Becerra, on a motion by Johnson and seconded by Spence, on a vote of 4-1 with Councilman Toma abstaining due to possible conflict, to authorize the City Attorney's office to prepare a declaration in support of an arnicus brief regarding that matter. There was no other reportable action with nothing further to report. CHANGES TO THE AGENDA City Manager Freeland announced the request to pull Item #21 to a future agenda to allow the family of hit and run victim Tian Liu to continue to collect the private reward funds prior to asking the City Council to match those funds, and due to the anticipated lateness of tonight's meeting to pull the Item #19 presentation of the preliminary Fourth Quarter Financial Report for Fiscal Year 2016-17 to a subsequent meeting, but to have Council still consider adopting of 2 Tuesday November 07, 2017 Resolution No. 2017-104 to adopt a budget amendment for the fiscal year commencing July 1, 2016 and ending June 30, 2017. City Manager Freeland also announced that yellow speaker cards are for those who wish to speak on any item on the agenda during Oral Communications or a public hearing, however, separate speaker cards will be accepted for those who wish to speak on Agenda Item #18 following a presentation of the proposed development at the BKK site. Orange Agenda Item Position Slip cards may be submitted for those who wish to submit their position on an item but not speak on the item. Agenda Item Position Item slip will be read into the record when the item is discussed on the agenda. PRESENTATIONS Mayor Warshaw assisted by Police Chief Marc Taylor presented Police Dispatchers Penny Martin and Joan Phillipson with Resolutions of Commendations recognizing their retirement. Mayor Warshaw introduced San Gabriel Valley Mosquito & Vector Control District Operations manager Jason Famed presented a PowerPoint presentation update of mosquito activity. ORAL COMMUNICATIONS - Five (5) minutes per speaker Mayor Warshaw announced that anyone wishing to speak under Oral Communications submit a yellow speaker card or that an individual may submit an orange Agenda Item Position Slip with their name and position on the agenda item rather than speaking and the positions will be read into the record when the item is discussed on the agenda. Betty Chu, owner of the Mauna Loa Apartments, spoke in support of Council approving Item #7 in order to sell the property. Elsie Messman, West Covina resident, expressed concerns with a Public Records Act request she had submitted, and spoke in support of north/south council voting districts. Diana Novoa, West Covina resident, spoke on a letter received regarding the painting of red curbs on Orange Ave. and the limited parking it will create and traffic issues. George Arellanos, West Covina resident, spoke in opposition to the proposed no parking on Garvey Avenue North. Scott Schweppe, West Covina resident, expressed concerns with the Covina Valley School District and their sale of Pioneer School. Beverly Bulthuis, West Covina resident, spoke on the Historical Society Lights of Love event to be held On Friday, December 1, 2017. Wen Wen Zhang, West Covina Library Manager, addressed upcoming library events. 3 Tuesday November 07, 2017 Steve Herfert, West Covina resident, addressed traffic concerns on Azusa Avenue at Aroma Drive and Francisquito Avenue at the South Hills Center. Ramon Roman, West Covina resident, expressed concerns with parking on street sweeping days and requested the consideration of permitted street parking on Swanee Lane. Sandra Taylor, West Covina resident, expressed concerns with employee's knowledge of various programs and staff training and being transferred to various employees for information. Fredrick Sykes, West Covina resident, addressed traffic issues on Azusa and Arnar Rd. Alfred Williams, West Covina resident, addressed the Singpoli project at the BKK site, Council districts and support of certain maps, and Mayoral rotation. Leslie Martell, West Covina resident, addressed concerns with access to the 1-10 freeway with the current improvements, and concerns with the traffic issues on Azusa at the South Hills Center. Phil Kaufman, West Covina resident, addressed concerns with West Covina transit shuttle and lack of any discounts and upcoming community meeting to discuss the development at the Pioneer School site. John Shewmaker, West Covina resident, address the preliminary Fourth Quarter Financial Report. City Manager Freeland and staff responded to speakers comments. Adjournment Motions Councilman Johnson requested to