Ordinance - 26ORDINANCE NO. 2(0 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF WEST COVINA APPROVING THE ANNEXATION TO, INCORPORATING IN AND MAZING A PART OF THE SAID CITY OF.VIEST COVINA CERTAIN TERRITORY OUTSIDE OFTHE, SAID CITY AND CONTIGUOUS THERETO, WHICH SAID ANNEXATION WAS APPROVED BY THE QUALIFIED ELECTORS OF THE SAID TERRITORY AT. A SPECIAL ELECTION HELD ON 'THE 13TH DAY OF FEBRUARY, 1926, VOTING IN FAVOR OF THE ANNEXATION OF THE, SAID TERRI- TORY TO THE SAID,CITYj WHICH SAID TERRITORY HAS BEEN •AND IS DESIGNATEDAS NORTHWEST ANNEXATION DISTRICT. WHEREAS$ the' Board of Trustees of the City of West Covina did., on the 12.th day of January, 1926, receive a written petition signed by not less than one fourth in number of the qualified electors residing within the territory described in the said petition, 'which said aid territory is hereinafter particu- larly described, asking that the territory hereinafter described be annexed to, incorporated and included in, and made a part of the City of West, Covina; and WHEREAS, at the time of the filing of the said, -pe- tition, the said territory, was outside of the said City of West Covina and was contiguous thereto; and WHEREASt the said petition was by the said Board • of Trustees duly referred to the City Clerk of the said City of • West Covina, and the said City Clerk did on the 12th day of January, 1926, report to the said Board of Trustees that he had examined the said petition:and the register of voters of the County of Los Angeles, and found that the said petition was signed by more than one fourth in number of the qualified elec- tors residing within the said territory described in the said petition; and WHEREAS, the said Board of Trustees did on the 12th day of January, 1926, in the manner required by law, call a special election in the said territory described in the said petition and did designate the 13th day of February, 1926s as the day for holding the said election, and did cause notice of said election to be published in a newspaper of general • circula- tion outside of the said City of Vilest Covina., but in the County of Los Angeles, the same being the county in which the said ter- ritory was and is situated, at least once a week for a period of four successive weeks next preceding the date of said election, which said notice was in the form and was published in the man- ner -required by law; and IMEEAS, the said Board of Trustees, by resolution, did designate the said territory as Northwest .Annexation district, and did appoint officers of the said election in the manner re- quired by. law, and did establish the saidterritory as a voting precinct, and did designate a polling place therein; and a MAS, the said election was duly and. regularly held on the said 13th day of February, 1926, andthe same was con- ducted and the votes cast thereat were received and counted, and • the returns made thereon.in the time, in the form, and in the manner required by law; and WHEREA89 the said, Board of Trustees did meet on _ the 17th day of February, 1926, the said date being the first regular meeting of the said Board.of Trustees next after the expiration of three days from and after the date of the said election, for the purpose of canvassing the votes cast at the said election and the returns of the said election, and the said -2- Board of 'I"rustees did at its said meeting canvass the returns of the said election and completed the canvass thereof, and by the said canvass it vies found that, the total number of votes cast in favor of said proposition, and the 'total number of votes cast against the said proposition were in number as here- inafter particularly.set forth; and L,,vEEREAS,'it was found that a special election was • held on the 13th day of February, 1926, in the territory desig- nated as Northwest Annexation District, more particularly herein- after described-, at which election there was submitted to the qualified electors of said district 'the question whether the said territory lie annexed to, incorporated- in and made a part of the said City of TvIest Covina; and that at the said election the total number of votes cast was <Y? votes; and that the total number of votes cast for the proposition: Shall the territory designated as "NORTMirEST &-NNEXATION DISTRICT" be annexed to. -the City of 'West, Covina? YES 0 wa votes; and that the total number of votes cast for the pro position: • Shall the territory designated. as "NORTHWEST A M MXATIOIa DISTFICT" be annexed to-th.e City of West Covina? NO was Vo tee; that the total number of vo�-Ps cast in the said election in favor of annexation of the aforesaid territory to the said City of West Covina was votes, and that the total number of 'votes cast against the an- nexation of the said territory to, the said City of TvVest Covina was votes; and WHEREAS, the City Clerk' of the said City 'of West Covina did on the 17th day of February, 1926, cause a record of the canvass of votes