Ordinance - 290 • ORDINANCE NO. AN ORDINANCE REGULATING THE MOVING OF ANY BUILDING OR STRUCTURE ALONG PUBLIC STREETS OF THE CITY -OF VIEST COVINA. The Board of Trustees of the City of West Covina do ordain as follows: .Section 1. -It shall be unlawful for any person, firm or corporation to move or to cause to be moved any building or structure, or any portion of any building or structure, over, upon, along or across any public street, alley or other public place, without first obtaining a permit in writing from the Superintendent of Streets so to do in the manner provided by this ordinance. Section 2. Any person, firm or corporation de- siring to move, or to cause to be moved,any building or structure, or any section or portion of any building or structure, over, upon, along or across any public street, alley or other public place shall first file a written ap- plication therefor vvith the Superintendent of Streets, specifying the kind of building to be moved, the location of the same, the location to which, and the route and length of the route over or along which such building or section or portion of such building is to be moved, the number of sections in which the building will be moved, and the time within which such removal will be completed. • Upon approval of such application by the Superin- tendent of Streets, he shall issue a permit or permits for the moving of the building or the sections or portions thereof mentioned in such application. No permit shall authorize the moving of moxe than one building, or more than one section or portion of any building in any case where any building is to be moved in two or more sections or portions. Every permit shall become and be void unless such removal shall be completed within the time specified in the application for such permit. Provided, however, that the Superintendent of Streets may extend such time when the moving of any building or any section or portion thereof is rendered impracticable by reason of inclemency of the weather. Section 3. No permit shall be issued for the re- moval of any building or any section or portion of any build- ing over, along, upon or across any public street, alley or other public place until the applicant therefor shall have paid to the Superintendent of Streets the sum of $2.00 for such permit and $5.00 for each day which will be*requi-red for the -removal of such building or section or portion thereof as stated in the application, and shall have deposited with o� the said Superintendent of Streets a special deposit of for each each one hundred lineal foot or fraction thereof of the -route over or alonpr which such building or section or portion thereof is to be moved. Section 4. The Superintendent of Streets shall keep in proper books an accurate account of all fees -received under this ordinance, giving the name of the person by whom the deposit is made, the date and the amount thereof, together with the location from which and to which the build- ing or section or portion thereof is to be moved, which book shall be open for public inspection. Said Superintendent of Streets shall pay all fees -received by him into the city treasury at least once each week. • Section 5. Every building and every section or portion of any building moved over, upon, along or across any public street, alley or other public place shall be moved under the inspection by and supervision of the Super- intendent of Streets. Section 6. It shall be the duty of any person, firm or corporation to whom any permit shall be issued for the removal of any building or any section or portion of any building, pursuant to this ordinance, when required _ by the Superintendent of Streets, to cause boards of suf- ficient strength to carry the load without breaking to be placed under all of the rolls or wheels to serve as a • -runway for such rolls or wheels during the removal of such • building or any section or portion thereof, along every street, alley or other public place which has been improved in any manner, and at no time shall such -rolls or wheels be permitted to revolve except when upon such board runway. Section 7. In case of damage to any public street, alley or other public place by -reason of the moving of any building or any section or portion thereof the Superintendent of Streets shall do such work as shall be necessary to restore such street, alley or other public place to as good a condit_on as the same �Jas in prior to such damage of the same, and shall charge the actual cost thereof to the person, firm or corporation to whom the permit was issued for such moving. Section 8. The City of Test Covina shall deduct from the deposit made asrequiredby this ordinance the cost of all repairs, if any, made by the Superintendent of Streets pursuant to this ordinance, and the sum of $5.00 for each day during which such building or any section or portion thereof shall have occupied any portion of any public street, alley or other public place, and the remainder of such deposit, if there be any -remainder, shall be -refunded to the person, firm or corporation making such deposit. In case the de- posit made pursuant to this ordinance shall not be sufficient to pay the costs herein required, the person, firm or cor- poration to whom such permit is issued shall upon demand pay to the Superintendent of Streets a sufficient sum to cover all such costs. Upon failure to pay such sum, the same may be recovered by the City of West Covina in any court of com- petent jurisdiction. - Section 9. All moneys -refunded pursuant to the provisions of this ordinance shall be .aud it-ej, :ands: pai� upon demand in the same manner as other claims or demands against the city are audited and paid. Section 10. It shall be unlawful for any person, firm or corporation moving or causing to be moved any build- ing or any section or portion thereof over, upon, along or across any public street, alley or other public place to fail, refuse or neglect to keep a red light burning at all times between sunset and sunrise at each corner of said build- ing, and at each corner of any such section or. portion of any building while the same or any portion thereof is located in or upon any public street, alley or other public place.. Section 11. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine of not less han 0,, nor more than $300.00, or by imprisonment in the '� for a period of not less than five days, nor more than three months, or by both such fine and imprisonment. Every such person, firm or corporation be deemed guilty of a separate offense for each and every day during which any building, or any section or portion thereof, is moved over, upon, along or across any public street, alley or other public place in violation of any of the provisions of this o-rdi- nance, and shall be punishable therefor as herein provided. Section 12. The moving of buildings over, upon, along or across public streets contrary to the provisions of this ordinance and without supervision will greatly damage the public streets of the city of West Covina, and for that -reason this • • ordinance is urgently necessary for the immediate preservation of the public peace, health and safety, and the City Clerk is directed to post this ordinance in the manner required by law and by the ordinances of the City of West Covina, and thereupon and thereafter the same shall be in full force and effect.
