Garvey Avenue, West Covina. INVOCATION Andrew Pasmant City Manager PLEDGE OF ALLEGIANCE Councilmember Herfert ROLL CALL Mayor Hernandez, Mayor Pro Tem Sanderson, Councilmembers Herfert, Lane, Touhey (arrived at 7:15 p.m.) REPORTING OUT FROM CLOSED SESSION Deputy City Attorney Scott Nichols reported the following: Prior to convening into closed session, all items on the City Council and Community Development Commission (CDC) agendas were announced for inclusion in the closed session discussion. Items on the City Agenda: Conference with Labor Negotiators — Employee Organizations: Confidential Employees, General Employees, Maintenance & Craft Employees, and Mid -Management Employees - City Manager briefed the City Council on the teens of the various agreements with the groups, there was no reportable action taken. Conference with Labor Negotiators — Unrepresented employees: Police Chief and Fire Chief — City Manager gave a presentation - there was no reportable action taken. Item on the CDC agenda: Conference with Real Property Negotiators —_ AAA Pad located Northeast corner of Azusa and Giambi Lane — Commission 'received a briefing regarding negotiations for the possible disposition/development of that property - there was no reportable action taken. CHANGES TO THE AGENDA City Manager Pasmant announced that the noticing requirement for the public hearing regarding Foothill Transit was properly published; however the mailed notices were not properly mailed within the required timeframe. Based upon this circumstance it is recommended that this matter not be heard but continued to a further council meeting. Foothill Transit requested the item be held until October 20, 2009. Deputy City Attorney Nichols stated the hearing needed to be opened and continued to October 20, 2009. E-1 Public Hearing Appeal Hearing Precise Plan No. 07-07 Conditional Use Pen -nit No. 08-05 Tree Removal Permit No. 08-05 Negative Declaration of Environmental Impact Applicant/Appellant: Roland Cordero (Foothill Transit) Motion by Herfert and seconded by Sanderson to open the public hearing and continue to the meeting of October 20, 2009. Motion carried 4-0. City Council Minutes of Septemberl5, 2009 Nichols announced that the item will be continued to October 20, 2009, no additional notices will be required to be sent, unless the City Clerk's Office wishes to send new mailed notices. PRESENTATIONS Mayor Hernandez called forward John Hughes, Chairman of the West Covina Muscular Dystrophy Association Volunteer Committee who discussed this year's MDA fundraising programs and recognized Firefighter/paramedic Adam Berger and Fire Chief Segalla for the success of their "Fill the Boot" fundraiser which raised over $13,000. Fire Chief Segalla introduced Los Angeles County Firefighter Eric Calderon and Los Angeles County Utility Driver Santos Luna for saving the life of their teammates while playing softball at Big League Dreams. Mayor Hernandez presented Fire Chief Segalla with a Proclamation for Fire Prevention Week, October 4-10, 2009. ORAL COMMUNICATIONS Kathleen Newman Kathleen, Newman, West Covina resident, informed the City Council of alleged harassment by the Police Department and Code Enforcement Division of Public Works. Shirley Buchannan Shirley Buchannan, West Covina resident, addressed the destruction and vandalism of campaign signs in her front yard. Ms. Buchannan distributed photos of the damaged signs. Lloyd Johnson Lloyd Johnson, West Covina resident expressed his dissatisfaction with the Los Angeles County Animal Control in which their delay in response time allowed an injured dog to die. Councilmember Touhey requested City staff send a letter to County Supervisor Antonovich to look into the situation. Elsie Messman Elsie Messman, West Covina resident, announced the success of National Night Out; addressed articles in the West Covina Discover; suggested the city adopt an ordinance requiring cars to be moved on street sweeping days; requested those who are illegally removing campaign signs to stop; and addressed an undeveloped