City Attorney Barlow reported there were no reportable actions taken in closed session.
CHANGES TO THE AGENDA
City Manager Freeland clarified contradictory language in Item #4 regarding by-district elections
in which the report and the ordinance text conflict in the effective date of the ordinance and will
default to the report date of 30 days after the adoption of the ordinance, stated that Item # 6 will be
pulled from the Consent Calendar to allow the City Treasurer to present the Investment Report,
stated a correction to Item # 16 regarding the tree trimming cycle of the West Coast Arborists
Agreement from seven-years to five-years and the total contract amount, and stated Mayor
Warshaw has provided his recommendation to advisory committees in Item # 24 and will ratify at
the following City Council meeting.

John Shewmaker, West Covina resident, addressed the proposed bike paths and Promenade
Apartment agenda item.

Steve Bennett, West Covina resident, spoke on concerns of bullying as it relates to the council
voting district lawsuit.
Alvin Love, West Covina resident, inquired into zone change at for three single family homes at
the corner of Sunset and Roseway and notification to area residents, and the need for a traffic signal
at Sunset and Roseway.
Fredrick Sykes, West Covina resident, expressed concerns with the title of Item No. 4 stating a
directly elected mayor in conflict the staff report and benefits of a rotating mayor, and voiced
concerns of possible zone change notifications at Sunset and Roseway.
Nickolas Lewis, West Covina resident, spoke in opposition to voting districts and councilmember
positions.
Jim Grivich, West Covina resident, addressed issues regarding traffic issues at Cameron and Lark
Ellen.
Lola Finley, West Covina resident, addressed campaign reform, graffiti abatement contract, overall
crime as reported in the Tribune, and commended the fire department for their response to an
incident.
Colleen Rozatti, West Covina resident and president of West Covina Beautiful, announced the
upcoming West Covina Birthday Celebration on February 15, 2017, at South Hills Country Club
and the Arbor Day and Earth Day events on April 22, 2017.
Bill Elliott, West Covina resident, addressed Concealed Carry Weapons (CCW) permits.
Dana Sykes, West Covina resident, spoke the California Voting Rights Act (CVRA) lawsuit,
commented on the signals at Roseway and Sunset, and ability to fund having the city open five
days a week.
Jefferson DeRoux, West Covina resident, addressed traffic concern at Cameron and Lark Ellen as
a previous speaker address and several community issues.
Jeremy Infranca, West Covina resident, addressed rumored zone changes at Roseway and Sunset
Avenue.
City Manager Freeland addressed speakers concerns. Planning Director Anderson addressed
comments regarding zone changes to Sunset and Roseway.

CALIFORNIA, TO ESTABLISH BY-DISTRICT ELECTION OF COUNCIL

ARTICLE II, DIVISION 1, OF THE MUNICIPAL CODE
This item was removed from the Consent Calendar by Mayor Pro Tern Spence who requested
clarification of the effective date of the ordinance, timeline for submittal of a referendum if one
were to be filed, and expressed concerns that the mayoral succession process as proposed will not
necessarily allow a mayor to rotate from district to district. City Attorney Barlow stated the
ordinance would be in effect 30 days after adoption and recommended deferring any changes to the
mayoral succession until after the first district election.

TRAFFIC COMMITTEE MEETING MINUTES (accept & file)
5) Traffic Committee Minutes from November 2016
It is staffs recommendation that the City Council receive and file the minutes of the Traffic
Committee meeting held on November 16, 2016.
This -item was continued from the December 6, 2016, City Council meeting to provide
additional notification to the affected properties and properties within 300-feet of the
proposed parking restrictions on Randall Way. Additional information was also provided
to the notified property owners of the type of parking restrictions and number of permits

issued per household. A separate report is provided to the City Council to approve the
requested parking restrictions [Agenda Item #20].
Public Works Staff also sent out notice to the properties along Aroma Drive between Azusa
Avenue and Galster Way of the proposed parking restrictions along the southerly side of
Aroma Way between Rose Court and Galster Way. Residents and property owners were
requested to contact the Public Works Department if they have input or comments regarding
this item. A separate report is provided to the City Council to approve the requested parking
restrictions [Agenda Item #21].
This item was removed from the Consent Calendar by Mayor Pro Tem Spence expressing concerns
with Item 3A East Cameron Avenue and South Lark Ellen Avenue Congestion and Queuing.
Public Works Director Consunji presented a brief report of several options reviewed by staff to try
to eliminate the traffic congestion during school arrival and departure times.
Council discussion included directional flow of traffic during school arrival and departure hours
and whether the proposed signage will help the situation.
Motion by Warshaw and seconded by Johnson to accept and file the Traffic Committee Minutes
from the November 16, 2016 Traffic Committee meeting as recommended and return in 6 months
to review 3A recommendation of "No Right Turn" between the hours of 7— 8 a.m. and 2:30 — 3:30
p.m. to evaluate its effectiveness. Motion carried 4-1 by the following vote:

AND TAKE ALL ACTIONS IN FURTHERANCE OF THE APPROVAL OF
REFINANCING THE PROMENADE APARTMENTS LOAN

as to what the City will gain with the refinancing of loans.

