June 19, 2012.
Mayor Touhey called to order the regular meeting of the West Covina City Council at 7:03 p.m. in the
City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

SUCCESSOR AGENCY Conference with Legal Counsel — Anticipated Litigation -
One Case — One potential litigation matter was discussed with
respect to action against the Department of Finance and/or County
of Los Angeles; was given to City Attorney's Office by unanimous
vote of the Successor Agency to file a lawsuit, if necessary, at a
future date if attempts to negotiate issues regarding RO.PS with the
Department of Finance/County of Los Angeles prove unsuccessful.

PRESENTATIONS Mayor Touhey announced that the Certificates of Appreciation
presentation to the Food Waste Demonstration Program would not

Mayor Touhey called forward Deputy City Manager Chris
Freeland to receive a Proclamation designating July as Parks and .
Recreation Month.
Freeland announced upcoming Recreation activities.
Mayor Touhey called forward West Covina Fire Engineer Bill
Mansour who introduced representatives from the West Covina
Firefighter's Association and Talk About Curing Autism (TACA).
Fire Engineer Mansour spoke on the fundraising events conducted
in their effort to assist TACA.
CHANGES TO THE AGENDA City Manager Pasmant announced a change to the Council Agenda
that requires City Council approval to add an item to Consent
Calendar.
City Attorney Alvarez-Glasman reported that it was
necessary to add an item that requires City Council approval as the
item came up after the posting of the Council agenda and that there
was an immediate need to take action on this matter at this
meeting. He announced that a resolution to continue FY 2011-12
appropriations was necessary with the adoption of following
resolution:

Bruce Leinbach Bruce Leinbach, West Covina resident, addressed the.quality of the
video streaming of Council meetings.
Tracy Moronatty Tracy Moronatty,. El Monte resident, spoke on behalf of the
Alliance to Keep Youth Tobacco Free.
Jefferson DeRoux Jefferson DeRoux, West Covina resident, requested to publically
disavow himself from negative comments made at a previous
meeting regarding Councilmember Sotelo; addressed the council
recall , attempt and recall comments by Council; the billboard
advertising of the Civic Center project; addressed concerns with
informing/noticing the residents of proposed actions by Council.
Irene Fleck Irene Fleck, Friends of the Library, announced upcoming Library
events.
Forrest Wilkins Forrest Wilkins, West Covina resident, addressed Athens trash
services contract, evergreen clause and contracts in other cities.
Alfred Williams Alfred Williams, West Covina resident, announced June 19t" as
Juneteenth, a celebration of the Emancipation of Slaves; addressed
processes of appointing elected officials.

Philip Moreno Philip Moreno, West Covina resident, addressed defaulting of bond
payments, transfer of funds from the city to the RDA and the loss
of those funds with the elimination of the Redevelopment agencies.
Carolyn. Arndt Carolyn Arndt, West Covina resident and chairman of the West
Covina Improvement Association, addressed the governance of the
City.
PJ Joyner. PJ Joyner, West Covina resident, requested an appeal on the City
Attorney's decision over rent control.
Ray Hernandez Ray Hernandez, West Covina resident, addressed Council meeting
video streaming; lack of media coverage that meetings are live;
stating that better broadcasting can be met.
Antoinette Falice Antoinette Falice, Volunteers of America in West Covina, thanked
the Council for their past support of CDBG Funding.
Herb Redholtz Herb. Redholtz, West Covina resident, addressed Greater West
Covina's (GWC) request for assistance of supportfrom the City
for the Summer Concerts and expressed his concerns with the..
proposed location, funding and sharing of revenues generated.
Lloyd Johnson Lloyd Johnson, West Covina resident, addressed the recent "Run
for the Wall'-' by the City of Ontario; thanked the Castucci
Foundation for the Support for the Memorial Day event; inquired
as to how much cash the City has in its reserves.
Councilmembers addressed and responded to concerns brought
forth by speakers.
City Manager Pasmant responded to question regarding the
loan to the Redevelopment Agency stating the City was receiving
.10% interest from the loan which. was being used to fund Public
Safety and also referred residents to the CAFR available on the
City's website to view details of the City's financial status.'
Assistant City Manager Thomas Bachman addressed the
City's current financial status.

cause an ordinance to be adopted to amend Sections 22-131
and 22-132 of the West Covina Municipal Code.

Meeting Minutes of March 20, 2012 since he was not on the City
Council during these meetings and Councilmember Sanderson
stated her abstention from Item #3 — Ordinances for Adoption —
Repeal of Moratorium for Properties on North Side of
Vanderhoof Drive since she did not participate in the public
hearing discussions due to her property's proximity to the area
involved.

