Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Toma, Wu, Warshaw NOES: None ABSENT: None 5 Tuesday October 17, 2017 CITY MANAGER'S OFFICE 5) Resolution of Support for the Cal Poly Pomona and Los Angeles County Fairplex Coordinated Proposal for the Second Amazon Headquarters in North America It is recommended that the City Council adopt the following resolution and direct staff to send a letter of support regarding the Cal Poly Pomona and Los Angeles County Fairplex coordinated proposal for the second Amazon Headquarters in North America: RESOLUTION NO. 2017-101 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, SUPPORTING THE CAL POLY POMONA AND LOS ANGELES COUNTY FAIRPLEX COORDINATED PROPOSAL FOR THE SECOND AMAZON HEADQUARTERS IN NORTH AMERICA This item was removed from the Consent Calendar by Councilman Toma regarding a timeline and types of jobs to be created. A brief overview was presented by City Manager Freeland as to the benefits to the San Gabriel Valley region and stated applications for proposals for the second Amazon headquarters in North American are due by October 19, 2017. Motion by Toma and seconded by Warshaw to approve as recommended. Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Toma, Wu, Warshaw NOES: None ABSENT: None COMMUNITY SERVICES DEPARTMENT 6) Approval of Amendment to Valley Light Industries, Inc. Contract for Bus Shelter Cleaning Services It is recommended that the City Council approve the amendment to the contract for bus shelter cleaning services with Valley Light Industries, Inc. effective July 19, 2017, through July 18, 2018. This item was removed from the Consent Calendar by Councilman Toma who expressed concerns that Valley Light Industries, being a non-profit organization, is not registered with the Department of Justice or the Attorney General's Office. City Attorney Barlow stated that Valley Light Industries has submitted most of the documents required but is still deficient in some areas, and Council has the option to award the contract subject to Valley Light becoming compliant or award the contract on a month to month basis and continue this item until they are in full compliance. 6 Tuesday October 17, 2017 Ivan Campos, Director of Work Services from Valley Light Industries, presented a summation that they are working with the Attorney General's Office to resolve the issue. Council discussion included length of time Valley Light Industries has been servicing the City of West Covina and their performance of work. Motion by Wu and seconded by Johnson to approve as recommended. City Manager Freeland stated the City would follow-up with Valley Light Industries becoming compliant with requirements within 30 days, and if not in compliance, would reagendize the item for the first meeting in December. Following Council discussion allowing Valley Light Industries to comply with legal requirements of the law and the City being able to declare a default thereafter if they have not. Councilman Wu amended his motion with a second by Johnson to approve as recommended with Valley Light Industries complying with legal requirement of the law by the first West Covina Council meeting of December. Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Toma, Wu, Warshaw NOES: None ABSENT: None PLANNING DEPARTMENT 7) Public Art Consultant On-Call Services for the Art in Public Places Program It is recommended that the City Council authorize the City Manager to execute an agreement with DG Hunt and Associates to be used for Public Art Consultant On-Call services for five (5) years ending September 19, 2022, in an amount not to exceed $100,000 over the term of the agreement. This item was removed from the Consent Calendar by Councilman Johnson who expressed concerns with the hiring of a consultant on an on-call basis and would like to have projects reviewed at the time they come forward and determine at that time whether additional services are needed. Staff report was presented by Planning Director Anderson. Council discussion included whether a consultant is a requirement for Art in Public Places projects, confirmation that the consultant does not receive a retainer and there is no expenditures unless a consultant is used, such expenditure being no more than 15% of the project itself, requirement of park fees with development projects, use of art consultants by the developer if they choose the art project versus paying an in-lieu fee to the city, funding source for consultant expenditure, burden of artwork or in-lieu fee on developers, expertise of consultant versus that of 7 Tuesday October 17, 2017 staff, and selection criteria of proposed consultant. Motion by Warshaw and seconded by Toma to approve as recommended. Motion failed 2-3 by the following vote: AYES: Toma, Warshaw NOES: Johnson, Spence, Wu ABSENT: None PUBLIC WORKS 8) Award Contract for Purchase and Installation of Full Capture Trash Devices in Catch Basins at Various Locations (Project No. 18007) It is recommended that the City Council take the following actions: 1. Authorize the City Manager, subject to the City Attorney approval, to execute a contract with Bio Clean, A Forterra Company, in the amount not to exceed $60,000 for the purchase and installation of catch basin full capture trash devices at various locations throughout the City; and 2. Authorize transfer of $10,000 in available funds from Used Oil Block Grant account number 149.41.4180.6120 to account number 18007.149.7900 to fully fund this project. This item was removed from the Consent Calendar by Councilman Wu who inquired as to the effectiveness of the catch basins and making sure that the water is clean. A brief overview of the effectiveness of the catch basins was presented by Public Works Director Consunji. Brief Council discussion regarding debris collection followed. Motion by Wu and seconded by Johnson to approve as recommended. Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Toma, Wu, Warshaw NOES: None ABSENT: None END OF CONSENT CALENDAR 8 Tuesday October 17, 2017 DEPARTMENTAL REGULAR MATTERS COMMUNITY ECONOMIC DEVELOPMENT 9) Request for Proposals (RFP) for a Citywide Branding and Marketing Strategy It is recommended that the City Council authorize staff to release a Request for Proposals (REP) for a branding and marketing strategy for the City of West Covina. Staff report and PowerPoint presentation was presented by Economic Development & Housing Director Morales. Council discussion included importance of branding to stimulate business, retaining current logo to reduce costs, use of marketing e-mails, estimated costs, concerns of expenditure when projects and events have been cut from the City budget, RFP process to determine costs, concerns with RFP response's meeting City's needs and/or vision, including an estimated budget within the RFP, and itemizing the cost of each deliverable to enable Council and staff to determine whether the deliverable creates a budgetary constraint. Motion by Spence and seconded by Wu to release a Request for Proposals (REP) for a branding and marketing strategy for the City of West Covina. Motion carried 4-1 by the following vote: AYES: Spence, Toma, Wu, Warshaw NOES: Johnson ABSENT: None PUBLIC WORKS 10) Certification of Environmental Document, Approval of Final Design Concept and Authorization to Proceed with Exploration of Funding Options for the Glendora Avenue Revitalization Project (Project No. 16047) It is recommended that the City Council take the following actions: 1. Adopt the following resolution: RESOLUTION NO. 2017-99 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFYING THE MITIGATED NEGATIVE DECLARATION ENVIRONMENTAL DOCUMENT FOR THE GLENDORA AVENUE REVITALIZATION PROJECT; and 2. Approve the final Glendora Avenue Revitalization Project design concept; and 3. Authorize the City Manager to initiate the process of securing bond financing in the total amount of $12 million for the construction, administration, construction management and inspection of the Glendora Avenue Revitalization Project. Tuesday October 17, 2017 City Manager Freeland stated that the design consultants of the project, Rick Kreuzer of Kreuzer Consulting Group and Mike Green of Clark and Green Landscape Architects, were available to answer any questions and that bond underwriters were present to discuss the bond process if Council requested. Staff report was presented by Public Works Director Consunji who then turned the presentation of over to design consultant Rick Kreuzer of Kreuzer Consulting Group who presented a PowerPoint presentation of the Glendora Avenue Revitalization Project design concept. Council questions and discussion included proposed removal of parking spaces and how to encourage patrons to utilize the parking structure, capacity of the "Great Lawn" area, parking issues, upgrades/improvements to the theater establishment and other stakeholders in the Glendora Avenue project area, maintenance costs, public restroorns, public art, security, possible creation of a Business Improvement District, infrastructure of project, breakdown of project costs, addressing the homeless issue in the area, funding sources to host events, broad band and Wi-Fi access in area, sales tax revenue to support bonds funding, and a variety of pros and cons of the project. Planning Director Anderson addressed questions regarding the mitigated negative declaration environmental report followed by Council discussion. Motion by Warshaw and seconded by Toma to adopt Resolution No. 2017-99 as recommended. Motion carried 3-2 by the following vote: AYES: Toma, Wu, Warshaw NOES: Johnson, Spence ABSENT: None City Manager Freeland introduced Thomas Jacob and John Kim of Stifel, the proposed bond underwriting firm for the California Statewide Communities Development Authority (California Communities) financing program, who gave a presentation on the bond process, the California Communities funding program, Total Road Improvement Program (TRIP) financing program and answered Council questions. City Manager Freeland addressed new transportation funding sources available through voter approved ballot measures. Council discussion ensued. Mayor Pro Tern Spence requested agenda item number 11 be carried over to the following meeting with no objection by the City Council. COUNCILMAN TONY WU 12) Request from Councilman Tony Wu for City Council to Discuss All City Sponsored Events and Corresponding Budget It is recommended that the City Council provide direction regarding the request from Councilman Tony Wu for staff to bring back an item for discussion by City Council regarding all City sponsored events and the corresponding budget for each event. Councilman Wu requested the Council consensus to agendized for a future meeting a discussion regarding City sponsored/co-sponsored events and the corresponding budget for each event. Council discussion included including in the future report the effect to the adopted City budget if any events are sponsored/co-sponsored and a summary of fees that have been waived. Motion by Wu and seconded by Spence to bring a report to a subsequent meeting to discuss City sponsored/co-sponsored events and the corresponding budget for each event, the effect to the adopted City budget and a summary of event fees that have been waived. Hearing no abstentions or objections, Mayor Warshaw declared the motion as passed. 1 1 Tuesday October 17, 2017 CITY COUNCIL COMMENTS Mayor Warshaw requested to agendize for discussion a monetary award for information leading to an arrest and conviction relating to a fatal hit and run at Azusa Ave. and Francisquito Ave. Mayor Pro Tern Spence requested to agendize for discussion to support the lawsuit filed by the ex-mayor of Poway regarding the California Voters Rights Act as unconstitutional.
