City Attorney Kimberly Hall Barlow announced Closed Session would continue after the
conclusion of the Council Meeting and that Council gave direction to the items which were
discussed during Closed Session and no reportable action was taken.

City Manager Chris Freeland announced the following changes:

ORAL COMMUNICATIONS - Five (5) minutes per speaker
Herb Redholtz, West Covina resident, spoke on the incident that occurred at the Subway
restaurant pertaining to the abandoned baby. Mr. Redholtz commended the individuals who
assisted in rescuing the baby and requested that the City Council recognize these individuals for
their efforts at a future Council meeting.
Dana Sykes, West Covina resident, spoke on her opposition of Agenda Item No. 16 — Council
Policy on Concealed Weapons Permits.
Alfred Williams, West Covina resident, expressed his opposition of Agenda Item N. 16 — Council
Policy on Concealed Weapons Permits.
Theresa, Alvarez, West Covina resident, spoke on Agenda Item No. 3 — January 20, 2016 Traffic
Committee Meeting Minutes and indicated her concerns pertaining to the west side of the
intersection of Amar Road and Shadow Oak Drive.
Cory Ellenson, Glendora School Board Member, introduced himself and his wife, Natalia
Ellenson, and shared that he will be running for State Assembly for the 48°i District.
William Elliot, West Covina resident and member of the Concealed Carry West Covina group,
spoke on his support in favor of Concealed Weapons Permits.
Trudy Saltmarsh, West Covina resident, stated her opposition of Agenda Item No. 16 — Council
Policy on Concealed Weapons Permits.

Phil Kaufman, West Covina resident, shared that the determination of who is entitled to a
Concealed Weapons Permit should be left to the Federal Government.
Steve Bennett, West Covina resident, spoke in support of Agenda Item No. 16 — Council Policy
on Concealed Weapons Permits.
City Council and City Staff comments made following Oral Communications:
• City Attorney Hall Barlow announced that with respect to the Sue Williams lawsuit,
correspondence and the dismissal relating to the case was located indicating that both
parties agreed to pay their own attorney fees with the dismissal of the case.
• Councilman Spence requested to have the Subway employees and customers who
rescued the abandoned baby recognized at a Council meeting. Councilman Spence also
shared that the City practices the Safe Surrender Law and that any child under the age of
3 can be taken to any of the City's fire stations and also Queen of the Valley Hospital
without no questions asked.

It is recommended that the City Council approve the proposed FY 15-16 Budget
Amendments:
1.) Appropriate revenue in the amount of $29,217.78 to the Used Oil Block Grant Fund
(Aect#149.41.4521) and expenditures in the amount of $1,500 to Other Contractual
Services (Acct# 149.41.4180.6120) and $1,480.78 to Community Awareness (Acct#
149.41.4180.6167) for the Cycle 5 Used Oil Block Grant Program; and
2.) Appropriate revenue in the amount of $103,617.51 to the C.R.V./Recycling Grant
Fund (Acct# 158.41.4521) and expenditures in the amount of $73,637.51 to Community
Awareness (Acct# 158.41.4180.6167) for the Recycling Grant Program; and
3.) Appropriate revenue in the amount of $67,013 to the Transportation Development Act
(TDA) Fund (AccO 128.41.4521) for monies allocated to the City for applicable projects;
and
4.) Appropriate expenditures in the amount of $10,000 from Proposition A funds to CIP
Miscellaneous (Acct#121.80.7003.7900) and establish the project # 16045; and
5.) Establish Project No. 16044 and appropriate a total of $52,740 ($47,945.64 plus 10%
contingencies) from the Capital Projects Fund reserves into Acct# 160.80.7010.7900 to
fund the repairs.

9) Approve Professional Services Agreement with Fuel Solutions, Inc. for the Design of
Compressed Natural Gas Facility Upgrades at the City Yard
It is recommended that the City Council take the following actions:
1.) Establish City Project No. 16038 for the design and construction of Compressed
Natural Gas (CNG) Facility Upgrades; and
2.) Close Project No. BP13301 and move the remaining funds in the amount of
$129,650.20 from Project No. BPI3301 (Acct# 119.83.8300.7900) to Project No. 16038
(Acct# 119.80.7001.7500); and
3.) Accept the South Coast Air Quality Management District (SCAQMD) Mobile Source
Air Pollution Reduction Review Committee (MSRC) grant in the amount of $300,000 and
Air Quality Management District (AQMD) Clean Fuels (CF) grant in the amount of
$200,000 for the design and construction of the project. Appropriate $500,000 to revenue
Acct# 119.41.4521 and $500,000 to expenditure Acct# 119.80.7001.7500; and
4.) Authorize the City Manager to execute a professional services agreement with Fuel
Solutions, Inc. for and amount not to exceed $49,131 for the design of CNG Facility
Upgrades at the City Yard; and
5.) Appropriate $70,349.80 in AB2766 (Fund 119) unappropriated funds to City Project
No. 16038 (Acct# 119.80.7001.7500) for the project.

