10-20-2009 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL October 20, 2009 Mayor Hernandez called to order the regular meeting of the West Covina City Council at 7:06 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION PLEDGE OF ALLEGIANCE ROLL CALL Absent Reverend Alexandra Conrads St. Martha's Episcopal Church Councilmember Herfert Mayor Hernandez Councilmembers Herfert, Lane, Touhey Mayor Pro Tern Sanderson REPORTING OUT FROM CLOSED SESSION The special meeting with a scheduled closed session item did not take place. CHANGES TO THE AGENDA No changes. PRESENTATIONS Mayor Hernandez called forward West Covina Fire Explorer Tony Saldana who was selected by the Los Angeles County Fair as one of West Covina's Hometown Heroes. Tony assists the Fire Department and volunteers at many of West Covina's city functions. Mayor Hernandez called forward Glenn Kennedy who was also selected by the Los Angeles Count Fair as one of West Covina's Hometown Heroes. Glenn volunteers his time with the City of West Covina Volunteer Graffiti Abatement Program and several groups in the community. Jennifer Quan, Regional Public Affairs Manager for the League of California Cities presented the City of West Covina the Helen Putnam Award for Excellence for the West Covina Commercial Center and Sportsplex. Mayor Hernandez called forward Police Chief Wills who introduced members of the West Covina Police Explorers (Post 499) and recognized them for taking first place at the Explorer Games Competition in Pasadena. Mayor Hernandez presented Public Works Director Shannon Yauchzee with a proclamation designating November 15, 2009, as America Recycle Day. ORAL COMMUNICATIONS Larry Ward Larry Ward, representing Holiday Retirement Corporation who owns and operates Bridgecreek Retirement Home, requested the City Council's assistance with expediting the permit process involved with the upgrading of the elevators at Bridgecreek Retirement Home. City Council Minutes of October 20, 2009 Olga Lepe Olga Lepe, West Covina resident and owner of catering truck, expressed to council that she had lost her location for her catering truck due to the new ordinance and requested council's consideration to be able to, relocate back to her original location. Harvey Sherman Harvey Sherman, West Covina resident, expressed his concerns regarding the lack of installation of Verizon Vios in his neighborhood. Public Works Director Yauchzee responded that Verizon has currently postponed the installation due to the economy. Lloyd Johnson Lloyd Johnson, West Covina resident, addressed the candidates forum hosted by the California League of Women's Voters and commented on one candidates response to a question regarding council districts. Per Resolution No. 2009-25 adopted June 2, 2009, when titles of ordinances and resolutions appear on the City Council agenda, they shall be deemed to have been read by title and further reading is waived. Authorize the Assistant City Manager to execute an amendment to its current Software License and Use Agreement with Tyler Technologies, Inc. (formerly Eden Systems) to purchase a new project account software system in an amount not to exceed $37,198 including license fees, taxes and all professional services necessary to implement the system, and 2. Appropriate an additional $5,398 to 161.84.8008.7900 from the Construction Tax Fund balance reserves of Fund 161. Miscellaneous — Finance Department D-4a Proposition lA Securitization Program rTax-Exempt Proceeds) Proposition lA Recommendation is to adopt the following resolution: Resolution No. 2009-62 RESOLUTION NO. 2009-62 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE FORM OF AND AUTHORIZING THE EXECUTION AND DELIVERY OF A PURCHASE AND SALE (AGREEMENT AND RELATED DOCUMENTS WITH RESPECT TO THE SALE OF THE SELLER'S PROPOSITION IA RECEIVABLE FROM THE STATE; AND DIRECTING AND AUTHORIZING CERTAIN OTHER ACTIONS IN CONNECTION THEREWITH CONSENT CALENDAR ACTION Motion by Herfert and seconded by Lane to adopt the resolution as recommended and approve all other items. Motion carried 4-0. City Council Minutes of October 20, 2009 PUBLIC HEARINGS E-1 Hearing Continued Appeal Hearing Precise Plan No. 07-07 Conditional Use Permit No. 08-05 Tree Removal Permit No. 08-05 Negative Declaration of Environmental Impact Applicant/Appellant: Roland Cordero (Foothill Transit) Foothill Transit submitted a letter requesting the hearing be rescheduled to December 15, 2009 due to a scheduling conflict. Motion by Herfert and seconded by Lane to continue the hearing to December 15, 2009. Motion carried 4-0. COMMUNITY DEVELOPMENT COMMISSION No meeting scheduled. COUNCILMEMBER COMMENTS Mayor Hernandez reiterated a previous requested for an update on the Senior Villas II project. ADJOURNMENT Motion by Herfert and seconded by Hernandez to adjourn the City Council meeting at 7:56 p.m. in memory of: • David Chung, father of Community Development Director Chris Chung, and • Harold Sarnecki, previous City Commissioner.
