Tuesday December 05, 2017 Mayor Spence introduced his family in the audience and gave introductory comments as incoming Mayor. RECESS — Mayor Spence recessed the City Council meeting at 7:24 p.m. and reconvened the meeting at 7:45 p.m. with all members present. PRESENTATIONS Mayor Spence assisted by Assistant City Manager/Community Services Director Bresciani presented a Resolution Commendation to Community and Senior Services Commissioner Steve Bennett for his service on the Commission. ORAL COMMUNICATIONS - Five (5) minutes per speaker Erik Intel totill, owner of West Covina business Craft Hill, spoke on the proposed development at the BKK location by Singpoli. Wen Wen Zhang, West Covina Library Manager, announced upcoming library programs. Jerri Potras, West Covina resident, expressed concerns with proposed marketing agreement for wireless telecommunications (item #13) and need for further education. Arthur Schaper, addressed concealed carried permits, and spoke of his support of Mike Spence as Mayor. Patrick Bacich, expressed concerns with city concerts and sponsorship monies. Gary Gileno, West Covina resident, spoke on concerns of renewable energy (item #16). Basil and Lisette Kimbro, thanked the Councilmembers for their attendance at the Thanksgiving dinner they hosted at the VFW and addressed homelessness. Phil Kaufman, West Covina resident, on behalf of West Covina Beautiful, announced the upcoming Home for the Holidays tour on December 15, 2017 beginning at 6:00 at Cameron Park. Fredrick Sykes, West Covina resident, addressed concerns of private tree maintenance, addressed telecommunications facilities and addressed the mayoral rotation. Bill Robinson, West Covina resident, addressed council district map, expressed concerns with the congregated meal program at the Senior Center, and spoke on net neutrality. Steve Bennett, West Covina resident, congratulated the new Mayor and Mayor Pro Tern, spoke on the chosen council district map, and addressed the Council liaison appointee to the Foothill Transit Board and action taken by that appointee as possibly unethical. Sheena Heng, West Covina resident, expressed concerns with the proposed telecommunication agreement on the agenda (item #13). Alfred Williams, West Covina resident, addressed personal issues of the Mayor and having the council address expectations of the Mayor's duties. City Manager Freeland and staff responded to questions and concerns of the speakers. 3 Tuesday December 05, 2017 CONSENT CALENDAR All matters listed under CONSENT CALENDAR are considered to be routine and can be acted on by one roll call vote. There will be no separate discussion of these items unless members of the City Council/Community Development Commission request specific items to be removed from the Consent Calendar for separate discussion or action. ORDINANCES FOR ADOPTION 1) Ordinance No. 2328 - An Ordinance of the City Council of the City of West Covina, California, Implementing By-District Elections per Chapter 2 Article II Division 1 Section 2.20 of the West Covina Municipal Code that Provides for City Council Elections by Districts It is recommended that the City Council adopt the following ordinance: ORDINANCE NO. 2328 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, IMPLEMENTING BY-DISTRICT ELECTIONS PER CHAPTER 2 ARTICLE II DIVISION 1 SECTION 2.20 OF THE WEST COVINA MUNICIPAL CODE THAT PROVIDES FOR CITY COUNCIL ELECTIONS BY DISTRICTS Motion by Warshaw and seconded by Johnson to approve as recommended. Motion carried 4-1 by the following vote with Mayor Spence who stated his dissenting vote: AYES: Johnson, Toma, Wu, Warshaw NOES: Spence ABSENT: None CITY MANAGER'S OFFICE 2) Update on Sister Cities Relationships It is recommended that the City Council notify Wuhu, China and Toluca, Mexico that the City of West Covina chose to terminate its sister-city relationship with their communities, due to inactivity. This item was pulled from the Consent Calendar by Councilmember Wu who inquired with the termination of the sister-city relationship with Wuhu, China how the City is going to promote activity with the newly formed sister-city relationship with Beijing, China. Authorize the City Manager to execute a memorandum of understanding with the San Gabriel Valley Council