Faithful Performance Cash Deposit in the amount of $105,000.

1.) Surplus and waive the public auction for unit T249, a 1977 Wenger Show Mobile, as it
is being sold to the City of Azusa for $1.00; and
2.) Authorize the sale of surplus vehicles and equipment listed below by the public auction
company, US Auctions in accordance with Section 2-316 of the West Covina Municipal
Code.

It is recommended that the City Council take the following actions:

Recorder; and
3.) Authorize release of retention in the amount of about $24,744.50 thirty-five (35) days
after recordation of the Notice of Completion.

OF WEST COVINA, CALIFORNIA, APPROVING CODE AMENDMENT NO. 15-01,
RELATED TO WATER EFFICIENT LANDSCAPING
Planning Director Jeff Anderson gave a report on Public Hearing Item No. 14.
Mayor Toma opened the public hearing and asked for any public comments. After seeing
no one wishing to make any public comments, Mayor Toma closed the public hearing
including any further public comments.
Mayor Toma asked for Councilmember comments.
After a discussion between Councilmembers and City Staff, a motion was made by
Councilman Spence and seconded by Mayor Pro Tem Warshaw to introduce and give first
reading of Ordinance No. 2292 regarding Code Amendment No. 15-01. Motion was
carried by a vote of 5-0.

ORDINANCE NO. 2293 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING ARTICLE II OF CHAPTER 25 OF
THE WEST COVINA MUNICIPAL CODE RELATED TO VEHICLES FOR HIRE
City Attorney Hall Barlow gave the report on Departmental Regular Matters Item No. 15.
Councilman Spence requested to have a moratorium put in place pertaining to
transportation network companies (TNC's) until a final decision is made in the court
system.
After a discussion between Council and City Staff, a motion was made by Councilman
Spence and seconded by Mayor Toma to agendize a moratorium for Council approval on
transportation network companies (TNC's) to a future Council meeting agenda and
introduce and give first reading of Ordinance No. 2293 regarding amending Article II of
Chapter 25 of the West Covina Municipal Code related to vehicles for hire. Motion was
carried by a vote of 5-0.

16) Council Policy on Concealed Weapons Permits
It is recommended that the City Council discuss and direct staff accordingly.
City Attorney Hall Barlow gave an overview on Departmental Regular Matters Item No.
16.
After a discussion between Council and City Staff, a motion was made by Councilman
Spence and seconded by Councilman Johnson to adopt a policy on Carry Concealed
Weapons (CCW's) permits that shows good cause and the standards for training that are
included in the State Law. Motion was carried by a vote of 3-2 with Mayor Pro Tern
Warshaw and Mayor Toma in opposition.

City Manager Freeland asked the Council for clarification on "good cause." Councilman
Spence indicated that "good cause" includes protecting ones family, business, sell=defense

A motion was made by Councilman Wu and seconded by Councilman Spence to adopt
Resolution No. 2016-16. Motion was carried by a vote of 5-0.

19) Federal Aviation Administration Flight Path Changes for Local Airports and
Associated Impacts

It is recommended that the City Council take the following actions:
1.) Forward a letter to the Federal Aviation Administration (FAA) expressing the City of
West Covina's frustration with the lack of transparency and noticing of cities of the
proposed flight changes; and
2.) Direct City staff to prepare letters of support for:
-I-iR 3965-FAA Community Accountability Act of 2015; and
-HR 3384-Quiet Communities Act of 2015.
City Manager Freeland gave a report on Mayor/Councilmember Reports Item No. 19.
A motion was made by Councilman Spence and seconded by Mayor Pro Tem Warshaw to
approve the aforementioned actions relating to the Federal Aviation Administration Flight
Path Changes for Local Airports and Associated Impacts. Motion was carried by a vote
of 5-0.

20) Request from Councilman Tony Wu Requesting the City Council's Consensus to
Reconsider the Number of Future Hotel Rooms Being Considered in the General
Plan Update
It is recommended that the City Council direct staff accordingly.

CITY COUNCIL COMMENTS
Councilman Wu wished all a happy lunar New Year and commended and thanked City Manager
Freeland and Human Resources Director Bokosky along with the Police Officers Association
(POA) during the negotiation of their contract.
Councilman Spence thanked City Staff for the courtesy notices that were on the agenda.
Councilman Spence requested two "Mother-May-I's" to be agendized for the next Council
meeting regarding reviewing the City's "Safe Surrender" program and reviewing the City's
campaign finance ordinance.
Councilman Johnson requested to have a "Mother -May -I" agendized for the next Council meeting
to review the City's election recount policy.
Mayor Toma spoke on his participation as a judge in an oratory contest for the West Covina
Unified School District and also congratulated Edgewood High School for coming in 2"d place in
the County's Academic Decathlon. Mayor Toma also congratulated West Covina High School
alumni, Leaner Moreno, for coming in 13d' place in the Olympic Marathon Trials.
ADJOURNMENT
Mayor Toma recessed the City Council meeting to the Closed Session meeting at 10:02 p.m. in
memory of Marianne Wrede.
