Garvey Avenue, West Covina. INVOCATION PLEDGE OF ALLEGIANCE Pastor Nestor Rebong St. Christopher's Church Mayor/Chairman Herfert PRESENTATION OF COLORS West Covina High School Air Force Junior Reserve Officer Training Corps ROLL CALL Mayor/Chairman Herfert, Mayor Pro Tem/Vice Chair Touhey, Councilmember/Commissioner Lane, Sanderson Absent: Councilmember/Commissioner Armbrust REPORTING OUT FROM CLOSED SESSION Deputy City Attorney Matt Gorman reported the following: Prior to convening into closed session, all items on the City Council/Community Development Commission agenda were announced for inclusion in the closed session discussion; all members of the Council/Commission were present with the exception of Councilmember/Commissioner Armbrust. Items on the agenda: Conference with Legal Counsel — Anticipated Litigation — One case — Staff provided a report to the Council; direction was provided to staff and the City Attorney with no final action taken and nothing further to report. Conference with Legal Counsel — Existing Litigation — Chris Chung v. City of West Covina. — Report was provided by special counsel, no final action taken and nothing further to report. Public Employment — City Manager — A report was provided by staff to the City Council with no final action taken and nothing further to report. Conference with Real Property Negotiators — Property: Civic Center Property (West Covina Parkway/West Covina Avenue/Southwest Corner) — Staff provided a report to the Commission with no final action taken and nothing further to report. Conference with Real Property. Negotiators — Property: Assessor Parcel Numbers 8474-007-035, 037, 928, 932 and 934 — A report by staff was provided to the Commission with no action taken and nothing further to report. CHANGES TO THE AGENDA None ANNOUNCEMENT Mayor Herfert requested that due to tonight's special occasion of certifying the election results and the transition of the Council, he asked that comments be kept positive for the sake of the ceremonial process. Vincent in West Covina and announced the Police Association's Toy Drive. Lisa Mayo Lisa Mayo, West Covina resident, represents "They Will Know," a non-profit organization which teaches teens about Domestic Violence, expressed her desire to teach high school teenagers through the School District. Barbara Sepulveda Barbara Sepulveda, West Covina resident, requested the City help with the functions of her condo board and their operations. Lloyd Johnson Lloyd Johnson, West Covina resident, congratulated Mayor Herfert on his re-election and congratulated Fred Sykes on his election and requested the meeting be adjourned in memory of Thomas Gillam, former West Covina Councilmember. Jessica Shewmaker Jessica Shewmaker, West Covina resident, addressed comments made by Mayor Pro Tem Touhey at a previous meeting regarding an incident at a school district campus and statements by her father regarding the recent police incident and also expressed her disappointment of a comment made by a councilmember which insinuated that Candidate Redholtz was involved in a "hit piece" during the election. Mayor Pro Tern Touhey responded by reiterating and clarifying his comments. Forrest Wilkens Forrest Wilkens, West Covina resident, congratulated the newly elected and re-elected councilmembers; addressed a campaign flyer circulated prior to the election and his follow-up investigation of the origin of the flyer and addressed campaign donations made to area politicians by Athens Services. Irene Fleck Irene Fleck, West Covina resident, expressed her opposition to the proposed medical building on the Civic Center site. Carolyn Arndt Carolyn Arndt, West Covina resident, spoke in opposition to the proposed development on the Civic Center site and provided the Council with a listing of vacant medical buildings in West Covina. Beverly Bulthius Beverly Bulthius, West Covina resident, requested the City Council reject the proposal by CGM Development. Jerry Sanchez Jerry Sanchez, West Covina resident, addressed the abundance of cars on the streets at Shadow Oak and the amount of cars parked at individual residences. Bertie Azpetia Bertie Azpetia, West Covina resident, congratulated Mayor Herfert and Fred Sykes; addressed a recent blackout in her apartment complex and her disappointment with agencies such as the Red City Council/CDC Minutes December 6, 2011 Cross who did not check on the elderly during power failures; commented