REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
December 04, 2012
Mayor Sanderson called to order the regular meeting of the West Covina City Council at 7:06 p.m. in
the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

Deputy City Attorney Matt Gorman reported the following:
Prior to convening into closed session, all items on the City
Council and Successor Agency agendas were announced for
inclusion in the closed session discussion; all members of the
Council/Board were present except Councilmember/Board
Member Touhey.

with no final action taken and nothing further to report.

Conference with Legal Counsel - Existing Litigation —
Daniel Wilber vs. City of West Covina — A presentation was
provided by the City Attorney's office, direction was provided to'
legal counsel with no final action taken and nothing further to
report.
Conference with Legal Counsel - Existing Litigation — West
Covina Improvement Association vs. City of West Covina — A
report was provided by legal counsel with no action taken and
nothing further to report.

ORAL COMMUNICATIONS
Shirley Buchanan Shirley Buchanan, West Covina resident, thanked the Council for
the latest edition of Discover West Covina; addressed the Civic
Center development project in which an injunction was filed.
Dana Sykes Dana Sykes, West Covina resident, described the City of West
Covina as a bedroom community and the benefit of the green space
and trees located at the Library/Civic Center property.
Forrest Wilkins Forrest Wilkins, West Covina resident, addressed a possible
conflict of interest of Councilmember Sotelo, regarding the
employment of one of his family members.
Councilmember Sotelo responded to his comments.
Bobby Reyes Bobby Reyes, West Covina resident, addressed the Civic Center
development and Tree City USA.
Elsie Messman Elsie Messman, West Covina resident, read a statement addressed
to Councilmember Touhey who was not present expressing her
concerns during his tenure.
Carolyn Arndt Carolyn Arndt, West Covina resident, read an open letter to the
citizenry on the Injunction filed regarding the Civic Center/Library
Development and requested that the Mayor call for council action
to rescind its approval of the project as required by the Injunction.
City Manager Pasmant requested the City Attorney address
the outcome of the Court's ruling.
Deputy City Attorney Gorman gave a brief overview of the
Court's decision and clarified the outcome concerning the Civic
Center/Library project. The Court's decision does not mean the
project has to stop if requirements are met and that the City would
have to comply with the Surplus Land Act for the project to
proceed.
Deputy City Attorney David King reported that there is no
official order from the Court and that it will require the Plaintiffs
attorney to prepare a writ for review by the City Attorney's office
and the developer's counsel before a judge will sign it.
Ceasar Marroquin Ceasar Marroquin, La Puente resident, requested Council's
support/sponsorship for a fundraiser to support Cancer victims.
Abel Mesa Abel Mesa, West Covina resident, expressed his disappointment
with his internet service and requested the City assist with the
offering of Verizon FIGS.
Deputy City Manager Chris Freeland briefly addressed the
deregulation of Cable and the downturn in the economy as the
reason for the companies' delaying installation of their services but
-that the City will continue to encourage FIOS in West Covina.
Irene Fleck Irene Fleck, West Covina resident, announced upcoming Library
events and events held at Galster Park.
Monica Farias Monica Farias, representing Greater West Covina (GWC) Business
Association., thanked Council for partnering with GWC for the
upcoming 2013 Summer Concert Series.
Mayor Sanderson spoke on current activities in West Covina and
invited all to visit some of the holiday events and to bring their
families along.

Traffic Committee Recommendation:
That advance warning signs and centerline delineation be installed
for the knuckles of Vine Avenue at Sandyhook Street and

That the 25 miles per hour speed limit signs be installed on
eastbound Vine Avenue between westbound Wescove Place.
That the Police Department monitor vehicular speeds along Vine
Avenue between California Avenue and Sandyhook Street as
feasible.

8) Summer Concert Series Funding Request from Greater West
Summer Concerts Covina Business
Recommendation is that the City Council instruct the City
Manager to enter into an agreement with the Greater West Covina
Business Association (GWC) to manage the 2013 Summer Concert
Series at the Civic Center at a cost not to exceed $14,500, with
funds from the West Covina Community Services Foundation.
9) 0' of July Celebration
4th of July Recommendation is that the City Council authorize the use of
$45,000 for the 2013 4°i of July Celebration at Edgewood School,
with $30,000 from the Community Services Foundation (Account
#220.51.5150.6490) and $15,000 from the General Fund Reserves
to be held on Wednesday, July 4, 2013 and Thursday July %, 2013.

10) amending Compensation and Benefits for Classes Represented by

2011-2012 Supplemental Law Enforcement Services Fund
11) (SLESF) Grant
SLESF Grant Recommendation is that the City Council:
1. Appropriate $3,105.18 in additional 2010-2011 SLESF funds
received from the State into 155.31.3110.5113 (supplemental
front line police overtime).

2. Accept the 2011-2012 Supplemental law Enforcement Services
Fund (SLESF) grant, and appropriate the $201,912 grant as
follows:
• $59,260 into 155.31.3110.6120 for Graffiti Tracker service
• $42,650 into 155.31.3110.6220 for Police supplies
• $100,000 into 155.31.3110.7170 for an upcoming command
vehicle purchase using multiple funding sources
Asset Forfeiture Funds for Overtime and Supplies
12) Recommendation is that the City Council:
Asset Forfeiture 1. Appropriate a total of $41.3,000 in federal asset forfeiture funds
from the fund balance of Fund 117, as follows:
• $400,000 into 117.31.3120.5113 for supplemental,
unbudgeted sworn overtime for staffing shortages,
neighborhood crime responses, targeted enforcement, and
emergency SWAT deployments;
• A total of $13,000 into 117.31.3110.6220 for police supply
and technology items.
CONSENT CALENDAR ACTION Motion by Herfert and seconded by Sotelo to approve all items
listed on the Consent Calendar as presented.

SUCCESSOR AGENCY Mayor Sanderson recessed the City Council meeting at 7:50 p.m.
to convene the Successor Agency meeting.
Mayor Sanderson reconvened the City Council meeting at 7:51
p.m. with all members present except Councilmember Touhey
CITY COUNCIL REQUESTS FOR REPORTS, STUDIES OR INVESTIGATIONS
Councilmember Fredrick Sykes
Request from Councilmember Fredrick Sykes Requesting the City
Council to Instruct City Staff to Prepare a Report to Develop a
13) Rental Housing Licensing Program
Rental Housing Inspection Program Councilmember Sykes requested Council's approval to ask Staff to
research a program for inspecting multi -residential and business
properties for maintenance issues to assist lode Lworcement in
their effort to enforce property maintenance concerns in the City.
Mayor Pro Tem Herfert requested that any apartment or
business owners be notified and be part of the process.
City Manager Pasmant said he would have a report brought
back to include what other cities are doing and what has occurred
in the past for the Council's review and input.
Motion Motion by Sykes and seconded by Herfert to bring back a report on
a program for inspecting multi -residential and business properties
for maintenance concerns in the City and research City of Covina's
program.
Motion carried by 4- 0.
ADJOURNMENT Motion by Sotelo and seconded by Herfert to adjourn the meeting
at 7:58 p.m. in memory of the following:
