By an affirmative vote of 5-0 on a motion by Spence and second by Johnson, direction was given to the City Manager to notify the school district that the City would not be pursuing use of the property. There was no other reportable action taken. CHANGES TO THE AGENDA City Manager Freeland stated that there were no changes. PRESENTATIONS Mayor Toma called forward Dr. Barbara Dickerson representing Congresswoman Grace Napotitan°, Margaret Duenez representing the East Valley Community Health Center, and Ester Ybarra Bryant parent of a suicide victim and each spoke on suicide prevention and where to get assistance, Mayor Toma presented each with a proclamation recognizing September 2016 as Suicide Prevention Month. 2 Tuesday September 20, 2016 Mayor Toma along with Community Services Director Bresciani presented Certificates of Recognitions to the West Covina Girls All-Star softball team who recently won the Amateur Softball Association Fast Pitch Girls 18 and under Western National Championship. Mayor Toma called forward resident and West Covina Improvement Association member Carolyn Arndt and presented her with a Certificate of Recognition for being named one of three Community Service Volunteers of the Year. Mayor Tama recognized Athens Services, Norm Reeves Honda Superstore, The Colony at the Lakes, Suburban Water Systems and the Greater West Covina Business Association for their sponsorships for the 2016 West Covina Summer Concerts in the Park. Mayor Toma along with Police Chief Faulkner introduced new West Covina Police Officers Joshua Volasgis, Erik Cuellar, Joseph Surdam, and Stephanie Waidley. Mayor Toma along with Police Chief Faulkner recognized this year's National Police Canine Association's K-9 Apprehension of the Year Award recipient, West Covina K-9 Officer Jessie Miller and K-9 Rocky. Mayor Tama introduced Robert Cruz, representing the Southern California Gas Company, who gave a presentation about the need for conservation efforts regarding natural gas consumption and an update on the progress made by South California Gas since the 2015 Aliso Canyon Gas Leak. ORAL COMMUNICATIONS - Five (5) minutes per speaker Nickolas Lewis, West Covina resident and elected City Clerk, stated his support for the expansion of Cameron Park, and expressed concern with the proposed duties of the City Treasurer's proposed increase of the elected City Treasurer stipend. Jim Grivich, West Covina resident, addressed an informal survey he conducted in the community regarding the proposed ordinance concerning marijuana dispensaries and medical/recreational marijuana in the city. Jerri Potras, West Covina resident, also addressed the informal survey of the community regarding marijuana and the proposed ordinance. Fredrick Sykes, West Covina resident, addressed concerns with the agendized request to study homelessness in the parks. Gary Gileno, West Covina resident, addressed the City's lack of transparency with many agenda items being discussed late in the evening when attendance is low and expressed concerns with the Tuesday September 20, 2016 League of California Cities proposed resolution to be voted on by member cities at the armual business meeting to be held in October 2016 and in support of concealed carry permits. Daniel Luevanos, ambassador to One Legacy/Donate Life, addressed transplants and tissue donations, registration opportunities and provided an update of their recent activities. Steve Gresham, MKL Industries, spoke in support of medical marijuana and the revenue opportunities available and marijuana as an alternative source of medicine. Lisa Mayo, West Covina resident, thanked the City Council for their support and participation at her recent event bring awareness to anti-bullying and domestic violence awareness and expressed her opposition to marijuana dispensaries. William Elliott, West Covina resident, spoke in opposition to marijuana dispensaries in the City and in opposition to gun restrictions. Juan Reinoso, West Covina resident, stated that there is no transparency within the City and addressed the graffiti removal services contract. Bruce Leinbach, West Covina resident, addressed the importance of the City Treasure position and in opposition to the marijuana dispensaries. City Attorney Barlow addressed speakers concerns with the graffiti removal contract. CITY ATTORNEY'S OFFICE I) Termination of Wireless Lease Agreement for Shadow Oak Park with Verizon Wireless It is recommended that the City Council authorize the City Manager to send notice to Verizon declaring immediate termination of the communication site lease agreement for property at Shadow Oak Park for failure of condition precedent. Approve the list of consultant to be used for Environmental Consulting Services for three years ending September 30, 2019 that includes DUDEK, Ultra Systems, PSOMAS, Michael Baker International, Terry Hayes (TAHA), and Rincon Consulting, Inc.; and 2. Upon submittal of a development application, authorize the City Manager to execute agreements up to $75,000 to complete environmental services for a development project. This item was pulled from the Consent Calendar by Councilman Spence for clarification on the prequalification process. Planning Director Anderson provided a brief overview of the proposal and clarified that each consultant on the prequalified list would receive a Request for Proposal (RFP) upon receipt of a development proposal application and stated that