01-15-2013 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL January 15, 2013 Mayor Sanderson called to order the, regular meeting of the West Covina City Council 'at 7:03 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Officer Jeff Mosley West Covina Police Department ,PLEDGE OF ALLEGIANCE Councilmember Sykes ROLL CALL Mayor Sanderson, Mayor Pro Tern Herfert, Councilmembers Sotelo, Sykes REPORTING OUT FROM CLOSED SESSION Deputy City Attorney Gorman reported the following: Prior to convening into closed session, all items on the City Council and Successor Agency agendas were 'announced for inclusion in the closed session discussion; all members of the Council/Board were present except Mayor/Chairperson Sanderson. Items on the agenda: COUNCIL/SUCCESSOR AGENCY Conference with Legal Counsel - Existing Litigation -City. of West, Covina and City of West Covina Community Development Commission v. Lassen Imports Partnership, et at and related cross complaints and cases — Deputy City Attorney Gorman reported that a report was provided by Special Counsel to the Council and Successor Agency with no final action taken and nothing further to report. CITY COUNCIL Conference with Legal Counsel —.Existing Litigation - City of Alhambra, et. at v. County of Los Angeles —Gorman reported that a report was provided by the City Attorney's office with no final action taken and nothing further to report. Conference with Legal Counsel— Existing Litigation - West Covina Police Officers' Association v. City of West Covina — Gorman reported that a report was provided by the City Attorney's office on this litigation with no final action and nothing further to report. Conference with Legal Counsel — Anticipated Litigation — One case — Gorman reported that a report was provided by Staff to Council with no final action taken and nothing further to report. CHANGES TO THE AGENDA None. City Council Minutes of January 15, 2013 Shirley Buchannan Shirley Buchannan, West Covina resident, also addressed the passing of longtime resident Joanne Wilner and an previous Oversight Board item regarding a payback to the state of $12.5 million dollars. John Shewmaker John Shewmaker, West Covina resident, addressed the vacancy on the Council and the qualities needed of an appointee. Herb Redholtz Herb Redholtz, West Covina resident, addressed the closure of the Staples store at the Heights; reiterated his request for an update of the litigation between the City and the Hassen Imports dealerships. Gary Lawson Gary Lawson, West Covina resident, complimented Council on their appointment of Chris Chung as City Manager and expressed his confidence in his leadership which he has observed in working with him and the business community. Mayor Sanderson addressed the requests from speakers and asked that staff provide a response to each request. Authorize the purchase of reflective street name panels for 71 City intersections from JTB Supply Company for a total cost of $96,067.58 including sales tax and delivery. 2. Authorize the installation of reflective street name panes for 71 city intersections from PTM General Engineering Services for a total cost of $25,795. Traffic Committee Recommendation: That the City concur with the County's recommendation to install a marked school crosswalk and the placement of crossing guard, with the condition that the County fully fund the crossing guard program. IL Request: Guia Devera, West Covina Resident That a curve warning sign be installed on westbound Garvey Avenue northeast of Lang Avenue. 2 City Council Minutes of January 15, 2013 Traffic Committee Recommendation: That advance warning signs be installed on westbound Garvey Avenue northeast of Lang Avenue. HL Request: Gloria Hidalgo, West Covina Resident That parking on Phillips Avenue from Workman Avenue to Shamwood Street, Idahome Street from Phillips Avenue to the end of the street, and Shamwood Street from Phillips Avenue to the end of the street be restricted to permit only parking, Sunday through Saturday from 10:00 p.m. to 6:00 a.m. Traffic Committee Recommendations: That parking on Phillips Avenue from Workman Avenue to 235 N. Phillips Avenue be restricted to permit only . parking every day, Sunday through Saturday, from 10:00 p.m. to.6:00 a.m. That parking on Phillips Avenue from 235 N. Motion carried by 4 — 0. PUBLIC HEARINGS Public Hearing General Plan Amendment No. 12-01 Zone Change No. 12-01 6) Mitigated Negative Declaration of Environmental Impact 512 S. Valinda Ave. GPA 12-01 