CHANGES TO THE AGENDA City Manager Freeland indicated that there are additional attachments for Item No. 19 provided by City staff. Mr. Freeland also stated that the dates for the Summer Art Festival and Night Market City Sponsorship Request on Item No. 28 are incorrect and should be corrected from July 28-29 to August 18-19. PRESENTATIONS Recognition of Public Works Director Chino Consunji Presentation by Mt. San Antonio College Academy Presentation by Ca'trans on Update on the I-10 High Occupancy Vehicle (HOV) Lane Construction Project Mayor Johnson made adjournment motions in memory of: 1. West Covina resident Royall Brown 2. Retired West Covina Police Detective John E. Corby ORAL COMMUNICATIONS - Five (5) minutes per speaker John Shewmaker expressed concerns regarding the City's budget and expenditures. Phil Kaufman expressed concerns regarding the timeline concerning the Caltrans Construction Project on the I-10 Freeway. Mr. Kaufman also shared his approval regarding Item No. 26 to improve transparency for the public, as well as for Item No. 30 to ensure there is clean and safe water for all. Herb Redholtz spoke in favor of Item No. 31 in setting term limits for all City Council members as well as for City Elected Officials. Angie Gillingham expressed concerns regarding Councilman Spence's position on the City Council. Elsie Messman shared her disapproval regarding Item No. 13 and expressed concerns regarding the fiscal situation of the City. 2 Tuesday June 19, 2018 Jim Grivich spoke on Item No. 13 and suggested for the City to adopt a policy to limit all future expenditures to ensure they do not exceed the budget. Kim Potras expressed concerns regarding Item No. 13 and stated that the City cannot afford to give raises to staff due to the current fiscal decline of West Covina. Frederick Sykes shared his concerns regarding the City's financial situation. Brian Tabatabai expressed concerns regarding Councilman Spence's absence during the public comment portion of the Regular City Council Meeting on June 5, 2018, and asked for Mr. Spence to resign from the City Council. Bruce Leinbach commented on the late Royall Brown and shared his sentiments regarding the late resident. Mr. Leinbach also expressed his concerns regarding the City's budget and stated that the only resolution will result in bankruptcy. Robert Torres asked Councilman Spence to resign from the City Council and advised Mr. Spence to seek help for his condition. Amy Tremmel proposed an art festival to help increase business opportunities and as a way to increase revenue within the City. City Manager Freeland gave responses to speaker inquiries. Motion was carried by a vote of 5-0. A motion was made by Councilmember Warshaw and seconded by Mayor Pro Tern Wu to 5 Tuesday June 19, 2018 direct staff to review the City's current Conflict of Interest Code. Motion was carried by a vote of 5-0. Enterprises LLC. A motion was made by Councilmember Warshaw and seconded by Mayor Pro Tern Wu to authorize the City Manager to execute a 90-day extension to the Agreement for Construction and Maintenance of a Soundwall between the City of West Covina and P.T. Enterprises LLC. Motion was carried by a vote of 5-0. AYES: Spence, Toma, Warshaw, Wu, Johnson NOES: None ABSENT: None FINANCE DEPARTMENT 9) Resolution to Continue Fiscal 2017-18 Appropriations It is recommended that the City Council adopt the following resolution: RESOLUTION NO. 2018-79 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, TO CONTINUE APPROPRIATIONS CONSISTENT WITH THE FISCAL YEAR 2017-18 CITY OF WEST COVINA AND THE SUCCESSOR AGENCY TO THE FORMER WEST COVINA REDEVELOPMENT AGENCY OPERATING BUDGETS AND THE CAPITAL IMPROVEMENT PROGRAM UNTIL THE ADOPTION OF THE FISCAL YEAR 2018-19 ANNUAL BUDGET Councilman Spence pulled Item No. 9 for further discussion and expressed concerns regarding the adoption of Resolution No. 2018-79. Councilmember shared his concerns regarding budget cuts for City personnel. Mayor Pro Tern Wu suggested for the budget discussion to be tabled until the next scheduled budget meeting on July 2, 2018. 