CHANGES TO THE AGENDA City Manager Freeland reported that the Pumpkin Run presentation needs to be moved to the March 6 th meeting due to a scheduling conflict. Victims of the Douglas High School shooting in Florida ORAL COMMUNICATIONS - Five (5) minutes per speaker Lisa Mayo spoke on behalf of the Lions Club, and thanked Councilmember Toma and Mayor Pro-Tern Johnson for attending their speech contest event. Jim Grivich expressed concerns regarding the City's budget and asked the City Council to rectify the situation. Michael Feinstein proposed a change in the elections process of state legislatures. 2 Tuesday February 20, 2018 Tam Dinh spoke on behalf of the Greater West Covina Business Association and stated that they will be moving to a new location within the West Covina Plaza. John Shewmaker expressed concerns regarding the City's budget and expenditures. Chris Miller shared his concerns on the amount of light the City intersections produce and expressed his dissatisfaction regarding the City's expenditures and budget. Elsie Messman shared her concerns regarding a need for an increase in transparency within City Hall. She also asked the City Council to provide a detailed written report regarding Maintenance District No. 4, which states what projects the residents of that district are financially responsible for and what projects the City is fiscally responsible for. Alfred Williams expressed concerns regarding the Code Enforcement department. RECESS — Mayor Spence recessed the City Council meeting at 8:25 p.m. and reconvened the City Council meeting at 8:40 p.m. with all members present. City Manager Freeland gave responses to speaker inquiries. CONSENT CALENDAR All matters listed under CONSENT CALENDAR are considered to be routine and can be acted on by one roll call vote. AYES: Johnson, Toma, Warshaw, Wu, Spence NOES: None ABSENT: None 3 Tuesday February 20, 2018 ORDINANCES FOR ADOPTION 2) Code Amendment No. 16-02 Temporary Signs General Exemption - CEQA It is recommended that the City Council adopt the following ordinance: ORDINANCE NO. 2332 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, TO AMEND CHAPTER 26, ARTICLE VII OF THE WEST COVINA MUNICIPAL CODE RELATING TO SIGNS Mayor Pro-Tern Johnson pulled Item No. 2 for further discussion. Mayor Pro Tern Johnson stated that by prohibiting political signs, the City is eliminating freedom of speech and would like to have the Ordinance reversed. Mayor Spence expressed that said Ordinance was flawed and requested to remove the word "written" from the language of the aforementioned Ordinance with regards to the written consent needed by those posting signs. Councilman Wu asked the City Attorney what state law mandated regarding signs. City Attorney Barlow shared that case law states that if political signs are allowed, then all other signs must be allowed as well. Ms. Hall Barlow also informed the City Council that this Ordinance prohibits posting of temporary signs 75 days prior to an event, including elections. Councilmember Warshaw spoke on his support of the Ordinance. A motion was made by Mayor Spence and seconded by Mayor Pro Tern Johnson to allow all temporary signs in public right of ways and delete the "written consent" requirement in the Ordinance to post signs on private party. Motion failed by a vote of 2-3 with Councilmembers Toma, Warshaw and Wu in opposition. AYES: Johnson, Spence NOES: Toma, Warshaw, Wu ABSENT: None A motion was made by Councilmember Toma and seconded by Councilmember Warshaw to amend Ordinance No. 2332 to eliminate the "written consent" requirement from said Ordinance and change to "prior" consent with respect to the posting of temporary signs on private property, and continue prohibiting all temporary signs in public right-of-ways. Motion was carried by a vote of 3-2 with Mayor Pro Tern Johnson and Mayor Spence in opposition. 4 Tuesday February 20, 2018 AYES: Tama, Wu, Warshaw NOES: Johnson, Spence ABSENT: None 3) Ordinance Regarding Unlawful Camping and Storage of Personal Property in Public Places It is recommended that the City Council adopt the following ordinance: ORDINANCE NO. 2334 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADDING CHAPTER 19-14 (UNLAWFUL CAMPING AND STORAGE OF PERSONAL PROPERTY) OF TITLE 19 (STREETS, SIDEWALKS AND PUBLIC PLACES) OF THE WEST COVINA MUNICIPAL CODE REGARDING CAMPING AND STORAGE OF PERSONAL PROPERTY IN PUBLIC PLACES A motion was made by Councilmember Warshaw and seconded by Councilman Wu to adopt Ordinance No. 2334. Motion was carried by a vote of 5-0. AYES: Johnson, Toma, Warshaw, Wu, Spence NOES: None ABSENT: None FIRE DEPARTMENT 4) Back up Emergency Ambulance Transportation Agreements It is recommended the City Council authorize the City Manager, or his designee, to execute agreements through December 31, 2018, with four twelve-month renewal options for a maximum term of five years with (1) American Medical Response, (2) CARE Ambulance Service, and (3) Schaefer Ambulance Service to provide backup emergency ambulance transportation services. AYES: Johnson, Toma, Warshaw, Wu, Spence NOES: None ABSENT: None 5 Tuesday February 20, 2018 5) Purchase of Self-Contained Breathing Apparatus (SCBA) Face Masks It is recommended that the City Council take the following actions: 1) Confirm the Finance Department/Purchasing Officer's findings that the purchase and delivery of the Honeywell Titan self-contained breathing apparatus (SCBA) face mask from L.N. Curtis & Sons, Inc., the sole distributor authorized to