City Manager Freeland announce that Agenda Item #10 Agreement for Janitorial Services for City Buildings and Facilities will be removed from the agenda for further evaluation and will be brought back at the January 17, 2017 meeting, and requested Agenda Items #12, #13, #14 be reordered on the agenda and considered prior to Agenda Item #11. There was no objection by the City Council. PRESENTATIONS None ORAL COMMUNICATIONS - Five (5) minutes per speaker Gary Gileno, West Covina resident, expressed concern with consideration of high profile agenda items late in the evening and right before a holiday when there is such low public turnout. Fredrick Sykes, West Covina resident, addressed Planning Commission meeting in which a development at South Hills Plaza was discussed and establishment of voting districts with a rotating mayor. 2 Tuesday December 20, 2016 Johnny Chua, President of the Filipino American Chamber of Commerce of San Gabriel Valley, expressed holiday greeting and announce the last weekend of Lights on Miracle Hill at City Blessing Church from 7:00 p.m. — 10:00 p.m. Lola Finely, West Covina resident, inquired into the development/sale of property at BKK and expressed concerns of traffic impact, requested updates of the development on the City's website, addressed Mayor Pro Tern Spence's personal legal/drug issue and his conduct as a councilmember, spoke in support of a councilmember taking a leave of absence or resigning if they are arrested for drug or alcohol abuse. Colleen Rozatti, City Treasurer and West Covina Beautiful president, announced the success of the West Covina Beautiful Home for the Holidays tour held last Friday and announced the home winners, announced the City birthday celebration to be held on February 15, 2017, and addressed the recent City audit which will be reviewed by the Audit Committee, Trudy Saltmarsh, West Covina resident, addressed voting districts and supported five districts with a rotating mayor and inquired into how the district boundaries will be established, addressed Mayor Pro Tern Spence's reasons for being fit to rotate into the position of Mayor Pro Tern. Grace Barrios, representing Filipino American Chamber of Commerce, spoke in support of West Covina and being involve within the community. Steve Bennett, West Covina resident, spoke in opposition to voting districts and stated districts will not bring out more candidates and if voting districts is approved would support four districts with an elected mayor. William Elliott, West Covina resident, spoke on Concealed Weapon permits (CCW's), requested community input be received for the future police chief selection, commented on who can use the projection screen for presentation, electronic council voting systems, and voting districts. Valerie Munoz, La Puente Mayor, requested Council support for appointment to the San Gabriel Basin Water Quality Authority Board of Directors. Margaret Clark, Rosemead Councilmember, also requested Council support for appointment to the San Gabriel Basin Water Quality Authority Board of Directors to fill the current vacancy and complete the two year term. Angie Gillingham, West Covina resident, spoke in support of four voting districts with any elected mayor rather than five district with a rotating mayor. Jerri Potras, West Covina resident, spoke in opposition to voting districts and supported fighting the lawsuit and how district will change to composition of the city. Gloria Gandara, West Covina resident, addressed the CRA lawsuit and voting districts. 3 Tuesday December 20, 2016 Dana Sykes, West Covina resident, addressed voting districts and supported five districts with rotating mayor, benefits of voting districts, and the cost of fighting the lawsuit and ramification of expending those funds of lost jobs. City Manager Freeland and City Attorney Barlow addressed comments by the speakers. This item was removed from the Consent Calendar by Councilman Spence who requested information on when the fees collected will be expended on the affected impacts. City Manager Freeland stated some of the funds may have been approved within the CIP budget or future CIP budget and the City needs to be assured funds have been collected. Approve wage adjustments to six (6) Limited Service positions to bring them into compliance with the State's minimum wage requirement as of January 1, 2017; and 2. Authorize the City Manager to enter into an agreement with the California Highway Patrol (CHP), subject to City Attorney approval, for interagency supplemental law enforcement investigative services; and 6 Tuesday December 20, 2016 2. Appropriate expenditures in the amount of $100,000 in the Federal Asset Forfeiture Fund to other contractual services (Acct. # 117.31.3131.6120). DEPARTMENTAL REGULAR MATTERS CITY ATTORNEY'S OFFICE 12) Ordinance Declaring that the Use of Sunset Field as a Public Park is Discontinued and Abandoned It is recommended that the City Council introduce and give first reading and waive further reading to the following ordinance: 7 Tuesday December 20, 2016 ORDINANCE NO. 2306 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING THAT THE USE OF SUNSET FIELD AS A PUBLIC PARK IS DISCONTINUED AND ABANDONED Brief staff report was presented by City Attorney Barlow. Council comments and discussion included timeline to procure additional parkland with the proceeds of the sale of Sunset Park, benefit to the community of small parkette vs. adding parkland to an existing park, availability of land and receiving public input regarding parkland. Motion by Spence and seconded by Johnson to introduce, give first reading and waive further reading of Ordinance No. 2306. Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Toma, Wu, Warshaw NOES: None ABSENT: None CITY MANAGER'S OFFICE 13) Election of Board Member and Alternate Representing Cities without Prescriptive Water Pumping Rights to the San Gabriel Basin Water Quality Authority Board of Directors It is recommended that the West Covina City Council adopt the following resolution casting its eleven (11) votes to either Rosemead Councilmember Margaret Clark or La Puente Mayor Valerie Munoz, to serve on the San Gabriel Basin Water Quality Authority Board of Directors to represent cities without prescriptive water pumping rights: RESOLUTION NO. 2016-89 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CASTING ITS VOTES FOR TO REPRESENT CITIES WITHOUT PRESCRIPTIVE WATER PUMPING RIGHTS ON THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY Staff report was presented by City Manager Freeland. Council question included the alternate being only able to utilize Board funds to attend meetings in the absence of the Director, otherwise personal funding is utilized. In response to Council questions regarding Board policies, City Manager Freeland stated he is unaware of the details of the Water Quality Authority Board policies. Candidates Clark and Munoz responded to questions from the Council regarding parties responsible for the water clean-up. 8 Tuesday December 20, 2016 Motion by Wu and seconded by Toma to cast West Covina's eleven (II) votes to elect La Puente Mayor Valerie Munoz to represent cities without prescriptive water pumping rights on the Board of the San Gabriel Basin Water Quality Authority, and adopt Resolution No. 2016-89 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CASTNG ITS VOTES FOR VALERIE MUNOZ TO REPRESENT CITIES WITHOUT PRESCRIPTIVE WATER PUMPING RIGHTS ON THE BOARD OF THE SAN GABRIELD BASIN WATER QUALITY AUTHORITY." Motion carried 3-2 by the following vote: AYES: Toma, Wu, Warshaw NOES: Johnson, Spence ABSENT: None RECESS — Mayor Warshaw called for a recess at 8:45 p.m. The City Council reconvened at 8:56 p.m. with all members present. 14) California Voting Rights Act - Proposed Ordinance of the City Of West Covina, California, to Establish By-District Election of Council Members, and Possibly a Directly Elected Mayor It is recommended that the City Council consider the attached report from its November 15, 2016 meeting and the attached draft ordinances, and if appropriate, introduce and give first reading to the selected ordinance. City Attorney Barlow stated that at the December 6, 2016 meeting no action was taken to adopt the proposed ordinance to establishing district-based election with four districts and a directly elected mayor for two years, therefore, the item has been re-agendized for further discussion and consideration of other options and provided a brief overview of options. Councilman Johnson stated he requested this item come back for action after the previous districting ordinance did not pass, and stated he did not support voting districts but would support a district composition that was supported by a majority of the residents. Motion by Johnson and seconded by Toma to introduce, give first reading and waive further reading of an ordinance to establish five voting districts and continue with a rotational mayor and introduce Ordinance No. 2310 entitled AN ORDINANCE OF THE CITY OF WEST COVINA, CALIFORNIA, TO ESTABLISH BY-DISTRICT ELECTION OF COUNCIL MEMBERS, AND RPEALING AND REPLACING SECTIONS 2-20 AND 2021 OF ARTICLE II, DIVISION I, OF THE MUNICIPAL CODE." Council discussion included councilmembers representing the city as a whole, the CVRA lawsuit as a bullying tactic to transpire to districts, holding a special election to allow the voters determine to fight lawsuit or transition to districts, and financial responsibility of the Council, Motion carried 3-2 by the following vote: 9 Tuesday December 20, 2016 AYES: Johnson, Toma, Warshaw NOES: Spence, Wu ABSENT: None HEARINGS PUBLIC HEARINGS 11) Public Hearing for General Plan Amendment No. 14-03 (General Plan Update) Zone Change No. 16-01 Code Amendment No. 16-01 Environmental Impact Report It is recommended that City Council take the following actions: 1. Adopt the following resolutions: RESOLUTION NO. 2016-87 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFICATION OF THE FINAL ENVIRONMENTAL IMPACT REPORT (SCH#2016021069), ADOPTION OF A MITIGATION MONITORING PROGRAM, ADOPTION