05-18-2010 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL May 18, 2010 Mayor Sanderson called to order the regular meeting of the West Covina City Council at 7:03 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. ,INVOCATION PLEDGE OF ALLEGIANCE ROLL CALL Andrew Pasmant, City Manager Mayor Pro Tern Herfert Mayor Sanderson, Mayor Pro Tern Herfert Councilmembers Herfert, Lane, Touhey REPORTING OUT FROM CLOSED SESSION None. CHANGES TO THE AGENDA City Manager Pasmant announced a correction to Item G-1 — 2010-11 Fiscal Year Preliminary Budget Preview due to an error related to the 2010 Year End Estimates for Account 110-11-1110- 6040 through 110.11.110.6050. Corrected pages were made available. PRESENTATIONS Mayor Sanderson presented Mary Donielson, Principal of Orangewood Elementary School, and Denise Patton, Principal of San Jose Edison Academy, certificates of recognition for receiving the Title I Achievement Award from the California Department of Education. Mayor Sanderson, assisted by Police Chief Wills, introduced and recognized Mr. Chuck Foote for establishing and coordinating the Baker to Vegas Police Relay. Mayor Sanderson, assisted by Tony Nunez and Mike Wooten from South Hills High School, introduced the members of the South Hills School Percussion Ensemble who recently won the Gold Medal at the 2010 Winter Guard International World Championships. Mayor Sanderson presented Public Works Director Shannon Yauchzee with a Proclamation designating May 16-22, 2010 as Public Works Week. ORAL COMMUNICATIONS Larry Whithorn Larry Whithorn, West Covina Fire Department, expressed concerns with the proposed cuts to the Fire Department that will affect service to the community. Travis Tibbets Travis Tibbets, on behalf of West Covina Police Officers Association, expressed the association's opposition to the proposed cuts that would affect the safety of the residents. City Council Minutes of May 18, 2010 Cory Cisneros Cory Cisneros; oh behalf of West Covina Firefighters Association, thanked the City and the surrounding communities for their donations to the Muscular Dystrophy Association. Mike Fountain Mike Fountain, President of West Covina Firefighters Association, requested council to consider the consequences of the proposed cuts to the fire department and that these cuts would reduce response times to emergency calls. Doug Murray Doug Murray, West Covina Police Department, addressed concerns over the proposed cuts to Police budget and asked that Police Chief be given time to explore other ways of making cuts. Gene Huber Gene Huber, West Covina resident, spoke in support of the police and fire departments and addressed discretionary and non -essential activities of the city, which should be eliminated before any reductions to public safety. Ed Cano Ed Cano, West Covina resident, stated it is the responsibility of the Council to protect and preserve the police and fire departments and expressed his disapproval of awarding a. contract to Athens without a bid process. Bill Schafer Bill Schafer, West Covina resident, expressed concerns with budget cuts to public safety. Fred Sykes Fred Sykes, West Covina resident, addressed several issues relating to health and welfare; requested council consider a ban on tobacco in parks; addressed vehicles driving on sidewalks at Shadow Oak Park; vagrants causing blight throughout the city; graffiti at the schools; and city contracts. Joanne Wilner Joanne Wilner, West Covina resident, concerned with previous speakers in regards to preservation of public safety; inquired into income and debt relating to Big League Dreams; addressed finding other areas to cut to prevent cuts to Police and Fire. Yolanda Saldana Yolanda Saldana, West Covina resident, addressed personal situation in which the Fire Department responded and saved a family member's life and requested Council reconsider the cuts to Fire and Police departments. Lloyd Johnson Lloyd Johnson, West Covina resident, expressed his disapproval of graffiti contractor's work; addressed tow company revenues and requested a performance report from the police department on towing companies' response time and working relationships; expressed opposition to reductions in Fire Department budget; opposed cuts to SWAT Team. Mario Garcia Mario Garcia, West Covina resident, introduced himself and his company, which provides. portable fencing and restrooms and offered his services to the city. Commissioner's Term of Office Recommendation is that the City Council introduce the following ordinance: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING SECTIONS 2-68 AND 2-69(c) OF CHAPTER 2, ARTICLE III, OF THE WEST COVINA MUNICIPAL CODE TO ELIMINATE THE STAGGERING OF COMMISSIONERS TERMS OF OFFICE D-3b Miscellaneous — Community Services Department Grant Application for Galster Authorization to Apply for a State Grant for Construction of a Nature Center Permanent Facility to House the Galster Nature Center Recommendation is that the City Council: 1: Authorize the application to the Nature Education Facility Program Funds Grant for construction of a permanent facility to house the Galster Nature Center. 