REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
December 1, 2009
Mayor Hernandez called to order the regular meeting of the West Covina City Council at 7:10 p.m. in
the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

REPORTING OUT FROM CLOSED SESSION
Deputy City Attorney Scott Nichols reported the following:
All members were present except Mayor Pro Tem
Sanderson and Councilmember Touhey.
Prior to convening into closed session, all items on the City
Council and Community Development Commission (CDC)
agendas were announced for inclusion in the closed session
discussion.
Items on the City Council agenda:
Conference with Legal Counsel — Anticipated Litigation —
One Case — Council voted 3 — 0 to retain legal counsel regarding
this matter.
Conference with Legal Counsel — Existing Litigation —
Mendoza, et al vs. City of West Covina — Deputy City Attorney
stated there was no final action and nothing further to report.
Items on the CDC Agenda:
Conference with Real Property Negotiators — 1420 South
Willow Avenue — Council unanimously voted to approve the sale.
CHANGES TO THE AGENDA No changes.
PRESENTATIONS Mayor Hernandez called forward Michelle McNeill, Community
Services Director, to present Marion Landesman, Senior Citizens
Program Coordinator with a Resolution of Commendation for her
service to the City and the seniors of West Covina. Ms.
Landesman is retiring with eleven years of service.
Mayor Hernandez announced the unveiling of the . City's new
website with a display onscreen showing the new features and
information available to residents and businesses as well as
visitors.
ORAL COMMUNICATIONS
Bruce Leinbach Bruce Leinbach, West Covina resident, congratulated the reelected
councilmembers; thanked Mayor Hernandez for doing a good job;
and spoke on PEG funds and the lack of cable tv access..

Jorge Marquez Jorge Marquez, Field Representative for Assemblyman Dr. Ed
Hernandez, announced the Holiday Toy Drive on December 14,
2009 at Torch Middle School at the Watanabe Center.

Irene Fleck Irene Fleck, West Covina resident, announced. Library activities for
the month of December; announced West Covina Beautiful and the
City's Anniversary, and thanked the Council for their support of
the West Covina Symphony Orchestra.
Fred Sykes Fred Sykes, West Covina resident, congratulated the winners of the
November 3 election; spoke on voter participation and registration,
the importance of voting, and addressed cable tv access to council
meetings.
Alfred Williams Alfred Williams, West Covina resident, addressed community
participation in meetings, cable tv access and costs to provide the
service.
Jesus Moreno Jesus Moreno, West Covina resident, spoke in support of Tacos
Hernandez and allowing them to return to their former location.
Jeremy Moreno Jeremy Moreno, West Covina resident, spoke in support of Tacos
Hernandez and requested they be allowed to return to the former
location.
Jesus Lepe Jesus Lepe, West Covina resident, requested the City reconsider
returning Tacos Hernandez to the former location.
Isidro Parra Isidro Parra, Covina resident, spoke on behalf of Tacos Hernandez
requesting to return them to the former location.
Olga Lepe Olga Lepe, West Covina resident, addressed concerns regarding
problems with her mobile food vender business and the permit
issued by the City.
Mayor Hemdndez addressed comments regarding the
speaker's comments and requested staff look into the matter.
Frank Williams Frank Williams, West Covina resident, spoke on voter
participation and praised the many volunteers who were involved
in the election process; addressed the City's progress and growth.
Birdie Azpetia Birdie Azpetia, West Covina resident, congratulated the reelected
councilmembers and expressed her delight for the district ballot
measure not passing.

Garvey Avenue to Puente Avenue be reviewed.

Treasurer's Report
Traffic Committee Recommendation:
That stop signs, stop ahead signs, and appropriate pavement
markings be placed on the north and southbound approaches on
Orange Avenue at Pacific Lane.
That right edge striping be added along Orange Avenue from
North Garvey Avenue to Puente Avenue.
That the radar trailer be utilized to make drivers aware of their
vehicle speed along Orange Avenue and the Police Department
increase speed enforcement as feasible.
That the speed feedback sign be relocated from Morris Avenue
and be installed along Orange Avenue between Pacific Lane
and Puente Avenue.
That pedestrian crossing signs and advance warning signs be
installed for the marked crosswalk on Orange Avenue at
Thelborn Avenue.
That "No Trucks Over 3 tons" signs be installed on Orange
Avenue at Puente Avenue and Pacific Lane.

