CHANGES TO THE AGENDA City Manager Freeland requested that regarding Item #14, Approval of Side Letter to the Memorandum of Understanding with various bargaining units, that Resolution No. 2017-93 pertaining to the approval of the side letter between the City of West Covina and the Police Officers Association be removed from the Agenda Item and brought back at a subsequent meeting, and that Item #8, Police Chief Salary Range Increase & Retiree Medical Benefit Retention, be continued to the next meeting to allow for a full Council to comment and vote. City Manager Freeland introduced Edward Macias as the new Human Resources Director and Marc Taylor as the new Chief of Police. PRESENTATIONS Mayor Pro Tern Spence with Assistant City Manager/Community Services Director Bresciani recognized Sehella Radford as Teacher of the Year at Hollingsworth Elementary School and presented her with a Certificate of Recognition. Mayor Pro Tern Spence called forward Angie Shaw, District Representative from the Office of Senator Josh Newman, and Ghazal Seino, Field Representative for Assemblyman Phillip Chen, 551h District, and presented them with a Proclamation proclaiming September 9 th as California Admission Day recognizing the 167th Anniversary of California becoming a State. Mayor Pro Tern Spence called forward Councilman Johnson who recognized West Covina Police Department Officer Eddie Flores who assisted in the escort of Marine Lance Corporal Ruben Velasco from Los Angeles Airport to Rose Hills Memorial Park. 2 Tuesday September 05, 2017 Adjournment Motions Mayor Pro Tm Spence requested to adjourn tonight's meeting in memory of Maria A. ORAL COMMUNICATIONS - Five (5) minutes per speaker Mayor Pro Tern Spence announced that an individual may submit an orange Agenda Item Position Slip with their name and position on the agenda item rather than speaking and the positions will be read into the record when the item is discussed on the agenda. Ben Gibbins, Montclair resident, spoke on the program Run 4 Recovery which assists with housing for those in drug recovery and announced upcoming fund raising event to be held on October 7, 2017. Lisa Slaughter, Woodland Hills attorney, addressed marijuana cultivation regulations and spoke in support. Barbara Gonzalez, spoke in support of marijuana cultivation. David Valenzuela, Oxnard resident, spoke in support of marijuana cultivation. Jim Grivich, West Covina resident, recommended that the City's current marijuana cultivation ordinance remain as is with no changes. Javier Montes, Torrance resident, spoke in support of marijuana cultivation regulations. Steve Gresham, spoke in support of marijuana cultivation. Jerri Potras, West Covina resident, expressed concerns with marijuana cultivation and opposed code amendment. Emiliano Magdalen°, Los Angeles resident, spoke in support of marijuana cultivations. Chris Miller, West Covina resident, requested proceeds from marijuana cultivation be utilized for retirement funding and that employee raises be limited to 2%. Joao Silverstein, Los Angeles resident, addressed marijuana dispensary regulations. Herb Redholtz, West Covina resident, requested the Council initiate a code amendment for review by the Planning Commission for the cultivation of marijuana and addressed maintenance issues at the Lakes shopping center. Wen Wen Zhang, West Covina Library manager, announced upcoming library events. 3 Tuesday September 05, 2017 John Shewmaker, West Covina resident, addressed several agenda items pertaining to the City's budget and finances. Lu Arredondo, West Covina resident, spoke in support of the upcoming Red Ribbon rally event and requested City involvement. Don Fernald, co-chair of the Red Rally committee, spoke in support of City involvement in the upcoming Red Ribbon rally. Moises Arredondo, West Covina resident, spoke in opposition to allowing marijuana cultivation in the City. John Lim, spoke in support of marijuana cultivation. Jefferson DeRoux, West Covina resident, addressed marijuana cultivation. Erik Intermill, West Covina business owner (Craft Hill), addressed the Conditional Use Permit (CUP) process. Bruce Leinbach, West Covina resident, addressed the construction of the freeway on/off ramps and lack of progress. City Manager Freeland and staff responded to speakers comments. Motion by Johnson and seconded by Toma to approve as recommended with the record reflecting a dissenting vote by Toma. Motion carried 2-1 by the following vote: AYES: Johnson, Spence NOES: Toma ABSENT: Wu, Warshaw 8) Police Chief Salary Range Increase & Retiree Medical Benefit Retention It is recommended that the City Council adopt the following resolution to increase the salary range of the Police Chief and to amend the Department Head Summary of Benefits to allow the suspension of retiree medical benefit for those Department Heads that come out of retirement to serve the City: RESOLUTION NO. 2017-77 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADJUSTING THE SALARY RANGE OF THE POLICE CHIEF AND AMENDING DEPARTMENT HEAD BENEFITS This item was removed from the Consent Calendar and rescheduled for