CHANGES TO THE AGENDA City Manager Freeland indicated that there was a typo on the minutes for the Regular City Council Meeting on July 3, 201 8 on Item No. 1. However, he clarified that this item did not need to be pulled, as it would be amended as part of the motion. He also stated that staff had requested to pull Item No. 13 off the agenda and that it would be brought back for Council consideration and discussion at a future meeting in September. PRESENTATIONS Recognition of West Covina Police Officer David Reyes Mayor Johnson made an adjournment motion in memory of Manuel Cervantes, father of West Covina Resident Lola Finley. ORAL COMMUNICATIONS - Five (5) minutes per speaker Herb Redholtz spoke on term limits and expressed concerns regarding the lack of candidates for Districts No. 4 and No. 5. Jim Grivich expressed his approval regarding the proposed budget policy. Beverly Bulthuis spoke on behalf of the West Covina Improvement Association and shared that they would be hosting the District Candidate Forums in the Council Chambers. She also informed the public that forums would occur on the following dates: District No. 2 would take place on September 12, 2018, District No. 4 would occur on September 26, 2018, and District No. 5 would occur on October 10, 2018. She also indicated that the event would begin at 6:30 p.m. for public inquiries and a meet-and-greet followed by the forum beginning at 7:00 p.m. Chris Miller spoke on Items No. 9 and 13 and expressed concerns regarding the financial situation of the City. He also stated the City should adhere to the budget plan and limit expenditures to ensure that they are not more than the allotted amount. In addition, he also expressed his disapproval regarding the Active Transportation Plan and requested for the Council to take action to support the repeal of Proposition 6. Fredrick Sykes expressed concerns regarding the lack of security and safety at Shadow Oak Park during the evening hours and discussed the issue of homelessness running rampant within the City. 2 Tuesday August 21, 2018 Bill Elliott expressed his approval regarding Item No. 23 and spoke on his disapproval regarding the elimination of City Council stipends. He also discussed districting and expressed concerns regarding the City Council candidates for the upcoming election. City Manager Freeland gave responses to speaker inquiries. AYES: Spence, Toma, Warshaw, Wu, Johnson NOES: None ABSENT: None 7 Tuesday August 21, 2018 HUMAN RESOURCES 13) Approving the Salary and Benefit Schedule for Non-Represented Department Heads It is recommended that the City Council adopt the following resolution: RESOLUTION NO. 2018-98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE SALARY AND BENEFIT SCHEDULE FOR NON-REPRESENTED DEPARTMENT HEADS FOR THE PERIOD OF JULY 1,2017 THROUGH JUNE 30, 2019 Item No. 13 was pulled by staff and be brought back for further Council discussion during an upcoming September City Council Meeting. POLICE DEPARTMENT 14) Recommended Responses to the Annual Los Angeles County Civil Grand Jury Report 2017-2018 It is recommended that the City Council authorize the City Manager to respond to the Presiding Judge of the Superior Court concerning recommendations made by the 2017- 2018 Los Angeles County Civil Grand Jury. Mayor Johnson pulled Item No. 14 for further discussion. Captain Doug Murray gave an overview on Item No. 14 and provided information regarding the Los Angeles County Civil Grand Jury and the City's interaction with this group. After a discussion between the City Council and city staff a motion was made by Councilmernber Toma to make complaint forms available online, make complaint forms available on the city's website in the required languages, make signs in the required languages showing the locations of the complaint forms, make complaint forms printable from city's website, and have staff check on the cost to have the public be able to submit the complaint form through City's website. After further City Council discussion, Councilmember Toma indicated that he would be making separate motions for each of the items discussed. A motion was made by Councilmember Torna and seconded by Councilmember Warshaw to make complaint forms downloadable and printable from city's website. Motion was carried by a vote of 5-0. AYES: Tama, Warshaw, Johnson NOES: Spence, Wu ABSENT: None 17) Fiscal Year 2018-19 Budget Amendment for the Active Transportation Cycle 4 Grant It is recommended that the City Council adopt the following resolution: RESOLUTION NO. 2018-108 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2018, AND ENDING JUNE 30, 2019 (ATP Cycle 4 Grant) Mayor Pro Tern Wu pulled Item No. 17 for further discussion. Mayor Pro Tem Wu inquired on the safety of bicycle lanes around school areas. After a discussion between the City Council and city staff, a motion was made by Councilmember Warshaw and seconded by Councilmember Toma to adopt Resolution No. 2018-108. Motion was carried by a vote of 3-2 with Councilman Spence and Mayor Pro Tern Wu in opposition. AYES: Toma, Warshaw, Johnson NOES: Spence, Wu ABSENT: None 18) Extension of Contract with RICA Consulting Group For "As-Needed' Building Plan Check and Inspection Services It is recommended that the City Council authorize the City Manager to execute a contract amendment with RKA Consulting Group in the total amount not to exceed $225,000 (including not to exceed $75,000 annually) for three successive one-year extension terms 10 Tuesday August 21, 2018 to provide 'as-needed' building plan check and inspection services. A motion was made by Councilman Spence and seconded by Councilmember Toma to authorize the City Manager to execute a contract amendment with RKA Consulting Group in the total amount not to exceed $225,000 (including not to exceed $75,000 annually) for three successive one-year extension terms to provide 'as-needed' building plan check and inspection services. Motion was carried by a vote of 5-0. AYES: Spence, Toma, Warshaw, Wu, Johnson NOES: None ABSENT: None END OF CONSENT CALENDAR DEPARTMENTAL REGULAR MATTERS CITY ATTORNEY'S OFFICE 19) Rebuttal Arguments Regarding Ballot Measures on Changing the Office of City Treasurer and the Office of the City Clerk from Elected Positions to have them Appointed by the City Manager It is recommended that the City Council consider and approve a rebuttal argument responding to any arguments against the ballot measures on changing the office of the City Treasurer and the office of the City Clerk from elected positions to have them appointed by the City Manager, or, alternatively act to authorize in writing any other person or persons to prepare, submit, or sign the rebuttal arguments as provided in California Elections Code 9285. City Attorney Kimberly Hall Barlow gave the report on Item No. 19. After a discussion between the City Council and city staff on the editing of the rebuttal arguments for the offices of the City Clerk and City Treasurer, a motion was made by Councilmember Warshaw and seconded by Mayor Johnson to approve the rebuttal arguments as edited by the City Council. Motion was carried by a vote of 3-1-1 with Mayor Pro Tern Wu in opposition and Couneilmember Toma abstaining. Beverly Bulthuis spoke on behalf of the West Covina Improvement Association and shared that they would be hosting the District Candidate Forums in the Council Chambers. She also informed the public that forums would occur on the following dates: District No. 2 would take place on September 12, 2018, District No. 4 would occur on September 26, 2018, and District No. 5 would occur on October 10, 2018. Mayor Johnson pulled Item No. 14 for further discussion. Captain Doug Murray gave an overview on Item No. 14 and provided information regarding the Los Angeles County Civil Grand Jury and the City's interaction with this group. After a discussion between the City Council and city staff a motion was made by Councilmember Toma to make complaint forms available online, make complaint forms available on the city's website in the required languages, make signs in the required languages showing the locations of the complaint forms, make complaint forms printable from city's website, and have staff check on the cost to have the public be able to submit the complaint form through City's website.