of Governments (SGVCOG); and 2. Adopt the following resolution: RESOLUTION NO. 2017-119 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30, 2018 (City Homeless Plan - SCVCOG) Motion by Warshaw and seconded by Johnson to approve as recommended. This item was pulled from the Consent Calendar by Councilmember Warshaw who inquired into the identity of projects in which funds received within each different Development Impact Fee fund are to be used in which City Manager Freeland responded. Accept public improvements for the traffic signal at the intersection of Francisquito Avenue and Sunset Avenue, Federal Project No. HSIPL-5259 (027)/City Project No. TP-15501; and 2. Authorize recordation of Notice of Completion with the Los Angeles County Recorder; and 3. Authorize the release of retention funds 35 days after recordation of the Notice of Completion. Motion carried 5-0 by the following vote: AYES: Johnson, To ma, Wu, Warshaw, Spence NOES: None ABSENT: None END OF CONSENT CALENDAR HEARINGS PUBLIC HEARINGS 9) Ordinances Amending West Covina Municipal Code Regarding Alarm Systems and a Resolution of the City Council of the City of West Covina, California Amending the Fee and Fine Schedule for the City Alarm Program It is recommended that the City Council read by title only, waive further reading, and introduce the following two ordinances for first reading: ORDINANCE NO. 2325 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, FINDING THAT THIS ORDINANCE IS NOT SUBJECT TO REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, REPEALING CHAPTER 4.5 (ALARM SYSTEMS) AND AMENDING THE WEST COVINA MUNICIPAL CODE WITH THE ADDITION OF A CHAPTER 4 (POLICE ALARM SYSTEMS) PERTAINING TO ALARM REGISTRATION, A REGULATORY SCHEME FOR ADMINISTERING AND MANAGING THE CITY'S RESPONSE TO ALARMS, FEES, FINES, APPEAL PROCESS, AND PROVIDING OTHER MATTERS PROPERLY RELATING THERETO ORDINANCE NO. 2327 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, FINDING THAT THIS ORDINANCE IS NOT SUBJECT TO REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY 7 Tuesday December 05, 2017 ACT AND AMENDING THE WEST COVINA MUNICIPAL CODE WITH THE ADDITION OF A CHAPTER 4.5 (FIRE ALARM SYSTEMS) PERTAINING TO ALARM REGISTRATION, A REGULATORY SCHEME FOR ADMINISTERING AND MANAGING THE CITY'S RESPONSE TO ALARMS, FEES, FINES, APPEAL PROCESS, AND PROVIDING OTHER MATTERS PROPERLY RELATING THERETO And hold a public hearing regarding the establishment of new fees and changes to existing fees and fines; and adopt the following resolution: RESOLUTION NO. 2017-113 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE FEES AND FINES RELATED TO THE CITY ALARM PROGRAM ON THE CITY FEE SCHEDULE Mayor Spence introduced the Public Hearing matter, Assistant City Clerk Butler verified proper legal notice was given and Mayor Spence opened the Public Hearing. The staff report was presented by Lieutenant Plunkett and Management Analyst Narahara. Council questions included how the proposed new alarm systems with $25 registration can reduce a false alarm, having alarm companies realized the registration fee and paying on behalf of clients, cause of false fire alarms, collection method of false alarm fines, liability of City if an alarm system is suspended due to lack of paying fines, responsibility of alarm company in responding to alarms, responsibility of alarm company client with faulty equipment, assessment of late fees, response times to alarms, man hours in response with current process vs. proposed process, and suspension standards of alarm systems. Mayor Spence opened the Public Testimony period. Members of the public Bill Robinson, Jerri Potras, Sheena Heng, Jefferson DeRoux, and Edgar Naranjo expressed concerns with the proposed alarm system and proposed fees and fines. There was no one else wishing to speak, therefore, Mayor Spence closed the Public Testimony period. Council discussion included concerns with item being a revenue issue rather than a policy issue, late fee charges, use of police resources when responding to a false alarm, registration fees, and defining a false alarm. Council provided direction to staff revisit the registration permit fee, to provide information on how the permit can reduce false alarms and to research whether the false alarm billing company can provide complete data of the location in which public safety is responding. 