03-05-2013 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL March 5, 2013 Mayor Sanderson called to order the regular meeting of the West Covina City Council at 7:03 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Pastor Stephen Ichiriu PLEDGE OF ALLEGIANCE Councilmember Sykes Mayor Sanderson read a written statement prepared by Mayor Pro Tem Herfert which stated his retirement from Southern California Edison and that he will be traveling for the next few weeks and will not be in attendance at the March 5t" meeting. ROLL CALL Mayor Sanderson, Councilmembers McIntyre, Sotelo, Sykes Absent Councilmember Herfert Motion by Sanderson and seconded by Sotelo to excuse Mayor Pro Tem Herfert's absence. Motion carried 4-0. REPORTING OUT FROM CLOSED SESSION City Attorney Alvarez-Glasman reported the following: Prior to convening into closed session, all items on the City Council agenda were announced for inclusion in the closed session discussion; three members of the Council were present, Councilmembers McIntyre, Sotelo and Sykes. Items on the agenda: Conference with Legal Counsel — Existing Litigation — City of West Covina vs. Yeager Skanska, Inc. and Heinbuch Golf, LLC et. al — City Attorney Alvarez-Glasman reported that there was discussion on this matter with direction provided to Special Counsel by the City Council with no final action to report. CHANGES TO THE AGENDA None. City Manager Christopher Chung introduced Rick Genovese, Interim Fire Chief. ORAL COMMUNICATIONS Irene Fleck Irene Fleck, West Covina resident, thanked the City for their support and partnership with the recent Litfest event and announced upcoming Library events. Dana Sykes Dana Sykes, West Covina resident, announced Rowland Unified School District fund raiser FOR US for local students in need. Forrest Wilkens Forrest Wilkens, West Covina resident, addressed Mayor Pro Tem Herfert's question to Councilmember Sykes at the February 5t" Council meeting. Julie Shepherd Julie Sheppard, West Covina resident, addressed a comment made by Mayor Pro Tem Herfert at the February 5"' Council meeting. City Council Minutes of March 5, 2013 Lisa Mayo Lisa Mayo, West Covina resident, introduced herself to the Council stating she has submitted her application for a vacant commission seat. Shirley Buchanan Shirley Buchannan, West Covina resident, addressed the comment by Mayor Pro Tern Herfert at the February 5th Council meeting. Corey Warshaw Corey Warshaw, West Covina resident, addressed Item # 13 — Request from Councilmember Andrew McIntyre Requesting the City Council to Instruct City Staff to Prepare a Report on the Creation of a Program to Provide Incentives & Educate Landlords on the Importance of Maintaining Their Property — reporting that a program is already in place through the Police Department and proceeding with the current request is not a good use of time and resources. Mayor Sanderson responded to comments by speakers. Councilmember Sykes responded to comments by speakers. Motion carried by 4 — 0. PUBLIC HEARINGS Public Hearing Authorization to Draft the FY 2013-2014 Community Development Block Grant (CDBG) Action Plan Mayor Sanderson announced the hearing matter and Assistant City Clerk Rush verified that proper legal notice had been given. Mayor Sanderson then proceeded to open the hearing and Management Analyst Kelly McDonald provided a summary reporting that as a condition of receiving federal CDBG grant fiends, the City is required to prepare an annual Action Plan which details the intended use of the grant funds. The public hearing is required to provide the public an opportunity for citizen input and he further explained the development of the funding allocations and the reductions that required the City to reprioritize those allocations. Although the 2013-2014 funding has not been announced, HUD has advised the City to move forward with the process and roll over current priorities and amend them, if necessary, once allocations are known. Based on the outcome of this hearing, the staff will prepare and publish the draft action plan which will be available for a 30-day public review and comment period with a final draft presented on April 16, 2013 for Council approval. Public testimony Mayor Sanderson then proceeded to open the public testimony portion of the hearing and called for public comment. Close testimony There being no one wishing to address Council, Mayor Sanderson proceeded to close the public testimony portion of the hearing. Motion Motion by Sotelo and seconded by Sykes to direct staff to develop a draft FY 2013-2014 CDBG Action Plan, based on the needs and priorities identified in the staff report. Motion carried by 4- 0. DEPARTMENTAL REGULAR MATTERS Finance Department Exception to the 18-Day Wait Period to Hire Interim Finance 11) 180-Day Wait Period to Hire Director Mayor Sanderson introduced the subject matter and asked for Council's direction. Assistant City Clerk Rush presented: Resolution No. 2013-15 RESOLUTION NO. 2013-15 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING AN EXCEPTION TO THE 180-DAY WAIT PERIOD FOR EMPLOYMENT OF A RETIREE Motion Motion by McIntyre and seconded by Sykes to adopt the resolution. Motion carried by 4 - 0. SUCCESSOR AGENCY Mayor Sanderson recessed the Council meeting at 7:31 p.m. to convene the Successor Agency meeting. The City Council reconvened at 7:32 p.m. with all members present except Councilmember Herfert. 4 City Council Minutes of March 5, 2013 MAYOR/COUNCILMEMBER REPORTS Request from Mayor Shelley Sanderson 12) School Violence Programs City -Wide School Violence Training and Intervention Program Mayor Sanderson introduced the subject matter and West Covina Police Lieutenant Pat Benschop presented a report detailing the Police Department's efforts to devise programs to protect children in West Covina schools in response to the recent tragedy in Connecticut. Lt. Benschop detailed the Police Department's focus on three areas: Police Training and Campus Threat Assessments; Training of School Staff; and Reality Based Scenario Training, and explained how these areas will help all to work together to diminish the danger to students at school and thanked the Council for their support and for taking steps to address this important issue. Motion Motion by McIntyre and seconded by Sotelo to approve and support. the proactive efforts of the Police Department in addressing school violence thereby increasing the safety and security of children in West Covina schools. Motion carried by 4- 0. Councilmember Sykes expressed his support and would like to see a comprehensive study to address staffing levels and funding of public safety. CITY COUNCIL REQUESTS FOR REPORTS, STUDIES OR INVESTIGATIONS Request from Councilmember Andrew McIntyre Request from Councilmember Andrew McIntyre Requesting the 13) City Council to Instruct City Staff to Prepare a Report on the Private Property Maintenance Creation of a Program to Provide Incentives & Educate Landlords on the Importance of Maintaining Their Property Mayor Sanderson introduced the subject matter and Councilmember McIntyre explained his view of preferably providing reminders to property owners and felt it was not feasible to have one Code Enforcement officer cover inspections in the entire City. His concern was for the overall effect on property values as well as revenues and wanted to gather ideas from staff on. how to provide reminders to property owners on why maintaining their properties is beneficial for all. Council discussion ensued. Motion Motion by Sanderson and seconded by McIntyre to approve bringing back a report with ideas. Motion carried by 4 — 0. CITY COUNCIL COMMENTS Councilmember Sotelo made a request to have Council and department heads take a bus tour of the City and/or selected areas, to see the issues being raised by residents.
