Ordinance - 36ORDINANCE NO. AN'ORDINANCE GRANTING TO THE AZUSA IRRIGATING COMPANY, A CORPORATION, A FRANCHISE TO CONSTRUCT AND FOR A PERIOD,OF FORTY (40) YEARS TO MAINTAIN AND OPERATE A SYSTEM OF PIPE LINES FOR THE TRANSPORTATION AND DIS- TRIBUTION OF WATER UNDER, ALONG AND ACROSS CERTAIN PUBLIC STREETS IN THE CITY OF WEST COVINA, CALIFORNIA. The City Council of the City of west Covina does ordain as follows: Section 1: The right, privilege and franchise is hereby • granted to the Azusa Irrigating Company, a corporation, to construct, and for a period of forty (40) years after the granting of such franchise, to maintian and operate a system of pipe lines for the transportation and distribution of water under, along and across any and all public streets in the City of West Covina, State of California, within the following described territory: On Arroyo Avenue from Orange Avenue to Lark Ellen Avenue; On Workman Avenue from ©invent Avenue to Lark Ellen Avenue; On Rowland Avenue from Vincent Avenue to Lark Ellen Avenue; On Puente Avenue from Irwindale Avenue to Lark Ellen Avenue; On Covina Boulevard from Azusa Canyon Road to Orange Avenue; On Orange Avenue from Arroyo Avenue to Covina Boulevard; On Irwindale Avenue from Arroyo Avenue to North City Limits • Rest Covina; On Vincent Avenue from Arroyo Avenue to North City Limits • West Covina; On Lark Ellen Avenue from Arroyo Avenue to North City Limits West Covina; Section 2: This franchise is granted and shall be held and enjoyed only in accordance with the provisions and subject to all terms and conditions of all of the ordinances of the City of Wdst Covina whioh may be relevant thereto, and any and all amendments thereto, and in accordance with the terms and conditions of this ordinance specifically. LJ • Section 3: The grantee shall pay at all times before receiving authorization from the City Clerk of the City of Pest Covina for the construction of any work contemplated hereunder the sum of Fifteen Dollars ($15.00) for every mile, or fraction thereof, of pipe line laid under the provisions of this franchise and by virtue of the franchise hereby granted. Section 4: No pipe line laid under the terns of this franchise shall exceed thirty inches (30") in internal diameter. Section 5: The grantee of this franchise shall have the right during the period for which this franchise t$:�ranted to transport and distribute water through said pipe line system. Section 6: This ordinance shall take effect thirty days afterihe date of its adoption, and prior to the expiration of fifteen days from the passage hereof shall be published once in a newspaper published in the County of Los Angeles, State of California, nearest the City of West Oovina, together with a statement of the names of the members of the City Council of West Covina, Voting for and against the same-. 2. Wolfinger, being first duly sworn, says: That he is the Clerk of the City of Vest Covina, a citizen of the United States, over the age of 21 years, and that on the 18th day of February, 1128, he posted three copies of Ordinance No.36 entitled, "an ordinance grant- ing to the Azusa Irrigating Company, a corporation, a franchise to • construct and for a period of forty (40) years to maintain a system of pipe lines for the transportation and distribution of water under, along and across certain public streets in the City of West Covina, Calif." in three public places in the said city, to -wit: one at the door of the West Covina club house, where the meetings of said Council are held, one on Sunset Avenue in front of the West Covina School house and one at the northwest corner of Puente Street and Lark Ellen Avenue.
