10-15-2013 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL October 15, 2013 Mayor Sanderson called to order the regular meeting of the West Covina City Council at 7:02 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Police Officer Jeff Mosley West Covina Police PLEDGE OF ALLEGIANCE Councilmember Fredrick Sykes ROLL CALL Mayor Sanderson, Mayor Pro Tern Herfert, Councilmembers McIntyre, Sotelo, Sykes REPORTING OUT FROM CLOSED SESSION Deputy City Attorney Cardinale reported the following: Prior to convening into closed session, all items on the City Council agenda were announced for inclusion in the closed session discussion. Items on the City Council agenda: Conference with Legal Counsel — Existing Litigation — City of Alhambra and 46 Other Cities v County of Los Angeles — Direction was provided to settle this litigation with no settlement agreement finalized and there is no further action to report. Public Employment Performance Evaluation — City Manager — Direction was given to prepare an agreement with no reportable final action taken. CHANGES TO THE AGENDA No changes. PRESENTATIONS Mayor Sanderson called forward Interim Fire Chief Rick Genovese to recognize Firefighter Randy Isaman for 28 years of service to the West Covina Fire Department. Mayor Sanderson called forward David Alfaro and Don Fernald with West Covina Rotary to receive a proclamation declaring October 23 — 31, 2013 as Red Ribbon Week. Mayor Sanderson, assisted by Youth Pony Manager John Buhac, presented certificates of recognition to West Covina Youth Pony Pinto 8 Red All Stars to recognize their achievement as the Pinto 8 All -Stars Section Champions for 2013. Mayor Sanderson, assisted by Little League Mets Manager Frank Valles, presented certificates of recognition to West Covina American Little League Mets to recognize their achievement as the City Major Tournament Champions for 2013. Mayor Sanderson, assisted by Little League Angels Manager Danny Hernandez, presented certificates of recognition to West Covina American Little League Angels to recognize their achievement as the City Minor Tournament Champions for 2013. Recess Mayor Sanderson recessed the City Council meeting at 7:36 p.m. City Council Minutes of October 15, 2013 The City Council reconvened their meeting at 7:47 p.m. with all members present. ORAL COMMUNICATIONS Lola Finley Lola Finley, West Covina resident, inquired about obtaining a draft of the rental ordinance before it is presented. Norma Ingram Norma Ingram, West Covina resident, spoke in support of the Centenarian program requesting her mother be recognized Juan Reinoso Juan Reinoso, West Covina resident, addressed a previous Public Record Request for graffiti records which were denied as documents were deemed investigative records and addressed current contractor and Graffiti Tracker records. Jeremy Infranca Jeremy Infranca, West Covina resident, addressed the approval of local development projects in his neighborhood; the conditions of City parks; the lack of accessibility of elected officials and the lack of responsiveness to the community by the Council. Shirley Buchanan Shirley Buchanan, West Covina resident, requested to see the P & L statements that are addressed within the 10/21/2003 1" Amendment to the Maintenance and Operating Agreement for Big League Dreams and quoted a statement in the agreement that would allow public access to the statements. Herb Redholtz Herb Redholtz, West Covina resident, reminded residents to vote at the upcoming election and praised Public Works Director Shannon Yauchzee and the contractor who worked on the intersection improvements of Amar and Azusa and requested a review of the;traffic signals synchronization. Corey Warshaw Corey Warshaw, West Covina resident, congratulated Council for bringing forward the addition of two new officers and asked why more officers are not being considered if the City has reserves as stated in campaign material. Dora Gomez Dora Gomez, appearing on behalf of Project 29:11, detailed the activities of Project 29:11 and thanked Councilmember Robert Sotelo for his assistance. Forrest Wilkens Forrest Wilkens, West Covina resident, addressed comments made by Mayor Sanderson at a previous meeting directed toward him regarding children; addressed Mayor Sanderson's previous motion to sell parkland at Shakespeare Park. Cameron Saylor Cameron Saylor, West Covina resident, spoke on the usage of Maverick Field by the Community. Lloyd Johnson Lloyd Johnson, West Covina resident, stated it is a Brown Act violation for the City Attorney to prevent anyone from asking a question of a councilmember during oral communications; complimented those involved with the campaign for not using negative campaign material during this election cycle; complimented the current graffiti contractor; addressed the recent free services provided to the community suggesting that it be more readily publicized. Deputy City Attorney Cardinale addressed the Brown Act section governing oral communications in response to a speaker's comment. 