8 Tuesday December 05, 2017 10) Appeal of Conditional Use Permit No. 17-10 to Allow a 6-Bed Residential Care Facility at 1315 W. Merced Avenue Applicant/Appellant: Jeffrey B. Fajardo Categorical Exemption It is recommended that the City Council hear the appeal of the Planning Commission approval of Conditional Use Permit No. 17-10 (which limits the number of residents to six) and uphold the decision of the Planning Commission by adopting the following resolution: RESOLUTION NO. 2017-115 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND APPROVING CONDITIONAL USE PERMIT NO. 17-10 ON APPEAL OF PLANNING COMMISSION ACTION Mayor Spence introduced the Public Hearing matter, Assistant City Clerk Butler verified proper legal notice was given and Mayor Spence opened the Public Hearing. The staff report and PowerPoint presentation was presented by Planning Director Anderson. Mayor Spence opened the Public Testimony period. Members of the public applicant/appellant Dr. Jeffrey Fajardo spoke in favor of the appeal requesting a Conditional Use Permit to allow a 10-bed facility. Council questions included ages of the residents, whether residents are allowed visitors and visiting hours, location of required rehab of residents, meal preparation, why applicant requested 10-beds vs. 6-beds, and planning department staff to recommend a 10-bed facility vs. the Commission approval of a 6-bed facility. Member of the public Jerri Potras spoke in opposition to the appeal. Dr. Fajardo gave rebuttal testimony to those who spoke in opposition at the Planning Commission meeting stating that the residents are special needs residents and not troubled residents such as addicts. Dr. Fajardo son's added comments regarding the ratio of staff to residents. There was no one else wishing to speak, therefore, Mayor Spence closed the Public Testimony period. Motion by Johnson and seconded by Toma to uphold the decision of the Planning Commission and deny the appeal by adopting Resolution No. 2017-115. Council discussion included parking issues during visiting hours. Read by title only, waive further reading and introduce the following ordinance: ORDINANCE NO. 2326 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, REPEALING SECTIONS 22-131 AND 22-132 AND ADDING A NEW SECTION 22-131 (SPEED LIMITS OF CERTAIN STREETS) BY AMENDING DIVISION 4 OF ARTICLE IV OF CHAPTER 22 OF THE WEST COVINA MUNICIPAL CODE TO UPDATE POSTED SPEED LIMITS FOR A NUMBER OF STREETS CITYWIDE; and 2. Adopt the following resolution: RESOLUTION NO. 2017-100 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017 AND ENDING JUNE 30, 2018 (E&T Survey) Mayor Spence introduced the Public Hearing matter, Assistant City Clerk Butler verified proper legal notice was given and Mayor Spence opened the Public Hearing. The staff report was presented by Public Works Director Consunji who then turned the report over to Vanessa Munoz, Director of Engineering at Willdan Engineering, who presented the Engineering and Traffic Survey. Council questions included clarification of the determining the 85 11' percentile speeds and meaning of 85 th percentile, various street studies, special condition criteria of certain streets, and the various recommended changes from the survey. Assistant City Clerk Butler stated that six oppositions have been received. Assistant City Clerk Butler read into the record objections received from Michael Scott, Workman Avenue; Albert Glick, Vine Avenue; Margaret Lopez, Vine Avenue; Wallace Cane, Vine Avenue; Irma Valdez Troder; and Angie Gillingham. Mayor Spence opened the Public Testimony period. Members of the public Rose Marie Filipe, Vine Avenue; Juan Mavizidis, Vine Avenue; Chris Miller, Puente Avenue; Rosa Franco, Vine Avenue; Margo Mavizidis, Vine Avenue; and Steve Bennett, near Workman and Toland; addressed the City Council. 