■ AN ORDINANCE PROVIDING FOR THE CREATION,
IN THE CITY OF WEST COVINA, OF ZONES CONSISTING OF
VARIOUS DISTRICTS AND PRESCRIBING THE CLIESES
OF BUILDIItiGS, STRUCTURES AND IMPROVEMENTS IN THE
SAID SEVERAL ZONES, AND THE USES THEREOF.
The Board of Trustees of the City of West Covina
do ordain as.follows:
Section 1: Except as hereinafter provided, the use
or uses of all buildings, improvements and structures existing
in the zone created by this ordinance, or hereafter to be created
by amendment hereto, at the time of the adoption of this ordinance,
may be continued. Except as herein provided no building, struc-
ture or improvement now existing shall be altered or enlarged,
and no building, structure or improvement shall be erected, con-
structed or established which is designed, arranged or maintained
for occupancy or use in the zone or district hereby created,
or in any zone or district hereafter to be created, restricted
by this ordinance against such erection, construction or establish-
• ment .
Section 2. All of the City of West Covina is hereby
created as and declarea to be in the "A" zone.
Section 3. No building, structure or improvement
shall be erected, constructed., established., altered or enlarged
in the "A" zone which is designed, arranged or intended to be
occupied or used for any purpose other than a single family
dwelling, together with the usual accessories located on the same
lot or parcel of land, including a private garage containing space
for automobiles owned and used by the ottiTner or occupant of such lot or
parcel of land, and a stable or other structure for the housing of
horses, cows, and other animals owned by the owner or occupant of
such lot or parcel of land, and. structures for the use and pro-
tection of produce raised upon such lot or parcel of land. Only
one (1) single-family dwelling house shall be erected, constructed
or established, altered or enlarged upon any one lot or parcel of
land which is forty (40) feet, or less, in width, other probisions
• of this ordinance to the contrary notwithstanding; provided, how-
ever, that the provision pertaining to the minimum width of lots in
the said "A" zone shall not apply to any lot officially recorded
in a map or plat of record in the office of the County Recorder of
Los Angeles County prior to the adoption of this ordinance.
Section 4. The Board of Trustees of the City of West
Covina shall have power, from time to time, to create and establish
other and additional zones, and to provide for the use and occupancy
thereof.
Section 5. Upon the verified petition.of any property
owner, filed with the said Board of Trustees, stating fully the
grounds of his application and all the facts relied upon by the
• petitioner, the said Board of Trustees may create exceptions to
. any of the restrictions established by this ordinance in the zone
or district -created by this ordinance, or in any zone or district
hereafter to be created, and the said Board of Trustees may, by
ordinance, permit the erection, alteration, reconstruction or
enlargement of any building, structure or improvement in any of the
said zones which is restricted against said building, structure or
improvement, upon such terms and conditions as said Board of Trustees
may deem proper under -the special circumstances so shown to exist,
whenever the said Board of Trustees shall be satisfied from a con-

sideration and investigation of the facts stated in the said
petition, that such exception or permit is necessary for the
preservation and enjoyment of any substantial property right or
rights of the petitioner, and not materially detrimental to the
public welfare or injurious to the property and improvements in 4,.--
the said zone or district thereof. Upon the filing of such peti-
tion the said Board of Trustees shall appoint a time for the
hearing thereof, and shall give notice of such hearing b7 po,sting
of notices thereof at the places provided for the posting of
ordinances of the said city, and by such other means as the said
Board may direct, and upon such hearing the said Board shall
hear all evidence in support of the said petition and in opposition
thereto, and the decision of the said Board of Trustees upon
said petition shall be final and conclusive as to all matters and
things.involved therein.
Section 6. Except as herein specifically provided,
it is not intended by this ordinance to modify or abrogate or
repeal any ordinance heretofore adopted relating to the use,
occupation, management or conduct of buildings, structures, im-
provements or premises.
Section 7. Any person, firm or corporation, violating
any of the provisions of this ordinance shall be deemed guilty
of a misdemeanor, and upon conviction thereof shall be punish-
able by a fine of not more than three hundred dollars ($300.00)
or by imprisonment for a period of not more than three (3) months,
or by both such fine and imprisonment. Each such person, firm
or corporation shall be deemed guilty of a separate offense for
each day during any part of which any violation of any provision

of this ordinance is continued or permitted by such person, firm
or corporation, and shall be punishable therefor as provided by
this ordinance.
Section:S. If any section, subsection, sentence,
clause, or phrase of this ordinance is for any reason held to be
invalid or unconstitutional. by the decision of any court of
competent jurisdiction,. such decision shall not affect the validity
of the remaining portions of the ordinance. The Board of Trustees
of the City of West Covina hereby declare that it would have passed
this ordinance, and each section, subsection, sentence, clause and
phrase thereof, irrespective of the fact that any one or more other
sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
Section 9. The erection, construction, establishment,
alteration or enlargement of buildings and structures in the City
of West Covina contrary to the provisions of #� ordinance is
hereby declared to endanger public peace, health and safety, and
for that reason this ordinance is urgently necessary for the
immediate preservation of the public peace, health and safety, and
the City Clerk is hereby directed to post this ordinance in the
manner required by law and the ordinances of the City of 4iest
Covina and thereupon the same shall be in full force and effect.
