REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
June 20, 2006
Mayor Herfert called to order the regular meeting of the West Covina City Council at 7:10 p.m. in the
10 City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

City Attorney Alvarez-Glasman reported the following:
Prior to convening into closed session, all items on the
City Council and Community Development Commission agendas
were announced for inclusion in the closed session discussion.
All members were present with the exception of
Councilmember/Commissioner Lane. Vice Chairman Touhey
recused himself from participation in discussions related to
properties located at 2533 East Workman Avenue and 730 South
Orange.
Items on the City Council Agenda:
Conference with Legal Counsel —Existing Litigation —
Aaron Dunkle, a minor vs. City of West Covina, et. al.— and
West Covina vs. Valencia Heights Water Company, et. al. —
Briefing was provided and direction was given to the City
Attorney's office - no' final action taken and nothing further to
report.
Davis vs. City of West Covina — Briefing was provided and the
settlement proposal offered from the Davis' was rejected by a vote
of 4-0, no final action taken and nothing further to report.
Conference with Legal Counsel — Anticipated Litigation —
One potential case. — No final action taken and nothing further to
report.
Conference with Real Property Negotiators —Property.•
Approximately 2.6 acre area of southeast corner of West Covina
Parkway and West Garvey Avenue South of the Civic Center
Property — Council received a briefing and direction was provided
to Agency negotiators. This item will be brought back for
consideration of an Exclusive Negotiating Agreement at the next
open session meeting consistent with the terms expressed, no final
• action taken and nothing further to report.

Mayor Herfert presented Marilee Marrero, West Covina Librarian,
a certificate of recognition for being named Los Angeles County
Librarian of the Year. Ms. Marrero announced the upcoming
summer reading program at the Library.
PROCLAMATIONS Mayor Herfert presented Interim Community Services Director
Steve Samaniego with a Proclamation designating July as Parks
and Recreation Month.
VIDEO PRESENTATION Community Development Commission Project Update was not
aired due to technical difficulties.
ORAL COMMUNICATIONS
Tyra Mason Tyra Mason, representing the Chamber of Commerce, promoted
the West Covina Farmers' Market.
John Hughes John Hughes, West Covina resident, announced the upcoming 41h
of July event at Cameron Park on June 30-July 2 with fireworks on
Sunday, July 2.
Mayor Herfert announced the city co-sponsorship with Faith
Community Church for a fireworks at the church on July 4.
John Scheuplein John Scheuplein, West Covina resident, addressed the Council on
his commitment to the community and voiced his opinion.
Lloyd Johnson Lloyd Johnson, West Covina resident, complimented the actions of
Commissioners Rosatti and Thrasher and the West Covina Fire
Department at a previous Planning Commission meeting.
Mayor Herfert commented on the unfortunate event at the Planning
Commission meeting. City Manager confirmed that a portable
defibrillator will be installed in the chamber.
Joanne Wilner Joanne Wilner, West Covina resident, inquired about the status of
the golf course portion of the Sports Plex project.
City Manager Pasmant gave a brief update of the golf course
project stating the reduction of the amount of ground coverage is
still being analyzed.

D-4a Award of Bid for the Senior Citizen Center North
Senior Center Roofing Annex Roofing (Project No. BP-06306B)
Recommendation is that the City Council:
1. Accept the bid of Best Roofing and Waterproofing, Inc. in the
amount of $98,666 as submitted at the bid opening on June 6,
2006, and authorize the Public Works Director/City Engineer
and City Clerk to execute the contract.
2. Appropriate an additional $33,000 from Community
Development Block Grant Fund to perform this. work.
D-4b Award of Bid for Street Rehabilitation Work of Bus
Street Rehab - Bus Routes Route at Various Locations Citywide
(Proiect No. SP-06110)
Recommendation is that the City Council take the following
actions:
1. Accept the bid of All American Asphalt in the amount of
$833,060.85 as submitted at the bid opening on June 8, 2006,
and authorize the Public Works Director/City Engineer and
City Clerk to execute a contract for the work to be done.
2. Transfer $300,000 from Project No. SP-04109 Proposition "C"
fund (122.81.8432.7200) to Project No. SP-06110
(122.81.8631.7200).
3. Approve a Change Order in an amount of $100,000 for
additional street rehabilitation work to be done on North Citrus
Street from North Garvey Avenue to Workman.Avenue.
4. Adopt the following resolution:

authorize the Mayor to execute the Lease Agreement.

Item D-3 Ordinance for Adoption — Procedures for Accepting Public
Testimony at City Council Meetings — Brief staff report was
presented by Assistant City Clerk Rush.
West Covina residents Joanne Wilner, Royall Brown and John
Scheuplein spoke in opposition to the ordinance as written and

requested Council to reconsider to continue allowing comments at
the time the item is being considered.
Council concurred that the goal of the extended time and one
public comment period was to expedite and continue with an
effective and efficient meeting. Except for public comments
relating to a public hearing, all public comments, to all governing
• boards in which the Council sits, will be heard during one Oral
Communication period.
Assistant City Clerk presented:

Motion by Touhey and seconded by Herfert to waive

Item D-4a Award of Bid for Senior Citizen Center North Annex Roofing —
Brief staff report was presented by Public Works Director
Yauchzee.
Royall Brown, West Covina resident, commented that the south
building of the Senior Center is also in need of repairs.
Motion by Herfert and seconded by Lane to approve the staff
recommendation regarding the Senior Center north annex roofing
and to also look at the condition of the south building. Motion
carried 4-0.
Item D-7a Proposed Lease Agreement with Metro PCS — Mayor Pro Tem
Touhey recused himself from discussion of this item due to
possible conflict of interest with his family trust owning property
and having lease with Spectrasite Communications.
A brief staff report was presented by Communications Director
Durbin.
Motion by Herfert and seconded by Hernandez to approve the
lease agreement as recommended by staff contingent on the
Conditional Use Permit (CUP) process before the Planning
commission and to return to the City Council for final approval.

project and answered questions.

answered questions.

Royall Brown, West Covina resident, questioned whether the
applicant's new plan should be approved by the Planning
Commission or the City Council.
Kevin Wilkes, with Drafting & Design LTD., offered to answer
any questions regarding the plans.

City Attorney Alvarez-Glasman recommended the City Council,
Community Development Commission and Public Financing
Authority entertain a motion to continue the hearing to June 29,
2006.
Joanne Wilner, West Covina resident, addressed revenue and
costs of the project.
Motion by Sanderson and seconded by Touhey, representing all
three boards, to hold this joint public hearing to June 29, 2006.
Motion carved 4-0.
PUBLIC FINANCING AUTHORITY
Mayor Herfert requested a motion to adjourn the Public Financing
Authority. Motion by Hernandez and seconded. by Herfert to
adjourn the Public Financing Authority at 8:32 p.m. Motion
carried 4-0.
COMMUNITY DEVELOPMENT COMMISSION
Mayor Herfert recessed the City Council meeting at 8:32 p.m. to
continue the Community Development Commission. The City
Council reconvened at 9:03 pm with all members present.
