Mayor Spence called to order the regular closed session meeting of the West Covina City
Council at 6:01 p.m. in the City Manager's Conference Room at City Hall, 1444 W. Garvey

REPORTING OUT FROM CLOSED SESSION
City Attorney Hall Barlow stated that the City Council approved an extension of the BKK Tolling
Agreement which will be extended to January 2, 2021. A motion was made by Mayor Spence
and seconded by Mayor Pro Tern Johnson to approve the extension. Motion was carried by a vote
of 5-0.

Bruce Leinbach expressed concerns regarding City Hall's attentiveness to residents.
Wen Wen Zhang spoke about special library programs and events occurring during the month of
February and she also discussed tax preparation assistance programs held at the West Covina
Library.
Barbara Sepulveda expressed concerns regarding safety and traffic issues at her apartment
complex.
Frederick Sykes expressed concerns regarding homeless encampments and voting districts.

William Elliott shared his concerns regarding the overflow of trash in City Hall and spoke on
state versus city laws.
John Shewmaker expressed concerns regarding the speed and efficiency of City Hall
Craig Melicher shared his concerns regarding the General Plan update and asked the City Council
to revisit the Glendora Avenue Project.
Leticia Colchado expressed her concerns regarding Ordinance No.'s 2333 and 2334, pertaining to
unlawful camping on public property and asked Council to come up with a solution to combat
homelessness.
Vicky Scheliga spoke on behalf of The West Covina Alliance Club and asked the City Council to
consider co-sponsoring the organization's annual fundraiser.
Herb Redholtz shared his support for Mayor Spence opposing Senate Bill (SB) 827 regarding
Planning and Zoning in Transit Areas.
Ray Edmondson expressed his concerns regarding homelessness in the City and asked the City
Council to create better solutions.
Forrest Wilkins expressed concerns regarding soliciting along freeway on and off ramps, and
shared his concerns regarding the Singpoli project.
City Manager Freeland gave responses to speaker inquiries.

5) Modified Ownership Covenant for Auto-Mall Properties
It is recommended that the City Council approve the Reaffirmed and Restated Ownership
Covenant and Equitable Servitude, modifying the covenant which was recorded
November 12, 2014, regarding ownership of 1900, 1932 and 2000 E. Garvey Avenue
South, West Covina, California ("the Auto-Mall properties").
A motion was given by Councilmember Warshaw and seconded by Councilmember Toma

compliance with the State's minimum wage requirement as of January 1, 2018; and

3) Approve the deletion of Recreation Assistant from the Limited Services Pay Schedule
due to the operational obsolescence of the position; and

2) Authorize the City Manager to sign an agreement with Foothill Transit for installation
of bus stop improvements at two locations in the City; and
3) Establish City Project No. SP-18035 for Vincent Avenue Bus Stop Enhancement
Project and appropriate $200,000 of the BSEP Grant to Account No. 160.80.7003.7900;
and
4) Adopt the following resolution:
RESOLUTION NO. 2018-07 - A RESOLUTION OF THE CITY COUNCIL OF THE

Planning Director Jeff Anderson gave a Power Point Presentation on Public Hearing Item
No. 17 and provided information regarding the U.S. Supreme Court's ruling on Reed v.

City Council discussed and commented on Public Hearing Item No. 17.
Mayor Spence opened the public hearing and asked for speaker comments, but none were
given.

take all actions and introduce, waive further and give first reading to Ordinance No. 2332.
Motion was carried by a vote of 3-2 with Mayor Spence and Councilmember Johnson in
opposition.