6 Tuesday June 19, 2018 City Manager Freeland informed Council that since the City will not have a finalized budget plan readily available for adoption by June 30, 2018, there must be a pending continued Resolution prepared for Council approval. He also stated that due to the complications regarding the final budget adoption, staff has recommended that the final adoption should take place in August. Councilmember Warshaw suggested for a hiring freeze to be implemented on all available positions, with the exception of the Finance Director, as well as an extension for the final adoption of the City's budget. A motion was made by Councilmember Warshaw and seconded by Mayor Pro Tern Wu to postpone the adoption of Resolution No. 2018-79, to continue Fiscal 2017-18 appropriations until the next scheduled Special Meeting on July 2, 2018. Motion was carried by a vote of 5-0. AYES: Spence, Tama, Warshaw, Wu, Johnson NOES: None ABSENT: None 10) Audit Committee Appointment It is recommended that the City Council appoint Mayor Pro Tern Tony Wu to the City's Audit Committee, replacing Councilman Mike Spence. Councilmember Warshaw pulled Item No. 10 for further discussion and stated in order for a new appointment to occur, a majority vote must be made by Council in order to remove Councilman Spence as a member of the City's Audit Committee. In addition, Mr. Warshaw requested for two separate votes to be done to remove Councilman Spence as a member, as well as open the nomination period for another Councilmember to replace Mr. Spence on the aforementioned committee. City Attorney Hall Barlow agreed that two actions must be taken in order to remove Mr. Spence as a member of the Audit Committee and to replace him with another Councilmember. A motion was made by Councilmember Toma and seconded by Mayor Johnson to remove Councilman Spence as a member of the City's Audit Committee. Motion was carried by a vote of 3-2, with Councilman Spence and Councilmember Warshaw in opposition. AYES: Tom, Wu, Johnson NOES: Spence, Warshaw ABSENT: None Councilmember Warshaw nominated Councilmember Toma for the Audit Committee. Councilmember Toma respectfully declined Councilmember Warshaw's nomination and 7 Tuesday June 19, 2018 nominated Mayor Pro Tern Wu for the Audit Committee. A motion was made by Councilmember Toma and seconded by Councilmember Warshaw to appoint Mayor Pro Tern Tony Wu to the City's Audit Committee, replacing Councilman Mike Spence. Motion was carried by a vote of 4-1, with Councilman Spence in opposition. AYES: Toma, Warshaw, Wu, Johnson NOES: Spence ABSENT: None FIRE DEPARTMENT 11) Second Amendment with MAK Fire Protection Engineering and Consulting, Inc., and PE Consulting Group for Fire Prevention Plan Check Services It is recommended that the City Council take the following actions: 1) Authorize the City Manager, or his designee, to sign the second amendment to the Professional Services Agreement with MAK Fire Protection Engineering and Consulting, Inc., for plan check services; and 2) Authorize the City Manager, or his designee, to sign the second amendment to the Professional Services Agreement with PE Consulting Group for plan check services; and 3) Authorize the City Manager, or his designee, to execute the two (2) optional, one-year renewal terms following the initial 36-month term for both MAK Fire Protection Engineering and Consulting, Inc., and PE Consulting Group. A motion was made by Councilmember Warshaw and seconded by Mayor Pro Tern Wu to approve the aforementioned actions. Motion was carried by a vote of 5-0. AYES: Spence, Toma, Warshaw, Wu, Johnson NOES: None ABSENT: None 12) Fiscal Year 2017-18 Budget Amendment - Fire Department Strike Team It is recommended that the City Council adopt the following resolution: RESOLUTION NO. 2018-80 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30, 2018 (Fire Department Strike Team Reimbursement) A motion was made by Councilmember Warshaw and seconded by Mayor Pro Tern Wu to adopt Resolution No. 2018-80, for Fiscal Year 2017-18 Budget Amendment - Fire Department Strike Team. Motion was carried by a vote of 5-0. 