Garvey Avenue, West Covina. Prior to convening into closed session, all items on the City Council and Community Development Commission agendas were announced for inclusion in the closed session discussion. Items on the City Agenda: Conference with Labor Negotiators — Employee Organizations: Confidential Employees, General Employees, Maintenance & Crafts Employees, Mid -Management Employees, Non -Sworn Safety Support Employees — Briefing provided by staff, no final action and nothing further to report. Conference with Real Property Negotiators — Property: Approx. 2.6 acre area of the southeast corner o/ West Covina Parkway and West Garvey Avenue South of the Civic Center Property — No final action taken. The matter is on open session agenda for consideration of extension of Exclusive Negotiating Agreement. Nothing further to report. Conference with Real Property Negotiators — Property: Approximately 14,418 square feet of the southwest quadrant of Sunset Avenue adjacent to the I-10 Freeway — City Council provided direction to continue negotiating and to return with an Exclusive Negotiating Agreement for the next meeting consistent with term expressed. Unanimous approval. Conference with Legal Counsel — Existing Litigation — City • of West Covina vs. Valencia Heights Water Company — Mayor Touhey abstained from participation due to previously declaring a conflict; direction was provided to legal counsel, there was no final action and nothing further to report. Items on the CDC Agenda: Conference with Real Property Negotiators — Property: Northeast corner of Valley/Nogales Vice chairman Lane was not present, direction was provided to continue negotiations by unanimous consent, no final action and nothing further to report, an agreement will come back at a future date. City Council Minutes of December 19, 2006 Conference with Real Property Negotiators — Property: 2538 East Garvey Avenue — Chairman Touhey abstained from consideration of this matter. Commissioners rejected the terms as presented by vote of 3 — 0. • CHANGES TO THE AGENDA City Manager Pasmant announced there was an addendum to Item D-4e. PRESENTATIONS Blue Star Video was aired. Mayor Touhey presented Assemblyman Ed Hernandez with a City Tile. Assemblyman Hernandez was elected on November 71h to serve as the Assemblyman for the 57`h Assembly District of which West Covina is a part. Mayor Touhey called forward Michele McNeill, Community Services Director and Vanessa Carter, Former Senior Citizens Center Supervisor to be recognized for her service as the Supervisor at the Senior Center. ANNOUNCEMENTS No announcements made. ORAL COMMUNICATIONS Joanne Wilner Joanne Wilner, West Covina resident, addressed several issues listed on the agenda, stating that she would like to see all school grounds open to the public when not in use for school. Homer P. Castille Homer P. Castille, West Covina resident, owner of the Five Seas restaurant promoted his new establishment in West Coivna. Tyra Mason Tyra Mason, representing the West Covina Chamber of Commerce, announced holiday wrapping and shopping at the Mall and promoted the West Covina Farmers market. Ms. Mason introduced Seanah Owen, a Covina resident, who demonstrated yoga. Dana Sykes Dana Sykes, West Covina resident, addressed the lack of police officers; traffic issues surrounding development at the BKK site; and graffiti issues. Fred Sykes Fred Sykes, West Covina resident, spoke on graffiti and ways residents can assist with reporting graffiti and remarked on comments made in previous meetings. John Scheuplein John Scheuplein, West Covina resident, made several comments regarding the tree removal hearing; downtown signage program; downtown development; and proposed park ranger program. Bruce Leinbach Bruce Leinbach, West Covina resident, addressed a traffic issue at the Elephant Bar entrance on Lakes Drive. • Royall Brown Royall Brown, West Covina resident, addressed concern with Galster Park (Item D-4b) and the proposed park ranger program. Rudy Almeida Rudy Almeida, Hacienda Heights resident, wished the Council a good holiday season and thanked them for their leadership. Miscellaneous — Community Development Commission Amendment to the Exclusive Negotiating Agreement with Dynamic Business Holdings, Inc. for the Development of a 2.6 D-4h Acre Portion of the Civic Center Propertv ENA Amendment — Dynamic Recommendation is that the City Council approve an Amendment to the Exclusive Negotiating Agreement with Dynamic Business Holdings, Inc. and extending the term of the agreement for a period of one hundred fifty days to allow Dynamic Business Holdings, Inc. time to resolve various project development issues in order to prepare a Lease and Development Agreement for City Council consideration. (see change to recommendation below) CONSENT CALENDAR ACTION Item D-4h - Councilmember Herfert requested the motion and vote include changes made during closed session to Item D-4h. Council consensus during closed session was to approve an extension for 60 days instead of 150 days and to hold the developer to his proposal to building a parking structure. Motion by Herfert and seconded by Lane to waive further reading of the resolutions, read by title only and adopt, and approve all items with the record reflecting that Touhey abstained on Item D- 4a and to reflect change in Item D-4h as noted above. Motion carried 4 — 0 by the following Roll Call vote: AYES: Herfert, Hernandez, Lane, Touhey NOES: None ABSTAIN: Touhey on Item D-4a ABSENT: Sanderson Mayor Touhey requested Item E-2 be moved forward due to request to hold over. PUBLIC HEARINGS Public Hearing