Council question included what other affordable housing is in the area and total number within the
City.

1. Appropriate expenditures in the Integrated Waste Management Fund in the amount of
$6,000 to Legal Services (Acct# 120.41.4182.6111) and personnel expenditures in the
amount of $30,000 to Full Time Salaries (Acct# 120.41.4182.5111) for costs related
to the review of the Athens contract; and
2. Accept the Fiscal Year (FY) 2015-16 CalRecycle Beverage Container Recycling Grant
and appropriate revenue in the amount of $27,600 to the C.R.V./Recycling Grant Fund
(Acct#158.41.4521) and expenditures in the amount of $14,000 to Community
Awareness (Acct# 158.41.4201.6167) and expenditures in the amount of $13,600 to
Overtime (Acct# 158.41.4201.5113) for the 2015-16 Recycling Grant Program.

13) Architectural and Urban Design Services for Private Development Projects in the
Downtown Plan
It is staffs recommendation that the City Council authorize the City Manager to execute an
agreement with RRM Design Group to be used for Architectural and Urban Design
Consulting Services for three years ending January 17, 2020 in an amount not to exceed
$100,000 over the term of the agreement.

information as to the need for a consultant.
Planning Director Anderson presented a brief overview and stated the consultant will create
frontage standards along Walnut Creek Parkway in the downtown area.

14) Vehicle Mounted Equipment for Police Vehicles
It is staffs recommendation that the City Council take the following actions:
1. Authorize the purchase of a vehicle mounted camera system for 10 vehicles, per
specifications, directly from WatchGuard Video of Allen, TX, for a total of $63,438,
including taxes, from funds previously appropriated or budgeted for this purpose (in
funds 160, 361, and 117), in accordance with Municipal Code Chapter 2, Article VII,
Division 2, Sec. 2-330 (b), which states that bidding may be dispensed with when the
commodity can be obtained from only one (1) vendor; and
2. Find that the City of Arcadia's Request for Bid (RFB) in March of 2016 for safety
vehicle equipment and installation services satisfies West Covina's bid process, in

accordance with Municipal Code Chapter 2, Article VII, Division 2, Sec. 2-333 (i) (2),
and the findings of the West Covina Finance Department; and
3. Authorize the City Manager to enter into agreements with Black & White Emergency
Vehicles for public safety vehicle equipment and installation services through the term
of Arcadia's purchase agreements (through Fiscal Year 2019-2020). The first purchase
agreement, for the 12 police vehicles that were recently ordered, will total $117,130.44;
and
4. Waive the bid process and authorize the purchase of eight (8) vehicle mounted APX
radios from Motorola, totaling $56,072.25, using funds previously appropriated or
budgeted (in funds 160, 361, and 117), in accordance with Municipal Code Chapter 2,
Article VII, Division 2 Sec. 2-330 (b), which states that the City Council can dispense
with the bidding process when it will prove impracticable or uneconomical.

15) Rejection of Bid for Graffiti Abatement Services
It is staffs recommendation that the City Council take the following actions:
1. Reject the bid received for graffiti abatement services as submitted in the Office of
City Clerk; and
2. Authorize the City Manager to perform graffiti abatement services in-house; and
3. Increase the number of authorized full-time Maintenance Worker I positions in the
Public Works Department by two; and
4. Appropriate expenditures in the General Fund in the amount $31,825.53 to Graffiti
(Acct # 110.41.4142.6169), revenues in the General Fund in the amount o I $20,000 to
Facility Rentals (Acct # 110.51.4682), expenditures in the Gas Tax Fund in the amount
of $3,825.91 to Graffiti (Acct # 124.41.4151.6169) and expenditures in the Housing
Fund in the amount of $1,739.04 to Graffiti (Acct # 820.22.2210.6] 69)

Council discussion included the continued use of Graffiti Tracker for use by the Police Department,
locations of graffiti, overlap use of park maintenance personnel to assist with graffiti abatement,
spot checking for graffiti, signage with graffiti hotline phone numbers, concerns of receiving only
one bid and the bid process, total proposed budget for proposed two additional employees, and
future concerns if work cannot be completed by two additional employee creating additional cost
issues.
Motion by Spence to rebid project. Motion dies for a lack of a second.