adjourn tonight's meeting in memory of Terry Corey Wells, Rick Lawford, John Mekes Jr. and Dr. Walter McCan Wade, alumni from Edgewood High School, and Margaret Capessi, mother of John Capessi. Approve the revised guidelines for the City of West Covina Housing Preservation Program and authorize the City Manager to revise and add forms to implement the revised guidelines; and 2. Authorize the City Manager, acting as the Executive Director for the Community Development Commission, to execute a Professional Service Agreement with Barr & Clark, for a period of two (2) years, in an amount not to exceed $29,000, with an option to extend for an additional two (2), one-year extensions, at the City's discretion. Agreement for Transit Services It is recommended that the City Council take the following actions: Approve the amendment to the agreement for transit services with MV Transportation, Inc. effective September 1,2017 Through March 2,2019; and 2.. Approve the following resolution: RESOLUTION NO. 2017-108 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1,2017, AND ENDING JUNE 30, 2018 (Transit Services) This item was removed from the Consent Calendar by Mayor Pro Tern Spence who expressed concerns with how service costs for actual ridership for the fixed routes exceeded the proposed service costs for a higher ridership, fixed route costs per passenger, costs per Dial-a-Ride passengers, utilization of Prop C monies, and alternative options. Staff discussion included looking at different service models for more effective ridership and discussed the budget amendment due to impact of minimum wage. MV Transit General Manager Steve Allen addressed the City Council and stated that MV Transit 7 Tuesday November 07, 2017 is also working with LYFT as an alternative option for Dial-a-Ride services. Motion by Spence and seconded by Johnson to approve staff recommendation to approve the amendment to the agreement and adopt Resolution No. 2017-108 and directed staff to return to council with an analysis of different service modes and costing for senior and disabled riders. City of West Covina, ET AL. and Addition of the Firm to the City's Panel of Legal Defense Firms It is recommended that the City Council approve the retainer agreement with Castanon Law Group (CLG) for legal defense of Los Angeles Superior Court Case No. BC 677342 (Joshua Volasgis vs. City of West Covina, et al.) and the addition of CLG to the City's panel of legal defense firms. Appropriate expenditures from the Fiscal Year (FY) 2017-18 Supplemental Law Enforcement Services Account (SLESA) funds, totaling an estimated $164,954, for frontline law enforcement items detailed in the attached budget amendment. 2. Adopt the attached resolution authorizing the necessary budget amendment: RESOLUTION NO. 2017-102 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017 AND ENDING JUNE 30, 2018 (2017-18 SLESA) 8 Tuesday November 07, 2017 3. Authorize the transfer of any remaining balance of previously appropriated SLESA funds between accounts for personnel, supplies and equipment in order to expedite expenditures that must be completed by the end of this fiscal year. Find that Flymotion LLC is the lowest responsible bidder for the seven (7) unmanned aircraft systems for the Police Department; and 2. Approve a purchase order agreement with Flymotion LLC totaling $60,777.50, from account 117.31.3120.7160 This item was pulled from the Consent Calendar by Mayor Pro Tern Spence expressing concerns of the purchase of drones when a City policy regarding drones has been discussed, but such ordinance is pending and not yet in place. Police Captain Murray gave a brief report and stated the pending City ordinance pertaining to drones is in reference to privately owned drones and that the police department does currently have a policy in place on the use of drones by the police department. Council discussion included the proposed City policy to include both private and police department use of drones, to bring back both private citizen use and police department use policies to a future meeting, and required need of lead time for companies to build drones to specifications as need by the police department, Motion by Warshaw and seconded by Wu to approve as recommended. In accordance with Municipal Code Chapter 2, Article VII, Division 2, Sec. 2-330 9 Tuesday November 07, 2017 (b), which states that the City Council can dispense with the bidding process when it will prove impracticable or uneconomical, waive the bid process and authorize the purchase of a Trimble 