10-06-2009 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL October 6, 2009 Mayor Hernandez called to order the regular meeting of the West Covina City Council at 7:09 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. CHANGES TO THE A PRESENTATIONS ORAL COMMUNICATIONS Herb Redholtz Elsie Messman No changes. Mayor Hernandez called forward Police Chief Frank Wills and Stephan Ichiriu, Pastor of Campus Ministries at Faith Community Church. Chief Wills recognized Faith Community Church and Pastor Ichiriu for the use of their facility and their assistance in the Police Department's recent training and presented the church with a plaque thanking them. Police Chief Wills introduced Police Officer Peter Gallardo and his K9 partner Quattro, who is retiring from service with the City. Mayor Hernandez presented Officer Gallardo with a plaque recognizing Quattro. Mayor Hernandez presented Dr. Davi& Alfaro of West Covina Rotary with a proclamation designating October 18 — 24, 2009 as Red Ribbon Week. Dr. Alfaro announced the Red Ribbon Rally at West Covina High School on October 24, 2009. Mayor Hernandez introduced Jose Martinez and Genoveva Arellano who made a video presentation on the proposed California High Speed Rail project. Herb Redholtz, West Covina resident, addressed campaign material that was being distributed with the County seal printed on the material and requested an explanation as to the criteria of such use and possible election law violation. Elsie Messman, West Covina resident, expressed concerns with campaign signs being removed from yards; addressed the distribution of West Covina •Discover newsletter; and restated a concern she previously brought forward regarding vacant property at the West Covina Heights that is still not developed. City Council Minutes of ber 6, 2009 Councilmembers Touhey and Lane responded to comments regarding missing campaign signs. Mayor Pro Tern Sanderson requested the City Attorney respond to the question regarding the use of seals on campaign material. City Attorney Alvarez-Glasman stated he would not comment on the use of the County seal due to the County reviewing the issue at this time; however the use of any local or governmental seal is not permitted under the Elections.,Code on campaign material without permission. The use of the City seal with the intent to mislead or misrepresent matters to the voters can be a misdemeanor and prosecuted by the District Attorney's Office. Per Resolution No. 2009-25 adopted June 2, 2009, when titles of ordinances and resolutions appear on the City Council agenda, they shall be deemed to have been read by title and further reading is waived. Award of Bid for Citywide Street Rehabilitation Improvements, Street Barrier Removal, and Curb and Gutter Repair, and D-4b Construction of Storm Drain on Workman Avenue Recommendation is that the City Council accept the bid of Gentry Street Rehab etc. Brothers, Inc. in the amount of $2,143,412 as submitted at the bid opening on September 22, 2009, and authorize the Public Works 2 City Council Minutes of 6, 2009 D-4c Street Rehab D-5 Traffic Committee D-6 Treasurer's Report D-7a Grant Director/City Engineer to execute an agreement with Gentry Brothers, Inc. for the work to be done. Award of Bid for Project No. SP-09111 — Major Street Rehabilitation Improvements, American Recovery and Reinvestment Act of 2009, Federal Project ESPL-5259 (018) Recommendation is that the City Council accept the bid of All American Asphalt in the amount of $2,586,500.00 as submitted at the bid opening on September 1, 2009, and authorize the Public Works Director/City Engineer to execute an agreement with All American Asphalt to perform the work. Traffic Committee Minutes of September 15, 2009 (accept and file) I. City Initiated Annual Intersection Collision Rate Report for the year 2008 (informational). Traffic Committee Recommendations: That 85-feet of curb on the north side of Cameron Avenue east of Evanwood Avenue be painted red and 85-feet of curb of the south side of Cameron Avenue west of Evanwood Avenue be painted red. That staff prepare warrants for the installation of a multi -way stop and/or traffic signal at the intersection of Orange Avenue and Pacific Lane. That 20-feet of curb on the east side of Ardilla Avenue south of Pacific Avenue be painted red. Submit request to the City of Baldwin Park to paint 70-feet of curb on the south side of Pacific Avenue west of Ardilla Avenue red. That 70-feet of curb on the south side of La Puente Road west of Forecastle Avenue be painted red. That staff continue to monitor Ardilla Avenue at Pacific Avenue, Forecastle Avenue at La Puente Road, and Lark Ellen Avenue at Vine Avenue intersections. II. Quan Tran, West Covina Resident Review traffic control devices on Hillside Drive between Alpine Drive and Rolling Hills Drive. Traffic Committee Recommendations: That advance curve warning signs (W1-5) be installed on Hillside Drive between Alpine Drive and Rolling Hills Drive. That speed limit signs with Radar Enforced plate be installed on Hillside Drive east of Hollencrest Drive and west of Rolling Hills Drive. City Treasurer's Report (receive & file) Report for the Month of August 2009 Miscellaneous — Police Department 2009 Recovery Act Edward Byrne Grant Competitive Grant for Civilian Police Support Personnel Recommendation is that the City Council: 3 City Council Minutes of ber 6, 2009 D-7b Police Dept. Grants CONSENT CALENDAR 1. Appropriate the 2008 State Homeland Security grant, totaling $255,831, as follows: • $83,710 into 228.31.3120.5111 (CSO salary) • $34,112 into 228.31.3120.5XXX (CSO benefits) • $92,532 into 228.31.3116.5111 (Dispatcher salary) • $37,707 into 228.31.3116.5XXX (Dispatcher benefits) • $3,000 into 228.31.3110.6050 (USDOJ-sponsored grant meetings) 2. Authorize one additional CSO position and one additional Dispatcher position. 3. Authorize the future appropriation of the retention funding using local funds for 1 year for these 2 positions, as required under the terms of the grant by the U.S. Department of Justice, at the conclusion of the grant in FY 2011-2012. State Office of Traffic Safety (OTS) Selective Traffic Enforcement Prop -ram (STEP) Grant It is recommended that the City Council accept the 2006 California Office of Traffic Safety (OTS) Selective Traffic Enforcement Program (STEP) grant for traffic enforcement overtime activities, • $43,237 in 198.31.3110.5113 (traffic enforcement overtime) • $2,500 in 198.31.3110.6050 (grant travel and training) ACTION Motion by Sanderson and seconded by Touhey to adopt the ordinances as recommended and approve all other items. Motion carried 4-0. COMMUNITY DEVELOPMENT COMMISSION Mayor Hernandez recessed the Council meeting to convene the Community Development Commission meeting at 7:56 p.m. The City Council reconvened at 7:57 p.m. with all members present. Motion by Sanderson and seconded by Touhey to instruct staff to prepare a report with options. Councilmember Touhey requested that alternatives be considered for areas that don't allow any off street parking (i.e. homes with short driveways, alley parking only). Motion carried 4-0.
