John Shewmaker, West Covina resident, addressed the ordinance to restrict contractor campaign
contributions and year-end audit.
Colleen Rozatti, West Covina resident and President of West Covina Beautiful, announced West
Covina Beautiful's City of West Covina birthday celebration on February 15, 2017 at South Hills
Country Club, Arbor Day on April 22, 2017 at Cameron Park, expressed concerns of changing the
signage at the traffic signal of Lark Ellen and Cameron to "No Right Turn" during specific times
of the day
Steve Gresham, addressed revenue sources from the sale of marijuana.
Royall Brown, West Covina resident, thanked the Council for proposed campaign restriction for
West Covina contractors, and spoke on educating residents of City business.
Wen Wen Zhang, West Covina Library Manager, spoke on programs at the Library.
Carolyn Arndt, West Covina resident, addressed the lack of handicapped parking spaces at Shadow
Oak Park and limited access for seniors.
Elsie Messman, West Covina resident, addressed the warrant list not giving full disclosure of
expenditures.
Robert Torres, West Covina resident, addressed several items listed on the agenda and requested
the Council to revisit banning smoking in parks.
Marisol Tones, West Covina resident, addressed the issue of smoking in the parks and requested
the Council prohibit smoking in the parks.
Shirley Lu, West Covina resident, spoke in support of banning smoking in City parks.
Erik Rodriguez, West Covina resident, spoke in support of banning smoking in City parks.
Grace Pugh, West Covina resident, spoke in support of banning smoking in City parks.
Lola Finley, West Covina resident, thanked the Council for implementing further restrictions on
campaign contributions and addressed the proposed designation of Amar and Azusa as Little Mania
as the area is very diverse in all ethnicities.
Fredrick Sykes, West Covina resident, spoke in support of banning smoking in the parks, addressed
a resident's complaint against the police department, expressed concerns with Los Angeles County
Animal Control services, addressed campaign contribution limits and Athens Disposal.
Amy Arnold and Keith Parrish, thanked the City for the new Farmers Market.
Pablo Lucanera, West Covina resident, spoke in support of a smoking ban in the City Parks and
expressed concerns with Hustler Hollywood and seeing in the windows at night.

Dana Sykes, West Covina resident, addressed campaign contribution restrictions, addressed lack
of parking at Shadow Oak Park for events and opposed smoking in the parks.
Steve Bennett, West Covina resident, addressed voting districts and proposed referendum to oppose
voting districts.
Angel and Esther Feliciano, West Covina residents, addressed an unfavorable experience with the
police department regarding a crime at their home.
City Manager Freeland and City Attorney Barlow responded to several comments from the
speakers.

This item was removed from the Consent Calendar by Mayor Pro Tern Spence who expressed
concerns on how a candidate would possibly know who is ineligible to make a campaign
contribution and the enforcement.
Council discussion included restrictions as they apply to candidates versus a sitting councilmember
who is running for re-election, ability to enforce, proposed ordinance not applying to employee

bargaining units, and eliminating residential permit or variance applications from the proposed
ordinance.
Councilman Johnson requested to eliminate from the proposed ordinance residents who want to
remodel by requesting a permit or variance.
City Attorney Barlow suggested to bring back a revised ordinance at the following meeting for first
reading and introduction.
Council discussion ensued regarding purpose of proposed ordinance to effect big developers and
not individual homeowners and ordinance effecting residential project of five units or more, and
how to enforce.
It was the consensus of the City Council to have the City Attorney return with a revised ordinance
for first reading and introduction to include the elimination of residents who request a permit or
variance for their personal residence and how to enforce for the Council consideration and
discussion.

5) City Investment Report for the Month Ended December 31, 2016
It is staffs recommendation that the City Council receive and file the Investment Report for
the month ended December 31, 2016.

National League of Cities Prescription Discount Program, which benefits residents in West
Covina who do not have prescription drug insurance.

per year, not to exceed $97,500.

