08-18-2009 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL August 18, 2009 Mayor Hernandez called to order the regular meeting of the West Covina City Council at 7:12 p.m. in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Pastor Mason Okubo Immanuel First Lutheran PLEDGE OF ALLEGIANCE Councilmember Lane ROLL CALL Mayor Hernandez, Mayor Pro Tern Sanderson, Councilmembers Herfert, Lane Absent: Councilmember Touhey REPORTING OUT FROM CLOSED SESSION None. CHANGES TO THE AGENDA None. PRESENTATIONS Gautam Dutta, Deputy Director of Political Reform Programs for New America Foundation on Choice Voting, presented information on AB1121, a program to change the current voting procedures in California and requested Council's support. Councilmember Herfert commented that he would not be supporting the bill. Mayor Hernandez requested that the item be placed on the next agenda for consideration to endorse the bill. Councilmember discussion ensued with Council consensus to bring to the next meeting as a councilmember request. Mayor Hernandez called forward Mike Quinn, Manager of the American Major League Cardinals, champions of the American City Major League Tournament who introduced his team. Team members received certificates of recognition from the Council. Mayor Hernandez called forward Kurt Lippert, Manager of the American Minor League Padres, champions of the American City Minor League Tournament, who introduced his team.. Team members received certificates of recognition from the Council. Mayor Hernandez called forward Armando Flores, Manager of the National Little League District 19 11-12 year old Allstar Champions, who introduced his team. The team received certificates of recognition from the Council. ORAL COMMUNICATIONS Bonnie Clarke Bonnie Clark of SBPEA and representing the West Covina Non - Sworn Public Safety Unit, addressed the status of the non -sworn public safety Memorandum of Understanding (MOU) and City Council Minutes of August 18, 2009 requested the council to add discussion and approval of the MOU to the agenda. Jesus Antonio Novoa Jesus Antonio Novoa, West Covina resident, requested that the City reconsider speed limit on Orange between Puente and north Garvey due to the frequency of accidents and submitted photos of an accident. Liz Romero Liz Romero speaking on behalf of Jan Poirier read a letter from Ms. Poirier, representative of the Non -Sworn public safety bargaining unit regarding the non -sworn group's MOU. Glenn Kennedy Glenn Kennedy, West Covina resident, commented on previous speaker's concerns of excessive speed and spoke on graffiti. Bruce Leinbach Bruce Leinbach, West Covina resident, addressed project on Workman Avenue and the City not broadcasting council meetings. Council discussion Mayor Hernandez asked City Attorney Alvarez-Glasman whether the non -sworn contract approval could be added to the City Council agenda. City Attorney Alvarez-Glasman responded as to the criteria to add an item to the agenda as an emergency matter. The City Council concurred that the matter needs to be brought to a subsequent meeting. Lauren Becker Lauren Becker addressed a call she made to the District Attorney's office to discuss Brown Act violations. Mayor Hernandez requested that staff look into concerns regarding Orange Avenue speed and traffic flow from Garvey north to San Bernardino Road. L City Initiated That speed limit for Azusa Avenue from south Garvey Avenue to the northerly City limit be established at 40 miles per hour. Traffic Committee Recommendation: That speed limit be established at 40 miles per hour on Azusa Avenue from south Garvey Avenue to the northerly City limit and cause an ordinance to be adopted amending Section 22-132 of the West Covina Municipal Code. II. City Initiated That speed limit for Shakespeare Drive from Nogales Street to Shadow Oak, Drive be established at 35 miles per hour. Traffic Committee Recommendation: That speed limit be established at 35 miles per hour on Shakespeare Drive from Nogales Street to Shadow Oak Drive and cause an ordinance to be adopted to amend Section 22-131 of the West Covina Municipal Code. III. Christina Martinez, West Covina West Covina resident That no parking on street sweeping days be implemented on Ardilla Avenue from Clydewood Avenue to Channing street on the first and third Tuesday of each month from 7:00 a.m. to 3:30 p.m. Traffic Committee Recommendation: That no parking on street sweeping days be implemented on Ardilla Avenue from Clydewood Avenue to Channing street on the first and third Tuesday of each month from 7:00 a.m. to 3:30 p.m. IV Teresa Marquez, Merlinda Elementary School Principal That a passenger -loading zone for school days be established at Merlinda Elementary School on the east side of Valinda Avenue between the southerly and northerly entrances to the school's parking lot. Approve the First Amendment Telecommunications Network License and Encroachment Agreement with Next G to encroach upon and occupy a portion of the Public Right -of - Way for the limited purpose of constructing, installing, operating, and maintaining licensed communications equipment to provide service to wireless carriers. 2. Authorize Licensee to attach telecommunications nodes to certain identified traffic lights or streetlight poles. 3. Authorize the City Manager to execute the First Amendment Telecommunications Network License and Encroachment Agreement and to approve any future phases and proposed node locations. D-8b Prop A Fund Exchange — City of Commerce Prop A Fund Exchange Recommendation is that the City Council approve the agreement authorizing the sale of Prop A Funds to the City of Commerce. Miscellaneous — Fire Department D-8c Medical Evaluations — Award of Professional Services Fire Dept. Medical Evaluations Recommendation is that the City Council approve an award to retain the professional services of Concentra Mobile Health ' Service of Houston, Texas, to provide medical evaluations for the West Covina Fire Department's Wellness and Fitness Program, in an amount not to exceed $39,440.00 Miscellaneous — Human Resources Department D-8d Contract Amendments — FFA & FMA Amendments Firefighters Association (FFA) Fire Management Association (FMA) Recommendation is that the City Council adopt the following resolution: 4 City Council Minutes of August 18, 2009 Resolution No. 2009-56 RESOLUTION NO. 2009-56 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 2008-13, RELATING TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE WEST COVINA FIREFIGHTERS' ASSOCIATION AND RESOLUTIONS NO. 2008-64 RELATING TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE WEST COVINA FIRE MANAGEMENT ASSOCIATION D-8e ' Contract Approval — Miscellaneous Employee Bargaining Units Miscellaneous Employees Contract Recommendation is that the City Council adopt the following resolution: Resolution No. 2009-57 RESOLUTION NO. 2009-57 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING THE PROPOSED MEMORANDUMS OF UNDERSTANDING BETWEEN THE CITY AND THE WEST COVINA MID -MANAGEMENT, CONFIDENTIAL, AND MAINTENANCE AND CRAFTS EMPLOYEES' ASSOCIATIONS; AND THE GENERAL EMPLOYEES' ASSOCIATION (REPRESENTED BY THE SAN BERNARDINO PUBLIC EMPLOYEES' ASSOCIATION (SBPEA) Miscellaneous — Public Works Department D=8f Maintenance of Heating, Ventilation, and Air Conditioning HVAC Maintenance Contract Equipment Contract Extension (Project No. WCMHVAC-02) Recommendation is that the City Council authorize the Public Works Director/City Engineer to approve a contract with Allison Mechanical for a negotiated annual contract for the amount of $108,360, and authorize the Public Works Director/City Engineer and City Clerk to execute the contract extension to provide Heating, Ventilation, and Air Conditioning (HVAC) maintenance services at City facilities for a period of five years with renewal options. CONSENT CALENDAR ACTION Motion by Sanderson and seconded by Lane to introduce/adopt resolutions/ordinances as recommended and approve all items. Motion carried 4 — 0. COMMUNITY DEVELOPMENT COMMISSION Mayor Hernandez recessed the City Council meeting at 8:13 p.m. to convene the Community Development Commission. The City Council reconvened at 8:14 p.m. with all members present except Councilmember Touhey.