by utilizing a limited size list with the top scoring firms that submitted Requests for Qualifications (RFQ), there would be a potential savings of time for the processing of the environmental documents. Council discussion included concerns that not all the firms that responded to the RFQ, and qualified, will be allowed to submit bids for environmental consulting services, criteria used to rate the submitted RFQ's, and goal to expedite review process, Motion by Warshaw and seconded by Johnson to approve as presented. Approve a purchase order agreement with Frontier Ford of Santa Clara totaling $389,589.82, from accounts 160.80.7008.7170, 361.15.1520.6417, 117.31.3120.7170, and 117.31.3130.7170. This item was pulled from the Consent Calendar by Councilman Wu who requested further information on the cost of the vehicles. Police Chief Faulkner provided a brief overview of the bid process utilized. Motion by Wu and seconded by Warshaw to approve as piesented. - Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Warshaw, Wu, Toma NOES: None ABSENT: None END OF CONSENT CALENDAR HEARINGS PUBLIC HEARINGS 10) Code Amendment No. 15-03 Temporary Use of Vehicle Storage Ordinance General Exemption It is recommended that the City Council introduce and give first reading to the following ordinance: ORDINANCE NO. 2300 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING CODE AMENDMENT NO. 15-03, RELATED TO THE OFFSITE STORAGE OF VEHCILES BY AUTOMOBILE DEALERSHIPS Mayor Toma introduced the Public Hearing matter, Assistant City Clerk Conde verified proper legal notice was given and Mayor Toma opened the Public Hearing. Planning Director Anderson presented the staff report and a PowerPoint presentation. Council question included what zoning the proposed temporary storage would be in, and Planning Director Anderson responded it would be in commercial zone. Mayor Toma opened the Public Testimony period. With no one wishing to speak, Mayor Toma closed the Public Testimony period. Tuesday September 20, 2016 Council discussion included time frame for temporary storage and requests for extensions, how ordinance will help eliminate the illegal temporary storage in vacant office building parking lots or private lots, and opportunity to utilize City owned parking lots, Motion by Warshaw and seconded by Toma to approve as presented. Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Warshaw, Wu, Toma NOES: None ABSENT: None DEPARTMENTAL REGULAR MATTERS CITY ATTORNEY'S OFFICE 11) Urgency Ordinance regarding Marijuana Cultivation and Prohibition of Commercial Marijuana Activity - Categorical Exemption It is recommended that the City Council introduce, give first reading arid adopt the following urgency ordinance allowing limited indoor cultivation of recreational and medical marijuana, and prohibiting commercial marijuana activity, to be effective if the Adult Use of Marijuana Act is approved by voters at the November 8, 2016, election as follows: ORDINANCE NO. 2299 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, REPEALING AND REPLACING DIVISION 27, SECTIONS 26-685.9100 - 26-685.9300 ("MEDICAL MARIJUANA DISPENSARIES") AND AMENDING DIVISION 28, SECTIONS 26-685.10000 - 26.685.10300 ("MARIJUANA CULTIVATION") OF CHAPTER 26 ("ZONING") OF ARTICLE 12 ("SPECIAL REGULATION FOR UNIQUE USES") RELATING TO CULTIVATION OF MARIJUANA AND CERTAIN MARIJUANA RELATED USES City Attorney Barlow presented the staff report. Council discussion included age restriction of those allowed to cultivate for recreational purposes, ability for the City to reasonably regulate if persons under 21 reside in the residence, proof of necessity for cultivation for personal medical use, removing the proposed restriction of the right to indoor cultivation where persons of under 21 reside if a person over 21 requires the cultivation for medical purposes, inability to provide proof that person under 21 is a resident of the household and enforcement issues. Motion by Toma and seconded by Warshaw to approve Urgency Ordinance No. 2299 as presented. Motion carried 4-1 by the following vote: AYES: Johnson, Warshaw, Wu, Toma NOES: Spence 9 Tuesday September 20, 2016 ABSENT: None CITY MANAGER'S OFFICE 12) 2016 League of California Cities - Vision Zero/Toward Zero Resolution It is recommended that the City Council discuss and provide direction regarding voting at the League of California Cities annual business meeting on Resolution No. 1 - Vision Zero/Toward Zero Deaths. Deputy City Manager Minnich presented the staff report. Council comments included support of the League of California Cities (League) resolution and the need for safer streets and previous League resolutions brought back to Council for implementation within the City. Councilman Spence spoke in opposition to the resolution. Motion by Toma and seconded by Warshaw to approve as presented. Motion carried 4-1 by the following vote: AYES: Johnson, Warshaw, Wu, Toma NOES: Spence - ABSENT: None 13) Authorization to Purchase Property to Expand Cameron Park It is recommended that the City Council take the following actions: 1. Authorize the City Manager to execute the documents necessary for the purchase of 707 South Lark Ellen Avenue, for the expansion of Cameron Park, at a cost not to exceed $900,000; and 2. Make the necessary appropriations and fund transfers as outlined in the Fiscal Impact section of this staff report to facilitate the purchase; and 3. Authorize the City