Garvey Avenue, West Covina. ROLL CALL Mayor Pro Tern Sykes Councilmembers Spence, Toma, Warshaw Absent: Mayor Herfert Others Present: Chung, Lee, S. Owens, C. Cardinale PUBLIC COMMENT ON ITEMS ON THE AGENDA — Closed Session CLOSED SESSION Recess OPEN SESSION No comments offered. Mayor Pro Tem Sykes commej to discuss the following matter: CONFERENCE WITH LEGAL LITIGATION the closed session at 5:36 p.m. — EXISTING City of West Covina v. Hassen Imports Partnership, et al. Los Angeles Superior Court Case No. KC048157 In re Hassen Imports Partnership, Debtor, United States Bankruptcy Cou Case No. 2:11-bk-42068-ER In re Hassen Imports Partnership; Debtor, United States District Court Case No. 2:13-cv-07532-CAS i Mayor Pro Tern Sykes concluded the closed session discussion at 6:05 p.m. and recessed the Special Meeting to convene the City Council open session portion off the meeting in the City Council chambers. Mayor Pro Tern Sykes called to ,order the open session portion of the special meeting at 6:19 p.m. ROLL CALL Mayor Pro Tern Sykes Councilmembers Spence, Toma, Warshaw Absent: Mayor Herfert j REPORTING OUT FROM CLOSED SESSION Deputy City Attorney Chris Cardinale reported the following: The City Council/Successor Agency convened into closed session to discuss the following ;item. All members were present with the exception of Mayor Herfert. Items on the City Council'/Successor Agency agendas: Conference with Legal Counsel Existing Litigation — City of West Covina v. Hassen Imports Partnership, et al.; Los Angeles Superior Court Case No. KC048157; In re Hassen Imports Partnership, Debtor, United States Bankruptcy Court Case No. 2:11-bk-42068-ER; In re Hassen Imports Partnership, Debtor, United States District Court Case No. 2:13-cv-07532-CAS — Special Meeting of May 28, 2014 Briefing was given by special counsel, direction was given by the Council/Agency, no final action was taken. PLEDGE OF ALLEGIANCE Councilmember Toma PUBLIC COMMENT ON ITEMS ON THE AGENDA Councilmember Warshaw requested Mayor Pro Tern allow each speakers to be allowed to raise their hand, if during the study session they would like to speak at that time. Mayor Pro Tern Sykes stated he would accept five minute public comments from speakers who submitted a speaker card and would allow only two minutes for any speaker wishing to speak during the study session. John Shewmaker John Shewmaker, West Covina resident, addressed legal services fees in the budget but lack of monies for police or fire services; how much will the city recoup from the Auto Mall litigation; expressed concerns with various areas of the proposed budget. City Manager Chung responded to several of Mr. Shewmaker's concerns. 2014-2015 FISCAL YEAR BUDGET — STUDY SESSION 2014-2015 Fiscal Year Proposed Operating and Capital Improvement Program Budget Study Session City Manager Chung made introductory comments of the proposed budget stating that this is an opportunity to both educate and discuss the proposed budget with the public and City Council. A second study session has ben scheduled for June 9 and adoption of the budget is scheduled for June 17. Chung proceeded to stated that the proposed budget is a balanced budget in which revenues exceed expenditures. Chung highlighted several major budget changes. Director of Finance and Administrative Services McKay presented a brief overview of a combined fund summary; and a PowerPoint presentation of the General Fund fund balance, revenues and expenditures. McKay stated the City has a balance budget with a surplus of $3240.00. Ms. McKay proceeded to provide a detailed presentation through the budget by individual department, beginning with line item discussion of Revenues, and following by the Police Department. Philip Moreno Philip Moreno, West Covina resident made public comments on public safety budget. Recess Mayor Pro Tern Sykes called for a recess at 837 p.m. The City Council reconvened the City Council meeting at 8:50 p.m. with all members present. McKay continued a detailed presentation of the departments in the following order: City Manager/Community Development Commission, City Clerk's Office, Planning Department, Fire Department and Community Services Department. 2 Special Meeting of May 28, 2014 Lloyd Johnson Lloyd Johnson commented on the cost discussion during the Community Service s Several areas of discussion requiring follow up are licenses and permits detailed in the Revenue section, Business License Processing fee, Ambulance Subscription Program, Transfer amounts within the Revenue section, International Council of Shopping Centers budget, cost for stand-alone election, impact fee study, ambulance billing services, and canopies for the Community Services Department. ADJOURNMENT At 10:01 p.m. motion by Warshaw and seconded by Toma to adjourn the meeting to Monday, June 9 at 6:00 p.m. Motion carried 4-0.