sell Honeywell SCBA accessories to municipal fire departments in California, satisfies West Covina's bid process as stated in the West Covina Municipal Code, Chapter 2, Article VII, Division 2, Section 2-333(i)(1); and 2) Approve a purchase order with L.N. Curtis & Sons, Inc., in the amount of $74,460 (including sales tax, delivery, and options) for the purchase of 100 Honeywell Titan SCBA face masks as approved in Fiscal Year (FY) 2017-18 Capital Improvement Program (CIP) budget. Councilmember Warshaw pulled Item No. 5 for further discussion. Councilmember Warshaw requested that Fire Chief Whithom give a report on the item and inquired about the need of the number of masks being requested by the Fire Department. Fire Chief Whithom shared that 100 masks were needed due to the masks being custom- sized to fit the individual user. Furthermore, Fire Chief Whithom shared that these face masks cannot be shared due to the customization of each mask. The longevity of each mask depends on how the firefighter utilizes them, but are expected to last around 5-10 years. Motion was carried by a vote of 5-0. 7 Tuesday February 20, 2018 AYES: Johnson, Toma, Warshaw, Wu, Spence NOES: None ABSENT: None POLICE DEPARTMENT 8) Award of Contract for New Citywide Phone System Including Police & Fire, and State Funding for 9-1-1 Dispatch Upgrades It is recommended that the City Council take the following actions: 1) In accordance with Municipal Code Chapter 2, Article VII, Division 2, Sec. 2-333 (i), waive the bid process and authorize the purchase of a Vesta 9-1-1 system directly from AT&T, under State Contract (#4156-6) pricing, totaling $213,723.95, from Account No. 160.31.3116.7160; and 2) In accordance with Municipal Code Chapter 2, Article VII, Division 2, Sec. 2-330 (b), which states that the City Council can dispense with the bidding process when it will prove impracticable or uneconomical, waive the bid process and authorize the purchase of emergency medical dispatch computer products from PowerPhone, totaling $53,338, from Account No. 160.31.3116.7160; and 3) Authorize the City Manager to execute all agreements related to this reimbursable project; and 4) Authorize the City Manager, subject to City Attorney approval, to execute a professional services agreement with Maverick Networks of Pleasanton, California in the amount not to exceed $388.993.21 over a five-year period for the replacement of existing telecommunications systems; and 5) Adopt the attached resolution authorizing the necessary budget amendment: RESOLUTION NO. 2018-14 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FORTHE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30, 2018 (DISPATCH CENTER 9-1-1 SYSTEM EQUIPMENT UPGRADE) Councilmember Warshaw pulled Item No. 8 for further discussion. I.T. Manager Shawn Granger discussed item further and stated that MITEL bought out the City's current telecommunications system SHORETEL in January 2018. Granger also stated that the new phone system, MITEL Connect, would be more cost-effective and would save the City in annual maintenance costs. Furthermore, Mr. Granger shared that the new phone lines would be extremely useful in emergency situations, as the phone system for emergency services would not be affected. 8 Tuesday February 20, 2018 A motion was made by Councilmember Warshaw and seconded by Councilman Wu to approve all the aforementioned actions and adopt Resolution No. 2018-14. AYES: Johnson, Toma, Warshaw, Wu, Spence NOES: None ABSENT: None PUBLIC WORKS 9) Purchase of Replacement Aerial Lift Work Truck It is recommended that the City Council take the following actions: 1) Approve a purchase order to National Auto Fleet Group in the amount of $123,029.55 (including sales tax, delivery and options) for the purchase of an aerial lift work truck; and 2) Confirm the Finance Department/Purchasing Manager's findings that the purchase of aerial lift work truck through the National Joint Powers Alliance (NJPA) Cooperative Purchasing Agreement satisfies West Covina's bid process as stated in West Covina Municipal Code Chapter 2, Article VII, Division 2, Section 2-333 (i)(2); and 3) Appropriate $23,029.55 from Measure M to cover the shortfall in funding; and 4) Adopt the following resolution: RESOLUTION NO. 2018-12 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30, 2018 (Aerial Lift Work Truck) A motion was made by Councilmember Warshaw and seconded by Councilman Wu to approve the aforementioned actions and adopt Resolution No. 2018-12. City Manager Freeland indicated that the Police and Fire Fees and Fines Schedule which was part of Resolution No. 2018-15 would need to be revised to show that the "Registration and Renewal" and "Senior Residential 65+ Registration and Renewal" fees were $10 and not the fees of $25.00 and $12.00 as shown. After further discussion by Council and city staff, Councilmember Toma made a motion and was seconded by Councilmember Warshaw to introduce and waive further reading of Ordinance No.'s 2335 and 2336 and adopt Resolution No. 2018-15. Motion was carried by a vote of 3-2 with Councilman Wu and Mayor Spence in opposition. Councilmember Warshaw spoke on the SLWA program and informed property owners how they could be a part of the program. City Manager Freeland shared that Chick-Fil-A would be having hosting a community meeting on February 28, 2018 from 4:00 p.m. to 6:00 p.m. at the Colony at the Lakes. The meeting was to inform the community about Chick-Fil-A coming to the Elephant Bar Restaurant location.
