Mayor Pro Tem Lane called forward the following outgoing Commissioners to receive Resolutions of Commendation for their service to the City Council and the community: Lydia Solis, Senior Citizens Commissioner, Mary Grace Barrios, Community Services Commissioner and David Stewart, Community Services City Council Minutes of April 3, 2007 Commissioner. Mark Hamer, Human Resources Commissioner was not able to attend. Mayor Pro Tem Lane called forward Olivia James to receive a certificate of recognition for being named Outstanding Woman of the 32°d Congressional District by Congresswoman Hilda Solis for • her volunteerism with the NAACP and the League of Women Voters. Mayor Pro Tern Lane called forward Environmental Management Director Steve Samaniego to receive a Proclamation recognizing the Clean -Up Saturdays program that runs April 21 through May 19, 2007 and a Proclamation designating April 21, 2007 as Earth Day. Mr. Samaniego announced he would be hosting an Earth Day fair on April 21, 2007 at the West Covina Farmers' Market. Mayor Pro Tern Lane called forward Clay Durbin, Communications- Director to receive a proclamation designating the week of April 8, 2007 as National Public Safety Telecommunicators Week, recognizing the work of the 9-1-1 operators that provide quality service. ANNOUNCEMENTS City Manager Andrew Pasmant announced upcoming City events. ORAL COMMUNICATIONS Assemblyman Ed Hernandez Dr. Hernandez provided highlights of the Local Government Summit on Transportation that was held on January 20 in the Community Room, introduced his field representative and provided a brief overview of current legislation in Sacramento. Brandon Leong Brandon Leong of the Japanese Community Center, promoted the upcoming Cherry Blossom Festival to be held April 28. Caroline Chacon Caroline Chacon, West Covina resident, requested the Councils support for the 2007 Latin Summer Fest proposal for this summer. Elsie Messman Elsie Messman, West Covina resident, raised questions and concerns regarding graffiti and the lack of response for removal. Alfred Williams Alfred Williams, West Covina resident, addressed issues brought up at a previous council meeting regarding credit given to individuals for the closure of BKK and south side issues, and remarked that there are several residents and groups that have gone unrecognized in their efforts in representing the southern end of the City. Phillip Estrada Phillip Estrada, West Covina resident, addressed issues of excessive graffiti and the need to review tactics to abate graffiti. Royall Brown Royall Brown, West Covina resident, addressed Mayor Touhey's agenda item seeking Council's consensus to pursue the development of a Health & Wellness facility at the Senior Center; and current programs at the Center. Milford Walker Milford Walker, West Covina resident, stated that lie hoped the City council would start working together and hoped that Assemblyman Hernandez will help with health care reform. 2 City Council Minutes of April 3, 2007 Joanne Wilner Joanne Wilner, West Covina resident, addressed concerns of Mayor Touhey's proposal for a Health & Wellness facility and suggested the item be held over due to Mayor Touhey's absence tonight; commented on lack of playground equipment for ages 6-12 in the parks. Fredrick Sykes Fredrick Sykes, West Covina resident, requested residents come to City Hall and get involved with their City. Bill Roe Bill Roe, West Covina resident, addressed the upcoming Cherry Blossom Festival and requested that council do the right thing and appoint Councilmember Hernandez as Mayor. Mike Lee Mike Lee, Azusa resident, supported Councilmember Hernandez; stated the need for stronger graffiti cleanup; addressed social issues (war, medical care); and encouraged residents to vote. Norma Martinez Norma Martinez, West Covina resident, stated she is a concerned citizen and asked council to re-evaluate their commitment made to residents and to allow Councilmember Hernandez to serve as Mayor. Dana Sykes Dana Sykes, West Covina resident, played a video tape on a lap top containing excerpts of councilmembers comments made at a previous meeting in which Councilmember Hernandez' placement in the rotation was discussed and his placement as Mayor, if allegations under review by the DA's office are cleared. Natalie Mendoza Natalie Mendoza, West Covina resident, continued the playing of the video tape and made comments supporting Councilmember Hernandez' rotation to the position of Mayor. Bruce Leinbach Bruce Leinbach, West Covina resident, spoke in support of Councilmember Hernandez' contributions to the City; supported the East Valley Health Center and Councilmember Hernandez's rotation to Mayor. Councilmember