sign, placard, notice, advertisement, seat, bench, table, stand, material or ether obstruction in any street, nit'_in said City, with- out a permit in iFlriting so to do, first had and obtained from the Traffic Authority or the Street Superintendent, or the City Council of said City; provided hoTvev -r, that the provisions of this section shall not ap-:.ly t o : (a) The U. The provisions of this Section shall not apply to the slight leakage -which is nec- essarily °ncident to the careful and proper operation of a motor ve= . hicle, Section 10. ADVERTISII,,;G LTC. VEHICLES. No person shall operate or drive, park or leave standing any vehicle: (a) While same is being used for advertising purposes, or (b) :any vehicle used for announcing; or other purposes, or vlith any sound producing or noise alaking device or means, or a sound amplifyin{, or loud speaking device or iaeans (other than sirens, horns, or amplif'ring devices required or authorized by la;), upon any street at any tiiae with In said City tiahile such device or means is in use .:or operation, without first obtaining a written permit from the Traffi( Authority so to do, or in any manner contrary to any condition under or pursuant to t7-"ich any such permit may be issued. When the signs hereinabove referred to in Sec. 13 of this Article VII of this Ordinance are erected and in place, it shall be unlatRiful for the driver or operator of any coin r ercial vehicle to drive or operate any such commercial vehicle in or upon any such light traffic street or portion thereof except i=a:�en necessary to traverse the same for the purpose of loading or unloading, but then only by such deviation from the nearest Leavy traffic street as is re-jsonably necessary. Section 16. HEAVY TRAFi{IC STREETS. All streets within the City of West Covina, California, other than those and the portions of those hereinabove specifically set forth and designated as light traffic streets shall be and the same are hereby designated and established as heavy traffic streets Within the meaning of this Ordinance. ARTICLE VIII. PEDESTRIANS. Section 1. THE TRAFFIC AUTHORITY TO ESTABLISI=i CROSSWALKS. (a) The Traffic Authority shall establish, designate and t,iaintain crosswalks at intersections and other places -by appropriate devices, marks, or lines upon the surface of the rca dway as follows: Crosswalks may be established and maintained by the Traffic Autho--ity at all intersections where the Traffic Authority determin-s that there is particular hazard to pedestrians crossing the roadway subject to the limitation c_­ntained in (b) of this section. (b) Other than crosswalks at intersections no crosswalk shall be established in any block which is less than 200 feet in length. Elsewhere not more than one additional crosswalk shall be established in any one block and such crosswalk shall be'located as nearly as practicable at mid -block. ARTICLE IX. STOPPING, STANDING AND PARKING. Section 1. APPLICATION' OF ORD�NAIICE.