8 Tuesday June 19, 2018 AYES: Spence, Toma, Warshaw, Wu, Johnson NOES: None ABSENT: None HUMAN RESOURCES 13) Approving Memoranda of Understanding with the Confidential Employees' Association, General Employees' Association, Maintenance and Crafts Employees' Association, Mid-Management Employees' Association, and Non-Sworn Safety Support Employees' Association and the Appropriation of Funds It is recommended that the City Council adopt the following resolutions: RESOLUTION NO. 2018-87 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF WEST COVINA AND THE WEST COVINA NON-SWORN SAFETY SUPPORT EMPLOYEES' ASSOCIATION FOR THE PERIOD OF JULY 1, 2016 THROUGH JUNE 30, 2017. Mayor Pro Tern Wu pulled Item No. 13 for further discussion and clarification. City Manager Freeland addressed Mayor Pro Tern Wu's concerns and stated that the proposed Resolutions will resolve a variety of employee issues that have carried on over the last couple of years. In addition, he also stated that if Council were to make any adjustments regarding City staff, a contract would be strongly advised. City Attorney Hall Barlow added that the 2016-2017 2% salary increase for non-sworn employees was proposed to these individuals almost three years ago as part of labor negotiations for that contract year, and cannot be reversed unless the City gives the aforementioned employees something of equal value. Mayor Pro Tern Wu expressed concerns regarding the salary increase for City employees during a fiscal decline. City Attorney Hall Barlow clarified that the 2016-2017 2% salary increase is a one-time bonus for non-sworn City employees, whereas the 2% Cost Of Living Adjustment (COLA) increase will not be implemented until July 1, 2018. Mayor Pro Tern Wu asked if Item No. 13 could be held over until the next scheduled Special Meeting on July 2, 2018 in order for staff to compile additional information for Council. City Manager Freeland informed Mayor Pro Tern Wu that further details regarding the aforementioned Resolutions will not be available for Council discussion at the July 2, 2018 meeting as complications will arise should the proposed Resolutions not be adopted 9 Tuesday June 19, 2018 at tonight's meeting. A motion was made by Mayor Pro Tern Wu and seconded by Councilman Spence to hold Item No. 13 over to the next scheduled Special Meeting on July 2, 2018. Motion failed to be approved by a vote of 2-3, with Councilmember Toma, Councilmember Warshaw, and Mayor Johnson in opposition. AYES: Spence, Wu NOES: Toma, Warshaw, Johnson ABSENT: None Councilman Spence asked City Attorney Hall Barlow to explain what the legal ramifications would be for the City, should the Council choose to reject all proposed agreements previously approved by the majority of the Council during labor negotiation meetings. City Attorney Hall Barlow stated that a complaint would be made to the Public Employment Relations Board (PERB) and legal action would be taken against the City, should the Council reject all previously agreed upon contracts. Councilman Spence stated his approval regarding Item No. 13. A motion was made by Councilmember Warshaw and seconded by Councilmember Toma to adopt Resolution No. 2018-87, amending the memorandum of understanding between The City of West Covina and the Non-Sworn Safety Support Employees' Association for the Period of July 1, 2016 Through June 30, 2017 Motion was carried by a vote of 4-1, with Mayor Pro Tern Wu in opposition. Motion was carried by a vote of 5-0. • AYES: Spence, Toma, Warshaw, Wu, Johnson NOES: None ABSENT: None PUBLIC WORKS 15) Award of Construction Contract for Fiscal Year 2016-17 Residential Streets Rehabilitation It is recommended that the City Council take the following actions: 1) Authorize the City Manager to execute a contract agreement with Copp Contracting Inc. of Buena Park, California in the amount of $647,876.10 for the construction of the Fiscal Year 2016-17 Residential Streets Rehabilitation Project; and 2) Adopt the following resolution: RESOLUTION NO. 2018-72 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017 AND ENDING JUNE 30, 2018 (Residential Street Rehabilitation Fiscal Year 2016-17) A motion was made by Councilmernber Warshaw and seconded by Mayor Pro Tern Wu to 12 Tuesday June 19, 2018 adopt Resolution No. 2018-72, for Award of Construction Contract for Fiscal Year 2016- 17 Residential Streets Rehabilitation. City Manager Freeland clarified that the home improvement plan is being funded by the City's housing program funds. Councilman Spence asked Community Services Manager McDonald if there was any additional funding available to improve the infrastructure of the Senior Center. Community Services Manager McDonald indicated that the only funding available to complete these improvements would be included in the