D-5a Miscellaneous — Community Services Department
Commercial Marketing Program Request to Begin Commercial Marketing Program that will Utilize
Go -West and Dial -A -Ride Transit Fleet as Moving Billboards
Recommendation is that the City Council approve the concept of
utilizing the City's transit fleet as moving billboards; authorize the
City Manager to negotiate and execute a contract to operate a
segment of the transit marketing program; and direct staff to brand
and develop "Shop West Covina" bus wraps. This program would
be funded from CDC's Economic Development budget.
D-5b Request for Cameron Park Lighting for the Annual Toys for Tots
Cameron Park Lighting Tournament
Recommendation is that the City Council authorize the use of
Cameron Park Field lights on Friday and Saturday, December 11-
12, 2009 for the West Covina Girls Softball Toys for Tots
Tournament.
D-5c Miscellaneous — Public Works Department
Funds Transfer for Street Rehab Additional Transfer of Funds to the Residential Street
Rehabilitation Work (Project No. SP-09106)
Recommendation is that the City Council approve the transfer of
$150,000 of Prop 42 Traffic Congestion Relief Funds from Project
No. SP-10105 (Account No. 125.81.8026.7200) to Project No. SP-
09106 (Account No. 125.81.8925.7200).

D-5d Miscellaneous — Risk Management
Workers' Comp Award of Contract — Workers' Compensation Third Party
Claims Administration Services Contract
Recommendation is that the City Council authorize the City
Manager and City Clerk to execute a five-year contract with
CorVel Corporation, Inc. to provide Workers' Compensation Third
Party Administration (TPA) Services, effective January 1, 2010.
CONSENT CALENDAR ACTION Motion by Touhey and seconded by Sanderson to approve all
items. Motion carried by 5 — 0.
COMMUNITY DEVELOPMENT COMMISSION.
Mayor Hernandez recessed the City Council meeting at 7:57 p.m.
to convene the Community Development Commission meeting.
The City Council reconvened at 7:59 p.m. with all members
present.
ELECTION RESULTS AND COUNCIL REORGANIZATION
Official Results of the November 3, 2009 General Municipal
Election
J-1 2009 General Election Staff report was presented by Deputy City Manager Chris
Freeland announcing the certified results of the 2009 General
Municipal Election.
Deputy City Manager presented:

2009 General Municipal Election COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA,

ELECTION HELD NOVEMBER 3, 2009, DECLARING THE
RESULTS THEREOF
Motion Motion by Touhey and seconded by Herfert to approve the
resolution as recommended and adopt. Motion carried 5-0.
J-2 Administration of the Oath of Office
Sherri Lane City Clerk Carrico administered the Oath of Office to newly re-
elected Councilmember Sherri Lane and presented her with a
Certificate of Election.
Michael Touhey City Clerk Carrico administered the Oath of Office to newly re-
elected Councilmember Michael Touhey and presented him with
a Certificate of Election.
Shelley Sanderson City Clerk Carrico administered the Oath of Office to newly re-
elected Councilmember Shelley Sanderson and presented her with
a Certificate of Election.
Council Reorganization
J-3 Mayor Hernandez requested a motion to uphold the Mayoral
Succession order.
Motion Motion by Touhey and seconded by Lane to uphold the succession
and install Councilmember Shelley Sanderson as Mayor and Steve
Herfert as Mayor Pro Tem.
Motion carried by 5-0.
Brief Comments by New Mayor
Mayor's Comments Mayor Sanderson thanked the community and her family for their
support and made brief comments regarding the upcoming year.

Brief Comments by Councilmembers
Mayor Pro Tem Mayor Pro Tem Herfert thanked the community and friends for
their support, made comments regarding the election and stated he
looks forward to continue to improve the City.
Mayor Pro Tem Herfert also addressed possible election
reporting violations.
Presentation of Mayoral Plaque to outgoing Mayor Hernandez
Mayor Sanderson presented outgoing Mayor Roger Herndndez
with the traditional Mayoral plaque for his past year as Mayor of
West Covina.
Roger Herndndez Former Mayor Herndndez thanked the community and fellow
councilmembers recapping some of the City's projects and success
during the downturn in the economy.
Continue Comments by Councilmembers
SherriLane Councilmember Sherri Lane thanked her family and friends for
their support, and congratulated the reelected councilmembers and
former Mayor Herndndez.
Michael Touhey Councilmember Touhey thanked his family for their support and
friends from surrounding areas.
Designation of Alternate to L.A. County Sanitation District
Mayor Sanderson requested nominations for Council to designate
an alternate to the Los Angeles County Sanitation District.

at 8:37 p.m. in memory of Harold Blackard and Joseph J.