16) Amendment No. 1 to West Coast Arborists' Contract for Citywide Tree Maintenance
Services
It is staff's recommendation that the City Council authorize the City Manager to execute
Amendment No. I to West Coast Arborists' contract extending the contract for five years
and establishing a five-year tree trimming cycle.
This item was removed from the Consent Calendar by Councilman Toma who expressed concerns
of not rebidding and the benefits of competitive bidding.
Council discussion included bidding process, increase of state prevailing wages for tree
maintenance laborers and phasing in of prevailing wage rates, and proposed tree trimming cycle of

It is staff's recommendation that the City Council authorize the City Manager to execute a
contract with Superior Pavement Markings, Inc. in the amount not to exceed of $180,000
($60,000 annually) for a one-year contract with the option of two one-year extensions to
provide annual on-call services for the maintenance of street striping and pavement
markings at various locations throughout the City.

providing the service in-house instead of with a contractor.
Public Works Director Consunji and Public Works Superintendent Micah Martin presented a brief
overview and stated that the city currently does not have trained staff or the equipment to provide
the currently mandated process of pavement markings.

It is staff's recommendation that the City Council Approve the installation of bicycle lanes

This item was removed from the consent Calendar by Councilman Johnson to inquire why parking
is being removed for a bike lane that appears to go nowhere.
Public Work Director Consunji presented a brief overview and stated the bike lanes comply with
Assembly Bill 1358 [Complete Streets Act] and the Complete Street Policy the Council adopted
with the General Plan.
Council discussion included the proposed bike path as an incomplete bike path, the removal of
parking spaces, established bike lanes in the City, bicycle safety, lack of connectivity of bike lanes,
, completion of bike study and grant funding received with implementation of Complete Streets Act.
Motion by Johnson and seconded by Warshaw to receive and file the report. Motion carried 3-2

Councilman Johnson stated that after further review of the proposed ordinance he would like to
reconsider his previous vote.
Motion by Johnson and seconded by Warshaw to reconsider the proposed ordinance regarding
restriction of campaign contributions. Motion carried 3-2 to reconsider by the following vote:

City Attorney Barlow presented an overview of the proposed ordinance regarding restrictions of
campaign contributions from City contractors, subcontractors and vendors and entitlement
applicants
Council discussion included whether a contractor/vendor who submitted a Request for Proposals
(RFP) for a project not yet awarded be allowed to make a contribution, how a candidate running
for office would know who submitted an RFP to a City department, ordinance not affecting
independent expenditures, and spending limits of candidates.
Motion by Warshaw and seconded by Johnson read by title only, waive further reading and
introduce Ordinance No. 2312 entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, AMENDING CHAPTER 2, ARTICLE VIII OF THE
WEST COVINA MUNICIPAL CODE RELTING TO CAMPAIGN CONTRIBUTIONS BY
CONTRACTORS, SUBCONTRACTORS, VENDORS AND ALLPLICANTS FOR
ENTITLEMENT' amended to include proposer [any vendor submitting an RFPI.
Council discussion continued and included enforcement, eliminating contributions from
contractors, and increasing contribution limits from $500 to $1,000.
Motion by Spence and seconded by Johnson to increase contribution limits for individuals from
$500 to $1,000. City Attorney Barlow stated increasing contribution limits is not on the agenda for
discussion and it would be inappropriate to take any action. Councilman Spence rescinded his
motion and requested to agendize increasing contribution limits and candidate spending limits for
the following meeting.
Motion to introduce ordinance as amended carried 3-2 by the following vote.

23) Athens Settlement Agreement
It is staff's recommendation that the City Council:

1. Reclassify the $650,000 settlement revenue with Athens Services form Franchise Fee
revenue to a Settlement; and
2. Appropriate revenues in the amount of $650,000 to Settlements (Acct# 110.11.4826)
and decrease revenues in the amount of $650,000 to Franchise Fees (110.00.4120).
City Manager Freeland provided a brief staff report.
Councilman Spence inquired why reclassification of Franchise Fee to Settlement was not made at
the time the budget was approved when the one-time $650,000 was appropriated into the budget.
Motion by Spence and seconded by Toma to return the $650,000 to the rate payers.
Council discussion included utilizing the money in the best interest of the city and returning to rate
payers as the money never should have been collected by the rate payers,

CITY COUNCIL COMMENTS
Mayor Warshaw announced the annual Public Safety Luncheon to be held on January 19, 2017 at
Faith Community Church and the Greater Los Angeles County Homeless Count to be held on
January 24, 2017.
Councilman Toma thanked the NAACP for their organization of the Martin Luther King Day event,
and announced an upcoming City Council Town hall meeting will be held on Monday, January 23,
2017 at 6:30 p.m. at the East San Gabriel Valley Japanese Community Center.
