06-04-2013 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL June 4, 2013 Mayor Sanderson called to order the regular meeting of the West Covina -City Council at 7:19 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Minister Ellis Lewis, Sr. Church of Christ PLEDGE OF ALLEGIANCE Councilmember Sotelo ROLL CALL Mayor Sanderson, Mayor Pro Tem Herfert, Councilmembers McIntyre, Sotelo, Sykes REPORTING OUT FROM CLOSED SESSION City Attorney Alvarez-Glasman reported the following: Prior to convening into closed session, all items on the City Council agenda were announced for inclusion in the closed session discussion; all members of the City Council were present. Items on the City Council agenda: Conference with Legal Council — Anticipated Litigation, One Case — Direction was provided to the City Attorney's Office with no final action taken and nothing further to report. Conference with Legal Counsel — Existing Litigation — Johnson vs. City of West Covina — Direction was provided to the City Attorney's Office with Councilmember Sykes dissenting with the direction. There was no final action taken, and nothing further to report. PRESENTATIONS Mayor Sanderson called forward Minister Ellis Lewis of Church of Christ to present him a Certificate of Recognition for 40 years of service to the Community,, Mayor Sanderson called forward West Covina Police Chief Frank Wills, conveyed his numerous accomplishments as Chief of Police' for West Covina and presented him with a Resolution of Commendation and City Tile. . Mayor Pro Tem Herfert congratulated Reverend Lewis on his retirement, and service to the. community and made parting comments regarding Chief Wills and his dedication and devotion to the community and thanked him for protecting the residents. Mayor Sanderson thanked residents for their support of her and addressed her recent absence from events. CHANGES TO THE AGENDA . None. ORAL COMMUNICATIONS George Ogden George Ogden, West Covina resident, thanked the City for the Memorial Day service and the staff that participated in conducting the service and those in attendance; thanked retiring Police Chief for his service to the community. Carolyn Arndt Carolyn Arndt, West Covina resident and Chair of West Covina Improvement Association,. commented on a recent I Planning Commission meeting she attended and addressed the lack of discussion on issues and suggested a Blue Ribbon Committee to oversee the revision of the General Plan. City Council Minutes of June 4,'2013 Bruce Leinbach Bruce Leinbach, West Covina resident, thanked Chief Frank Wills fqr improvemn rits in the City and said he will be missed; commented on the new upgrade to the, camera system in the Council Chambers; addressed the development in South Hills which is the. subject of a moratorium. Phil Moreno Phil Moreno, West Covina resident, stated Michael Touhey should be replaced on the Oversight Board due to a conflict of interest; addressed the Department of Finance letter to the City regarding Oversight Board actions and requested_ answers to questions. Herb Redholtz Herb Redholtz, West Covina resident, thanked Chief Wills and his staff for many years of dedicated service to the City. Lloyd Johnson Lloyd Johnson, West Covina resident, thanked Chief Wills for his leadership and friendship to the community; thanked Councilmember Sykes for presiding over the Memorial Day event and expressed his disappointment that the Mayor was not in attendance at the event. Lee Knot Lee Knot, West Covina resident, requested the Council's support for the feasibility study for County Fire services. Alan Sams Alan Sams, Vice President of West Covina Firefighters Association and on behalf of the Firefighters, spoke in support of the feasibility study. John Shewmaker John Shewmaker, West Covina resident, addressed comments by Mayor Pro Te.m Herfert and the.City's financial and legal issues. Yvonne Hillman Yvonne, Hillman, West Covina resident, addressed parking by permit on Virginia Avenue and the overflow of cars from neighboring apartment complexes and Traffic Committee Minutes item regarding the parking issue, and congratulated Police Chief Wills. John Solis John Solis, West Covina resident, thanked war veteran Lloyd . Johnson for his service; addressed the safe disposal of unused medications and the "Safe Drug Drop -Off", program currently being utilized by the L.A. County Sheriff's Department suggesting the City implement the program; addressed the Fire Association's request for a Feasibility Study stating the Council needs to do what is best for the residents. Wen Wen Zhang Wen Weil Zhang, West Covina Library Manager, announced the Children's section of the Library is expanding;. announced upcoming Library events. Patrick McGowan Patrick McGowan, West Covina Firefighter's Association President, stated he was here to respond to questions regarding Item # 19 Feasibility Study for Los Angeles County Fire " Protection and Paramedic Services on the Agenda. Councilmember Sotelo requested that Item No. 5 — Traffic Committee Meeting Minutes of May 21, 2013 be pulled for separate consideration to address a speaker's concern. Mayor Sanderson proceeded to open the hearings. Public Works Director Shannon Yauchzee presented the staff report that will cover the three districts briefly explaining their history, their operation and . funding. Yauchzee reported that Maintenance Districts 4 and 