WEST COVINA CITY COUNCIL

Mayor Pro Tern Herfert called to order the adjourned special meeting of the West Covina City Council
at 5:03 p.m. in the City Manager's Conference Room at City Hall, 1444 W. Garvey Avenue, West
Covina.

Councilmembers McIntyre, Sotelo, Sykes
Absent: Mayor Sanderson
Others Present: Chung, Lee, Alvarez-Glasman, D. King
City Attorney Alvarez-Glasman announced the one item for closed session discussion under existing
litigation, West Covina Improvement Association v. City of West Covina, et al.
PUBLIC COMMENT ON ITEMS ON THE AGENDA
Public Comments were heard on this item at the Tuesday Special
meeting held on February 5, 2013.
CLOSED SESSION Mayor Pro Tern Herfert commenced the closed session at 5:08
p.m. to discuss the following matter:
CONFERENCE WITH LEGAL COUNSEL —
EXISTING LITIGATION
Pursuant to Government Code §54956.9(a)
West Covina Improvement Association vs. City of West Covina, et al.
REPORTING OUT The City Attorney reported. the following:
The City Council by a vote of 3 — 1 (Sykes, no) approved
the City of West Covina filing an appeal from, the trail court
decision in the matter of West Covina Improvement Association v.
City of West Covina, et al.
ADJOURNMENT

The City Council further approved by a vote of 3-,1 (Sykes, no) to
retain the law firm of Squire Sanders and Owens in this matter and
they are to serve as lead counsel and to work in conjunction with
the City Attorney.
No further action was taken and there was nothing further to
report.
Mayor Pro Tem Herfert adjourned the meeting at 5:33 p.m.
