REGULAR MEETING OF THE
WEST COVINA CITY COUNCIL
September 6, 2005
Mayor Sanderson called to order the regular meeting of the West Covina City Council at 7:09 p.m. in
the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina.

PLEDGE OF ALLEGIANCE Led by Councilmember Herfert
ROLL CALL Mayor Sanderson, Councilmember Herfert, Councilmember Miller
Absent: Mayor Pro Tem Wong and Councilmember Hernandez
Mayor Sanderson asked that the minutes reflect that Mayor Pro
Tem Wong was not present because he was attending the memorial
services for Dr. Phinneas Goldstein.
Staff Present: Pasmant, Fields, Alvarez-Glasman, Freeland, McIsaac, Morgan,
Anderson, Samaniego, Rush
REPORTING OUT FROM CLOSED SESSION
City Attorney Alvarez-Glasman reported the following:
Mayor Pro Tem Wong and Councilmember Hernandez
were not present. Prior to recessing into closed session, all items
on the City Council and Community Development agendas were
announced for inclusion in the closed session discussion.
c Conference with Labor Negotiators — West Covina
Firefighters' Association, I.A.FF, Local 3226: Council received
a briefing from Labor Negotiators, no final action was taken and
nothing further to report.
Items on the CDC Agenda:
Conference with Legal Counsel - Anticipated Litigation —
One potential case — Council received a briefing from legal
counsel with no final action taken and nothing further to report.

APPROVAL OF MINUTES The following minutes were approved as presented:

PRESENTATIONS Blue Star Video was aired.
Mayor Sanderson presented a Blue Star Poster to Tommy and
Vivian Garcia. Their son Paul is serving in the United States
Army. Mayor Sanderson presented Paul Garcia with a certificate
recognizing his service to our country.
Fire Captain Jim Rudroff reported on the City's Disaster
Preparedness Program with a PowerPoint presentation.
Mayor Sanderson presented Certificates of Recognition to the
West Covina Youth Pony Baseball League, Eight -Year Old Pinto
Division District Champions and the National Little League
District 19 All Stars, Nine and Ten -Year Old Champions.

PROCLAMATIONS Mayor, Sanderson declared the month of September as National
Alcohol and Drug Addiction Recovery Month.
ORAL COMMUNICATIONS
Tyra Mason Tyra Mason, representative for the West Covina Chamber, gave a
brief presentation to promote the City's Saturday morning
Farmers' Market.
Marilee Marrero Marilee Marrero, West Covina Librarian, announced that the
month of September is Library Card Sign Up Month and
encouraged the public to visit the library.
Joanne Wilner Joanne Wilner, West Covina resident, requested the enforcement
of speakers announcing their names and city at the podium and
requested the status of the Clippinger construction.
Ed Casanova Ed Casanova, West Covina resident, spoke on the recent hurricane
disaster.
Glen Delameter Glen Delameter, West Covina resident, spoke on the efforts of
local businesses during the hurricane disaster.
Cookie Nance Cookie Nance, West Covina resident, spoke on efforts for relief for
hurricane victims.
John Scheuplein John Scheuplein, West Covina resident, spoke on natural disasters
and preparedness and notification of upcoming community
meetings.
Herb Redholtz Herb Redholtz, West Covina resident, thanked the Council for the
Summer Concerts and requested an update on the proposed
business at Shakespeare and Nogales.
City Manager Pasmant and City Attorney Glasman responded to
request for information regarding Clippinger. City Manager
Pasmant also informed the public that notices for a town hall
meeting were publicized.
UPDATES/REPORTS FROM CONSULTANTS
B-1 BKK Landfill Site Monthly Status Report
Special Counsel Colin Lennard presented an update and
highlighted changes since his last report on August 2, 2005
regarding BKK focusing on 1) compliance with the DTSC order
and 2) Proposition 65 Warning notices.
The following West Covina residents addressed Council regarding
BKK issues: Royall Brown addressed the landscaping plan, and
John Scheuplein asked for preliminary information on the borings
where toxic contaminants were found. Special Counsel Lennard
responded that we are waiting to hear from EPA for the work plan
on mitigation and making attempts for funding and completing the
closure of the landfill.
Motion Motion by Herfert and seconded by Miller, to receive and file the
report. Motion carried 3 — 0.

