All members were present with the exception of Mayor Herfert. Conference with Labor Negotiators — Five (5) Employee Organizations — Confidential, General, Maintenance & Crafts, Mid -Management, and Non -Sworn Safety Support employees — Briefing was received from City negotiator, there was no final action and nothing further to report. Conference with Legal Counsel — Existing Litigation — Jennifer Rodriguez et al. vs City of West Covina — Direction was provided with respect to possible settlement, there was no final action and nothing further to report. CHANGES TO THE AGENDA City Manager Pasmant announced that Item D-3 is amended to exclude the Tort Claim of Arturo & Rose Filippe vs. City of West Covina. PRESENTATIONS Blue Star Video was aired. Jim Hartman with Los Angeles County Department of Agriculture/Weights & Measures gave a brief presentation on coyote services provided in West Covina. . Mayor Pro Tern Touhey and Police Chief Frank Wills presented Bill and Bryan Delosa with a Resolution of Commendation for assisting the West Covina Police Department in the arrest of individuals responsible for numerous residential burglaries. Bryan Delosa was not able to attend. Mayor Pro Tern Touhey presented Denel Dupree, widow of Kenneth Scott Wrede, Maryanne and Ken Wrede, parents of Kenneth Scott Wrede a Resolution of Commendation recognizing City Council Minutes of October 3, 2006 a portion of Interstate 10 as the Kenneth Scott Wredc Memorial Highway. Mayor Pro Tem Touhey presented Assemblyman Ed Chavez with a Resolution of Commendation for sponsoring the legislation naming the highway. Mayor Pro Tem Touhey called forward Arianna Masten, who was named "Hometown Hero for West Covina" by the Inland Valley Daily Bulletin and Los Angeles County Fair. Arianna lost her left arm while saving her 2-year-old brother during a car accident. Mayor Pro Tem Touhey presented Steve Samaniego, Environmental Management Director with a proclamation proclaiming October 2 through 6, 2006 as Rideshare Week. Mayor Pro Tem Touhey presented Fire Chief Richard Elliott with a proclamation proclaiming October 8 through 14, 2006 as Fire Prevention Week. Mayor Pro Tem Touhey presented Anna Lee Parker of the Lions Club, with a proclamation proclaiming October 7 and 8, 2006 as White Canes Day. ANNOUNCEMENTS Assistant City Manager Artie Fields announced that City Manager Andrew Pasmant will receive the Humanitarian NAACP Award. City Manager Pasmant announced upcoming City events. ORAL COMMUNICATIONS John Hughes John Hughes, West Covina resident, presented Community Services Director Michelle McNeill with a certificate recognizing the Community Services Department for their assistance with the Muscular Dystrophy Association fundraising events. Mr. Hughes also presented the West Covina Fire Department and West Covina Police Department with certificates recognizing their support and participation with the MDA fundraising events. Tyra Mason Tyra Mason, representing the West Covina Chamber, promoted the West Covina Farmer's Market and upcoming Chamber sponsored events. Rainbow Yeung Rainbow Yeung from the South Coast Air Quality Management District, spoke on the programs and current events sponsored by the agency. Stephen R. Goostrey Stephen R. Goostrey, Gustafson & Goostrey, LLP, spoke on behalf of his client Councilmember Roger Hernandez regarding allegations of creating a hostile work environment and lack of ® information provided to Councilmember Hernandez. Brief discussion followed Mr. Goostrey's comments. Michelle McNeill Michelle McNeill, Community Services Director, announced the Ridge Riders' 50`h Anniversary event. 2 City Council Minutes of October 3, 2006 0 0 Fredrick Sykes Fredrick Sykes, West Covina resident, requested the Council address maintenance issues at Shadow Oak Park and public safety in the area around the park. Royall Brown Royall Brown, West Covina resident, spoke on recent legislation pertaining to redevelopment laws and development of the lower plateau at Shadow Oak Park. George Ogden George Ogden, West Covina resident, announced the renaming of Rimsdale Covina Post Office after Capt. Lillian Kiel and the Red Ribbon Rally at West Covina High School on October 28. Joanne Wilner Joanne Wilner, West Covina resident, commented on the limited time for speaking; Shadow Oak Park; selling City property; (budget items); requested staff to respond to questions; smoking in City vehicles; the recent neighborhood meeting at Hollencrest School. Lloyd Johnson Lloyd Johnson, West Covina resident, spoke on procedures for addressing the City Council supporting the new ordinance allowing 5 minutes per speaker. Don Carman Don Carman, West Covina resident, addressed oral communications and comments made at previous meetings regarding civility. Two individuals spoke regarding item I-4 and asked not be identified. Speakers requested Council's support of Jessica's Law [Prop. 83] and for Council to take some action regarding sex offender Steven Conklin, who has returned to West Covina. Council discussion Councilmember Sanderson requested support of Jessica's Law. Mayor Pro Tern Touhey requested the following two items be moved forward due to the number of interested audience members. COUNCIL REQUEST FOR REPORTS, STUDIES OR INVESTIGATIONS Request from Mayor Pro Tern Michael Touhey Requesting the City Council to Consider Supporting Various Measures I-4 Re2ardin2 Sexual Predators/Offenders Sexual Predators Motion by Touhey and seconded by Sanderson to