the following meeting to allow a full Council to comment and vote. COMMUNITY ECONOMIC DEVELOPMENT 9) Plaza Parking Agreement Amendment It is recommended that the City Council authorize the City Manager to execute an amendment to the Parking Agreement with Starwood Capital Partners to increase the portion of the City Parking Lot allowed to be leased by Starwood Capital Partners at the Plaza West Covina mall and extend the term of the agreement. City Manager Freeland provided a brief overview of the cancellation of the aquatics programs and agreement with the West Covina Unified School District for the use of the pool facility and effect on the budget, and Community Services Director Bresciani provided an overview of the timeline for the construction of the new aquatics center. Adopt the following resolution: RESOLUTION NO. 2017-85 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ESTABLISHING A PENSION RATE STABILIZATION TRUST FUND ADMINISTERED BY PUBLIC AGENCY RETIREMENT SERVICES (PARS) 2. Appoint the City Manager as the City's Plan Administrator; and 3. Authorize the City Manager to negotiate and execute the final documents of the Trust; and 4. Authorize the transfer of $312,195 in budgeted funds to the Pension Rate Stabilization Trust Fund. Accept the 2017-18 Office of Traffic Safety (OTS) Selective Traffic Enforcement Program (STEP) reimbursable grant (#PT18156), and authorize the City Manager, or his designee, to execute all grant related documents; and 2. Authorize the addition of one sworn Officer position in the Police Department; and 3. Adopt the following resolution: RESOLUTION NO. 2017-81 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2017, AND ENDING JUNE 30, 2018 (CITY HALL RESTROOM ADA UPGRADES) 2. Accept the City Hall restroom improvements construction for Project No. BP-17001; and 3. Motion carried 3-0 by the following vote: AYES: Johnson, Spence, Toma NOES: None ABSENT: Wu, Warshaw END OF CONSENT CALENDAR HEARINGS PUBLIC HEARINGS 18) Ordinance Requiring Expedited Permitting Procedures for Electric Vehicle Charging Stations Pursuant to Assembly Bill 1236 It is recommended that the City Council read by title only, waive further reading and introduce the following Ordinance: ORDINANCE NO. 2323 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY ADDING ARTICLE XVIII TO CHAPTER 7 TITLED "PERMIT PROCESS FOR ELECTRIC VEHICLE CHARGING STATIONS" Mayor Pro Tern Spence announced the Public Hearing matter, Assistant City Clerk Butler verified that proper legal notice was given and Mayor Pro Tern Spence opened the Public Hearing. Staff report was presented by Building Official Long Tang. Assistant City Clerk Butler confirmed that no written comments or protests have been received. 12 Tuesday September 05, 2017 Mayor Pro Tern Spence opened the Public Testimony period. With no one wishing to speak, Mayor Pro Tern closed the Public Testimony period. Council discussion included providing a report annually of the number of permits issued, Southern California Edison charging programs, locations of charging stations, and installation of charging stations in single family homes with new developments. Motion by Torna and seconded by Johnson to approve as recommended. Motion carried 3-0 by the following vote: AYES: Johnson, Spence, Toma NOES: None ABSENT: Wu, Warshaw PLANNING DEPARTMENT 20) Code Amendment No. 16-04 Marijuana Regulations (Cultivation) General Exemption It is recommended that the City Council provide direction to staff regarding processing a Code Amendment for the commercial cultivation of marijuana in a manufacturing zone to 13 Tuesday September 05, 2017 allow the Planning Commission to consider changes to the Licenses and Business Regulations (Chapter 14) section of the Municipal Code as well as changes to Zoning (Chapter 26). Councilman Johnson stated his reasons to re-agendize the processing of a Code Amendment for the commercial cultivation of marijuana and stated he would change his vote from an Aye to No regarding the processing of a Code Amendment. Motion by Johnson and seconded by Toma to reconsider action from the August 15, 2017 meeting to direct staff to process a Code Amendment for the commercial cultivation of marijuana in a manufacturing zone and to allow the Planning Commission to consider changes to the Licenses and Business Regulations section of the Municipal Code. Mayor Pro Tem Spence announced that Mayor Warshaw has requested that the item be carried to the next meeting so he can have input into the matter and requested Councilman Johnson hold his motion. Councilman Johnson stated he wished to move forward with the motion to reconsider tonight. Council discussion continued. City Manager Freeland announced that there will be a Gold Star Banner ceremony, date to be determined, to honor Lance Corporal Ruben Velasco. Councilman Toma announced the Kings of Cameron football game to be held on Friday between West Covina High School and South Hills High School and Southern California Air Quality Management District (AQMD) electric car event to be held on September 9, 2017 at the AQMD office located in Diamond Bar.
