City Attorney Barlow reported that no reportable action was taken in closed session but direction
was given by the Council.
CHANGES TO THE AGENDA
City Manager Freeland stated there are typographical errors to Items # 3 and #14 and addendums
to the staff report are available, that Item 15 will be removed from the Consent Calendar in order
for the City Treasurer to present the report, and Stated that Items #8 and SA#2, authorizing the
issuance of tax allocation bonds, will be removed from the City Council and Successor Agency
agendas in order for staff to give a verbal report for the public benefit.
PRESENTATIONS
Mayor Toma called forward Fire Department Assistant Chief Mike Fountain and presented him a
Proclamation proclaiming the week of October 9-15, 2016 as Fire Prevent Week.

enforcement services and opposition to voting districting in West Covina.
Angie Gillingham, West Covina resident, opposed the closure of the Walnut Creek Parkway and
announced the Friends of the Library fall book sale on October 7 th and 8th.
Jim Grivich, West Covina resident, addressed concerns of medical marijuana in the city and
concerns with the Walnut Creek bikeway.
Cesar Cervantes, West Covina resident, announced an upcoming Community Coffee with
Assemblymember Hernandez on Saturday, October 8, 2016.
Rachel Chan, West Covina resident, addressed concerns with the Walnut Creek bikeway.
Patricia Dorado, West Covina resident, also addressed concerns with the Walnut Creek bikeway.
Linda Nguyen, West Covina resident, echoed concerns with Walnut Creek bikeway.

1. Authorize the City Manager to execute a purchase order for an amount not to exceed
$30,000 annually with Commercial Aquatic Service Inc. to furnish and deliver water
chemicals (12.5% Sodium Hypochlorite, Muriatic Acid and Sodium Bicarbonate) to the
City of West Covina Municipal Pool and Del Norte Park Splash Pad using the City of
Burbank Price agreement; and

2. Confirm the Finance Department/Purchasing Officer's findings that the purchase and
delivery of water chemicals through the City of Burbank purchasing agreement satisfies
West Covina's bid process as stated in the West Covina Municipal Code-Chapter2,

It is recommended that the City Council accept the recommendation of the Community and

Kaufman.
Mayor Toma stated he would recuse from the vote on this item due to his employment with the
States Attorney General Office and oversight of nonprofit organizations.

amendments 16-02 and 16-04/16-05 and include interested parties on the lists with information

It is recommended that the City Council:

2. Appropriate a total of $30,000 in federal asset forfeiture funds from the fund balance of
Fund 117 into 117.31.3120.6120.

11) Ordinance Amending West Covina Municipal Code Regarding Removal of
Commissioners and Application Requirements
It is recommended that City Council introduce and give first reading to, and waive further
reading of the proposed Ordnance as it may be amended by the City Council action.
ORDINANCE NO. 2301 - AN ORDINANCE OF THE CITY OF WEST COVINA,
CALIFORNIA AMENDING SECTIONS 2-67 (d) AND 2-69 (e)(1) OF CHAPTER 2,
ARTICLE III, OF THE WEST COVINA MUNICIPAL CODE REGARDING REMOVAL
OF COMMISSIONERS
City Attorney Barlow presented the staff report.
Councilman Spence spoke in opposition to Councilmembers being able to remove a
Councilmember's appointee by a 415 th vote and that the appointing Councilmember be held
accountable to the public for any wrong doing of their appointee.
Lengthy Council discussion included 415 th vote a process for removal of a commissioner if
necessary, appointed commissioners represent the city and not their appointing Councilmember,
concern with verbal finding of harassment versus written finding, legality of requiring
commissioners to submit fingerprints, commissioners not employees and should not be held to same
provisions as employees, no criteria/standards or screening process in place for appointment to
commission, and clarity of failure to comply with the requirements of AB 1234.
Motion by Warshaw and seconded by Toma to introduce Ordinance No. 2301 amending Section
2-67(d) to include the following criteria for removal of a commissioner:
• misuse of city property
• falsifying city records
• a sustained finding of harassment or discrimination against any city employee or member
of the public on the basis of race, ancestry, ethnicity, national origin, religion, marital
status, sex, gender, gender identity, gender expression, sexual orientation, pregnancy,
disability, medical condition, military and veteran status, or any other unlawful basis.

