Mr. Freeland also reported that the two presentations including the "Check Presentation by West Covina Improvement Association for Veterans' Memorial" and "Certificate of Recognition for Outstanding Community Service" would be rescheduled.. PRESENTATIONS Recognition of West Covina Police Department Explorers Presentation of the 2016 Healthy Play Action Grant Award ORAL COMMUNICATIONS - Five (5) minutes per speaker Fredrick Sykes, West Covina resident, spoke in favor of Agenda Item No. 6 regarding the Opposition of Senate Bill 876 (Homelessness) and also spoke on his concern of smoking in public parks. 2 Ben Wong, West Covina resident, spoke on his concerns regarding Agenda Item No. 14 pertaining to an election recount ordinance and past election vote recounts conducted by the County of Los Angeles Register Recorders Office. William Elliott, West Covina resident and member of the Concealed Carry Weapon (CCW) group, commented on the posting of a video on a previous City Council meeting and also spoke on his support in favor of Concealed Weapons Permits. Keith Reeves, La Verne resident, commented on the topic of CCW permits and expressed his support in the issuances of these permits. Carolyn Arndt, West Covina resident, voiced her concern regarding a past City Councilmember. Forrest Wilkins, West Covina resident, spoke in favor of audits. Daniel Luevanos, member of One Legacy/Donate Life, spoke on his support in organ donations. Richard Hopkins, Board Member of the East San Gabriel Valley Coalition for the Homeless, spoke on the Coalition and the services provided to the homeless. Bruce Leinbach, West Covina resident, gave recommendations to improve the sound system and hearing devices for the Council Chambers. James Gardner, Rowland Heights resident, spoke in favor of the East San Gabriel Valley Coalition for the Homeless. Colleen Rozatti, West Covina resident and President of the West Covina Beautiful group, commented on the various upcoming event brought forth by West Covina Beautiful. City Manager Freeland responded to speakers concerns and comments. CONSENT CALENDAR APPROVAL OF MEETING MINUTES (receive & file) 1) January 12, 2016 Joint City Council/Planning Commission Special Meeting Minutes General Plan Update A motion was made by Councilman Spence and seconded by Mayor Pro Tern Warshaw to receive and file the meeting minutes presented. Motion carried by a vote of 5-0. AYES: Johnson, Spence, Warshaw, Wu, Toma NOES: None ABSENT: None ORDINANCES FOR ADOPTION 3) An Ordinance Adding Sections 15-63 through 15-72 to Article III (Fireworks) of Chapter 15 (Miscellaneous Provisions Relating to Public Health and Safety) of the West Covina Municipal Code Imposing Penalties for the Improper Use of Fireworks This ordinance was introduced at the West Covina City Council meeting of March 1, 2016. The purpose of Ordinance No. 2294 is to add sections to Article III (Fireworks) of Chapter 15 of the West Covina Municipal Code establishing administrative citations with fines for the discharge or storage of fireworks within City limits. The ordinance will take effect 30 days after its adoption on March 15, 2016. It is recommended that the City Council waive further reading and adopt the following ordinance: ORDINANCE NO. 2294 - ADDING SECTIONS 15-63 THROUGH 15-72 TO ARTICLE III (FIREWORKS) OF C1 APTER 15 (MISCELLANEOUS PROVISIONS RELATING TO PUBLIC HEALTH AND SAFETY) OF THE WEST COVINA MUNICIPAL CODE IMPOSING PENALTIES FOR THE IMPROPER USE OF FIREWORKS This item was pulled from the Consent Calendar by Councilman Spence for further discussion. Councilman Spence spoke on the broadness of the ordinance and asked to table the item in order to receive more information. Mayor Pro Tent Warshaw requested to have ordinance amended to the original ordinance. A motion was made by Mayor Pro Tern Warshaw and seconded by Mayor Toma to waive further reading and adopt Ordinance No. 2294. Motion carried by a vote of 4-1 with Councilman Spence in opposition. AYES: Johnson, Warshaw, Wu, Toma NOES: Spence ABSENT: None 4 COMMUNITY SERVICES DEPARTMENT 