Mayor Touhey called to order the regular meeting of the West Covina City Council at 7:05 p.m. in the
City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

CHANGES TO THE AGENDA City Manager Pasmant announced that an Amended Attachment to
Item # 20 — Approval and Transmittal of an Administrative Budget
for the Successor Agency to the West Covina Redevelopment
Agency, and Schedules of Distribution of Future Tax Revenues
(Recognized Obligations Payment Schedules `ROPS') Pursuant to
ABIX26 had been distributed to the Council and copies were
available for the public.
PRESENTATIONS Mayor Touhey called forward Councilmember Jack Hadjinian
from the City of Montebello to receive a Proclamation designating
April 23, 2012 'as Armenian Remembrance Day, its 97`
Anniversary of the Armenian Genocide.
Mayor Touhey presented Shannon Yauchzee, Public Works
Director, with a proclamation designating Saturday, April 21 as
Earth Day.
Mayor Touhey presented Shannon Yauchzee with the National
Arbor Day Foundation's Trophy recognizing West Covina as a
Tree City USA for the 301" consecutive year.
Mayor Touhey presented Geneva Nixon and Irene Fleck of West
Covina Beautiful, with a proclamation designating April 22, 2012
as Arbor Day in West Covina.

Mayor Touhey, assisted by Police Chief Frank Wills, presented
Certificates of Recognition to West Covina Police K-9 Handlers
Joe Serrano and Nick Franco and their K-9 dogs, Rambo and
Rocco who were honored with the Quarterly Award from the
National Police K-9 Association for their service to the
community.
Mayor Touhey called forward Bob Cruz, Public Affairs Manager
for the Gas Company, who presented a brief PowerPoint
presentation highlighting their new meter reading system.
ORAL COMMUNICATIONS
Bruce Leinbach Bruce Leinbach, West Covina resident, announced the Lions Club
fundraiser, the 42°d Night on the Town on May 23, 2012..
Dr. Luis Perez Dr. Luis Perez, West Covina resident, introduced himself. as an
interested candidate for the vacant council seat.
Karin Armbrust Karin Armbrust, West Covina resident, expressed her desire to be
appointed to fill the vacant council seat.
Greg Tuttle Greg Tuttle addressed redevelopment debt; a recall flyer which has.
been mailed to residents; officials' salaries as posted on the
California State Controller 2010 website; suggested the City Council
to take responsibility for redevelopment activities during their tenure.
John Shewmaker John Shewmaker, West Covina resident, addressed the financial state
of the City; and new businesses at Eastland Shopping Center.
Alan Carrico Alan Carrico, West Covina resident, addressed the vacant Council
seat and recommended his colleagues on the Planning Commission
as qualified and highly recommended Rob Sotelo as the best
candidate.
Lola Finley Lola Finley, West Covina resident, addressed the police and fire
services and stated she is opposed to County services.
Jane Apodaca Jane Apodaca, West Covina resident, expressed her support of Gloria
Gallardo as the appointee to the vacant Council seat.
Shirley Buchanan Shirley Buchanan, West Covina resident, addressed voters'
expectations from their elected officials and her repeated request for
an annual report regarding Big League Dreams; :expressed her
concern over lack of video streaming of meetings; inquired about the
status of soccer fields approved for the Orangewood Little League;
and thanked the Council for the McIntyre project.
Philip Moreno Philip Moreno, West Covina resident, addressed theft of political
signs and expressed concerns about considering County fire and
police services for the City and a political mailer.
Lloyd Johnson Lloyd Johnson, West Covina resident, spoke on the Veterans Wall
and looks forward to its completion; addressed the Council vacancy
requesting the Council pick the best candidate and a person who has-
been involved and active in the City; inquired as to the rumor of a
new attraction at Crazy Horse; and inquired into the County's
appointment to the City's oversight committee.

Royall Brown Royall Brown, West Covina resident, addressed the administrative
budget for the Successor Agency and the "Recognized Obligations
payment schedules" described in the agenda report Item #20.
Blanca Venzor Blanca Venzor, West Covina resident, addressed Mayor Pro Tern
Sanderson's comments at past meetings that she feels "attacked" by
residents, stating that the residents are only exercising their
democratic right to express themselves to their elected officials.
Elsie Messman Elsie Messman, West Covina resident, addressed lawsuits by
employees and requestedthe outcome; requested whether any City
funds are being used to subsidize the Wal-Mart at Eastland Shopping
Center.
Carolyn Arndt Carolyn Arndt, West Covina resident, addressed the sale of Civic
Center property; the removal of political signs; and the divisiveness
in the community.
Joanne Wilner Joanne Wilner, West Covina resident; addressed commission salary
changes suggesting the Council should also reduce their benefits and
perks to reflect their status as elected officials and eliminate the tie-in
of their benefits and salary to other employee classifications; and
addressed the Letter of Interest submitted for the Council vacancy
stating Corey Warshaw is qualified to fill the vacancy.
Ray Hernandez Ray Hernandez, West Covina resident, addressed the appointment to
the vacant council seat and mentioned desirable qualities the person
should have supporting Herb Redholtz.
Mayor Touhey addressed comments brought forward
regarding the ROPS report.
Mayor Pro Tern Sanderson also addressed several
comments brought forward which included campaign signs, flyers,
the ROPS report and police and fire.
Councilmember Sykes thanked the residents for
coming to the meeting and addressed transparency and addressed his
previous request for information only regarding outsourcing of police
and fire services.
Councilmember Herfert addressed comments
regarding County fire and police services and measures introduced
by State Assemblyman Hernandez affecting the City.
CONSENT CALENDAR Mayor Pro Tern Sanderson requested that Item No. 6 Award of Bid -