And not accept the proposed revisions regarding failure to comply with the requirement of AB
1234, failure to file or falsify any Statement of Economic Interest and make no changes to Section
2-69(e)(1) requiring applicants to submit fingerprints and submit a completed 1-9.

Councilman Johnson stated he would support the amendments if the sustained finding of

12) Analysis or Various City/Successor Agency Owned Property
It is recornmended that the City Council provide direction to City staff
City Manager Freeland presented the staff report and a PowerPoint presentation which provided a
summary of a certain parcels owned by the City/Successor Agency [City Yard/former Chamber of
Commerce, vacant lot at Oak Knoll Drive and Holt Avenue, Gemini Development open space,
Plaza West Covina parking lots, Eastland Shopping Center parking lots, Lakes Office
Complex/Entertainment Center Parking lots ,and former BK.K properties], which the City Council
expressed interest of possible sale or development at the September 6, 2016 meeting.
Council discussion included seeking interest for the development or sale of the various properties,
Oak Knoll area not large enough for development and home to oak trees, receiving neighborhood

input for open space within residential area [Oak Knoll and Gemini open space], seeking sale of
parking lots and current status of the City Yard/Chamber property and BKK properties.
Mayor Pro Tern Warshaw requested himself from action pertaining to the Oak Knoll property due -
to the proximity of his residence.
Motion by Spence and seconded by Johnson to explore selling the various parking lots to the
surrounding businesses or interested parties and explore opportunities for park/commercial
development in the Gemini Development open space. Motion carried 5-0 by the following vote:

Mayor Toma recessed the City Council meeting at 8:41 p.m. to convene the Successor Agency
meeting. The City Council meeting reconvened at 8:48 p.m. with all members present.

COUNCILMAN MIKE SPENCE
14) Proposed Closure of Walnut Creek Bikeway
It is recommended that the City Council direct staff accordingly.
Council discussion included the history of the bikeway, the impact to the surrounding residents,
whether closure will alleviate the problems to the surrounding residents, agreement with County
and ability to close a portion of the bikeway, costs of installation of gates to close bikeway, and
whether the ownership of bikeway property is the City or the Los Angeles County Flood Control
District.. City Manager Freeland stated that the City will approach the County with the direction
of the City Council and if the County has any objection to the direction of the City Council, the
item will return to the City Council.
Motion by Johnson and seconded by Wu to close the section of Walnut Creek Bikeway between
California Avenue and Valinda Avenue to public access at a cost of $6,000 to install gates and close
the section and an annual cost of $3,000 to maintain the closed section. Motion carried 5-0 by the
following vote:

15) Impact of New Interstate 10 Sound Wall
It is recommended that City Council authorize City staff to reach out to businesses along
Interstate 10 to educate them on the sign standards and encourage them to apply for new
signage if desired.

Council discussion included why the City was able to get cutouts along the Interstate 10 sound
wall, the requirement of the California Department of Transportation (Caltrans) to reduce overall
sound quality by 10 decibels to achieve Federal requirements which allowed the elimination of
certain sections of the wall, and sound wall interfering with the signage of businesses and ability
of businesses to raise signage above the sound walls,
Motion by Spence and seconded by Wu to authorize staff to reach out to businesses along Interstate
10 to educate them on the sign standards and encourage them to apply for new signage if desired.

16) Evaluation of Homelessness in City Parks
It is recommended that the City Council provide staff direction.
Councilman Spence stated he brought this issue forth to evaluate what the .City can do to combat
the issue of homelessness in the parks.
Council discussion included enforcement of park operating hours, police enforcement, social issues
with homeless individuals in the parks and difficulty to procure services for the individuals, and
police bike patrolling after park closures,
Motion by Spence arid seconded by Johnson to bring back to the City Council further information
regarding enhanced police bike patrols of the parks and associated costs. Motion carried 5-0 by the

17) Senior Services Program Update
It is recommended that the City Council provide staff direction.
Community Services Director Bresiani presented the staff report.
Council discussion included Dial a Ride utilization and availability, complications with riders who
utilize Dial a Ride, enrollment in senior classes, quantifying senior involvement in programs and
events, expanding programs to the west side of the City, marketing programs, and streaming of
classes for participation of individuals from home.