Herfert left the dais at 8:24 p.m. and returned at 8:27 p.m. Herb Redholtz Herb Redholtz, West Covina resident, requested council support the proposed appropriation of funds for a public art consultant; questioned behavior of Councilmember Hernandez and his j udgment. Lloyd Johnson Lloyd Johnson, West Covina resident, addressed issues surrounding Councilmember Hernandez and the District Attorneys investigation and requested that he apologize before being allowed to rotate into the Mayor position. That Chevrons be installed on eastbound Garvey Avenue South and reflective raised pavement markers along the painted center line of the curve at Garvey Avenue South and Calvados Avenue. IV. Placement of Los Angeles County Fair Banners on Azusa Avenue D-7k Between City Limits County Fair Banners Recommendation is that the City Council: 1. Approve an encroachment permit to allow the Los Angeles County Fair Association to place banners along Azusa Avenue in the City of West Covina's right-of-way; and 2. Instruct staff to prepare a resolution initiating a code amendment to establish guidelines for placing future banners in the City of West Covina's right-of-way. Miscellaneous — Finance Department D-71 Surplus EQulDlrlent Surplus Equipment Recommendation is that the City Council authorize the sale of the surplus vehicles listed in the report by public auction company, US Auctions, in accordance with Section 2-316 of the West Covina Municipal Code. 7 City Council Minutes of April 3, 2007 • • Miscellaneous — Planning Department Appropriation for Public Art Consultant (Training, Guidelines, D-7m Work Program) Public Art Consultant Recommendation is that the City Council appropriate $12,000 from the Art In Public Places Fund to Account No. 212.21.21 10.6120 to cover the cost of hiring a public art consultant to provide training, and prepare guidelines and an annual work program for the City's citywide Art In Public Places Program. CONSENT CALENDAR ACTION Motion by Herfert and seconded by Sanderson to waive further reading of the resolutions and ordinance and adopt, and approve all items. Motion carried by the following roll call vote: AYES: Herfert, Fernandez, Lane, Sanderson NOES: None ABSENT: Touhey PUBLIC HEARINGS PUBLIC HEARING General Plan Amendment No. 06-04 Zone Change No. —06-04 Appeal of Precise Plan No. 06-18 Appeal of Tentative Tract Map No. 67864 Negative Declaration of Environmental Impact Location: 850-856 Sunset Avenue E-1 Appellant: Andrew McIntyre (Mclntvre Companies) Appeal — 850 Sunset Development Mayor Pro Tern Lane announced the hearing matter. Assistant City Clerk Rush verified that proper legal notice had been given and Mayor Pro Tem Lane opened the hearing. Planning Director Mclsaac presented the staff report detailing the project, a 20-unit condominium development. The project was denied by the Planning commission on March 13 and subsequently appealed. Public Testimony Mayor Pro Tern Lane opened the public testimony portion of the hearing and asked for public comments. In Favor Andrew McIntyre, representing McIntyre Companies, addressed the three major concerns of the area residents; 1) traffic, 2) density, 3) privacy and the measures taken to mitigate. Councilmember Hernandez shared his concerns that the variance requests lowering various development standards would set a precedence. McIntyre addressed the variance requests which included a second -story setback of 10 feel instead of 20 feet; ground coverage of 64 percent instead of 55 percent; a minimum dimension in one recreation -leisure open space area of 11 feet instead of 50 feet; and 8 feet of building separation where 14 feet is required. Planning Director Mclsaac addressed several of the mitigation measures taken and stated that deviations are not unreasonable. John Mordoff, West Covina resident, spoke in support of the appeal and urged Council to support staff recommendation and stated the project provides the highest and best use of the land. Lloyd Johnson, West Covina resident, supported the development requesting Council look at the merits of the project and not the developer. Rod Perryman, West Covina resident, supported the appeal and development of the project. 