6) Del Norte Splash Pad Construction (Project No. PP-12206)
Del Norte Park Splash Pad Recommendation is that the City Council take the following actions:
1. Authorize the construction of a new Splash Pad facility at Del.
Norte Park per the design of Vortex Aquatic Structures
International, Inc. dated March 5, 2012.
2. Accept the bid of Micon Construction in the amount of $498,448
as submitted at the bid opening on March 22, 2012, and authorize
the Public Works Director/City Engineer and City Clerk to
execute the contract to build the designed improvements at Del
Norte Park.
3. Authorize the. adjustment of current and future Fiscal Year
budgets to include the costs needed for ongoing operating and
maintenance of this new park feature, using either General Funds
or Park Bond funds (if approved), in an annual recurring amount
of $30,000.
4. Find the project categorically exempt under CEQA.
Award of Bid for Project No. SP-11110 — Major Street
7) Rehabilitation Improvements — Various Locations
Major Street Rehabilitation Recommendation is that the City Council take the following actions:
1. Establish City Project No. SP-I I110, Federal Project 5259(024),
for .major street rehabilitation work at various locations in the
'City of West Covina.
2. Appropriate $330,000 of Federal Highway Fund to Account No.
140.81.8224.7200.
3. Transfer $42,755 from Project No. SP-12105 of Gas Tax Fund
(Account No. 124.81.8213.7200) to Project No. SP-11110
(Account No. 124.81.8224.7200).
4. Accept the bid of Gentry Brothers, Inc. in the amount of
$313,030 as submitted at the bid opening on March 22, 2012, and
authorize the Public. Works Director/City Engineer and City
Clerk to execute an agreement with Gentry Brothers, Inc. to
perform the work.
Award of Bid for the Traffic Signal Modifications at Lark Ellen
Avenue and Puente Avenue Intersection — City Project No. TP-
8) 12501 and Federal Project No. HSIPL-5259(025)
Traffic Signals — Lark Ellen/Puente . Recommendation is that the City Council accept the bid of Freeway
Electric, Inc. in the amount of $40,998.00 as submitted at the bid
opening on April 3, 2012 and authorize the Public Works
Director/City Engineer and City Clerk to execute a contract with
Freeway Electric, Inc. to perform the work.
9) Award of Bid for Tree Maintenance Contract
Tree Maintenance Contract Recommendation is that the City Council:
1. Find that the City of Garden Grove process is at least as stringent
.as the process used by the City of West Covina and the bids for
tree trimming services submitted on August 15, 2011 satisfy the
formal bid process required under Section 2-333 of the West
Covina Municipal Code (WCMC) and thus justify the waiver of
the formal bid process per Section 2-330, WCMC.
2. Accept the tree maintenance bid schedule from West Coast ,
Arborists, Inc. of Anaheim, California as submitted in the above
referenced Garden Grove bid process and authorize the Public
Works Director and City Clerk to execute a five-year contract

agreement not to exceed $367,000 annually with said West Coast
Arborists, Inc. for the service to be performed.

Recommendation is that the City Council receive and file this report.
11) CDC Treasurer's Report City Treasurer's Report for the Month of February 2012
Recommendation is that the .City Council, acting as the Successor
Agency to the West Covina Redevelopment Agency, receive and file
this report.
Community Services Department — Miscellaneous
12) Energy Efficiency Upgrades to the West Covina Municipal Pool
Municipal Pool Upgrades Recommendation is that the City Council authorize the City Attorney
to prepare, and the City Manager to execute, a second amendment to
the 1994, Community Recreation Agreement between the City of
West Covina and West Covina Unified School District with the
terms given within the staff report.
Police Department — Miscellaneous
13) 2012 BJA Justice Assistance Grant
BJA Justice Assistance Grant Recommendation is that the City Council approve the 2011 BJA
Justice Assistance Grant and authorize the appropriation of an
estimated $26,361 for future grant purchases, as follows:
• $5,000 into 130.31.3111.5113 for supplemental overtime for
enforcement
• $13,361 into 130.31.3111.6220 for law enforcement supplies
• $8,000 into 130.31.3111.6215 for police computer supplies
14) Asset Forfeiture Funds for Police Vehicles, Overtime; and Supplies
Asset Forfeiture Funds Recommendation is that the City Council:
1. Find that the Los Angeles County RFB#IS-11201188-1 for Ford
Police Interceptors satisfies West Covina's bid process and
authorize the purchase of a total of thirteen (13) vehicles per
specifications, director from Wondries Fleet Group of Alhambra
for $321,600.50 including taxes and fees, from account
117.31.3120.7170.