Public Hearing
18) West Covina Landscape Maintenance District No. 4

20) West Covina Landscape Maintenance District No. 7
Maintenance District No. 4, 6, 7 Mayor Touhey announced the public hearing matters and Assistant
City Clerk Rush verified that proper legal notice had been given.
Mayor Touhey proceeded to open the hearings. Public Works
Director Shannon Yauchzee presented the staff report and briefly
covered the operation of the Maintenance Districts and the
necessary. funding. Yauchzee reported that Maintenance Districts
4 and 6 rates are now capped by Prop 218 and an increase would
require a majority vote of the owners, so staff.is not recommending
a change in rates for Maintenance Districts 4 and 6. However,
upgrades and repairs would have to be deferred in these districts.
For Maintenance District 7 staff is recommending an increase of
2% to cover the costs of maintenance, repairs and improvements
and help maintain a healthy reserve and cash flow. 'Yauchzee then
offered to answer any questions.
Assistant City Clerk Rush confirmed that no written comments or
objections had been received.
Public testimony Mayor Touhey opened the public testimony portion of the hearing .
and asked for public comments.
Alfred Williams, West Covina resident, addressed City trucks that
damage sidewalks in Maintenance District No. 4 and asked that
City address this concern to the employees.
John Solis, West Covina resident, also addressed sidewalks in need
of repair in Maintenance District No. 4 north of Shadow Oak Drive
on Rebecca Street and inquired whether the funding collected and
budgeted could cover these repairs.
Testimony closed With no other speakers wishing to address Council, Mayor Touhey
closed the public testimony portion of the hearing.
Mayor Touhey addressed funding to the districts which is tied to
when the County disburses the City's share of property tax
revenues and the City having to fund the maintenance of the
Districts' .property until the revenues are received.
Councilmember Sykes addressed .the concern for liability to
the City due to unrepaired sidewalks.
Public Works Director Yauchzee elaborated on the funding
and reported that currently there is sufficient funding for the
Districts to make repairs although last fiscal year, some .sidewalk
repairs had to be denied due to lack of funds. He also reported that
the delay in revenues to the City has caused the City to expend
money all year round. He emphasized the importance of
maintaining reserves to cover costs due to the County's practice of
disbursing revenues only twice a year. He also addressed the
difficulty of City trucks having to drive into the area to do work
because the sidewalks . are not wide enough. Yauchzee asked the
public to feel free to call him or the City and report any concerns
with City vehicles and necessary repairs'that the City can look into.

CDBG Public Services Funding Mayor Touhey announced the hearing matter and Assistant City
Clerk Rush verified that proper legal notice had been given.
Mayor Touhey then proceeded to open the hearing and
Management Analyst Kelly McDonald gave a brief report on the
funding to public service. projects and reported that this is the .
second year of reductions in.funding. Of the total grant allocation
of funding, 15% would fund public services projects which
amounted to $152,446 as outlined in Attachment # 1 of the report
and offered to answer questions.
Assistant City. Clerk Rush verified that no written comments had
been received.

and called for public comments.

Councilmember Sykes gave an example of a family in need of
services funded through this grant and conveyed his support for the
funding.

22) West Covina Citywide Lighting Zting and Maintenance District
Lighting and Maintenance District Mayor Touhey announced the hearing matter and Assistant City
Clerk Rush verified that .proper legal notice had been given.
Mayor Touhey then proceeded to open the hearing and Public
Works Director Shannon Yauchzee briefly covered the District's
role in funding street lighting and maintenance of City trees
throughout the City. .He stated that in July 1997, voters approved
rate increases of 2.0% in accordance with Prop 218. Staff is
recommending a 2% increase to current rates as necessary in order
to build up reserves, meet cash flow, pay utility bills and properly
maintain City trees. � Yauchzee then offered to answer any
questions.

Forest Wilkens, West Covina resident, wanted to comment on the
previous Item #21 - FY2012-2013 Community Development
Block Grant (CDBG) Public Services Project Funding - stating
he was informed that the County has a service available to assist
any resident needing food and shelter on an emergency basis for
the evening by calling 211.

23) West Covina Citywide Sewer Service Charge
Citywide Sewer Service.Charge Mayor Touhey announced the hearing matter and Assistant City
Clerk Rush verified that proper legal notice had been given.
Mayor Touhey then proceeded to open the hearing and Public
Works Director Shannon Yauchzee gave a brief staff report
detailing that the purpose of the funds are for the maintenance and
operation of the Citywide sewer system; to meet compliance with
State and Federal Clean Water Act, provisions; to fund street
sweeping costs and build reserves for future sewer replacement
and upgrades and repairs. Yauchzee reported that staff is
recommending a 2% rate increase for FY 2012-2013 to cover
operating costs, keep the fund balance up, cover cash flow and to
build future reserves. In addition, staff is also recommending the
collection of the service charge through the County Tax bill. He
then offered to answer questions.
Councilmember Sotelo inquired as to why the monthly rates are so
low compared to neighboring cities and Mayor Pro Tern Sanderson
inquired if the 2% cap of Prop 218 was responsible for the fund
shortage.
Public Works Director Yauchzee responded to their
questions.