8 City Council Minutes of April 3, 2007 Dcbra Stapleton, West Covina resident, supported the appeal and stated traffic issues already existed and project will enhance and bring recognition to the area. William Fowler, West Covina resident, spoke in support of the project as it is good land use for the site. Opposed M. Alvarado, West Covina resident, lives in the area and is 0 opposed to the development citing traffic and parking issues. Dana Sykes, West Covina resident, spoke in opposition of the project and commented on the number of residents who attended the Planning Commission who were also in opposition of the project. Joanne Wilner, West Covina resident, recommended not approving the project pointing out that the project included too many significant variance requests; not enough adequate guest parking; and suggested that the Council listen to the neighbors who have spoken in opposition. Alvin T. Love, West Covina resident, spoke in opposition due to density and traffic issues. Michelle Zorrilla, West Covina resident, spoke in opposition citing increased traffic issues. Maria Diaz -Castillo, West Covina resident, spoke in opposition to the project and stated the project does not fit in the single story neighborhood; stated the developer and property owner has utilized scare tactics to the residents and have not been truthful on elements; inquired as to why the residents received a notice of a continuance of the Planning Commission public hearing in which the matter was to be discussed yet the developer and property owner were present to discuss the project. Planning Director Mclsaac stated that residents were informed that the public hearing would be continued allowing Mr. McIntyre to address concerns of the residents, however due to the number of residents that did appear, the Planning Commission allowed residents to speak on the matter. The Planning Commission had received no staff report or recommendations and were not able to take any action. Jeremy Infranca, West Covina resident, stated the area residents expressed concerns to Mr. McIntyre at a neighborhood meeting that they were not opposed to the development if he would minimize the number of units, which he has not done and shared many concerns in opposition to the project. William Schafer, West Covina resident, spoke in opposition and stated the development is a misuse of the property to the extent it impacts the neighbors citing traffic and parking issues. Bruce Leinbach, West Covina resident, spoke in opposition to the project due to its density and too many variance requests. Neutral Alex Gonzalez, West Covina resident, expressed his concerns and felt the project could meet the residents' concerns with a scaled down project and felt no concessions were made by Mr. McIntyre or the property owner regarding the concerns of the citizens. 9 City Council Minutes of April 3, 2007 Royal] Brown, West Covina resident, supported the Planning Commission decision citing the developer has not proposed any compelling reasons to warrant approval of the variances and stated the item should be sent back to the Planning Commission. Rebuttal Andrew McIntyre stated he requested the continuance of the Planning Commission public hearing in order to address the traffic, privacy, and density concerns of the residents. Mr. McIntyre also 0 stated that a Home Owner's Association would be Donned to oversee certain standards and restrictions. Sri Chakravarthy, Kimley Horn & Associates, addressed the traffic study conducted. City Attorney Alvarez-Glasman stated for the record correspondence was submitted on behalf of Ziad Alhassen in opposition to the variances requested. Councilmembers elaborated on aspects of the project. Councilmember Herfert stated his concern with the possible impact to the houses that abut the project. Councilmember Hernandez stated he would support the residents and not support the project as it is not suitable for the proposed area citing that the variance findings are not met. Councilmembers engaged in discussion as to whether to move forward with this item or to continue to another evening to be in compliance with the City Council's Standing Rules, which require councilmembers to decide at 11:00 p.m. whether items can be completed by midnight. Motion Motion by Hernandez to deny the appeal. Councilmember Hernandez also questioned why there was only a resolution provided to approve the project. City Attorney Alvarez-Glasman stated council was presented ,with a resolution approving the project because that is the recommendation of staff'. In response to inquiry by Councilmember Hernandez, Planning Director McIsaac stated that variance findings have been met. McIsaac further stated that resolutions were provided for approval as recommended by staff and denial as recommended by the Planning Commission. Motion failed Councilmembers Hernandez' motion failed due to lack of a second. Councilmember Sanderson requested that a traffic signal study be conducted at Roseway and Sunset Avenue. Motion Motion by Herfert to move forward with the appeal and adopt the resolutions to approve the project; seconded by Sanderson and to also include the traffic signal study at Roseway and Sunset Avenue.
