02-17-2009 - Regular Meeting - MinutesMINUTES REGULAR MEETING OF THE WEST COVINA CITY COUNCIL February 17, 2009 Mayor Herndndez called to order the regular meeting of the West Covina City Council at 7:06 p.m in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina. INVOCATION Pastor Doug Wilson Bethany Baptist Church PLEDGE OF ALLEGIANCE Councilmember Lane ROLL CALL Mayor Hernandez, Mayor Pro Tem Sanderson, Councilmember Herfert, Lane, Touhey REPORTING OUT FROM CLOSED SESSION None. CHANGES TO THE AGENDA None. PRESENTATIONS Mayor Herndndez, assisted by Police Chief Wills, recognized Sgt. Walt Hauser, who is retiring after 27 years from the West Covina Police Department and presented him with a resolution of commendation and city tile. Police Chief Wills presented Sgt. Hauser with a Police Department certificate and retirement badge. Police Chief Wills accepted a check for $2,000 from the West Covina Target Store to be used for forensic computer evidence software and supplies. Mayor Herndndez called forward Michelle McNeill, Community Services Director, who recognized this year's Community Services Volunteers of the Year: • Glenn Kennedy, Community Services Volunteer of the Year • Irene Fleck, Senior Services Volunteer of the Year Mayor Herndndez introduced Pamela Hayes, President/CEO, Valley Light Industries, who recognized the City of West Covina for their 20 years of service to individuals with developmental disabilities. Ms. Hayes presented the City Council with certificates. Mayor Herndndez called forward the following Counselors from West Covina Schools to present certificates of recognition for their work and making a difference in our schools: • Kari Harris, Edgewood Middle School • Sara Arce, Edgewood Middle School • Patricia Silva, San Jose Edison Academy • Danielle Alexander, South Hills High School • Erin Lippert, South Hills High School • Scott Fisch, South Hills High School • Marco Ibarra, Giano Middle School • Xochitl Sandoval, Giano Middle School City Council Minutes of February 17, 2009 Mayor Hernandez -recognized Boy Scout Troup 724, who were present in the audience earning a merit badge. ORAL COMMUNICATIONS Alfred Williams Alfred Williams, West Covina resident, spoke on internet access and cable access to City Council meetings and the contract with Mount SAC which transmitted the broadcasts. Cookie Nance Cookie Nance, West Covina resident, voiced her support for the ambulance subscription program. CONSENT CALENDAR D-1 City Council Meeting Minutes (receive & file) Minutes Special Meeting of November 4, 2008 • Regular Meeting of November 4, 2008 • Regular Meeting of November 18, 2008 D-2 Claims Against the City of West Covina Claims Government Tort Claim Denials (deny & notify claimant) Recommendation is that the following Government Tort Claims be denied and the claimants and/or respective attorneys be so notified. • Progressive Insurance vs. City of West Covina • Johnathan De La Cruz vs. City of West Covina • Steven J. Lynn, Trustee of the Lynn Family Trust vs. City of West Covina • Alethea Davis -Smith vs. City of West Covina • Suchen Lee Lo vs. City of West Covina Award of Bid Rejection of Bids for Maintenance Contract for Heating, Ventilation, and Air Conditioning Equipment at 23 City Locations D-3 (Project No. WCM-HVAC-09) HVAC Contract Bid Recommendation is that the City Council take the following actions: 1. Reject all bids. 2. Direct Staff to return to the City Council with HVAC service program options that may reduce maintenance and operational costs. 3. Authorize Public Works to continue its current service contract on a month -to -month basis with Allison Mechanical, the current vendor, at a negotiated cost of $9,000 per month. This extension shall use existing available funding, and be for a period of three to six months. Miscellaneous — Finance Department D-4a Surplus Equipment Auction of Surplus Vehicles Recommendation is that the City Council authorize the sale of 52 City surplus vehicles by public auction company, US Auctions, in accordance with Section 2-316 of the West Covina Municipal Code. Miscellaneous — Fire Department D-4b Appropriation of Fire Department Training Funds Fire Training Funds Recommendation is that the _City Council appropriate $11,947.63 from the Fund Balance in the Fire Training Fund (Fund 219) into the Fire Training Account (219.32.3210.6551) so these funds can be used for training purposes this fiscal year. 2 City Council Minutes of February 17, 2009 Miscellaneous — Police Department Los Angeles Radio Interoperable Communications System (LA D-4c -RIGS) Joint Powers AuthorityQPA) LA Radio Comm. JPA Recommendation is that the City Council authorize the City Manager to execute the agreement to join the Los Angeles Radio Interoperable Communications Systems (LA -RIGS) Joint Powers Authority. Appropriation of Private Grant from Target Corporation for D-4d Computer Investigations Target Grant for Investigations Recommendation is that the City Council appropriate the Target Corporation grant of $2,000 into 221.31.3130.6220 CONSENT CALENDAR ACTION Motion by Sanderson and seconded by Herfert to approve all items. Motion carried 5-0. PUBLIC HEARINGS Public Hearing Development of a Draft FY 2009-2010 Community Development E-1 Block Grant (CDBG) Action Plan CDBG Draft Action Plan Mayor Hernandez announced the public hearing matter and Assistant City Clerk Rush verified that proper legal notice had been given. Mayor Hernandez opened the public hearing and Management Analyst McDonald gave a brief staff report Public Testimony Mayor Hernandez opened the public testimony portion of the hearing and asked for public comment. Close Testimony There being no one wishing to address the Council, Mayor Hernandez closed the public testimony portion of the hearing: Assistant City Clerk Rush presented: Reso No. 2009-10 RESOLUTION NO. 2009-10 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, SETTING AND INCREASING CERTAIN FEES (PET STORE PERMIT FEE) Motion Motion by Touhey and seconded by Sanderson to waive further reading of the resolution and adopt. Motion carried 5-0. Public Hearing E-2 Voluntary Ambulance Subscription Fee Voluntary Ambulance Subscription Mayor Hernandez announced the public hearing matter and Assistant City Clerk Rush verified that proper legal notice had been given. Mayor Hernandez proceeded to open the public hearing and Finance Controller Swink presented the report. Public Testimony Mayor Hernandez opened the public testimony portion of the hearing and asked for public comment. Close Testimony There being no one wishing to address the Council, Mayor Hernandez closed the public testimony portion of the hearing. Council discussion Mayor Hernandez asked for City Council discussion. Assistant City Clerk presented: RESOLUTION NO. 2009-9 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA. CALIFORNIA, SETTING THE VOLUNTARY AMBULANCE SUBSCRIPTION FEE 3 City Council Minutes of February 17, 2009 Motion Motion by Sanderson and seconded by Herfert to waive further reading of the resolution, read by title only and adopt, and approve the Program in concept, and implement the program as described. Motion carried 3-2 (Touhey, Lane — No) COMMUNITY DEVELOPMENT COMMISSION Mayor Hernandez recessed the City Council meeting at 8:13 pin to convene the Community Development Commission meeting. The City Council reconvened at 8:14 pm. with all members present. DEPARTMENTAL MATTERS No reports for this meeting. MAYOR'S/COUNCILMEMBERS REPORTS No reports for this meeting.