10) New Farmers Market Management Team

weekly Farmers Market in the City's right of way on Glendora Avenue.

from the providers of the Farmers Market Management team.
Amy Arnold and Keith Parrish, of the Farmers Markets and Local Community Events provided a
brief background of their experience and their vision for West Covina.
Community Services Director Bresiani presented a brief staff report.
Council discussion included City's assistance for success, hosting a night time Farmer's Market,
and visions for growth with additional vendors and live music,

11) Fiscal Year 2016-17 Budget Amendments
It is staffs recommendation that the City Council approve the proposed Fiscal Year 2016-
17 Budget Amendments:
1. Appropriate expenditures in the amount of $2,968,432 from the Redevelopment
Retirement Obligation Fund and decrease expenditures in the amount of $2,968,432
from the Successor Agency Debt Services Fund; and
2. Authorize the City Manager to execute the grant documentation needed to accept the
Mobile Source Air Pollution Reduction Review Committee's (MSRC) 2015 Local
Government Match Program Grant and appropriate revenue in the amount of $54,199
to the Air Quality Improvement Trust Fund (Aect# 17002.119.500) and expenditures
in the amount of $54,199 to the Air Quality Improvement Trust Fund (Aect#
17002.119.7500) for the Electronic Vehicle (EV) Charging Stations CIP project
1117002.

13) Purchase of Rower X130 Crawler Sewer Camera System and Truck
It is staffs recommendation that the City Council take the following actions:
1. Approve a purchase order to Haaker Equipment Company in the amount of
$187,436.40 (including sales tax, delivery and options) for the purchase of the Rovver
X130 Crawler Sewer Camera System and truck; and
2. Confirm the Finance Department/Purchasing Officer's findings that the purchase and
delivery of the camera system and truck through the National Joints Powers Alliance
(NJPA) Cooperative Purchasing Agreement satisfies West Covina's bid process as
stated in the West Covina Municipal Code Chapter 2, Article VII, Division 2, Section
2-333(i)(2); and
3. Appropriate $87,436.40 from Sewer Fund 189 fund balance to cover the shortfall in
funding.

respectively.

15) Repealing Chapter 6 of the West Covina Municipal Code and Adopting by Reference
Title 10 of the Los Angeles County Code of Ordinance Relating to Animal Control, as
Amended
It is staffs recommendation that the City Council introduce and give first reading and waive
further reading to the following ordinance:
ORDINANCE NO. 2305 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, REPEALING CHAPTER 6 OF THE WEST
COVINA MUNICIPAL CODE AND ADOPTING BY REFERENCE TITLE 10 OF THE
LOS ANGELES COUNTY CODE OF ORDINANCES RELATING TO ANIMAL
CONTROL, AS AMENDED
Community Services Director Bresiani presented the staff report.
Animal Care and Control representatives Contract Cities Liaison Whitney Doung, Baldwin Park
Shelter Sgt. Frank Rojas, Deputy Director of Operations representative, and staff responded to
questions and engaged in discussion regarding the enforcement of non-compliance of pet licensing,
Baldwin Park euthanasia percentage, pet licensing cycle correlating with rabies expiration,
exception of spay/neuter for show dogs and guard dogs, retaining City Ordinance of no puppy mills
if City were to adopt County Title 10, rational of retaining City licensing of fees rather complying
with County license fee structure, notification of proposed changes of mandatory spay/neutering
and mierochipping to current licensees, proposed mandatory spay/neutering provisions and
microchipping which are both optional to enter a contract with the County, canvassing for licenses,
regulations for the transportation of a pet in an vehicle and whether spay/neutering regulations can
be required for new licenses only and renewal licenses will be grandfathered in with no
spay/neutering if owner chooses not to.
Motion by Warshaw to introduce Ordinance No. 2305 as presented with modifications that guard
dogs do not need to be spayed/neutered as long as the breeding owners have a business license in
West Covina and spay/neuter provisions apply only to new licenses and not renewal. Motion dies
due to a lack of a second.
Motion by Warshaw and seconded by Toma to hold the item over in order to receive additional
information regarding spay/neutering to only new licenses, excluding mandatory spay/neutering
from ordinance and excluding mandatory microchipping from ordinance, average cost from local
vets for spay/neutering and current number of altered/unaltered licensed animals in the City.
Motion failed 2-3 by the following vote:

