GARVEY AVENUE SOUTH WEST COVINA, CALIFORNIA 91790 MINUTES CALL TO ORDER - Mayor Corey Warshaw called the special meeting of the City Council and Successor Agency to order at 6:30 p.m. PLEDGE OF ALLEGIANCE — Led by Councilman Toma ROLL CALL Present: Mayor Corey Warshaw, Mayor Pro Tern Spence, Councilmen Lloyd Johnson, James Toma, Tony Wu Staff present: City Manager Chris Freeland, City Attorney Kimberly Hall Barlow, Deputy City Manager Laura Minnich and Interim Finance Director Nicole Lugotoff. CHANGES TO THE AGENDA City Manager Freeland announced that there are no changes to the agenda. ORAL COMMUNICATIONS Mayor Warshaw announced that anyone wishing to speak under Oral Communications submit a yellow speaker card or that an individual may submit an orange Agenda Item Position Slip with their name and position on the agenda item rather than speaking and the positions will be read into the record when the item is discussed on the agenda. Tuesday November 14, 2017 City Manager Freeland announced that comments under Oral Communications are pertaining to Items #2 and #3 on the agenda and that comments pertaining to Item #1 will be heard during discussion of that item. There was no one wishing to speak on Items #2 or #3, therefore, Mayor Warshaw closed Oral Communications. ITEMS ON THE AGENDA 1) Public Hearing Regarding Selection of a District Map for District-Based City Council Election It is recommended that the City Council take the following actions: 1) Review and discuss draft maps and election sequencing; and 2) Introduce by title only and waive further reading of the following ordinance regarding selection the preferred district map and setting the election sequencing: ORDINANCE NO. 2328 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, IMPLEMENTING BY-DISTRICT ELECTIONS PER CHAPTER 2 ARTICLE H DIVISION 1 SECTION 2.20 OF THE WEST COVINA MUNICIPAL CODE THAT PROVIDES FOR CITY COUNCIL ELECTIONS BY DISTRICTS Mayor Warshaw introduced the Public Hearing matter, Deputy City Manager Minnich verified that proper legal notice was given and Mayor Warshaw opened the Public Hearing. City Attorney Hall Barlow presented a brief overview of the public hearing process and stated that this is the fifth public hearing and that the City Council has narrowed the selection of submitted maps to six maps (Maps 106, 111, 114, 115, 117 and 120) for further community input, discussion and selection. Mayor Warshaw opened the Public Testimony period. Members of the public Elsie Messman, Armando Sanchez, Jerri Potras, Fredrick Sykes, Phil Kaufman, Alfred Williams, Bruce Lienbach, John Shewmaker, Cesar Cervantes, Dana Sykes and Jim Grivich commented. With no one else wishing to speak, Mayor Warshaw closed the Public Testimony period. In response to a speakers question as to why the residences of the Councilmembers are not depicted on the proposed district maps, City Attorney stated that while the residences of the Councilmembers are readily available, Councilmembers are not to consider the residences of past, current or future councilmembers or candidates in their selection of a map. Shalice Tilton, representing National Demographics Corporation (NDC) confirmed that all the six (6) proposed district maps meet the requirements of the California Voters Right Act (CVRA). 2 Tuesday November 14, 2017 Council discussion included pros and cons of proposed maps, previous council action taken to oppose Assembly Member Hernandez's proposed legislation to mandate council districts, lack of benefit to city with council districts, and general lack of support for council districts. Motion by Warshaw to select Map 117. Motion dies due to a lack of a second. Motion by Wu and second by Johnson to select Map 120. Motion fails 2-3 by the following vote: AYES: Johnson, Wu NOES: Spence, Toma, Warshaw ABSENT: None Motion by Toma to select Map 115. Motion dies due to a lack of a second. Motion by Warshaw to select Map 106. Motion dies due to a lack of a second. City Attorney Barlow stated a map must be adopted by ordinance no later than December 16, 2017 which would require three affirmative votes for an introduction of an ordinance followed by three affirmative votes to adopt an ordinance at a subsequent meeting. With no map chosen at tonight's meeting this can be brought back at the next Council meeting, however, if any changes are made to the six proposed maps or any new maps are submitted for consideration, at least two additional public hearing will need to be held. It was the consensus of the City Council to bring the proposed six maps to the Council meeting of November 21th for further discussion. 2) Preliminary Fourth Quarter Financial Report for Fiscal Year 2016-17 It is recommended that the City Council receive and file the preliminary Fourth Quarter Financial Report for Fiscal Year 2016-17. Staff report and PowerPoint presentation was presented by Interim Finance Director Lugotoff. Council questions and discussion included overages in both the police and fire departments; pay off of bonds, loans and notes; and ability to identify areas of overages by line item expenditures. Council requested a report on the specific line items that went over budget within the police and fire department. With no objection by the City Council, Mayor Warshaw declared the fourth quarter financial report for fiscal year 2016-17 as received and filed. 3) Report Regarding Request from Mayor Pro Tern Spence for City Council to Discuss Parking Lot Fees in the Civic Center Parking Lot It is recommended that the City Council discuss parking lot fees in the Civic Center parking lot and provide any applicable direction accordingly. 3 Tuesday November 14, 2017 Mayor Pro Tern Spence expressed concerns that residents business clients needing to do business at City Hall have-to pay to park. Motion by Johnson and seconded by Spence to direct staff to designate the six (6) parking spaces next to the City Council designated parking spaces as 1 hour parking for City Business only with no fee.