10 Tuesday December 05, 2017 There was no one else wishing to speak, therefore, Mayor Spence closed the Public Testimony period. Council discussion included how speed on Vine Avenue was previously rated to be 25 mph and now is recommended to be increased to 35 mph, enforceability of posted speed limits must be a speed limit established by an Engineering and Traffic Study (E & T) documentation, defining a street as a residential street to have enforceable posted speed limit of 25 mph, Vine Avenue speed set by an E & T and therefore not considered a residential district, and how to have Vine Avenue established as a residential district. Motion by Johnson and seconded by Warshaw Johnson to read by title only, waive further reading and introduce Ordinance No. 2326 with the exclusion of Vine Avenue, Workman Avenue and Rowland Avenue Street segments; adopt Resdlution No. 2017-100; and continue the Public Hearing to the next meeting for the consideration of Vine Avenue, Workman Avenue and Rowland Avenue street segments. With no objections from the City Council, the Items have been carried over to the December 19, 2017 meeting. DEPARTMENTAL REGULAR MATTERS Item # 16 was reordered and brought forth on the agenda due to a presentation that was given. PUBLIC WORKS 16) Status Update on the Implementation of a Community Choice Aggregation Program It is recommended that the City Council receive the status update on the implementation of a Community Choice Aggregation Program and direct staff accordingly. Update on the implementation of a Community Choice Aggregation Program was presented. Council questions and discussion included whether the JPA is a governmental agency and amount of local control, source of energy, advantages of joining the Program, responsible party for maintenance, whether projected energy savings is a guarantee, pros and cons and joining the program. Motion by Toma to direct staff to implement the process to join the Community Choice Aggregation Program. Motion dies for lack of a second. 11 Tuesday December 05, 2017 CITY ATTORNEY'S OFFICE 12) San Gabriel Valley Council of Governments Joint Powers Agreement Amendment It is recommended that the City Council adopt the following resolution amending the San Gabriel Valley Council of Governments (SGVCOG) Joint Powers Agreement to expand the construction function across the San Gabriel Valley and beyond grade separation projects: RESOLUTION NO. 2017-117 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING AND ADOPTING THE FOURTH AMENDED AND RESTATED JOINT POWERS AGREEMENT OF THE SAN GABRIEL VALLEY COUNCIL OF GOVERNMENTS AS ADOPTED BY THE COUNCIL'S GOVERNING BOARD Staff report was presented by City Manager Freeland. Council questions included consequence if Alameda Corridor East (ACE) Construction Authority fails to receive funding for construction projects once integrated into the SGVCOG and whether where any negatives with SGVCOG when approving the merger of ACE. Motion by Tomas and seconded by Warshaw to approve as recommended. Motion carried 5-0 by the following vote: AYES: Johnson, Toma, Wu, Warshaw, Spence NOES: None ABSENT: None 13) Senate Bill (SB) 649 and Marketing Agreement for Wireless Telecommunications Facilities It is recommended that the City Council direct staff to continue working with XG COMMUNITIES, LLC (doing business as 5 BARS) to implement the Marketing Agreement executed at the August 15, 2017 City Council Meeting. This item was carried to the meeting of December 19, 2017 by consensus of the City Council. CITY MANAGER'S OFFICE 14) Adoption of City Council Goals & Objectives for Fiscal Year 2017-18 It is recommended that the City Council discuss and adopt the City Council Goals & Objectives for Fiscal Year 2017-2018. PUBLIC WORKS 16) Status Update on the Implementation of a Community Choice Aggregation Program It is recommended that the City Council receive the status update on the implementation of a Community Choice Aggregation Program and direct staff accordingly. MAYOR/COUNCILMEMBERS REPORTS MAYOR MIKE SPENCE 17) Examine What Measures Other Cities are Taking to Balance Legal Protections for the Homeless Population and Ensuring the Protection of Access for All to Public Facilities It is recommended that the City Council direct City staff to draft an amendment to the City's Municipal Code to further address no camping in public spaces and include language regarding storage of personal property. This item was carried to the meeting of December 19, 2017 by consensus of the City Council. Confirm the Mayor's appointments to the various organizations described in the staff report; and 2.