to be made and entered upon the minutes of the said Board of Trustees, stating the proposition submitted to the qualified electors of the said territory, the total number of votes cast upon the said proposition in the said territory, the • number of votes cast therein in favor of the annexation of the said territory to the said City of West Covina, and the total number of votes cast therein against the said annexation; and WHEREAS, it appears from the canvass of the votes cast at the said special election that the proposition of the annexation of the said territory to the said City of West Covina described in the said petition and hereinafter particularly de- scribed, received a majority of all of the votes cast at the said election; ISOW, THEREFORE, the Board of Trustees of the City of West Covina do ordain as follows: Section 1. That the annexation to the said City of West Covina of the territory hereinafter described and designated on the ballots used at the said special election held in the said territoryas Northwest Annexation District be and the + same is hereby approved, and that the territory hereinafter described be, and the same is hereby annexed to, incorporatedin and made a part of the City of West Covina::. Section 2. That the territory hereinbefore referred to, and which is hereby annexed to, made a part of and incor- porated in 'the said City of West Covina, is more particularly described as follows: - 4- That certain portion of the County of Los Angeles, State of California, described as follows: Beginning at the northwesterly corner of lot eleven (11) of Eugene Riggin' s Subdivision of the Hathaway Tract, as per map recorded in Book 53, page 37, Miscellaneous Records of the County of Los Angeles, the same being an angle point in. the boundary line of the City of crest Covina; thence easterly • along the northerly line of��-the said lot eleven (11), (the said line being also the northerly line of the said City of crest Covina) to the northeasterly corner of the said lot; thence northerly along the easterly line of lots twelve (12) , thirteen (13) , fourteen (14) and fifteen (15) of 'the said Eugene Riggin's Subdivision of the Hathaway Tract and the northerly prolongation of the said line 'to a point in 'the northerly line of Covina Boulevard (or San Bernardino Road), the said last mentioned line being the southerly line of lot four (4) of the west part of the fractional north half of section sixteen (16) , township one (1) south, range ten (10) west, S. B. Be & Id. , as per map recorded in Book 1415 of Deeds, page 44, Records of said County • of Los Angeles; thence easterly along the southerly line of the said lot four (4) to the southeasterly corner of said lot; thence northerly along the easterly line of said lot Four (4) to the northeasterly corner of said lot; thence westerly along the northerly line of the said lot four (4) to the northwesterly corner of said lot; thence in a direct line to the northeasterly corner of lot sixteen (16) of the said Eugene 'Riggin's Subdivision of the Hathaway Tract, the said. point being in the southerly line of the right-Df-way of the Southern Pacific Railroad (Covina - 5 - Branch) ; thence westerly along the southerly line of the said right-of-vzay to the northwesterly. corner of a tract of 9.95 acres, more or less, belonging to Charles IE.endall, in lot tvao (2) of section seventeen (17) township one (1) south, range ten (10) west, S. B.B. & IkI. ; thence southerly along the westerly line of the said 9.95 acre tract to the northerly line of the • said Covina Boulevard; thence northeasterly and easterly along the northerly line of the said Covina Boulevard to a point which is ten (10) feet westerly, measured along the said line, from the northerly prolongation of the easterly line of lot fifteen (15) of the said Eugene Riggin's Subdivision of the Hathaway Tract; thence southerly to a point in the northerly line of 'the said lot fifteen (15) , which is ten (10) feet westerly from the northeasterly corner of said lot; thence westerly along -the north- erly line of the said lot fifteen (15) to the northwesterly corner of the said lot; thence southerly along the westerly line of lots fifteen (15) , fourteen (14) , thirteen (13) and twelve (12) of the said Eugene Riggin's Subdivision of the Hathaway '.Tact to 'the place of beginning. . Section 3. That the City Clerk shall certify to the passage of this Ordinance and cause the same to be posted in three of the most public places in the City of ffest Covina, to wit: At the door of 'the Wiest Covina Club House, and on Sunset Avenue in front of the West Covina School House, and at the northwest corner of Puente Street and Lark Ellen Boulevard,ancl shall file a certified copy of this ordinance with the Secretary of the State of California, and one with the County Surveyor of the County of Los Angeles, and said Ordinance shall be in full force and effect thirty days from and after the date of posting.
