11-05-2013 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL November 5, 2013 Mayor Sanderson called to order the regular meeting of the West Covina City Council at 7:11 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Arnold Alvarez-Glasman City Attorney PLEDGE OF ALLEGIANCE Councilmember Andrew McIntyre ROLL CALL Mayor Sanderson, Mayor Pro Tern Herfert (arrived 7:16 p.m.) Councilmembers McIntyre, Sotelo, Sykes REPORTING OUT FROM CLOSED SESSION City Attorney Alvarez-Glasman reported the following: Prior to convening into closed session, all items on the City Council and Successor Agency agendas were announced for inclusion in the closed session discussion with all five members present. Items on.the City Council and Successor Agency agenda: Public Employee Performance Evaluation —Direction was provided to the City Attorney's office to prepare the necessary and essential amendments to the appointment agreement of the City Manager which was approved by consensus vote 4 - 1 (Sykes — No); and further stated the matter would be brought back to the November 19, 2013 Council meeting. Conference with Legal Counsel — Existing Litigation — CGM Development, Inc. v. 'City of West Covina - The City Attorney's office did not participate in this matter as there was a declaration of a request for conflict by the plaintiff; Special Counsel was present who then reported to City Attorney Alvarez- Glasman that a resolution of this matter and settlement agreement has been authorized unanimously by the. five members of the City Council and which is in the process of being executed and will be available upon execution. Conference with Legal Counsel — Existing Litigation - City of West Covina v. Hassen Imports Partnership, et al.; Los Angeles Superior Court Case No. KC048157; In re Hassen Imports Partnership, Debtor, United States Bankruptcy Court Case No. 2:11 — bk-42068-ER; In 're Hassen Imports Partnership, Debtor, United States District Court Case No. 2:13-vc-07532-CAS — This matter corresponds to the Successor Agency item and includes various issues of Hassen Imports Partnership. A U.S. District Court Judge has authorized a Stay of any sale of any of these properties consistent with the request of the City subject to the posting of a bond; that City Council and Successor Agency authorized the posting of said bond with four members approving and City Councilmember/Successor Agency Board Member Sykes opposing. Public Employee Release — Two items were heard with direction provided to the City Manager's office with respect to ' those items but there was no final action taken and nothing further to report. CHANGES TO THE AGENDA No changes. City Council Minutes of November 5, 2013 ORAL COMMUNICATIONS Mark Smith Mark Smith, West Covina resident, addressed the privilege of voting and urged all who are able to vote and exercise their right. Lola Finley Lola Finley, West Covina resident, thanked the police staff for participating in neighborhood watch meeting and commended the police department. Lloyd Johnson Lloyd Johnson, West Covina resident, addressed his support of veterans and addressed a Councilmember's comment regarding veterans. George Ogden George Ogden, West Covina resident, reminded the audience of the upcoming Veteran's Day event on Monday, Nov. 11 at City Hall; addressed the privilege of voting; addressed a previous speaker's comment regarding the sacrifice made by veterans; and thanked Council for their efforts to do what's best for the City. Juan Mavridis Juan Mavridis, West Covina resident, spoke in support of reducing the speed limit on Vine Avenue. Request City Initiated Annual Intersection Collision Rate Report for the Year 2012 (Informational). Traffic Committee Recommendations: That signal ahead signs and pavement markings be installed on all approaches of the Merced Avenue and Valinda Avenue intersection. That the secondary vehicular signal faces on all approaches of the Merced Avenue and Valinda Avenue intersection be upgraded from 8 inches to 12 inches diameter. 2 City Council Minutes of November 5, 2013 That staff monitor the intersections of Shadow Oak Drive at Stephanie Drive and Service Avenue at West Covina Parkway. Councilmember/Commissioner Reports 5) Vine Avenue Speed Limits Reconsideration Vine Avenue Speed Limit Recommendation is that the City Council reconsider this item and introduce the following ordinance reducing the speed limit on Vine Avenue; from Glendora Avenue to Citrus Street, from 35 miles - per -hour to 25 miles -per -hour. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING SECTION 22-131 OF THE WEST COVINA MUNICIPAL CODE RELATING TO INCREASES OF STATE LAW MAXIMUM SPEEDS (VINE AVENUE) CONSENT CALENDAR ACTION Motion by Herfert and seconded by Sotelo to approve all items listed on the Consent Calendar as presented. Motion carried by 5 — 0. CITY COUNCIL REQUESTS FOR REPORTS, STUDIES OR INVESTIGATION Councilmember Fredrick Sykes Request from Councilmember Fredrick Sykes' Requesting the City Council to Instruct City Staff to Prepare a Resolution Supporting 6) Anti -Bullying Efforts in our Community and Schools Anti -Bullying Councilmember Sykes gave his reasons for requesting the City Council's support to look into any measures the City can implement to support anti -bullying in the community. Motion Motion by Sykes and seconded by Herfert to approve bringing back a report to a future Council meeting on Anti -Bullying efforts for Council consideration. Motion carried by 5 — 0. CITY COUNCIL COMMENTS Councilmember McIntyre announced the Annual . Field of Valor Event on November 10, 2013 from 9:30 — 11:30 a.m. at Sierra Vista Middle School. Councilmember Sykes urged candidates to have their campaign signs removed and asked for a resolution to prevent enacting or making major decisions prior to the installation of the new councilmembers.