6 are capped by Proposition 218 and cannot be increased without 'a majority vote of property owners in these districts. Funding in these districts will provide for ongoing maintenance and for CIP improvements for tree trimming and sidewalk repairs. He reported that staff is recommending a 2% increase in rates in District 7 which would amount to 22 cents per month per single family home that would help keep the reserve balance steady, allow for capital improvements in landscape and irrigation repairs and improvements and to ensure reserves for future repairs. Assistant City Clerk Rush confirmed that no written comments or objections had been received. . Mayor Sanderson opened the public testimony portion of the hearing and asked for public comments. With no one wishing to address City Council, Mayor Sanderson closed the public testimony portion of the hearing. Close testimony Motion Public Hearing Code Amendment No. 13-01 Pylon (Freestanding) Signs General Exemption Mayor Sanderson announced the public hearing matter and Assistant City Clerk Rush verified that proper legal notice had been given. Mayor Sanderson proceeded to open the hearing and Planning Director Jeff Anderson gave a brief summary of the staff report stating that in reviewing variances submitted to the City between 2007 and 2012, the Planning Commission found that the most frequent variance request was on pylon sign standards and determined that, it' would be appropriate to review the code standards to reduce the number of variance requests where possible. The Commission held study sessions and a public hearing and has finalized a code amendment with five code changes and revisions to the municipal code that allows for larger signs but which will not change the review process with the exception of Freeway Site Bonus that will now require a conditional use permit. .Mayor Sanderson proceeded to open the public testimony portion of the hearing and called for public testimony. There being no one wishing to address Council, Mayor Sanderson closed the public. testimony portion of the hearing. Motion by Sotelo and seconded by Herfert to introduce the following ordinance. Public Hearing Code Amendment No. 13-02 Vehicle Sales 16) General Exemption Vehicle Sales Mayor Sanderson announced the public hearing matter and Assistant City Clerk Rush verified that proper legal notice had been given. Mayor Sanderson proceeded to open the hearing and Planning Director Jeff Anderson presented the staff report on how the subject of. vehicle dealerships came to be reviewed and the discovery that the Mazda dealership on the west side of Citrus Street is not currently in a zone that allows for automobile dealerships. Therefore, staff has prepared a code amendment that allows vehicle sales in the C-2 zone and requires used car dealerships to obtain a conditional use permit to operate in order to allow the City to place conditions and establish standards on used car dealerships. The proposed amendments include changing the Code to allow auto sales in the C-2 zone and to. require a conditional use permit for used car sales. Councilmember McIntyre returned to the dais at 8:45 p.m. Public Hearing Urgency Ordinance Extending the Moratorium Prohibiting the Construction of Residential Structures on Vacant Properties in the South Hills Subdivision to Study Single -Family Development 17) Standards in the Residential Agricultural/Single Family Zone and Urgency Ordinance Providing a Progress Report on the Code Amendment Under Moratorium on Vacant Lots Consideration Mayor Sanderson announced the public hearing matter and Assistant City Clerk Rush verified that proper legal notice had been given. Mayor Sanderson proceeded to open the hearing and Planning Director Jeff Anderson began the presentation of the staff report by stating that an urgency moratorium had been established on May 7, 2013 by City Council on grading or construction of residential structures on 79 lots in the South Hills Subdivision and that this moratorium is due to expire in mid -June. Staff is recommending an extension of the moratorium for another 10 months, 15 days, until May 27, 2014, in order to allow City Council Minutes of June 4, 2013 staff" to evaluate current development standards due to concerns that conditions imposed in the 1990's are not to the level of standard that the City might require today. Anderson detailed the evaluation process and presented a timeline of the process. He then offered to answer questions. Open testimony Mayor Sanderson proceeded to open the public testimony portion of the hearing and called for public testimony in favor of the matter. In Favor John Solis, West Covina resident, inquired whether Mayor Pro Tem Herfert should legally recuse himself from this matter as he lives in the area. Mayor Pro Tern Herfert explained that he has checked with the Fair Political Practices Commission and it was determined that he does not have a conflict of interest in this matter. In Opposition City Attorney Alvarez-Glasman reported two correspondences were submitted to the City regarding this matter. One from Eric Sheck of Van Daele Homes dated 6/4/2013 asking to be excluded from the moratorium. And one from Gregory Weiler of Palmieri, Tyler, Wiener, Wilhelm & Waldron dated 6/4/2013 opposing the moratorium. Michael Van Daele, of Van Daele Homes, addressed his previous comments from a previous meeting