agendize for the next meeting, support of the upcoming ballot proposition, Proposition 83, (Jessica's law); stronger guidelines and monitoring of sex offenders; and a task force within the Police Department to track registered sex offenders. Motion carried 4-0. Request from Councilmember Hernandez Requesting the City Council to Instruct City Staff to Research the Development of I-2 the Lower Plateau at Shadow Oak Park Motion by Hernandez to start proceedings to develop the lower portion of Shadow Oak Park for park use commencing with community meetings in the immediate future, to receive input as to what the residents would like. Council discussion ensued in regards to having budgetary figures available prior to holding community meetings. It was the consensus of the council to have idea costs prior to community meetings. Councilmember Hernandez stated his motion is to include having costs prior to the community meetings. Mayor Pro Tem Touhey stated he would support looking at the development of the lower portion of the park as long as the 3 City Council Minutes of October 3, 2006 development attracts all the residents of West Covina and offered a second to the motion. D-6b Miscellaneous — Fire Department NIMS Emergency Program Adoption of the National Incident Management System RESOLUTION NO. 2006-78 - A RESOLUTION OF THE Resolution No.2006-78 CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING AND ADOPTING THE NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS) AND DIRECTING ITS IMPLEMENTATION CONSENT CALENDAR ACTION Motion by Sanderson and seconded by Hernandez to waive further reading of the resolution, read by title only and adopt, and approve all items on the Consent Calendar with the record reflecting 40 Touhey abstaining on Item D-6a. COMMUNITY DEVELOPMENT COMMISSION Mayor Pro Tern Touhey recessed the City Council meeting at 9:55 p.m. to convene the Community Development Commission meeting. The City Council reconvened at 9:56 p.m. with all members present except Mayor Herfert. DEPARTMENTAL MATTERS No reports for this meeting. MAYOR'S/COUNCILMEMBERS' REPORTS No reports for this meeting. COUNCIL REQUEST FOR REPORTS, STUDIES OR INVESTIGATIONS Reconsideration of City Council Procedures for Accepting I-1 Public Testimony at City Council Meetings Public Testimony Councilmember Hernandez opined that the recently adopted ordinance addressing public testimony at council meetings has resulted in limiting speakers' ability to accurately address issues. Councilmember Hernandez supported reinstating the three (3) minute limit for agendized items and to retain the five (5) minute speaking time for Oral communications, items not on the agenda. Motion Motion by Hernandez to bring this item back to reconfigure the residents' ability to speak to multiple items on the Council agenda. Councilmember Sanderson stated there is a multitude of ways for residents to speak with council besides during a council meeting and feels the current process does allow residents the affordability to speak. Mayor Pro Tern Touhey and Councilmember Lane also voiced reasons not supporting reconsideration. Motion died for a lack of second. Request from Councilmember Hernandez Requesting the City Council to Instruct City Staff to Research the Development of I-2 the Lower Plateau at Shadow Oak Park Shadow Oak Park This item discussed following Oral Communication earlier in the meeting. Request from Mayor Pro Tern Michael Touhey Requesting the City Council to Consider Replacing the Dugouts at Maverick I-3 Field Maverick Field Mayor Pro Tern Touhey stated the dugouts at Maverick Field are set inside the playing field and would like to see them set back flush with the foul ball lines. Motion by Touhey and seconded by Sanderson to direct staff to obtain costs to relocate the dugouts at Maverick Field and ® to return to Council for consideration. Motion carried 4-0. Request from Mayor Pro Tern Michael Touhey Requesting the City Council to Consider Supporting Various Measures I-4 Re2ardine Sexual Predators/Offenders Sexual Predators This item discussed following Oral Communication earlier in the meeting. 5 City Council Minutes of October 3, 2006 Request from Mayor Pro Tern Michael Touhey Requesting the City Council to Consider Partnering with West Covina Unified School District for the Construction of a New Football Field I-5 And Track at West Covina High School WCUSD Football Field Motion by Touhey and seconded by Sanderson to bring back for consideration partnering with the West Covina Unified School District for the construction of a new football field and track isimprovements. Motion carried 4-0. COUNCILMEMBER COMMENTS Councilmember Sanderson requested to agendize for Council consensus options for coyote control. Councilmember Lane stated it was a privilege to meet the West Covina Hometown Hero at the County Fair, Councilmember Lane asked whether the city was going to have a Haunted House or Halloween event this year. City Manager Pasmant stated that there is no budget for an event this year but staff could move forward with a scaled down event. Councilmember Hernandez gave a verbal report on a National League of Cities, Hispanic Elected Official Summit he recently attended. ADJOURNMENT Motion by Hernandez and seconded by Lane to adjourn the meeting at 10:25 p.m. in memory of Public Works Director Shannon Yauchzee's mother-in-law, Ms. Anita Fitzpatrick; Edward Kinsale, long time resident; and Art Velasquez, former employee and commissioner.
