Ordinance - 94ORDINANCE NO. 9 • • • • AN ORDINANCE RELATING TO AIR RAID PRECAUTIONS DECLARING THE URGENCY TH nEOF, AND PROVIDING THAT IT WILL TAKE IPt�t�iEDIAT Z EFFECT. The City Council of the City of Fullest Covina do ordain as follows: Section 1. ffAir Raid warning signalT1 means a signal by siren, whistle, horn or other audible device, of two minutes duration con- sisting of either a fluctuating or warbling 'signal of varying pitch or a succession of intermittent blasts of about five seconds duration sepa- rated by a silent period of about three seconds. in the absence of an air raid warning signal in the City of West Covina, the warning of any person by an Air Raid Warden shall have the same force and effect as the warning by a signal, and the failure by such person so warned to immedi- ately comply shall be a violation of this ordinance punishable as herein provided. Section 2. "All clear signal« means a continuous signal, by siren, horn or other audible device, of two minute's duration at a steady pitch. Section 3. "Period of air raid alarm" means the interval of time between the giving of the air raid warning signal and the giving of the next succeeding all clear signal. Section 4. "Blackout structure" means any structure or other space so enclosed that any illumination maintained or existing therein is not visible fron any point outside such enclosure, except as may be per- mitted under. appropriate Army and Navy regulations. Section 5. t'Vehicle?? is a device in, upon or by wlich any person or property is or may be propelled, moved or drawn upon a highway, except a device moved by human power or used exclusively upon stationary rails or tracks. Section 6. "Blackout emergency vehicle" means any one of the f'ollow- ing: (a) An I'Lrmy or Navy vehicle. (b) A vehicle with United States Government credentials indicating the necessity of emergency movement. (c) An authorized emergency vehicle as defined in Sections 44 and 44.1 of the vehicle Code of California. (d) A vehicle of the type described in Sections G-4 and 44.1 of the Vehicle Code of California when returning to its headquarters after .the responded to an emergency call. te) A vehicle being operated by members of the California State Guard while actually on duty. (f) A vehicle of volunteer personnel engaged in the operation of tine Aircraft `Uarning Service of the Fourth interceptor Command while such personnel are actually going to or from their posts.of duty. (g) A vehicle certified by the Sheriff, the District Attorney, the California State Highway Patrol, a police chief, the Forester and Fire - Warden or other fire chief, when within the respective territorial jurisdictions of the certifying office, as being essential to the pre- servation of the public peace or health or safety or to the dissemination of public information or to the national defense. _Such vehicles shall A conform to the uniform lighting regulations approved by the Depart- ment of Motor Vehicles and the California State Highway Patrol for blackout emergency vehicles. No certificate shall be issued which conflicts with any regulation or order of the United States Army applicable :in the area for which the certificate is issued. Section 7: The provisions of this ordinance do not apply to blackout emergency vehicles. Section 8: The Chief of Police of the City of West Covina shall cause the -sounding of an Air raid warning signal and of an All C L;ar signal when, and only when, he is notified so to do by the United States Aircraft Warnin S Service, and pending the installation of such • Air Raid Signal, shall cause the Air iiaid .,Vardens in said City to spread said warnings. . Section 9: Any person who causes effects or maintains any illumin- ation, or causes, permits or suffers any illumination under his control to be effec;ed or maintained except as may be permitted under appropriate Army or i:avy regulations at any place within.the County of Los Angeles during any period of air raid alarm in the hours of darkness, except within a blackout structure, is guilty of a misdemeanor. Section 10: The maintenance or leaving of any illumination, except within a blackout structure, or as may be permitted under appropriate Army or ivav-1 regulations, without provision for its extinguishment, within one minute after the commencement of a period of air raid alarm by a competent person over.the age of eighteen years attendant at the place where such illumindtion is controlled, is a misdemeanor. Section 11: Every person who disobeys any lawful direction or order of a peace officer, highi,-,,ay patrolman, or fireman given during a period of air raid alarm, which order is reasonably necessary for the main- tenance of public.*6rde.r::o;� safety or -to =-effect`,the.'-,ext.ingti shjMent*'of- '.ob- seuration or light,is guilty of a misdemeanor* Section 12: Any illumination contrary to the provisions of this ordinance ccnstitutes a public nuisance, and any peace officer, high- way patrolman, or fireman may summarily abate thesame. Section 13: Any peace officer, highway patrolman, or fireman, us- ing reasonable force if necessary, may enter any structure for the • purpose of abating such a nuisance by extinguishing such illumination. • aection 14: At the commencement of a period of air raid alarm,the operator of any vehicle shall forthwith bring such vehicle as far as possible to the side of the street, road or highway off the main traveled portion thereof, and the operator of such vehicle, and the operator of any street car, shall bring such vehicle or stre: t car to a stop clear of any crossing, intersection, fire house, fire plug, hospital or other emergency depot or area, and during the hours of darkness shall extinguish all lights therein or thereon and shall keep such vehicle or street car so situated during the period of air raid alarm unless directed or ordered to -move by a peace,officer, highway patrolman, or fireman . D ' Section 15: Every person who without authority, during any air raid alarm, uses, wears, exhibits or possesses any uniform, insignia, credential, or other indication of authority, or any imitation there- of, adopted and issued by any official civilian defense organization is guilty of a misdemeanor. Section 16: Every person who operates a siren, whistle, horn or other audible device in such a manner as to simulate an air raid turning signal or an all clear signal, except upon order of the Sheriff or other proper authority, is guilty of a miscdeineanor. Section 17: The provisions of every ordinance of this city and every administrative order made pursuant the:c°eto, requiring any illumination to be maintained in conflict with this ordinance shall be suspended during the period between any air raid warning signal and the next succeeding all clear signal. Section 18: Any person who violates any provision of this • ordinance is guilty of am.i'sdemean�and, upon conviction thereof, shall be punished by a fine of not exceeding three hundred dollars or by • imprisonment in the County jail not exceeding three months, or by both such fine and imprisonment, Section 19: If any provision of this ordinance, or the application thereof' to any person or circumstance is held invalid, the remainder of the ordinance, and the application of such provision to other persons and circumstances shall not be affected thereby. Section 20: A state of war exists in the United States and by reason thereof this country is in great and continuing danger of air and other attack by the enemy. By reason of the foregoing facts this ordinance is urgently re- quired for the immediate preservation of the public peace, health, and safety and shall therefore take effect immediately upon the Fassage hereof. Section.21: This ordinance prior to the expiration of fifteen days f ror.the passage hereof shall be posted in three (3) public places in the City of West Covina, together with the names of the members of the City Council voting for and against t e same.