4) Approval of Joint Use Agreement with the West Covina Unified School District for Parking It is recommended that the City Council approve the five (5) year Joint Use Agreement for parking with the West Covina Unified School District (WCUSD). This item was pulled from the Consent Calendar by Mayor Toma for filrther discussion. Community Services Director Nikole Bresciani provided more information on the item. A motion was made by Mayor Toma and seconded by Councilman Johnson to approve the five (5) year Joint Use Agreement for parking with the West Covina Unified School District (WCUSD). A motion was made by Councilman Spence and seconded by Mayor Pro Tern Warshaw to approve the request from the West Covina Rose Float Committee Foundation (WCRFF) for City Staff to prepare a Request for Proposal (RFP) for design and development of Heritage Park improvements. A motion was made by Councilman Spence and seconded by Mayor Pro Tem Warshaw to oppose Senate Bill - 876 (Homelessness). Motion carried by a vote of 5-0. AYES: Johnson, Spence, Warshaw, Wu, Toma NOES: None ABSENT: None 5 FINANCE DEPARTMENT 7) FY 15/16 Budget Amendments It is recommended that the City Council approve the proposed FY 15/16 Budget Amendments: 1.) Approve the closing of the Self Insurance - Uninsured Loss Fund to the Self -Insurance General/Auto Liability Fund and the required budget amendments to accomplish this; and 2.) Appropriate fund balance in the amount of $220,000 to Patrol Full Time Salaries (Acct# 110.31.3120.5110) for the FY 15/16 retro portion of the previously approved POA Contract Amendment; and 3.) Appropriate fiord balance of $25,000 for Professional Services (Acct# 110. 11. 1120.6120) for a Citizen Survey. A motion was made by Councilman Spence and seconded by Mayor Pro Tern Warshaw to approve the aforementioned recommendation. Motion carried by a vote of 5-0. AYES: Johnson, Spence, Warshaw, Wu, Toma NOES: None ABSENT: None FIRE DEPARTMENT S) Authorized Agent for Office of Emergency Services Grants It is recommended the City Council adopt the following resolution: RESOLUTION NO. 2016-22 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING THE CITY MANAGER, FINANCE DIRECTOR, AND/OR THE FIRE CHIEF TO ENTER AND EXECUTE THE APPLICATIONS AND DOCUMENTS, AS THE AUTHORIZED AGENT, FOR ALL PRE AND POST DISASTER FUNDING A motion was made by Councilman Spence and seconded by Mayor Pro Tem Warshaw to adopt Resolution No. 2016-22. Approve the following list of vendors to be used for the supply of emergency medical supplies and medications for three years ending June 30, 2019: Life -Assist, Inc., Bound Tree Medical, LLC, and Midwest Medical Supply Company, LLC; and 2.) Authorize the City Manager to execute purchase orders with Life -Assist, Inc., Bound Tree Medical, LLC, and Midwest Medical Supply Company, LLC. This item was pulled from the Consent Calendar at the request of City Manager Freeland in order to update the City Council on the project. City Councilmembers gave comments on the item. A motion was made by Councilman Johnson and seconded by Councilman Wu to amend the current ordinance which provides for reimbursement of recount costs whenever the vote separation between the winning vote getter and the losing vote getter is one-half of one percent of ballots cast, or less to one fourlh of one percent of ballots cast, or less. Motion carried by a vote of 4-1 with Mayor Pro Tern Warshaw in opposition. City Councilmembers and City Manager gave comments on this matter. A motion was made by Councilman Wu and seconded by Councilman Spence to instruct City staff to prepare a report on the procedure and plan for surveying property and hillsides in the City of West Covina regarding brush removal and weed abatement. Councilman Wu spoke on the City moving forward with internship program. Mayor Toma congratulated the South Hills girls' soccer team on their winnings and also the Edgewood High School Decathlon team. Mr. Toma also commented on the upcoming event of the Cherry Blossom Festival. Councilman Spence inquired on the grand opening of Blaze Pizza.