Woodside Village Master Plan Amendment No. 10 Deletion of "Mini -Storage" as a Permitted Use E-2 (Quail Ridge Shopping Center) Deletion of Mini -Storage Mayor Touhey announced the hearing matter. Assistant City Clerk Rush verified that proper legal notice had been given and Mayor Touhey opened the hearing. Motion by Herfert to continue to January 16, 2007 meeting. Discussion followed regarding request to continue. Planning director McIsaac explained that the Planning commission had initiated the Master Plan Amendment to delete the mini -storage use as a permitted use. Following discussion regarding to hold over or table the issue Council moved forward with the item and Herfert withdrew his motion and the item moved forward. Planning Director McIsaac presented the staff report. Public Testimony Mayor Touhey opened the public testimony portion of the hearing and asked for public comments. Len Kristensen, representing Realty Bancorp Equities, stated that they have not yet been able to secure a tenant for the major tenant space in the Quail Ridge shopping center and wanted to keep the option open of a mini -storage. Mr. Kristensen answered questions from Council regarding efforts in securing a tenant. Royall Brown, West Covina resident, supported the Planning Commission recommendation deleting mini -storage use from the Master Plan. Herb Redholtz, West Covina resident and Planning Commissioner, also supported the Planning Commission recommendation. Rebuttal Mr. Kristensen requested that the City Council approve keeping their option open for self -storage. Close Testimony There being no one else wishing to address the Council, Mayor Touhey closed the public testimony portion of the hearing. Council discussion Councilmember Herfert stated the dynamics of the center have changed since the project had begun and supported the Planning Commission recommendation to remove min -storage use from the Master Plan. Assistant City Clerk presented Resolution No. 2006-101 RESOLUTION NO. 2006-101 — A RESOLUTION OF THE CITY Deleting Mini -Storage Uses COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING WOODSIDE VILLAGE MASTER PLAN AMENDMENT NO. 10 RELATED TO DELETING MINI - STORAGE USES IN THE "PLANNED COMMUNITY DEVELOPMENT NO. 1" ZONE Motion by Herfert and seconded by Hernandez to waive further reading of the resolution and adopt. Motion carried 4-0. Public Hearing Athens Services Waste Collection Proposed Contract Amendments on Service Rate Increase, Waste Diversion Guarantee, Annual Clean -Up Campaign and Administrative E-1 Approval Process for Service Rate Increase Requests Athens Services Rate Increase Mayor Touhey announced the hearing matter. Assistant City Clerk Rush verified that proper legal notice had been given and Mayor Touhey opened the hearing. Environmental Management Director Samaniego gave a summary of the staff report and recommendations and explained Prop 218 requirements. Samaniego and City Manager Pasmant responded to questions from Council regarding the citywide waste diversion guarantee (recommendation #d), establishing requirement for clean-up Saturday (recommendation #e) and authorizing administrative 3 City Council Minutes of December 19, 2006 approval of future rate increases (recommendation #f) and retroactivity of rate increase. Public Testimony Mayor Touhey opened the public testimony portion of the hearing and asked for public comments. Dennis Chiappetta of Athens Disposal briefly reviewed each of Athens requests: Mr. Chiappetta responded to question regarding their request for Special Fuel Rate Increase, stating that fuel rates have exceed the CPI. Mr. Chiappetta stated that if fuel prices do go down, they would rebate back to the citizens and commercial business whatever it goes down. John Scheuplein, West Covina resident, voiced several opinions, concerned with the retroactive increase, supported adjusting the CPI period; and supported the special interim fuel rate increase. Joanne Wilner, West Covina resident, made several comments regarding each amendment recommendation. Royall Brown, West Covina resident, commented on waste diversion requirements and stated he did not get the notice of the hearing. Gabriel Bautista, West Covina resident, voiced concerns with language in the public hearing notice, requested Council consider all comments opposing retroactivity. Lloyd Johnson, West Covina resident, opposed the retroactive rate increase and special interim fuel rate increase, and voiced several opinions regarding the other provisions of the proposed amendment. Testimony Closed There being no one else wishing to address the Council, Mayor Touhey closed the public testimony portion of the hearing. Assistant City Clerk Rush stated that the City Clerk's Office received 28 responses to the Proposition 218 notification concerning the proposed refuse collection and that Proposition 218 requires that a rate increase be denied upon receipt of written protests from a least 50% of affected property owners which has not been meet, therefore, the rate increase may be considered. Council discussion Councilmember Herfert states he does not support the retroactivity of the rate increase to be home by the residents but will incorporate into his motion that the City absorb 50% of the retro rate increase to be from future franchise fees and will request that Athens Services absorb the other 50%. Herfert does not want to change the Annual Clean-up Saturday program but suggests a possible sub -committee with West Covina Beautiful to address large items. Motion Motion by Herfert and seconded by Lane to: • a) Approve revising the Schedule of Rates to include a 4.67% Consumer Price Index (CPI) increase, b) Approve 2.19% Special Interim Fuel Rate Increase, c) Deny retroactive rate increase to July 1, 2006 from residents, having the City pay 50% of the retroactive increase from future franchise fees and Athens absorbing the other 50% of the retroactive increase. 