area at the West Covina Heights. Mike Stella Mike Stella, West Covina resident, stated he loves West Covina Discover; addressed parked car issues that prevents the street sweeper from properly sweeping streets; commented on the art project in front of the Penske dealership and lack of the Nissan dealership art project required to be constructed by a developer. Mayor Hernandez requested the posting of "no parking on street sweeping days" be agendized for council consensus. Mayor Pro Tern Sanderson and Councilmembers Lane and Touhey commented on the vandalism of campaign signs. Rodriguez vs. City of West Covina • Marisela Noemy Quintanilla vs. City of West Covina D-4a Cortez Park Trails Resolution 2009-61 D-4b Training Funds D-4c Police Forensic Software Miscellaneous — Community Services Authorization to Apply to the Los Angeles County Regional Park and Open Space District for Fifth Supervisorial District Excess Fundina for Cortez Park Trails Extension Proiect Recommendation is that the City Council: 1. Authorize the application to the Los Angeles County Regional Park and Open Space District for Fifth Supervisorial District Excess Funding via the following Resolution for the Cortez Park Trails Extension Project in the amount of $150,000. 2. Adopt the following resolution: RESOLUTION NO. 2009-91 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT FOR FIFTH SUPERVISORIAL DISTRICT EXCESS FUNDING FOR CORTEZ PARK TRAILS EXTENSION PROJECT Miscellaneous — Fire Department Abnronriation of Fire Department Training Funds Recommendation is that the City Council appropriate $3,257.69 from the Fund Balance in the Fire Training Fund (Fund 219) into the Fire Training account (219.32.3210.6551) for training needs in Fiscal Year 2009-2010. Miscellaneous — Police Department Appropriation of Private Grant from Target for Police Forensic Software Recommendation is that the City Council appropriate the Target grant ($2,000) into account 221.31.3130.6220. D-4d 2008 State Homeland Security Grant Program Security Grant Program Recommendation is that the City Council accept and appropriate the 2008 Statement Homeland Security Grant, totaling $171,345 as follows: • $47,510 into 227.31.3110.6999 (Police digital mapping project) • $123,838 into 227.32.3210.7160 (Fire CBRNE/SCBA rescue equipment) 3 City Council Minutes of Septemberl5, 2009 Purchase of Vehicles and Radios Under 2009 Recovery Act Justice D-4e Assistance Grant Justice Assistance Grant Recommendation is that the City Council: 1. Waive the bid process and authorize the purchase of two used vehicles for Detectives from Reynolds Buick of. West Covina for $35,422.49, including sales tax, from account 208.31.3113.7170. 2. Find that Los Angeles County Contract #18105 for XTL-5000 UHF radios satisfies West Covina's bid process and authorize the purchase of six (6) radios (with motorcycle accessories, software, encryption, etc.) directly from Motorola for $30,829.92, including sales tax and shipping, from account 208.31.3113.7160. CONSENT CALENDAR ACTION Motion by Touhey and seconded by Herfert to adopt the resolution as recommended and approve all other items. Motion carried 5-0. Councilmember Touhey left the meeting at 7:49 p.m. to attend Back to School Night. PUBLIC HEARINGS Appeal Hearing Precise Plan No. 07-07 Conditional Use Permit No. 08-05 Tree Removal Permit No. 08-05 Negative Declaration of Environmental Impact E-1 Applicant/Appellant: Roland Cordero (Foothill Transit) Hearing Continued Action on this item was taken earlier in the evening under "Changes to the Agenda." This hearing was continued to October 20, 2009. COUNCILMEMBER COMMENTS Mayor Pro Tem Sanderson concurred with Mayor Herndndez's earlier request to agendize for council consensus the posting of "no parking on street sweeping days" for council consensus. ADJOURNMENT Motion by Sanderson and seconded by Herfert to adjourn the City Council meeting at-9:04 p.m. in memory of Eddie Miles, grandson of West Covina residents Ed and May Sue Miles; and Morio Marmura, owner of Morios' lawnmower Shop in Baldwin Park.