2. Approve and adopt the following Resolution: Resolution No. 2010-25 RESOLUTION NO. 2010-25 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE APPLICATION FOR NATURE EDUCATION FACILITY PROGRAM FUNDS SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 D-3c Miscellaneous - Police Department 2009 SLESF Grant 2009 Supplemental Law Enforcement Services Fund (SLESF) Recommendation is that the City Council: 1. Accept the Supplemental Law Enforcement Services Fund (SLESF) grant, and appropriate the $100,000 grant from the fund balance of Fund 155 as follows: • $29,630 into 155.31.3110.6120 for Graffiti Tracker service • $14,200 into 155.31.3110.7160 for LIDAR traffic enforcement items • $56,170 into 155.31.3110.7170 for two patrol vehicles, conversion costs, etc. 2. Find that Los Angeles County RFB#IS-232810-1 for Ford Police Interceptors satisfies West Covina's bid process and authorize the purchase of two (2) vehicles per specifications, directly from Wondries Fleet Group of Alhambra for $48,614.80 including taxes and fees, from account 155.31.3110.7170. D-3d 2010 BJA Justice Assistance Grant 2010 BJA Justice Assistance Recommendation is that the City Council approve the 2010 BJA Grant Justice Assistance Grant and authorize the appropriation of an estimated $43,896 for future grant purchases, as follows: • $5,811 into 208.31.3115.5113 for supplemental overtime for enforcement and training • $5,000 into 208.31.3115.6220 for public safety and counter terrorism items • $5,000 into 208.31.3115.6215 for police computer supplies • 28,085 into 208.31.3115.7170 for one patrol vehicle C City Council Minutes of May 18, 2010 D-3e Private Grant (Kaiser Permanente) for Victim Services Overtime Kaiser Grant for Victim and Training Services Recommendation is that the City Council accept the new Kaiser Permanente grant and appropriate this $5,000 grant as follows: • $3,000 into 221.31.3114.5113 for overtime • $2,000 into 221.31.3114.6050 for training D-3f Asset Forfeiture Funds for . Service Group WCSG Asset Forfeiture Funds Development and Implementation Projects Recommendation is that the City Council appropriate $375,939 in federal asset forfeiture from the fund balance of Fund 117 to fund supplemental West Covina Service Group development and implementation projects, and make the following appropriations: $25,000 into 117.31.3119.5113 for overtime $10,000 into 117.31,3119.6050 for training and materials $240,939 into 117.31.3119.6220 for project supplies • $100,000 into 117.31.3119.7160 for project equipment D-4 Councilmember Reports Auto Repair Businesses Request from Mayor Shelley Sanderson Requesting the City Council Amend the Municipal Code to Adopt Clear and Concise Regulations to Address Auto Repair Businesses Operating in Residential Zones Recommendation is that the City Council adopt the following resolution: Resolution No. 2010-26 RESOLUTION NO. 2010-26 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, INITIATING CODE AMENDMENT NO. 10-02 RELATED- TO AUTO REPAIR BUSINESSES OPERATING IN RESIDENTIAL ZONES CONSENT CALENDAR ACTION Motion by Herndndez and seconded by Lane to approve all items on the Consent Calendar as recommended. Motion carried 5 — 0. DEPARTMENTAL MATTERS G-1 FINANCE DEPARTMENT 2010-11 Budget Preview 2010-11 Fiscal Year Preliminary Budget Preview Introduction to the City's budget was presented by City Manager Pasmant. Mr. Pasmant emphasized the current economic crisis and the limited choice to preserve basic services. Finance Director Bachman presented a PowerPoint presentation detailing the current financial crisis facing the City, a review of past service reductions, overview of the proposed 2010- 11 budget with focus on the General Funds, review of proposed cuts to reduce the deficit and the need for change and developing a sustainable budget. The presentation highlighted that a status quo rollover budget contains an operating deficit of $8.7 million and if no action is taken all cash reserve will be depleted at the end of the 2010-11 fiscal year. Councilmember addressed several issues at the State level in which the City has no control and commented on the limited use of restricted funds. Councilmember Herndndez stated that proposed cuts are on the backs of public safety and requested staff to return with a proposal more aligned with the priorities of the community and recommended the elimination of all travel and conference budgets, except those that would constitute economic development for the city, and the reduction of positions of unequal levels throughout the city. Herndndez stated he would not support the budget and proposed reductions to the 2010-11 deficit. .19 City Council Minutes of May 18, 2010 Motion Following further comments as to the need to make tough decisions, partner with employee groups to develop options to reduce the deficit and to educate the community to eliminate a possible emergency financial situation, motion by Herfert and second by Touhey to approve the budget and as presented and proposed reductions. Substitute Motion Substitute motion by Hernandez to not make any decision tonight and to return in 30 — 45 days with a better thought out proposal aligned with the requests of the community. Motion died for lack of a second. MAYOR'S/COUNCILMEMBERS REPORTS AB1234 Conference and Meeting Report Mayor Pro Tem Herfert stated he attended the Contract Cities Conference in Indian Wells and attended several sessions regarding economic issues facing cities.