7 City Council Minutes of December 19, 2006 d) Approve the revision of the 50% citywide waste diversion guarantee definition which would reduce the percentage of waste diversion from 61 % to no less than 50%, e) Not make any changes to the Annual Clean -Up Saturday • program but possibly put together a subcommittee to address large items issues, f) Approve authorizing administrative approval of service rate increases, g) Approve adjusting the CPI period from May -April to March - February and rate review application submittal deadline to March 20, h) Approve the pass -through of the disposal fee increase. Councilmember Herfert asked Athens if they would absorb 50% of the retro rate increase. Mr. Chiappetta stated they would. Mayor Pro Tern Lane commented on the notice of the public hearing, waste diversion, retroactivity and clean-up Saturdays. Mayor Pro Tern Lane requested that any future notices of this type be presented in a clear and concise manner. Councilmember Hernandez had Councilmember Herfert repeat his motion for clarity. Councilmember Hernandez was opposed to the special interim fuel increase and the CPI should include that increase. Alternate Motion Alternative motion by Hernandez to: a) Approve revising the Schedule of Rates to include a 4.67% Consumer Price Index (CPI) increase, b) Deny 2.19% Special Interim Fuel Rate Increase, c) Deny retroactive rate increase to July 1, 2006 from residents, d) Deny revision of the 50% citywide waste diversion guarantee definition which would reduce the percentage of waste diversion from 61 % to no less than 50%, e) Maintain Annual Clean -Up Saturday program, f) Deny authorizing administrative approval of service rate increases, g) Approve adjusting the CPI period from May -April to March - February and rate review application submittal deadline to March 20, Alternate motion failed Motion failed due to lack of second. • Mayor Touhey made several comments and addressed components of the contract with Athens Services. Amendment to original motion Mayor Touhey supports the original motion by Herfert and requests to amend the motion to include Athens proposal to lower the Special Interim Fuel Increase (#b) if fuel rates go down. n City Council Minutes of December 19, 2006 Councilmember Herfert and Mayor Pro Tem Lane accept the amendment to the motion. Public Hearing Appeal of Tree Removal Permit No. 06-08 Applicant/Appellant: Gary Preston E-3 Location: 1007 S. Sunkist Avenue Appeal of Tree Removal Mayor Touhey announced the hearing matter. Assistant City Clerk Rush verified that proper legal notice had been given. Planning Director McIsaac presented the staff report in which the applicant is requesting approval of a tree removal permit. McIsaac answered questions from Council. Public Testimony Mayor Touhey opened the public testimony portion of the hearing and asked for public comments. Gary Preston, applicant, stated the tree was originally planted by his family and has overgrown and creates a mess. He also pointed out a section in the ruling that permits should be granted if • interfering with power lines. In Support Lloyd Johnson, West Covina resident, supports the appeal commending the resident for going through the proper process to obtain a permit. Opposed John Scheuplein, West Covina resident, voiced his concerns with possible liability to the City by neighbor who the shares tree. Assistant City Clerk Rush presented: Resolution No. 2006-102 RESOLUTION NO. 2006-102 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, OVERTURNING THE DECISION OF THE PLANNING COMMISSION AND APPROVING TREE REMOVAL PERMIT NO.06-08 Motion Motion Herfert and seconded by Hernandez to waive further reading of the resolution, read by title only and adopt. Motion carried by 4 -0. Public Hearing Appeal of Administrative Use Permit No. 06-49 (Maximum Unit Size Exception) Applicant: Gunnar and Connie von Kohler E-4 Location: Vacant Lot Behind 501 N. Vincent Avenue AUP No. 06-49 Mayor Touhey announced the hearing matter. Assistant City Clerk Rush verified proper legal notice had been given. Principal Planner Anderson gave a summary of the staff report in which the applicant is seeking to construct a new home on a vacant lot. Public Testimony Mayor Touhey opened the public testimony portion of the hearing and asked for public comments. Connie Von Kohler, applicant, requested the Council overturn the Planning Commission decision stating they have complied with the Planning commission's direction by reducing the size of the home from the original plans and revised the second -story window to address privacy concerns. In Favor The following individuals spoke in support of the applicant requesting the Council overturn the decision of the Planning Commission. Marjorie Cheatle, West Covina resident Dennis Sampson, West Covina resident Ken Cable, West Covina resident Oppose Joanne Wilner, West Covina resident, supported the decision of the Planning commission stating the house was out of character for the neighborhood. • Rebuttal Connie Von Kohler stated there are several houses in the neighborhood that are two story and of similar size. Motion carried 4-0. COMMUNITY DEVELOPMENT COMMISSION Mayor Touhey recessed the City Council meeting at 11:35 p.m. to convene the Community Development Commission.
