REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
September 4, 2012
Mayor Touhey called to order the regular meeting of the West Covina City Council at 7:07 p.m. in the
City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

REPORTING OUT FROM CLOSED SESSION
City Attorney Arnold Alvarez-Glasman reported the following:
Prior to convening into closed session, all items on the City
Council agenda and Successor Agency Agenda were announced
for inclusion in the closed session discussion; all ;members of the
Council/Successor Agency were present.
Items on the agenda:
SUCCESSOR AGENCY Conference with Legal Counsel — Anticipated Litigation —
One matter — City Attorney Alvarez Glasman reported that all five
members of the Successor Agency were present. The Agency was
briefed on one item of Anticipated Litigation by, Legal Counsel
with no final action taken and nothing further to report.
CITY COUNCIL Conference with Labor Negotiators — Employee
Organizations: Confidential Employees, Maintenance & Craft
Employees, Non -Sworn Safety -Support Employees, General
Employees, Mid -Management Employees, Miscellaneous
Unrepresented Management Employees: Assistant City Clerk,
Assistant City Manager, Community Development Dir.,
Community Services Dir., Deputy City Manager, finance
Director, Fire, Chief, Dir. Human Resources, Planning Director,
Police Chief, Public Works Dir/City Engineer, Dir. Risk
Management — Alvarez-Glasman reported "that , all five
Councilmembers were present. The Council received a briefing
from City Negotiators but there was no final action taken and
nothing further to report.
Conference with Real Property Negotiators — Property:
1305 East Cameron Avenue — This matter was not discussed and
will be continued when Council reconvenes them Special Closed
Session after conclusion of their regular Open City Council
meeting.
Conference with Legal Counsel — Anticipated Litigation —
Two Cases — Two matters were discussed with no final action on
either matter.
Conference with Legal Counsel — Existing Litigation — City
of Covina v. Hassen Imports Partnership, et al. — City Council
received a briefing on this matter with no final action and nothing
further to report.
Conference with .Legal Counsel — Existing Litigation —
Ahna Mendoza, et al. v. City of West Covina, et al. — City Council
was briefed on this matter by Legal Counsel; the City Council
unanimously authorized by a 5 — 0 vote the payment of punitive
damages in this matter for the officer involved.
Public Employment - City Manager — This matter was not
discussed and will be brought back at the end of the Open Session
meeting.

CHANGES TO THE AGENDA No changes
PRESENTATIONS Mayor Touhey called forward Robert Bryant of Flowers by Robert
Taylor to receive a certificate on their 17th Annual Good Neighbor
Day.
ORAL COMMUNICATIONS
Blanca Venzor Blanca Venzor, West Covina resident, addressed comments made
by Councilmember Herfert at the previous meeting as disrespectful
and requested' an apology.
Carolyn Arndt Carolyn Arndt, West Covina resident, thanked Councilmember
Sykes for attending the Summer Fest; addressed 'Councilmember
Sotelo requesting he become more actively involved now that he
has been on City Council for several months.
Philip Moreno Philip Moreno, West Covina resident, suggested` Mayor Touhey
step down from the West Covina Oversight Board questioning his
actions at the last meeting of the Oversight Board.
Mayor Touhey responded to Mr. Moreno's comments.
Shirley Buchannan Shirley Buchannan, West Covina resident, addressed
Councilmembers' decorum at the meetings when addressing
residents and specifically, Mayor Touhey's comments at the last
meeting directed to her. Ms. Buchannan requested an apology from
Mayor Touhey.
Ray Hernandez Ray Hernandez, West Covina resident, addressed web streaming of
City Council meetings and brought forth his research of costs from
other cities and requested Council put a staff report on the agenda
for review.
Herb Redholtz Herb Redholtz, West Covina resident, addressed proposals brought
forth at the previous meeting from a resident regarding term limits
of councilmembers and a cap on campaign spending to level the
playing field for candidates; addressed the condition of the vacant
building at the corner of Azusa and Amar; addressed the
announcement of Wa1Mart coming to West Covina supporting the
new business as a revenue generator.
Wen Wen Zhang Wen Wen Zhang, West Covina Library manager, announced the
100th Anniversary of the Los Angeles County Library inviting the
councilmembers to the celebration.
Philip Kaufman Philip Kaufman, West Covina resident, addressed comments by
Councilmember Herfert at the last meeting that were directed
towards the State and State legislators and cited several of the
recent actions taken by State legislators adding the State deserves
residents' support.
Elsie Messman Elsie Messman, West Covina resident, addressed comments by
Councilmember Herfert regarding a former councilmember
Hernandez and the recent Oversight Board meeting at which
Mayor Touhey left meeting.
Forrest Wilkens Forest Wilkens, West Covina resident, addressed a broken water
pipe at Cortez Park and the quick response from the Maintenance
Department; addressed Athens Services Contract and the variety of

fees between cities that also have Athens as their provider and
other concerns with Athens.
Beverly Bulthuis Beverly Bulthuis, West Covina resident, thanked the Traffic
Committee for their proposal of "No Parking" on their street on
street sweeping days.
Bruce Leinbach Bruce Leinbach, West Covina resident, distributed an article on
webcasting of West Covina council meetings; addressed video
streaming quality with one camera stating the City ''should invest in
more cameras for a better production as requested by the residents.
Councilmember Herfert and Mayor Pro Tern Sanderson
addressed and responded to concerns brought forth by speakers.
Deputy City Manager Chris Freeland addressed concerns brought
forward regarding costs of video streaming and airing of Planning
Commission meetings.
City Manager Pasmant addressed concerns brought forth
regarding Graffiti abatement and concerns about the Azusa/Amar
property. Mr. Pasmant also addressed the Oversight Board and the
City's representatives' efforts to ensure financial matters being
addressed by this Board are fair and in the best interest of the City.
Councilmember Sykes addressed the Athens contract and
open bidding.

Commerce Prop A Fund Exchange Recommendation is. that the City Council approve the agreement
authorizing the sale of Prop A Funds to the City of Commerce.

7) Appropriation of Housing Funds to Housing Related Programs
Appropriation of Housing Funds Recommendation is that the Community Development
Commission (CDC) make the following appropriation of funds:
1. $129,635 to Account Number 820.22.2210.6XXX to fund the
Housing Preservation Loan Program.
2. $2,500 to Account Number 820.22.2210.6120 to fund
Administrative Support for the San Gabriel Valley Consortium
on Homelessness.
3. $50,000 to Account Number 820.22.2210.6119 to fund the
Housing Element Update.

8) Approval of Class Specification and Salary Range for Community

10) Appointment of Community and Senior Services Commissioner
Community/Senior Services Motion by Herfert and seconded by Touhey to appoint Steve
Commissioner Appointment Bennett to the Community and Senior Services Commission to fill
John Hughes unexpired term ending on March 31, 2013 by
adopting the following resolution.

Mayor Touhey recessed the City Council meeting at 8:29 p.m. to convene the Successor Agency
meeting. Mayor Touhey reconvened the City Council meeting at 8:30 p.m. with all members present.
ADJOURNMENT Motion by Sotelo and seconded by Sanderson to adjourn the
Regular City Council meeting at 8:31 p.m. The City Council
continued the Special City Council meeting in the City Manager's
Conference Room.