It is recommended that the City Council take the following actions:
1) Introduce the following proposed regular ordinance for its first reading to be read by
title only and waive further reading:
ORDINANCE NO. 2334 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, ADDING CHAPTER 19-14 (UNLAWFUL
CAMPING AND STORAGE OF PERSONAL PROPERTY) OF TITLE 19 (STREETS,

Assistant City Manager/Community Services Director Bresciani gave a report on Item No.
19 and discussed reasoning for confiscating unattended personal property located in public
places.
City Attorney Hall Barlow spoke on the recent Federal court decision with respect to the
homeless encampments along the 57 Freeway in Orange County and discussed the
proposed provisions found in the proposed ordinances that were presented to the City
Council for introduction and adoption.
Councilmember Tema spoke on his concerns regarding the citations portion of the two
proposed ordinances.
Mayor Pro Tern Johnson also indicated he had concerns with the citations portion of the
ordinances and requested that the section be removed.
Councilman Wu shared that the homeless need to be helped by finding them shelters and
was in support of the ordinances.
Councilmember Warshaw stated that he agreed with the ordinances for the removal of
property in public places however he indicated that he had an issue with the fines that
were also being proposed in the ordinances and asked that the fines be removed.
A motion was given by Councilmember Warshaw and seconded by Councilmember Wu to
adopt URGENCY ORDINANCE NO. 2333 and introduce, waive further and give first
reading to Ordinance No. 2334 with the amendment of the removal of the citation/fine
section. Motion was carried by a vote of 5-0.

20) Award of Contract for the Installation of Electric Vehicle Charging Stations -
Project No. GP-17002
It is recommended that the City Council take the following actions:
1) Authorize the City Manager to execute a contract with Urban Professional Builders,
Inc. in the amount not to exceed $101,640 (which includes contingencies in the amount of
$9,240) for the installation of Electric Vehicle (EV) Charging Stations at various
locations; and
2) Adopt the following resolution:
RESOLUTION NO. 2018-03 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT
FOR THE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30,
2018 (Installation of Electric Vehicle Charging Stations)
Public Works Director Consunji gave a brief report on Item No. 20.
After a discussion between Council and staff, a motion was given by Councilmember
Warshaw and seconded by Councilmember Johnson to authorize the City Manager to
execute a contract with Urban Professional Builders, Inc. in the amount not to exceed
$101,640 (which includes contingencies in the amount of $9,240) for the installation of
Electric Vehicle (EV) Charging Stations at various locations and adopt Resolution No.
2018-03. Motion was carried by a 3-2 vote with Mayor Spence and Councilmember Wu
in opposition.

21) Request from Mayor Spence for City Council to Discuss Taking a Formal Position
Opposing SB 827 (Wiener)
It is recommended that the City Council discuss whether or not to take a formal position
opposing Senate Bill (SB) 827 and direct staff to send a letter to the authors, as well as our
local legislators, if a formal position is taken.
A motion was given by Mayor Spence and seconded by Councilmember Warshaw to take

a formal position opposing Senate Bill 827. Motion carried by a vote of 5-0.

22) Request from Councilman Tony Wu for City Council to Discuss Establishing a
Friendship-City Relationship with Fushun, China
It is recommended that the City Council discuss establishing a friendship-city relationship
with Fushun, China and provide direction accordingly.
Councilman Wu gave a brief report on Item No. 22 regarding establishing a friendship-
city relationship with Fushun, China and the benefits of such a relationship to the City of
West Covina.
A motion was given by Councilman Wu and seconded by Mayor Pro Tern Johnson to
establish a friendship-city relationship with Fushun, China. Motion was carried by a vote
of 5-0.

23) Request from Councilmember James Toma Requesting the City Council's
Consensus to Direct the City Clerk's Office to Timely Post Campaign Disclosure

It is recommended that the City Council direct staff accordingly.
City Council gave direction to City Clerk's Department to have campaign disclosure
documents posted on City's website within 2 business days of filing deadline.

Mayor Spence shared that he visited Three Valleys Municipal Water District where water related

CITY COUNCIL COMMENTS
Mayor Pro Tern Johnson announced that a replica of the Vietnam Veterans Memorial Wall will be
coming to the City of San Dimas from March 22, 2018 to March 25, 2018, and will stay available
for public viewing for 24 hours.
Councilman Wu shared that February 16, 2018 is the beginning of the Lunar New Year which
considered the year of the dog and wished everyone a Happy Lunar New Year.