and reiterated that his firm has been working with City staff to resolve any issues and asked, that Council give them time to continue working with staff as any stoppage of the development would be a hardship for his firm. Eric Scheck of Van Daele Homes, requested Council exclude his firm's project from the moratorium and detailed his firm's position to fulfill . their responsibilities to complete the project and the consequences of a delay to their timeline if the moratorium is imposed. He also described some of the changes made to their development to raise the standards to acceptable limits and asked for Council's consideration to exclude their project. Michael Van Daele, of, Van Daele Homes, addressed a comment from an earlier speaker who mentioned a lawsuit and affirmed that their firm is not a part of, or plans to be, part of a lawsuit. Close testimony There being no one else wishing to address Council, Mayor Sanderson closed the public testimony portion of the hearing. Council discussion Councilmember McIntyre expressed his concern that an extension of the moratorium of 10.5 months was too long and suggested a shorter period of time. City Manager Chung pointed to one of the alternatives to extend the moratorium for 90 days and allow Planning Commission to do a study session and provide a report back to City "Council and it would be up to Council to decide how to proceed. City Attorney Alvarez-Glasman added that 10 months is the maximum allowed by .law and the Council could adopt the ordinance for the moratorium with further direction within a selected timeframe to include periodic reports for Council's review to either adopt amendments to the code or stop the moratorium. Councilmember Sykes expressed concerns on the consequences of the moratorium and addressed other developments approved by Council. M City Council Minutes of June 4, 2013 Discussion continued and included the option to adopt the moratorium for the maximum length of time, but with the intent of the Planning department to conclude the review in a timely manner, to not take the full amount of time and to return in 90 days with a progress update. Motion Motion by McIntyre and seconded by Herfert to adopt the urgency ordinance to extend the moratorium for 10 1 /2 months with a stipulation that the Planning Department provide a report back to the City. Council in 90 days Ordinance No. 2245 ORDINANCE NO. 2245 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, EXTENDING A MORATORIUM FOR AN ADDITIONAL PERIOD OF TEN MONTHS. DEPARTMENTAL REGULAR MATTERS Public Works Councilmember Robert Sotelo 18) Consideration of Demolition.and Removal of the Galster Park Galster Park Restrooms Upper (Boys) Camp Restroom Building Councilmember Sotelo' expressed his reasons for asking that the facilities be removed. There was brief Council discussion with Public Works Director Yauchzee responding.to questions. Motion Motion by.Sotelo and seconded by Herfert to direct the Public Works Maintenance staff to demolish the upper camp restroom with City forces and continue to watch for grants to improve the facilities and trails. City Manager's Office 19) Feasibility Study for the Los Angeles County Fire Protection and County Fire Services Paramedic Services Community Services Director Chris Freeland presented the subject matter involving a letter received from the West Covina Firefighters Association requesting the City's consideration to authorize a Feasibility Study to be conducted by the Consolidated Fire Protection District of Los Angeles County (L.A. County Fire). He added that the Study is not a commitment by the City to transfer any duties to the County and then introduced West Covina Fire Fighters Association President Patrick McGowan to elaborate on their request. President McGowan detailed the reasons that the Firefighters Association is making this request that would benefit both the City and the Firefighters and how service to the community would also improve due to expanded resources along with savings that could also bring back eight sworn police officer positions that were cut from this year's budget. 10 City Council Minutes of June 4, 2013 Mayor Pro Tern Herfert and Councilmember Sotelo expressed their support for the study. _ Motion Motion by Sotelo and seconded. by Herfert to authorize the City Manager to contact L.A. AB1234 CONFERENCE AND MEETING REPORT Councilmember Sykes gave a brief report of the California Cities Association Conference he attended on May 16 — 19, 2013 and highlighted some of the economic issues discussed that are relevant to the City and region. CITY COUNCIL COMMENTS Mayor Pro Tern Herfert spoke on the financial difficulties the State has caused in California cities citing the manner in which the State seized funds that rightfully belong to the City through the elimination of redevelopment agencies'and then on a positive note, highlighted some of the new businesses opening up in West Covina such as Lucille's BBQ and several others. Councilmember Sykes thanked Minister Ellis Lewis, Sr. and Police Chief Wills for their outstanding service to the community. Councilmember Sotelo asked staff to look into funding sources and a timeline for adding police officers to the Police Department. Councilmember McIntyre added to Sotelo's comments and suggested to .begin outlining a plan for future implementation once the economy improves in the City.