Waive the bid process and authorize the purchase of four used
vehicles for Detectives from Toyota of Tustin for $70,850,
including sales tax, from account 117.31.3130.7170.
Authorize a purchase of fifty (50) mobile computers and
accessories totaling $349,469 from account 117.31.3120.7160, as
follows:
$217,749 for fifty (50) mobile computers (including
warranties, battery service, wireless communication kits,
tax and shipping) directly from General Dynamics of
Sunset, FL, the WCSG's existing current -generation
mobile computer vendor;
• $61,820 for mobile computer mounting hardware
(including tax and shipping) from Mobile Mounts Inc., of
Mckinley, TX,. to sole source provider of these mounting
items, power units, and wiring kits;
• $15,900 for required mobile computer software,
purchased subsequently.
Appropriate a total of $1,447,834.50 in federal asset forfeiture
funds from the fund balance of Fund 117, as follows:
• $500,000 into 117.31.3120.5113 for supplemental,
unbudgeted overtime for staffing shortages,
neighborhood crime responses, targeted enforcement, and
emergency SWAT deployments;

A Total of $405,515.50 into 117.31.3120.7170 for the
purchase ($321,600.50) and equipping ($83,915), of
thirteen (13) patrol vehicles, including conversion costs,
warranties, etc. utilizing the City's currently authorized
conversion vendor (West Coast Lights & Sirens), and
police vehicle warranty vendor (Wondries Ford);
• A total of $76,850 into 117.31.3130.7170. for the
purchase ($70,850) and equipping ($6,000) of four used
vehicles for Detectives;
• A total of $349,469 into 117.31.3120.7160 for the
purchase of mobile computers with accessories and
software;
• A total of $55,000 into 117.31.3110.7160 police
equipment items including a law enforcement records
retrieval device, technology items, and emergency
response gear;
• A total of $21,000 into 117.31.3110.6220 for police
supply items including forensic imaging items, police
facility furnishings, and tactical enforcement supplies;
• A total of . $40,000 into 117.31.3110.6050 for
supplemental law enforcement, tactical and support
services training.

Mayor Pro Tern Sanderson inquired whether funding being
used was from Park Bond funds.

City Manager Pasmant stated that was correct, that the City is
awaiting the County Board of Supervisor's action on the use of the
Park Bond funds.
Mayor Touhey inquired whether the funding was coming
from Prop 84 funds or CDBG funds.
Deputy City Manager Freeland explained use of funds.

21) Mayor Touhey requests looking into adjusting Commission stipends
Commission Stipends as discussed previously to garner further cost savings.

22) Appointment of City Commissioners
Appointment of Commissioners Deputy City Manager Chris Freeland gave a brief report regarding
the cost savings measure taken to consolidate the Community
Services and Senior Citizens Commissions, to be called the
Community and Senior Services Commission, and the Public Arts
and Planning Commissions, to be called the Planning Commission,
and the need for council to appoint members to the new consolidated
commissions.
Mayor Touhey proceeded to open the nominations for
appointing commissioners.

Consideration of Appointment to Fill the Vacancy of the City
Council Seat for the Unexpired Term Ending 2013
Mayor Touhey announced the subject matter and asked the
Council for their input on how to proceed with the selection process.
Councilmember Herfert made brief comments on Letters of
Interests received and applicants' excellent experience and thanked
them for their desire to serve the community.
Mayor Pro Tern Sanderson also thanked. the applicants for
their interest.
Councilmember Sykes expressed his appreciation for the
interest shown and encouraged anyone not. selected to continue to
stay involved in their City.
Mayor Touhey also thanked the applicants and commented
on the experience of serving as a Councilmember.
Nominations Mayor Touhey called for nominations by each councilmember:
Motion by Herfert nominated Rob Sotelo
Motion by Sykes nominated Drexel Smith.
Motion by Sanderson nominated Mark Booth.
Mayor Touhey seconded the motion to nominate Rob Sotelo.
Call for the question Following Council discussion, Councilmember Herfert called for the
question on motion to appoint Rob Sotelo who received a second.
Motion failed by 2 — 2 (Sykes, Sanderson —No).

Motion carried by 3 —1 (Sykes — No). Mayor Touhey announced
Rob Sotelo as the new councilmember to fill the vacancy.
Mayor Touhey called for a motion to reconsider the. Planning.
Commission resolution due to the vacancy created when Rob. Sotelo
was appointed to serve the unexpired term of the City Council
Vacant seat and thereby vacating his seat on the Planning
Commission.
Motion by Sanderson to nomination Dave Stewart to the Planning
Commission, second by Sykes.
Motion carried 4-0.
Motion to Reconsider Motion by Sanderson and seconded by Herfert to reconsider
Resolution No. 2012-25.
Motion carried by 4 — 0.
Motion to amend resolution Motion by Herfert and seconded by Sanderson to amend Resolution
No. 2012-25 to remove Rob Sotelo as Planning Commissioner and
place David Stewart as the new Planning Commissioner to serve the
unexpired term ending March 31, 2013.
Motion carried by 3 -1 (Sykes— No).