Recommendation is to accept the 2005 G.R.E.A.T. anti -gang
education grant, and appropriate the $42,750 reimbursable award
amount as follows:
• $20,655 in 1412.31.3110.5113 (instructor overtime)
• $1,600 in 141.31.3110.6050 (training, including mandatory
G.R.E.A.T. conference)
• $9,995 141.31.3110.6220 (student and curriculum supplies and
services)
• $10,500 in 141.31.3110.6270 (CEC facility costs and services)

Recommendation is that Council receive and file this report.
CONSENT CALENDAR ACTION Motion by Herfert and seconded by Miller, to waive further
reading of the resolution and adopt, and approve all items except
items D-2 (hold over to next meeting) and D-6b. Motion
carried 3-0.
D-6b West Covina Boys Group Home at 1333 Loma Vista — Police
Chief Wills presented the staff report regarding recent complaints
from residents and action taken.
Jean Chen Jean Chen of the California State Department of Social Services
addressed licensing approval process for group homes.

Susan Nunez Susan Nunez, West Covina resident, addressed recent issues at the
group home and thanked the Council for recent improvements on
Rowland Avenue.
John Scheuplein John Scheuplein, West Covina resident, commented on the need
for group homes but with better control and supervision.
Patricia Cuesta Patricia Cuesta, West Covina resident, requested further action
from Council in help with dealing with issues at the boy's home.
Councilmember Herfert supported sending a letter to the State
Legislature to change the Health & Safety Code and to solicit
Supervisor Antonovich for support.
Councilmember Miller suggested that the City Attorney research
areas of the law in which we can effect change.
Bernie Wilner Bernie Wilner, West Covina resident, asked if the City had passed
an ordinance requiring periodic inspections by police and fire of
this type of facility.
Motion by Herfert, seconded by Miller, to have staff and the City
Attorney pursue the State Legislature regarding legislation or
options that would give the City more control and calendar the
matter for three months follow-up. Motion carried 3-0.

HEARING
E-1 Aroma Park Master Plan
Mayor Sanderson introduced the hearing matter. Assistant City
Clerk Rush verified that proper legal notice had been given and
Mayor Sanderson opened the hearing. Planning director McIsaac
presented the staff report and outlined the proposed plan and
improvements for the park site.
Public Testimonv Charito Arceo, West Covina resident, spoke in support of the plan,
but concerned with measures being taken for parking, trash and
noise.
John Scheuplein, West Covina resident, spoke in opposition of the
plan.
Joanne Wilner, West Covina resident, spoke in opposition of the
plan.
Royall Brown, West Covina resident, spoke in opposition of the
plan.
Michael Chaing, West Covina resident and Director of Pacific Park
(community behind park area], spoke in support of the plan and
supported Concept B.
Testimony Closed With no further comments, Mayor Sanderson closed the public
hearing.
Council Discussion Councilmembers were in concurrence of a passive park with a tot
lot.

of the resolution and adopt, and approve design concept B. Motion
carried 3 -0.
COMMUNITY DEVELOPMENT COMMISSION
• Mayor Sanderson recessed the City Council meeting at 9:39 p.m.
to convene the Community Development Commission. The City
Council reconvened at 9:40 p.m.

support to send a letter opposing the Memorandum of
Understanding (MOU).
Motion by Miller, seconded by Herfert, to send a letter opposing
the MOU to Reduce Locomotive Emissions Between California
Air Resources Board and Union Pacific and BNSF Railway.
Motion carried 3 — 0.
ADJOURNMENT Motion by Herfert and seconded by Miller to adjourn the meeting
at 9:45 p.m. Motion carried 3 — 0.