Councilman Spence reported on his attendance at a meeting of the San Gabriel Valley Public
Affairs Network at which Secretary of State Alex Padilla spoke.
Mayor Pro Tern Warshaw reported on his attendance at the Los Angeles County Mayors meeting
in the City of Cudahy.

18) Request from Mayor James Toma Requesting the City Council's Consensus to Direct
Staff to Prepare a Report Regarding the Current Process for Approval of Liquor
Stores in the City of West Covina and Potential Alternatives
It is recommended that the City Council direct staff accordingly.
Mayor Toma expressed concern with the number of liquor stores in West Covina and the concerns
of the residents along the Walnut Creek bikeway and the close proximity to liquor stores and
requested a report regarding the approval process of liquor stores and alternatives.
Council discussion included whether a liquor store is a standalone liquor store or a market/place of
business which sells liquor. Councilman Spence stated his opposition to cities being involved with
the licensing of liquor stores.
Motion by Toma and seconded by Warshaw directing staff to prepare a report on the current process
for approval of liquor stores in West Covina and potential alternatives. Motion carried 4-1 by the
following vote:

19) Request from Mayor Pro Tern Corey Warshaw Requesting the City Council's
Consensus to Develop a Campaign Contribution Limitation Ordinance from
Contractors and Subcontractors of The City of West Covina
It is recommended that the City Council direct staff accordingly.
Mayor Pro Tern Warshaw expressed concerns with campaigns contributions from contractors doing
business with the City and requested to review what other cities are doing regarding contribution
restrictions from contractors and conduct a discussion of limiting contributions with businesses
holding large contracts. Councilman Spence spoke in opposition to limiting any campaign
contributions.
Motion by Warshaw and seconded by Wu to direct staff return with a report regarding restrictions
of campaign contribution by businesses holding large contracts with the City of West Covina.
Motion carried 4-1 by the following vote:
AYES: Johnson, Warshaw, Wu, Toma
NOES: Spence
ABSENT: None

20) Request from Councilman Lloyd Johnson Requesting the City Council's Consensus to
Direct Staff to Author a Support Letter Regarding H.R. 5936 Veterans Care
Agreement and West Los Angeles Leasing Act of 2016
it is recommended that the City Council direct staff accordingly.
Councilman Johnson presented a brief overview.
Motion by Johnson and seconded by Spence to direct staff to author a support letter regarding H.R.
5936 Veterans Care Agreement and West Cos Angeles Leasing Act of 2016. Motion carried 5-0
by the following vote:
AYES: Johnson, Spence, Warshaw, Wu, Toma
NOES: None

21) Request from Councilman Tony Wu Requesting the City Council's Consensus to
Direct City Staff to Prepare a Report Reviewing the City's Policy on Issuance of City
Commendations and Consideration to Modernize the Design of Current
Commendations.

Motion by Wu and seconded by Spence to prepare a report to review the City's policy on the
issuance of City Commendations and Certificates and to develop a more modern design of the
current Commendation and Certificate. Motion carried 5-0 by the following vote:

CITY COUNCIL COMMENTS
Mayor Pro Tern requested to agendize a discussion of the City's process for the City Council to
agendize an item for City Council consideration and to include process used by other cities.
Councilman Johnson thanked the City Council on behalf of resident John Solis for his plaque for
his work on the City of West Covina's Veteran Memorial Wall.
Mayor Tonaa announced the Pumpkin Run 5k and lk fun run to be held on Saturday, October 10,
2016 at Cortez Park Senior Center and Red Ribbon Rally event to be held October 29, 2016 at West
Covina High School.