16) Request from Mayor Pro Tern Mike Spence Regarding Possible Amendment of
Ordinance Regarding Campaign Contributions
It is staffs recommendation that the City Council discuss and direct staff accordingly.
Motion by Spence for interest in a discussion to not adopt a mandatory campaign contribution limit
but to have the submittal of a campaign statement contingent with candidate voluntary spending
limits similar to State of California provisions. Motion dies due to lack of a second.
Mayor Pro Tern Spence requested consensus to increase the amount of campaign contribution that
an individual can donate from $500 and stated that a candidate will not have enough funds to
combat an independent expenditure funded "hit" piece without the ability to raise sufficient funds.
Motion by Spence and seconded by Johnson to increase the amount an individual can donate to
local campaigns to $1,000.

17) Long Term Contract Listing
It is staffs recommendation that the City Council receive and file this informational report.
Councilmember Toma presented a brief over of his request to have Long Term Contract listing
provided and expressed concerns with long term contracts with auto renewals and evergreen clauses
and requested staff draft a policy that would restrict long term contracts in which the city cannot
release themselves from and remain competitive.

Council discussion included pros and cons of long term contracts and benefits of some types of
contract being long term or indefinite and difficulties of a policy that can serve all type of contracts
[i.e. service contracts, purchasing contracts, software licensing contracts].
Motion by Warshaw and seconded by Spence to have the item return to a future Council meeting
with a breakdown of types of type of contracts for further discussion. Motion carried 5-0 by the
following vote:

Mayor Pro Tern Spence reported on his attendance at the Independent Cities Association
conference recently held in Santa Barbara.
Mayor Warshaw reported on his attendance at the League of California Cities New Mayors and
Councilmembers conference held in Sacramento.

18) Request from Councilmember James Toma regarding use of Council Chambers
Audio/Visual Equipment by Members of the Public
It is staffs recommendation that the City Council discuss the use of Council Chambers
audio/visual equipment by members of the public and direct staff accordingly.
Councilmember Toma spoke in support of use of the Council Chambers audio/visual equipment to
be used by members of the public during presentations and oral communication.
Council discussion included prior review from staff of any material to be used by the public for
presentation on the Chambers audio/visual equipment to protect the system from any type of virus,
malware or inappropriate content.
Motion by Toma and seconded by Spence to allow access of the audio/visual equipment in the
Council Chambers to the public and direct staff to develop a policy for such use. Motion carried
5-0 by the following vote:
YES: Johnson, Spence, Tom, Wu, Warshaw

CITY COUNCIL COMMENTS
Councilman Wu thanked the staff for the implementation of the Shop Local After School Program.
Mayor Pro Tern Spence addressed courtesy notification to residents on permits and changes with
City policies or procedures and ways to streamline the process, and addressed the recent active
shooter presentation provided by the Police Department.
Motion by Councilman Toma and seconded by Johnson to agendize for a future meeting a
discussion on banning smoking in City parks. Motion carried 4-1 by the following vote:
YES: Johnson, Toma, Wu, Warshaw
NOES: Spence
ABSENT: None
Motion by Spence and seconded by Warshaw to discuss at the next Council meeting opposing SB
54. Motion carried 3-2 by the following vote:

Mayor Warshaw thanked the Kiwanis for the opportunity to speak at their recent meeting on current
issues in the City, and announced the Greater West Covina Business Association is hosting a
breakfast for the State of the City address by the Mayor to be held on March 9, 2017 at the Hurst
Ranch.
Councilman Toma congratulated resident Ken Kasamatsu for receiving the spirit award from the
Japanese Chamber of Commerce and spoke on his attendance at "In the Heights" production by
West Covina High School.