OF A STATEMENT OF OVERRIDING CONSIDERATIONS FOR GENERAL PLAN AMENDMENT NO. 14- 03, ZONE CHANGE NO. 16-01, AND CODE AMENDMENT NO. 16-01, PURSUANT TO THE CALIFORNIA ENVIORMENTAL QUALITY ACT OF 1970, AS AMENDED RESOLUTION NO. 2016-88 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 14-03 TO ADOPT THE NEW GENRAL PLAN 2. Introduce the following ordinances: ORDINANCE NO. 2308 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING ZONE CHANGE NO. 16-01 TO CHANGE THE ZONING DESIGNATION ON THE PROPERTIES IN THE DOWNTOWN AREA ORDINANCE NO. 2309 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING CODE AMENDMENT NO. 16-01 TO ADOPT THE DOWNTOWN PLAN AND CODE AND AMEND THE MUNICIPAL CODE TO DELETE SECTIONS THAT CONFLICT WITH THE DOWNTOWN PLAN AND CODE OR THAT ARE ANTIQUATED 10 Tuesday December 20, 2016 City Manager Freeland gave introductory remarks on the two year process of the General Plan Update which consisted of numerous community workshops, outreach programs, Planning Commission and City Council meetings with input from the community and stake holders. Mayor Warshaw introduced the Public Hearing matter, Assistant City Clerk Butler verified proper legal notice was given and Mayor Warshaw opened the Public Hearing. Planning Director Anderson announced the actions required in order to adopt the General Plan as 1) certifying the Environmental Impact Report, 2) approving General Plan Amendment No. 14-03 to adopt the General Plan, 3) approving Zone Change No. 16-01 to change the zoning designations on properties in the downtown area, and 4) approving Code Amendment No. 16-01 to adopt the Downtown Plan and Code and to amend the Municipal Code. The presentation format will consist of background, general plan/housing element revision, downtown plan, environmental impact report and conclusion and recommendations with questions from the Council following each segment of the presentation. Staff report and PowerPoint on the background and General Plan was presented by Planning Director Anderson and Kaizer Rangwala, consultant with Rangwala Associates and Sarah Walker of National Community Renaissance of California gave a presentation on the Housing Element Revisions. Mayor Warshaw asked the Council if there were any questions regarding the General Plan and Housing Element Revisions. With none, Planning Director Anderson to continue the presentation. Planning Director Anderson continued with a presentation on the Downtown Plan and Code which would require a zone change and code amendment to allow the Downtown Code to be incorporated within the Municipal Code. Mayor Warshaw asked the Council if there were any questions regarding the Downtown Plan and Code. With none, Planning Director Anderson to continue the presentation. Planning Director Anderson continued with a presentation on the Environmental Impact Report. Following the Environmental Impact Report presentation, Planning Director reiterated the required actions that need to be taken to adopt the General Plan. Mayor Warshaw asked the Council if there were any questions of staff. Planning Director Anderson and Consultant Kaizer Rangwala responded to a variety of questions regarding the General Plan and whether certain elements presented can be changed or excluded in the General Plan. Greg Martin of Rincon Consulting responded to questions regarding the Environmental Impact Report (EIR). Mayor Warshaw opened the Public Testimony period. Members of the public Jerri Potras, Steve Bennett, Gary Gileno and Jefferson DeRoux expressed concerns with various elements of the proposed General Plan. 11 Tuesday December 20, 2016 With no one else wishing to speak, Mayor Warshaw closed the Public Testimony period. Council engaged in lengthy question and comment session with staff. Expressing concern with no drive-through businesses within the Downtown Plan, Councilman Johnson initiated discussion to modify the Downtown Plan. Motion by Johnson and seconded by Spence to only allow drive-through businesses in the downtown area through a Conditional use Permit (CUP) process only. Amendment to motion by Warshaw to allow drive-through businesses outside of the perimeters Glendora Avenue from the San Bernardino Freeway to West Covina Parkway by CUP process only. Amendment accepted. Motion carried 3-2 by the following vote: AYES: Johnson, Spence, Warshaw NOES: Toma, Wu ABSENT: None Following further discussion, the following actions were taken. Environmental Impact Report certification Motion by Warshaw and seconded by Toma to adopt Resolution No. 2016-87 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITIY OF WEST COVINA, CALIFORNIA, CERTIFICATION OF THE FINAL ENVIRONMENTAL IMPACT REPORT (SCH #2016021069), ADOPTION OF A MIGIGATION MONITORING PROGRAM, ADOPTION OF A STATEMENT OF OVERRIDING CONSIDEERATIONS FOR GENERAL PLAN AMENDMENT NNO. 14-03, ZONE CHANGE NO. 16-01, AND CODE AMENDMENT NO. 16- 01, PURSUANT TO THE CALIFORNIA ENVIRONMENTL QUALITY ACT OF 1970, AS AMENDED" with modifications to Mitigation Measure T-1. There was no objection by the Council.
