02-18-2014 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL February 18, 2014 Mayor Herfert called to order the regular meeting of the West Covina City Council at 7:07 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Pastor Samuel Martinez Christian Faith Church PLEDGE OF ALLEGIANCE Councilmember Corey Warshaw ROLL CALL Mayor Herfert, Mayor Pro Tern Sykes, Councilmembers Spence, Toma, Warshaw REPORTING OUT FROM CLOSED SESSION Deputy City Attorney Scott Nichols reported the following: Prior to convening into closed session, all items on the City Council and the Successor Agency agendas were announced for inclusion in the closed session discussion with all members present except Mayor Herfert. Items on the City Council/Successor Agency agendas: Conference with Legal Counsel — Existing Litigation — City of West Covina vs. Hassen Imports Partnership, et al.; Los Angeles Superior Court Case No. KC048157; In re Hassen Imports Partnership, Debtor, United States Bankruptcy Court Case No. 2:11-bk-42068-ER; In re Hassen Imports Partnership, Debtor, United States District Court Case No. 2:13-cv-07532-CAS — Deputy City Attorney Nichols reported that Special Counsel gave an extensive briefing to the City Council and Successor Agency discussing various options; the City Council and Successor Agency gave direction to Special Counsel with no reportable action taken. CHANGES TO THE AGENDA No changes. ORAL COMMUNICATIONS Vickie Scheliga/Anita Ron Vickie Scheliga/Anita Ron, West Covina residents, spoke on the upcoming Night on the Town event on May 21. Ms. Ron spoke on the Lions Club and their activities. George Ogden George Ogden, West Covina resident, assisted by Don Gisolvich and Lloyd Johnson, presented the City a check for deposit to the West Covina Veterans Memorial Fund. Lloyd Johnson Lloyd Johnson, West Covina resident, inquired as to whether the City will continue to spend tax dollars on the Hassen Imports Partnership litigation and addressed litigation costs regarding the Civic Center Project and requested a. response on the continued costs of this litigation. Planning Department 4) Grant Application for Sustainable Communities Planning Grant Planning Grant Application and Incentives Recommendation is that the City Council take the following actions: 1. Adopt the following resolution authorizing the City to apply for a California Strategic Growth Council "Sustainable Communities Planning Grant and Incentives Program" grant. Resolution RESOLUTION NO. — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE SUSTAINABLE COMMUNITIES PLANNING GRANT AND INCENTIVES PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) 2. Appropriate funds in the amount of $12,300 from the General Plan Maintenance Fund (550-22222) to the Planning Department Other Contractual Services account (11.21.2110.6120) to allow for payment to the consultant. The following item was removed from Consent Calendar . for separate consideration. Councilmember Reports 5) Lions Club Sponsorship Co -Sponsorship of Lions Club Night on the Town Event Recommendation is that the City Council take the following actions: 1. Approve the co-sponsorship of the West Covina Lions Club 2014 Night on the Town event on May 21, 2014; and 2. Authorize the City Manager to waive the Temporary Use Permit and Street Banner Permit fees for the West Covina Lions Club Night on the Town event. CONSENT CALENDAR ACTION Motion by Warshaw and seconded by Sykes to approve all items listed on the Consent Calendar as presented except Item #4 Grant Application for Sustainable Communities Planning Grant and Incentives Program and Item #5 Co -Sponsorship of Lions Club Night on the Town event. Motion carried by 5 — 0. Item #4 Grant Application for Sustainable Communities Planning Grant and Incentives Program Councilmember Spence stated he is in support of updating the General Plan but would not support some of the State mandated standards. Mayor Herfert inquired about the consultant fee being encompassed in the grant amount and City Manager Chung responded. Motion carried 3-2 (No — Herfert, Spence) Item #S Co -Sponsorship of Lions Club Night on the Town Event Councilmember Spence inquired as to the fee waivers on non- profit events and how non-profit organizations know about and how they qualify for fee waivers. Following discussion regarding fee waivers, City Manager Chung offered to have all fee waiver requests come before Council for their review. Councilmember Spence wanted to ensure there was consistency for all non -profits. Motion Motion by Spence and seconded by Toma to: 1. Approve the co-sponsorship of the West Covina Lions Club 2014 Night on the Town event on May 21, 2014; and 2. Authorize the City Manager to waive the Temporary Use Permit and Street Banner Permit fees for the West Covina Lions Club Night on the Town event. Motion carried by 5 — 0. DEPARTMENTAL REGULAR MATTERS City Manager's Office 6) Council Goals and Objectives City Council Goals and Objectives City Manager Chung presented a brief report on the purpose of bringing this item before Council to obtain input from Council on their goals and objectives through a facilitator. Councilmembers had questions on the process the facilitator would use. Ray Patchett of Patchett & Associates gave a brief presentation of the process he recommends; meeting one on one with each councilmember to collect their ideas and vision for the next 5 years and then preparing the results for Council's review and approval. Staff is recommending Ray Patchett of Patchett & Associates. Motion Motion by Herfert and seconded by Warshaw to: 1. Direct staff to coordinate a study session to discuss and set City Council goals and objectives; and 2. Approve a consultant agreement with Ray Patchett with Patchett & Associates for consulting services to facilitate and support a City Council goal setting study session process not to exceed $8,500. Motion carried by 5 — 0. 3 City Council Minutes of February 18, 2014 SUCCESSOR AGENCY Mayor Herfert recessed the City Council meeting to convene the Successor Agency meeting at 7:30 p.m. The City Council reconvened at 7:37 p.m. with all members present. MAYOR/COUNCILMEMBER REPORTS No reports scheduled. Councilmember Spence thanked staff for their efforts put into r recent grand opening of new businesses. CITY COUNCIL REQUESTS FOR REPORTS, STUDIES OR INVESTIGATIONS Councilmember Corey Warshaw Request from Councilmember Corey Warshaw Requesting City 7) Council's Consensus to Instruct City Staff to Prepare a Report on Costs to Televise Meetings on the Costs to Televise City Council " and Planning Commission WCCT Meetings on WCCT Councilmember Warshaw provided the purpose of his request to look into live televising of the City Council and Planning Commission meetings that would also provide transparency and access to those residents with inadequate or without any internet service. He anticipates the cost to be manageable. Councilmember Herfert would like to see the number of Charter television subscribers and Charter Internet subscribers and franchise fee breakdown for each to determine the percentage of Charter subscribers Councilmember Spence added if possible, to know what percentage do not have any Internet and inquired as to streaming the current Internet feed directly to Charter Cable television Councilmember Sykes expressed support for this overdue matter. Motion Motion by Toma and seconded by Sykes to bring back a report on the costs to televise City Council and Planning Commission meetings on WCCT.