Manager to enter into an agreement with Ms. Imelda Sandoval, for the City to lease 707 South Lark Ellen to Ms. Sandoval, for six months, with the ability to extend on a month-to-month basis thereafter, at the discretion of the City. Motion carried 5-0 by the following vote: AYES: Johnson, Spence, Warshaw, Wu, Tonta NOES: None ABSENT: None 10 Tuesday September 20, 2016 FINANCE DEPARTMENT 14) Adoption of City Treasurer Duties and Responsibilities It is recommended that the City Council introduce and give first reading to the following ordinance: ORDINANCE NO. 2298 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CHAPTER 2 (ADMINISTRATION), ARTICLE IV (OFFICERS), DIVISION 4 (CITY TREASURER) OF THE WEST COVINA MUNICIPAL CODE City Manager Freeland stated Council direction at the previous meeting was to introduce the proposed ordinance to incorporate the duties being performed by the City Treasurer into the Municipal Code and to return with a resolution to increase the City Treasurer stipend, however, the stipend of the City Treasurer cannot be increased by resolution but only by ordinance. Therefore, tonight's proposed ordinance included an increase in the stipend along with the City Treasurer duties and will require the Council to reintroduce Ordinance No. 2298 due to the added changes. Motion by Johnson and seconded by Toma to introduce Ordinance No. 2298 as presented. Councilman Spence requested to include language that the elected City Treasurer cannot hold an employee position within the City. Council discussion ensued regarding State law and whether accepting a position in the City during an elected term would deem the person vacating their elected seat. Motion by Spence and seconded by Warshaw to amend the proposed ordinance and remove the verbiage to increase the stipend of the City Treasurer from the proposed ordinance. Motion to amend failed 2-3 by the following vote: AYES: Spence, Warshaw NOES: Johnson, Wu, Toma ABSENT: None Motion by Johnson and seconded by Toma to introduce Ordinance No. 2298 as presented. Motion carried 4-1 by the following vote: AYES: Johnson, Warshaw, Wu, Toma NOES: Spence ABSENT: None SUCCESSOR AGENCY Mayor Toma recessed the City Council meeting at 9:58 p.m. to convene the Successor Agency meeting. The City Council meeting reconvened at 10:00 pm. with all members present. 11 Tuesday September 20, 2016 MAYORJCOUNCILMEMBERS REPORTS COUNCILMAN MIKE SPENCE 15) Council Policy on Concealed Weapons Permits It is recommended that the City Council discuss and direct staff accordingly. Councilman Spence expressed concerns with the proposed resolution and requested to remove several whereas in the resolution due to the Police Chief not having the authority to impose restrictions in West Covina since he does not have the authority to issue Carry Concealed Weapons (CCW) permits [West Covina Police Chief delegated his authority to issue CCWs to the Los Angeles County Sheriff] and opposed to an applicant requiring a psychological evaluation. Council discussed that the County Sheriff has the authority to issue CCWs in West Covina due to the West Covina Police Chief relinquishing his authority to do so, therefore, the resolution will not have any impact or effect policy in West Covina, returning with a rewritten resolution or approving with rewrites, states law, defining good cause, the second amendment, and need for a psychological test for CCW applicants. Motion by Spence and seconded by Johnson to adopt Resolution No. 2016-78 with the following changes: • Removal of the third, fourth, and seventh whereas sections • Changing the fifth whereas to read "...the City Council recognized that the State of California has imposed..." and not the City of West Covina Police Chief has imposed • Limit Section 1 to only language stating good cause is the need or desire to defend one's family, business or self. Motion by Warshaw and seconded bylohnson to approve Resolution 2016-78 as amended. Motion carried 3-2 by the following vote: AYES: Johnson, Spence, Wu NOES: Warshaw, Torna ABSENT: None COUNCILMAN TONY WU 16) Establish a Sister-City Relationship with the City of Nantou, Taiwan It is recommended that the City Council direct staff accordingly. Councilman Wu expressed his desire to establish a sister city relationship with the City of Nantou, Taiwan stating it will also help promote West Covina. 12 Tuesday September 20, 2016 Council discussion included the need for community involvement and sponsorships to make a sister city relationship successful, city costs involved with a sister city, donations to the Community Services Foundation to help support, city staff time utilized, and community interest. Motion by Wu and seconded by Johnson to send an invitation to the Mayor ofNantou City, Taiwan, to visit West Covina in 2017, with the hope to establish sister-city relations between the two cities. Councilman Spence reported on his attendance to the Contract Cities conference held on Catalina Island. CITY COUNCIL REQUESTS FOR REPORTS, STUDIES OR INVESTIGATION (Per City of West Covina Standing Rules 4f- Requests for reports, studies, or investigations that are not readily available must be placed on the City Council/Community Development Commission agenda as items of business and must be approved by a majority of the City Council/Community Development Commission.) Motion by Spence and seconded by Wu to provide a report on senior services provided in the City.
