Ordinance - 28+l i r �\ d � ORDINANCE NO. o AN ORDINANCE REGULATING THE CONSTRUCTION, ALTER- ALT ION, REPAIR, DEMOLITION AND REMOVAL OF BUILD- INGS AND OTHER STRUCTURES IN THE CITY OR WEST COVINA, AND PROVIDING FOR THE ISSUING OF PERMITS THEREFOR. The Board of Trustees of the City of West Covina do ordain as follows: Section 1. It shall be unlawful for any person, firm or corporation to erect, construct, alter, -repair, -raise, build upon, move, demolish, maintain or use, or to cause, permit or Buffer to be erected, constructed,altered, repaired, -raised, built upon, moved, demolished, maintained or used, within the City of Vest Covina, any building or structure or any portion thereof contrary to the provisions of this ordinance. . Section 2. It shall be unlawful for any person, . firm or corporation to commence, or to proceed with the erection, construction, building,-reconst-ruction, enlarging, alteration, changing, adding to, -repair, raising, building upon, moving, demolishing or removal of any building or structure, or any portion thereof, in the City of Vest Covina, unless a permit so to do shall have, first been ob- tained for each separate building or structure as herein- after provided; provided, however, that the issuance of any such permit shall not grant any -right or privilege to do any construction or work not provided for in the said permit as shown by the application or plans and specifi- cations filed therefor; provided further that an additional and separate permit shall be obtained for any construction or work other than that for which any permit was issued; :provided further, that the provisions of this section shall not be deemed or construed to require any permit for the _restoration of plastering or painting, or for the erection, alteration or -repair of any fence or -retaining wall not connected with any building or structure. Any person desiring such permit shall file with the Superintendent of Buildings, on a blank to be furnished by him, an application therefor, which application for such permit shall be made by the owner'or by his agent. Such application shall describe the land upon which the purported work is to be done, describing the same by lot or block or other description by which the same may be easily and -readily located or identified; the general dimensions of the building to be erected, constructed, altered, repaired, • raised, built upon, moved or demolished; the number and height of the stories thereof; the names of the owners, architect, if any, contractor, if any, and the estimate of the entire cost of the proposed work; the purpose for which such building, alteration or -repair is designed. When such application is made, plans and specifi- cations in duplicate of the building for which the permit is reuuested shall be filed with the Superintendent of Build- ings; one of the copies of such plans and specifications shall be retained by the Superintendent of Buildings, and the other copy, when approved by him, shall be returned to the applicant for the permit. The Superintendent of Build- ings need not retain such plans and specifications in his custody for more than three (3) months after the completion or occupancy of the building to which they relate. The ap- proval of any plan or specification by the Superintendent of Buildings shall not be held to permit or to be an approval of the violation of any provision of this ordinance or of any law of the State of California. All distances and di- mensions on the plans shall be accurately figured, and the drawings shall be explicit and complete. All plans shall be accompanied by a set of specifications describing all materials to be used in the proposed building. All plans and drawings shall be drawn to a scale of not less than s one --eighth of an inch to the foot on paper or cloth in ink or by some other process that will not fade or obliterate. It shall be unlawful for any person to erase',.., alter,or modify any line, figure or coloring contained in any such drawing or specification so approved by the Superin - • tendent of Buildings, dr filed with him for reference. It shall be unlawful for any person to deviate in any manner from the plans and specifications so filed snd approved, or in any manner affecting the structural features or the stability of the building from the terms of applica- tion, plans or specifications, unless notice in writing of such intention to alter or deviate shall be given to the Superintendent of Buildings, and his permission shall have been first obtained. J Section 3. Nothing in this ordinance contained shall be deemed to apply to or to affect, or to authorize the moving of any building upon any public street, alley or other public place. Section 4. The Superintendent of Buildings shall, before the granting of any permit upon an application filed in accordance with the provisions of this ordinance, require the payment by the applicant of the sum of One Dollar ($1.•00) when the cost of the proposed work does not exceed the sum of One Hundred Dollars ($100.00), and for each additional one hundred dollars or fraction thereof of the cost of such work, the sum of :�P o • Section 5. The Superintendent of Buildings shall keep in proper books an accurate account of all fees re ceived by him under this ordinance, giving the name of the owners upon whose account'the same were paid, the date and amount of payment, together with the description of the pre- mises as described in the permit, which book shall be open - for public inspection. The said Superintendent of Build- • -ings shall pay into the city treasury all fees --received by. • hire at least once each week Section 6. If the work authorized by any permit .s. rib t..-,commenced within ninety days from date thereof, or if the work authorized by said permit shall be suspended or abandoned for a period of ninety days, then such permit shall thereupon and thenceforth be null and void; and before such. work can be -recommenced a new permit shall be taken out, and the same fees as he-reinbefo-re fixed for the original permit shall be paid therefor, Section 7. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be pun- ishable by a fine of not less than'` '' 0.00, nor more than $300.00, or by imprisonment in the 444y-jail for a period of not less than five days, nor more than three months, or by both such fine and imprisonment. Every such person, firm or corporation shall be deemed guilty of a separate offense for each and every day during which any portion of any building is erected, constructed, altered, repaired, raised, built upon, demolished or moved in violation of any of the provisions of this ordinance, and shall be punishable therefor as herein provided. Section 8. The erection, construction, building, reconstruc- tion, enlarging, alteration, changing, adding to, repair, -raising, building upon, moving, demolishing or -removal of buildings in the City of West Covina, without permits and without the supervision of the Superintendent of Buildings is and will be a menace to the safety and health of the citizens of the said city, and for that reason this ordinance is urgently necessary for the immediate preservation of the public peace, health and safety, and the City Clerk is directed to post this ordinance in the manner required by law and by the ordinances of the City of West Covina, and thereupon and thereafter the same shall be in full force and e f f e c OyTAttest: resident - f theBoard of Trustees -City Cler . of the City of hest Covina. • • • STATE OF CALIFORNIA, � COUNTY OF LOS ANGELES, ) SS: CITY OF WEST COVINA, ) I, C.