on overnight street parking and the need for overnight permit parking. Bruce Leinbach Bruce Leinbach, West Covina resident, reminded the audience that the West Covina High School Bulldogs will be playing for the championship this week; congratulated the City for their award as most business friendly City in L.A. County; addressed lack of video streaming of Council meetings; addressed the hit piece campaign flyer; expressed his opposition to the medical building development and the date the hearing is being held as inconvenient right before Christmas and also stated West Covina is a great place to live. John Shewmaker John Shewmaker, West Covina resident, addressed a misunderstanding .of his remarks regarding the Police Department and stated his concern for the public's safety. Mayor Pro Tem Touhey addressed Mr. Shewmaker's comments. Jefferson DeRoux Jefferson DeRoux, West Covina resident, thanked the Council for the results of the Traffic Study at Cameron and Lark Ellen Avenues. Councilmember Sanderson addressed the speaker's comment regarding the date of the public hearing for the Civic Center project stating an appeal must be heard within a specific time frame. City Council/CDC Minutes December 6, 2011 ELECTION RESULTS AND COUNCIL REORGANIZATION Election Results Official Election Results of the November 8, 2011 General 7) Municipal Election Election Results Staff report was presented by Assistant City Clerk Rush announcing the certified results of the 2011 General Municipal Election. Motion Motion by Touhey and seconded by Lane to adopt the following resolution. Motion carried by 4 — 0. Resolution No. 2011-57 RESOLUTION NO. 2011-57 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD NOVEMBER 8, 2011 DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW Administration of Oath of Office Steve Herfert Assistant City Clerk Rush administered the Oath of Office to newly re-elected Councilmember Steve Herfert and presented him with a Certificate of Election. Fredrick Sykes California State Assemblyman Roger Hernandez and former West Covina Councilmember administered the Oath of Office to newly elected Councilmember Fredrick Sykes and presented him with a Certificate of Election. Councilmember Sykes then took his seat at l the dais. Brief Comments by Newly elected and re-elected officials Fredrick Sykes Councilmember Fredrick Sykes briefly expressed his gratitude to the public for their support. Steve Herfert Councilmember Steve Herfert thanked the residents for their support, his parents, wife Jan, children, his council colleagues, the staff and announced the highlight of the past year as the birth of his first grandchild, Mackenzie. Fredrick Sykes Councilmember Fredrick Sykes thanked his family, his father, brothers, sisters, his wife Dana and the public. Council Reorganization ' Mayoral Succession Order Mayor Herfert announced the Mayoral Succession order. Motion Motion by. Herfert and seconded by Sanderson to uphold the Mayoral Succession and install Mayor Pro Tem Michael Touhey as Mayor and Councilmember Sherri Lane as Mayor Pro Tem. Motion carried by 5 — 0. Michael Touhey Morgan and Brandon Touhey, children of Michael Touhey, and Mrs. Touhey, administered the Oath of Office to Mayor Michael Touhey. Mayoral Plaque Mayor Michael Touhey presented outgoing Mayor Steve Herfert with the Mayoral plaque. Mayor Touhey thanked Councilmember Herfert for his year as Mayor. Comments New Mayor Mayor's Comments Mayor Touhey thanked his family and friends for their support over the years and made brief comments regarding the upcoming year. al ff _ City Council/CDC Minutes December 6, 2011 Comments by Councilmembers Mayor Pro Tern Mayor Pro Tern Lane thanked Councilmember Herfert for his service as Mayor and congratulated Councilmember Sykes on his election. Councilmember Sanderson Councilmember Sanderson congratulated Councilmember Herfert for his service to the City as Mayor. She also congratulated Mayor Touhey and Mayor Pro Tern Lane and thanked the staff and friends and community. Sanitation District Representative Designation of Alternate to Los Angeles County Sanitation District Mayor Touhey announced that as Mayor he will serve as the representative to the Los Angeles County Sanitation District but an alternate is required. Motion by Sanderson and seconded by Herfert to appoint Mayor Pro Tern Sherri Lane as alternate to the Los Angeles County Sanitation District. Motion carried by 5 — 0.