Applicant: Brandywine Homes Location: 512 S. Valinda Avenue (Immanuel First Lu& Mayor Sanderson announced the hearing matter and Assistant City Clerk Rush verified that proper legal notice had been given. Mayor Sanderson then proceeded to open the hearing and Planning Director Anderson presented the report providing the details of the project which is a 19-unit small lot single family subdivision on a portion of the property at 512 S. Valinda Avenue which is the location of the Immanuel First Lutheran Church. �I,, The property is located on the northeast corner of Service and Valinda Avenues. He then described in detail how the property would be subdivided into three parcels describing the project layout, design of the 2- story homes, circulation, guest parking, and protection of the privacy of single-family properties in the vicinity. Anderson also addressed the necessary changes in zoning and the General Plan. Council discussion Councilmember Herfert inquired about the open' space/play area and Park Funds. Anderson replied that the play area is basically open space and Park Development fees would be derived from the project. K City Council Minutes of January 15, 2013 Public testimony Mayor Sanderson then proceeded to open thepublic testimony portion of the hearing and called for public comments. In Favor Brad Whitehead of Brandywine Homes thanked the council for hearing the project and is looking forward to the project in the City and then offered to answer questions. CouncilmemberSotelo thanked the developer for their proactive consideration of surrounding neighbors in the area and making adjustments to minimize the project's impact on those properties.. Councilmember Sykes expressed concerns about, graffiti on the walls. Mr. Whitehead replied that they would be addressed in the CC& Rs through the Homeowners Association. Lloyd Johnson, West Covina resident, inquired about possible disputes arising at property lines. Planning Director Anderson replied that there are ' easements with easement rights that would grant access for any cleanup or problem resolution. Close testimony There being no one else wishing to address Council, Mayor Sanderson proceeded to close the public testimony portion of the hearing. Assistant City Clerk Rush presented: 2013-1 RESOLUTION NO. 2013-1 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFYING THE MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR GENERAL PLAN AMENDMENT NO. 12-01, ZONE CHANGE NO. 12-01, TENTATIVE PARCEL MAP NO. 71942 AND TENTATIVE TRACT MAP NO. 91960 PURSUANT TO THE! CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 1970, AS AMENDED 2013-2 RESOLUTION NO. 2013-2 — A RESOLUTION �OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,!,CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 12-01 Motion Motion by Herfert and seconded by Sotelo•to adopt the resolutions. Assistant City Clerk Rush presented: AN ORDINANCE OF THE CITY COUNCIL OFI THE CITY OF WEST COVINA, CALIFORNIA, APPROVING ZONE CHANGE NO. 12-01 Motion Motion by Her and seconded by Sotelo to introduce the ordinance. Motion carried 4 — 0 by the following Roll Call vote: AYES: Herfert, Sotelo, Sykes, Sanderson NOES: None DEPARTMENTAL REGULAR MATTERS City Clerk's Office 7) Options for Filling Vacancy of City Council Seat by Appointment Filling Council Seat Vacancy or by Calling for a Special Election Mayor Sanderson announced the matter and called for Council discussion. il City Council Minutes of January 15, 2013 Councilmember Herfert expressed his preference for Option 1 calling for a 7-day period to accept applications. Motion Motion by Herfert and seconded by Sotelo to approve Option No. 1 to fill the vacancy on the Council by appointment calling for a seven day period to accept applications. Motion carried by 4 — 0. Assistant City Clerk Rush asked for clarification and explained that the previous appointment of a Councilmember was made by calling for "Letters of interest" and said it would expedite the process eliminating the steps of preparing an application in the short time period. Council concurred. SUCCESSOR AGENCY Mayor Sanderson recessed the City Council meeting at 7:48 p.m. to convene the Successor Agency. Mayor Sanderson reconvened the City Council meeting at 7:49 p.m. with all members present. ADJOURNMENT Motion by Herfert and seconded by Sotelo to adjourn the meeting at 7:50 p.m. in memory of long-time resident Joanne Wilner and for her contribution to the community through her active participation.