proposed CDBG Action Plan. City Manager Freeland stated that the City applied for a Business Assistance Loan Program, which is currently in review, and will return for City Council consideration at a later date. In addition, Mr. Freeland informed Council that the funds from this loan can be re-allocated to fund other projects, or the funds can remain in the program for later use. (FY) Furthermore, Mr. Consunji shared that staff recommends a 5% increase of sewer rates as well as 6 new Capital Improvement Projects set to improve the City's sewer systems. City Manager Freeland clarified that the proposed 5% rate increase will not be an additional increase, but upholds Council direction from a previous meeting regarding this matter. Councilman Spence asked for further clarification from Public Works Director Consunji regarding the expenditure for the Best Management Practices Implementation. Public Works Director Consunji addressed Councilman Spence's concerns and clarified that these practices ensure that trash and debris do not get trapped inside City catch basins or sewer manholes, eventually draining out into the sea and polluting our oceans as well as endangering many sea creatures. Public Works Director Consunji gave a brief overview regarding the Citywide Lighting and Maintenance District, and stated that staff recommends an assessment increase of 2% to generate additional revenue for the City and to sustain the increasing electricity and water rates. He also explained that the Council has three options to implement the new assessment fees which include: increasing the rates by 2%, no rate increases, which will affect the General Fund, or to provide alternative direction to staff Councilmember Warshaw inquired about the tree trimming cycle and the amount the City spends on tree trimming over the 7 year cycle. Public Works Director Consunji explained that the tree trimming would be included in the Maintenance Contracts Costs of $292,339. Councilmember Warshaw asked how staff determined the amount spent on tree trimming and inquired how much each resident is paying for per tree. City Manager Freeland clarified that a summary regarding street trees can be found on the staff report for Item No. 22 and the total for street trees maintained under the Citywide Lighting and Maintenance District is $397,195. 17 Tuesday June 19, 2018 City Attorney Hall Barlow clarified that the exact total of trees within the City is 29,500 and there are only 963 street trees that are not included within the assessment fees for residents, and are paid out of the City's General Fund. Mayor Pro Tern Wu asked for clarification regarding what is covered under the Citywide Lighting and Maintenance District. He also asked if the City can reach out to Southern California Edison to switch to LED lighting to save on energy and cost. City Manager Freeland explained that switching to LED lighting is cost prohibitive for the City as Edison requires a fee to implement that change. Mayor Pro Tern expressed concerns regarding the proposed 2% fee assessment increase. Public Works Director Consunji clarified that residents of single-family homes located in the public right of way are charged a yearly rate of $348 for the assessment rate fee. Mayor Pro Tern Wu expressed concerns regarding the amount being charged to the residents versus the amount charged to commercial property owners. Public Works Director Consunji stated that the difference in fee for residential versus commercial properties is due to the size, as well as any special benefits that the commercial properties receive from completing capital improvements around their area. Mayor Pro Tern Wu shared his concerns regarding the tree trimming cycle and the frequency of said trimming. Public Works Director Consunji stated that staff is proposing a supplemental tree trimming budget of $50,000 per year in order to operate on a 7 year trimming cycle. Councilmember Warshaw requested for more information to be obtained from staff regarding a more detailed report in cost and expenditures for tree trimming. Assistant City Manager/Community Services Director Bresciani provided a brief overview regarding the Art Festival and Night Market and stated that the event would occur on Saturday, August 18 from 3:00 p.m. to 11:00 p.m. and Sunday, August 19 from 3:00 p.m. to 10:00 p.m. She also indicated that this event would take place along Glendora Avenue between East Dalewood Street and Lakes Drive and provided Council with an aerial view of the festival location. In addition, she informed Council that the event coordinators of the West Covina Paprika Art Festival and Night Market are requesting for a co-sponsorship in the amount of $9,914 for City services including: public safety personnel, road closures, fee waived permits, and any additional fees incurred by City staff. 