2 City Council Minutes of October 15, 2013 John Shewmaker John Shewmaker, West Covina resident, addressed several comments made by previous speakers including Maverick Park and City reserves; addressed developers involving campaign financing. Marcia Hazelton Marcia Hazelton, West Covina resident, spoke in support of the Centenarian Recognition Program requesting the Council to recognize all 100 year -old residents. Trudy Saltmarsh Trudy Saltmarsh, West Covina resident, addressed the rental ordinance that has been brought forward and questioned why Ms. Finlay cannot be involved in the process and spoke in support of the ordinance; addressed publishing information to address graffiti and inquired of traffic signal synchronization at Amar and Azusa. City Manager Chung addressed speakers' concerns brought forth regarding a rental ordinance; addressed the question on public records act requests for information on the graffiti program. Deputy City Attorney Cardinale addressed a speaker's request for financial information on Big League Dreams Park. Councilmembers addressed and responded to concerns brought forth by speakers. CONSENT CALENDAR Approval of Meeting Minutes (receive & file) 1) Minutes Special City Council Meeting Minutes of August 20, 2013 Regular City Council Meeting Minutes of August 20, 2013 Special City Council Meeting Minutes of September 11, 2013 Ordinance for Adoption Code Amendment No. 13-06 Density Bonus Standards 2) Ordinance for Adoption Recommendation is that the City Council adopt the following ordinance: Ordinance No. 2250 ORDINANCE NO. 2250 — AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CHAPTER 26 (ZONING) OF THE WEST COVINA MUNICIPAL CODE RELATED TO DENSITY BONUS STANDARDS IN THE LOW- AND MODERATE - INCOME AND SENIOR CITIZEN HOUSING SECTION OF THE MUNICIPAL CODE This item was pulled off the Consent Calendar for separate consideration. City Manager's Office 3) Centenarian Recognition Program Centenarian Recognition Recommendation is that the City Council formally approve the implementation of the Centenarian Recognition Program. Public Works Update on Security Measures for the Paseo behind the 1800 Block 4) Paseo improvements at of Woodgate Drive Woodgate Drive Recommendation is that the City Council receive and file this report. CONSENT CALENDAR ACTION Motion by Herfert and seconded by Sotelo to approve all items listed on the Consent Calendar as presented except Item 3 — Centenarian Recognition Program. Motion carried by 5 - 0 3 City Council Minutes of October 15, 2013 Item 3 Centenarian Recognition Program Councilmember Sykes elaborated on his request to formalize a centenarian recognition program for the City of West Covina. Motion Motion by Sykes and seconded by McIntyre to approve the implementation of a formal Centenarian Recognition Program. Motion carried by 5 — 0. MAYOR/COUNCILMEMBER REPORTS Councilmember Robert Sotelo Approval of Two Additional Police Officer Positions within the 5) Adding Police Officers for FY General Fund Police Department Operating Budget for Fiscal Year 2013/14 2013-14 City Manager Chung provided a brief staff report on the addition of two police officers through savings and additional revenues. Following Council comments, Chung addressed in more detail, how the City will fund the additional officers. Motion Motion by Sotelo and seconded by McIntyre to approve the addition of two police officers. Motion carried by 4 — 1 (Sykes - No). CITY COUNCIL COMMENTS Mayor Pro Tern Herfert requested that the Vine Street speed limit issue be brought back to the next agenda for reconsideration. ADJOURNMENT Motion by Herfert and seconded to adjourn the Council meeting at 9:26 p.m. in memory of Helena Redondo, former City Commissioner. Motion carried by 5 - 0.
