REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
August 20, 2013
Mayor Sanderson called to order the regular meeting of the West Covina City Council at 7:00 p.m. in
the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

REPORTING OUT FROM CLOSED SESSION
City Attorney Alvarez-Glasman reported the following:
Prior to convening into closed session, all items on the City
Council agenda were announced for inclusion in the closed session
discussion.
Items on the City Council agenda:
Conference with Legal Counsel — Existing Litigation —
CGM Development, Inc. v. City of West Covina — City Council
provided direction to City Manager to retain legal counsel for the
City due to the conflict of interest that exists for the City
Attorney's office. Motion carried 4 — 0 (Sanderson absent).
Conference with Legal Counsel — Existing Litigation — The
People of the State of California v. Sears Development Co., et al.,
including the City of West Covina — City Council and Successor
Agency, by a vote of 4 — 0 (Sanderson absent), authorized
defending the action filed by the State of California for
condemnation matters involving Sears Development and a number
of parties,. including the City of West Covina and the Successor
Agency with the City Attorney's office representing the City, and
Glenn Block serving as counsel for the Successor Agency.
Public Employee Performance Evaluation — City Manager
- Alvarez-Glasman reported that all five councilmembers were
present, no final action was taken, direction was provided to staff
and the matter will be brought back to a future date.

ORAL COMMUNICATIONS
John Hughes John Hughes, West Covina resident, thanked the Council for all
their support with the Muscular Dystrophy Association (MDA)
events. He introduced Annie Wondrie of the MDA who
announced upcoming events. Mr. Hughes also thanked Athens
Services, the Katherine Castucci Foundation, West Covina Police
and Fire, Monica Farias of Greater West Covina Business
Association and presented Mayor Sanderson with an award for the
City's support.
Leonor Carbajal Leonor Carbajal, West Covina resident, thanked the Council and
the City for their assistance regarding the burglaries at her home
and for the future improvements in the paseos.

Lola Finley Lola Finley, West Covina resident, thanked the Police Chief and
Public Works Director for the signs at the park; addressed the City
of Covina ordinance [rental inspection] and asked the city to
review it because it has been effective in Covina; and was grateful
for the City's efforts to look into this problem.
Jeffrey Weeks Jeffrey Weeks, West Covina resident, addressed his concern with
crime related to rental property owners and their tenants and
thanked the Council and staff for looking into the problem.
Trudy Saltmarsh Trudy Saltmarsh, West Covina resident, thanked the Police
Department for the increase in their presence in the area; addressed
concern over owners who do not monitor rental property and
tenants; and inquired about West Covina's allowance of affordable
housing and whether it is being monitored to prevent exceeding the
City's required allowance.
Dave Stewart . Dave Stewart, West Covina resident, reported on his own "bus
tour" of properties; addressed concern with fingerprinting
participants, in sports leagues; and addressed transparency
regarding development projects and issues.
George Ogden George Ogden, West Covina resident, spoke on the rules of
decorum for the public and thanked Chris Freeland for the food
trucks during City events.
Bruce Leinbach Bruce Leinbach, West Covina resident, expressed sympathy for
Councilmember McIntyre's recent ordeal; inquired about the
availability of hearing devices at meetings; and requested
improvement in videotaping speakers during oral communications.
James Toma James Toma, West Covina resident, addressed the ordinance on
the sale of civic center property and requested clarification on
language referring to rent or lease of property.
Lloyd Johnson Lloyd Johnson, West Covina resident, expressed well -wishes to
Councilmember McIntyre due to his ordeal; inquired about
Councilmembers' actions involving the development project at the
Civic Center and the pending lawsuit.
Phil Moreno Phil Moreno, West Covina resident, inquired about budgeting for
public safety equipment and had questions for two
councilmembers.
Lisa Mayo Lisa Mayo, representing West Covina Women's Club board,
requested assistance in offering scholarships to West Covina high
students through West Covina High School.
Shirley Leon Shirley Leon, West Covina resident, addressed pavement repairs;
speeding in her neighborhood; and requested police presence to
prevent home break-ins.
Irene Fleck Irene Fleck, West Covina resident, expressed concern about the
ordinance on the sale, lease or rent of Civic Center property and
requested clarification of public uses allowed and private party
leases and rentals.
Mayor Sanderson requested staff to respond to some of the
speakers'. questions and staff provided information.

Councilmember McIntyre addressed concerns regarding public
safety and crime in the neighborhoods and the impact of the State's
actions on West Covina and surrounding communities and the
need to find revenue sources to. increase public safety staffing and
not limit these resources through' City policy, as in limiting
revenue from City property rentals.

APPROVING FINAL MAP OF TRACT NO. 71960 LOCATED
AT 512 S. VALINDA AVENUE AND DIRECTING THE
RECORDATION THEREOF (WAVERLY GROUP)

Resolution Supporting the Efforts of the League of California Cities
and California Police Chief s Association to Discuss Public Safety
3) Realignment with the Governor and Legislature from a Local
Governor's Proposal on Prison . Municipal Law Enforcement Perspective
Overcrowding Recommendation is that the City Council adopt the following
resolution:
Resolution No. 2013-58 RESOLUTION NO. 2013-58 — A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA,
CALLING UPON THE GOVERNOR AND LEGISLATURE TO
ENTER INTO DISCUSSION WITH THE LEAGUE OF
CALIFORNIA CITIES AND CALIFORNIA POLICE CHIEFS'
ASSOCIATION REPRESENTATIVES TO IDENTIFY AND
ENACT STRATEGIES THAT WILL ENSURE THE SUCCESS
OF PUBLIC SAFETY REALIGNMENT FROM A LOCAL
MUNICIPAL LAW ENFORCEMENT PERSPECTIVE
CONSENT CALENDAR ACTION Motion by Herfert and seconded by Sykes to approve all items
listed on the Consent Calendar as presented.
Motion carried by 5 — 0.
Mayor Pro Tem Herfert requested Police Chief. LaCommare to
provide a brief report regarding the State's AB 109 bill.
Police Chief LaCommare addressed public safety and the
Governor's proposal to realign public safety responsibilities to the
County.
MAYOR/COUNCILMEMBER REPORTS
Councilmember Andrew McIntyre
Consideration of Adopting an Ordinance Requiring the Vote of the
Electorate Approving the Transaction Prior to the Sale, Lease, or
4) Rent of Civic Center Property to a Private Party
Civic Center Property Mayor Sanderson announced the matter and Councilmember
McIntyre explained that the intent of the ordinance is to address
the community concerns regarding the Civic Center project and
asked his colleagues for their support.

Ordinance No. 2249 ORDINANCE NO. 2249 —,AN ORDINANCE OF THE CITY

ADDING ARTICLE X — SECTION 2-500 REQUIRING THE
VOTE OF A MAJORITY OF WEST COVINA VOTERS IN
ORDER TO APPROVE ANY TRANSACTION INVOLVING
THE SALES, LEASE OR RENT TO A PRIVATE PARTY OF
PROPERTY LOCATED IN THE CIVIC CENTER OF WEST
COVINA, WHICH IS BORDERED BY WEST COVINA
PARKWAY, SUNSET AVENUE, AND GARVEY AVENUE
Motion carried by 5 — 0..
ADJOURNMENT Motion by Sotelo and seconded by Herfert to adjourn the meeting
at 8:10 p.m. in memory of his brother in-law, Juan Padilla.