23 Tuesday June 19, 2018 City Manager Freeland recommended for the organizers of said event to reimburse the City for any out-of-pocket fees due to the current financial challenges of the City. He also indicated that with the current budget situation, it would not be prudent for the City to proceed with the proposed request. Mayor Johnson expressed his concerns regarding the cost for the sponsorship and agreed with City Manager Freeland's position. Councilmember Warshaw stated that the organizers should bear the cost for their proposed sponsorship request. Mayor Pro Tern Wu expressed his approval regarding Item No. 29. Councilmember Warshaw asked if staff could verify the non-profit stance of the Hope Center organization. City Attorney Hall Barlow indicated that the number identified on the event plan can be verified to determine if the Hope Center is a non-profit organization or not. Councilman Spence expressed his disapproval regarding Item No. 30 and stated that a formal opposition must be made to the proposed tax. L.A. County Department of Public Works representative, Jolene Guerrero addressed Councilman Spence's concerns and stated that labor agreements will not be imposed on cities, and another version of the tax will be released on Friday after additional 25 Tuesday June 19, 2018 adjustments have been made. Councilmember Toma asked for clarification regarding what the Los Angeles County Parcel Tax consists of and what issues the proposed tax will address. Ms. Guerrero clarified that the proposed tax will rid the water of pollutants by capturing the water into multiple basins and filtering out the harmful waste. She shared that clean water is the highest priority for the L.A. County Department of Public Works and that each city will have the option to choose which watershed and municipal projects they wish to complete to comply with the proposed tax. Councilmember Toma requested for clarification regarding the language pertaining to the aforementioned tax. Ms. Guerrero clarified that the tax will result in clean water for the public. Councilmember Warshaw expressed his disapproval regarding the proposed tax and will be voting to oppose Item No. 30 unless the San Gabriel Valley Council of Governments (SGVCOG) recommendations are approved by the Los Angeles County Board of Supervisors. COUNCILMAN MIKE SPENCE 31) Options for Term Limits for City Council/City Elected Officials It is recommended that the City Council discuss options for implementing term limits for City Council or all City Elected Officials. Councilman Spence stated that there should be a 3 term limit for City Council members and all City Elected Officials. Mayor Pro Tem Wu expressed his disapproval regarding Item No. 31. 26 Tuesday June 19, 2018 Mayor Johnson stated that while he is in favor of the item, he would prefer that a future Council should determine whether or not term limits should be implemented in the City. Councilmember Warshaw requested for the language of the proposed ballot measure to be amended and explained that he would prefer for the public to make their own decision regarding this item. Councilmember Toma agreed with Mayor Johnson's position on term limits. Mayor Pro Tern Wu stated that due to the City's current financial situation, the term limit issue should be postponed and placed on a future ballot. Councilman Spence expressed his approval regarding term limits and shared that the aforementioned item should be placed on the ballot for the upcoming election. A motion was made by Councilman Spence and seconded by Councilmember Warshaw to recommend staff to place the implementation of term limits for City Council or all City Elected Officials on the upcoming ballot. Motion failed to be approved by a vote of 2-3, with Councilmember Toma, Mayor Pro Tern Wu, and Mayor Johnson in opposition.