Mayor Touhey made reference to additional legislation
being considered that would mean another expenditure of $150
million dollars for the City of West Covina to clean up the sewer
system and said it is impossible for the City to meet the expense.

24) Summer Concert Series Funding Request from Greater West

Mayor Touhey introduced the matter and called for a staff report.

Councilmember Herfert, inquired whether there were
restrictions on the use of the Business Improvement Tax (BIT)
funds.
Deputy City Manager Chris Freeland gave a brief history of
the BIT funds and their purpose explaining that it was a tax
collected on business licenses and its intent was to market
businesses in the community.
Discussion ensued on revenues and the use of the BIT
funds.

recommendations #1 and #2 and wait until Budget discussions
begin before considering #3 Appropriate the , Remaining BIT
Fund Balance to Community Services Special Events Fund
110.51.5150.XXX to be utilized for FY12-13 Special Events]:
1. Approve the Greater West Covina's (GWC) funding request to
hold the 20.12 Summer Concert Series at the Civic Center and
appropriate up to $11,900 from the Business Improvement Tax
(BIT) Fund Balance to Account 110.11.1120.6120 depending
on the venue selected;
2. Allow City staff to enter into an agreement with the GWC to
share equally (50%-50%) all revenues generated from the 2012
Summer Concert Series

Successor Agency
25) Transfer of Assets of Former Redevelopment Agency
Transfer of RDA Assets City Manager Pasmant made introductory remarks stating the
Successor Agency endeavored to identify properties formerly held
and owned by the Redevelopment Agency and found that these
properties are primarily used as parking facilities located at
Eastland, the Lakes and. the Westfield Mall. Staff felt that these
properties should be transferred to the West Covina Parking
Authority, which is still an active entity.
Community Development Director Chris Chung elaborated
on the details of the properties owned by the former
Redevelopment Agency that are being considered for transfer: He
cited Government Code law; used a PowerPoint presentation
showing the locations of the properties; and further explained the
factors that qualify the properties for transfer also citing other
cities that have successfully transferred similar properties with the
approval of the Oversight Board and the Department of Finance.
Further, the main use of these properties has been determined to be
for parking purposes and therefore, staff is recommending that
these properties be transferred to the City's Parking Authority
which is still an active entity, as the appropriate agency for these
properties.

Councilmember Fredrick Sykes
Report on Utilizing General Fund Reserves to Hire Additional
26) Police Officers
Hire Additional Police Officers Councilmember Sykes introduced this item addressing the increase
in crime in his neighborhood and shortage of police officers. He
acknowledged that due to budget constraints, increasing the
number of officers was difficult and said he would welcome any
suggestions by his colleagues to add more officers.
Councilmembers commented on the need for more police
officers and discussed the difficulty due to budget constraints and
loss of State revenues and discussed the use of volunteers and
finding new revenue sources.

27) West Covina Adopt -A -Park Program
Adopt -A -Park Program Councilmember Sykes stated his concern for the maintenance of
the City's parks which has declined due to the loss of staff.
Councilmembers expressed their support.
Motion Motion by Sykes and seconded by Sanderson to bring forth a
program to implement volunteers/sponsorships to assist in the
upkeep and maintenance of City parks.

f Request from Mayor Pro Tem Shelley Sanderson Requesting the
City Council to Instruct City Staff to Prepare a Report on
28) Developing Renewable Energy Projects in West Covina
Renewable Energy Projects Mayor Pro Tem Sanderson expressed a desire for staff to continue
to look into the use of energy saving measures in the City.
City Manager Pasmant said the City works with vendors
and companies to convert to solar energy in order to reduce utility
costs and Public Works Director Yauchzee explained how the City
has been working with these companies to use solar energy while
they receive tax breaks and help lower utility costs for the City..
Motion by Sanderson and seconded by Sotelo to receive
and file. Motion carried by 5 — 0.
Councilmember Herfert recused himself at 9:17 p.m. from participation in the following item due to his
employment with Southern California Edison and left the dais for the evening.

Council to Instruct City Staff to Prepare a Report on Southern
29) California Edison Power Outages
Edison Power Outages Councilmember Sykes expressed concerns with loss of electrical
service during outages and the impacts to residents; concerns with
SCE infrastructure 'and concerns of residents with needs.
Donna Lee, Regional Manager of Southern California
Edison addressed the recent power outage in Mr. Sykes area. Ms.
Lee stated this particular outage occurred in an underground cable.
Ms. Lee briefly explained Southern California Edison's procedure
for addressing outages and stressed the need for residents to call
and report problems and to be prepared for outages.

COUNCIL COMMENTS Mayor Pro Tem Sanderson inquired into services for the homeless.
City Manager Pasmant offered to update the Council in a
memo.
Councilmember Sykes stressed the need to prepare for electrical
outages.

meeting in memory of Alejandro Romero, brother of long time
residents Ricardo and Yolanda Romero. Motion carried by 4 - 0.