3D laser scanner, directly from the sole manufacturer authorized seller, Allen Instruments and Supplies, totaling $65,877.40 from account 117.31.3110.7160, and authorize the City Manager or his designee to execute related purchase documents; 2. In accordance with Municipal Code Chapter 2, Article VII, Division 2, Sec. 2-330 (c), which states that professional services, including computer consultants, are exempt from bidding procedures, approve a Marketing and Management Service Agreement specific to WCSG CAD-RMS operations, for up to $175,000/two years with Scientia Consulting Group, from account 117.31.3119.6120, and authorize the City Manager to execute related purchases and agreements; 3. In accordance with Municipal Code Chapter 2, Article VII, Division 2, Sec. 2-330 (b), which states that bidding may be dispensed with when the commodity can be obtained from only one (1) vendor, authorize the purchase of utility Ethernet line from Spectrum, totaling $51,400 from account 117.31.3110.6145, and authorize the City Manager or his designee to execute related purchase documents; and 4. Adopt the attached resolution authorizing the necessary budget amendments: RESOLUTION NO. 2017-103 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30,2018 (ASSET FORFEITURE FOR POLICE EQUIPMENT AND SERVICES) Motion by Johnson and seconded by Wu to approve as recommended. Adopt the following resolution: RESOLUTION NO. 2017-106 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30, 10 Tuesday November 07, 2017 2018 (Sunset Avenue Medians - Landscape Improvements); and 2. Waive formal bidding requirements as described in West Covina Municipal Code Section 2-330 and issue a purchase order to Aurio Lighting, Inc. in the amount of $19,335 to furnish 3,867 LED light fixtures for City buildings; 2. Appropriate expenditures in the amount of $19,335 from Construction Tax fund balance to Other Supplies/ Materials (Acct # 161.41.4140.6270); and 3. HEARINGS PUBLIC HEARINGS 16) Public Hearing Regarding Selection of a District Map for District Based City Council Elections It is recommended that the City Council take the following actions: 1. Review and discuss draft maps and election sequencing; and 2. If a map is selected that has been previously considered at the September 19 th public hearing, introduce and waive further reading of the following ordinance regarding selecting the preferred district map and setting the election sequencing: ORDINANCE NO. 2328 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ESTABLISHING AND IMPLEMENTING BY- DISTRICT ELECTIONS PER CHAPTER 2 ARTICLE H DIVISION 1 SECTION 2.20 OF THE WEST COVINA MUNICIPAL CODE THAT PROVIDES FOR CITY COUNCIL ELECTIONS BY DISTRICTS Mayor Warshaw introduced the Public Hearing matter, Deputy City Manager Minnich verified proper legal notice was given and Mayor Warshaw opened the Public Hearing. Deputy City Manager Minnich introduced Doug Johnson from National Demographics Corporation (NDC) who presented a report and PowerPoint presentation regarding the twenty (20) draft council district maps submitted by the public and three (3) draft maps submitted by NDC, five (5) of which do not meet criteria for council district. Mayor Warshaw opened the Public Testimony period. Mayor Warshaw announced that should the Council select a map that was previously presented at the September 19, 2017 meeting, this will be the last public hearing, however, if the Council should consider a map not previously presented, an additional public hearing will be scheduled. Council discussion included pros and cons of council district orientation and map preferences with interests in maps 106, 111, 114, 115, 117 and 120. City Manager Freeland provided additional information regarding the prior landfills, subject property and protected habitat at the location. Mayor Warshaw opened the public comment period. Council discussion included confirmation that there will be environmental and traffic studies and future community meetings regarding the project; project not a city funded project, multi-agency involvement due to the site being a landfill site, process in bring the project to the public, components of the project and how they work together, whether the project would be an economic success, need for high end hotel, support of Singpoli's investment in the City, need to know why the components of the project will work and receiving more community input. It was the consensus of the City Council to direct staff to work with Singpoli to set up community meetings in a more interactive format.
